HomeMy WebLinkAboutOrd 2002-08TOWN OF FOUNTAIN HILLS ORDINANCE 2002-08 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE REQUIREMENTS FOR ACCESSORY BUILDINGS AND SOLAR UNITS IN CHAPTER 5, SECTIONS 5.06.G, H AND I, OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS. WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18. 1993, which adopted The Zoning Ordinance for the Town of Fountain Hills, and; WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, provides for a procedure to amend said ordinance, and; WHEREAS, The Town of Fountain Hills desires to amend its regulations to allow for a modification of the requirements for accessory structures and solar units, and; WHEREAS, The Town of Fountain Hills has rewritten Chapter 5, Sections 5.06.G, H and I of The Zoning Ordinance for the Town of Fountain Hills and published these proposed text changes in the official newspaper of general circulation, The Times r of Fountain Hills and Rio Verde on April 24, May 1, and May 8, 2002, and; WHEREAS, Public hearings were advertised in the April 24, May 1, and May 8, 2002 editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and; WHEREAS, Public hearings were held by. the Fountain Hills Planning and Zoning Commission on May 9, 2002 and by the Fountain Hills Town Council on May 16, 2002. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Pursuant to Chapter 2, Section 2.01 of The Zoning Ordinance for the Town of Fountain Hills, Chapter 5, Sections 5.06.G, H and I, of The Zoning Ordinance for the Town of Fountain Hills shall be amended as follows, with text to be added shown as double -underlined: Ordinance 2002-08 Page 1 of 3 CHAPTER 5 GENERAL PROVISIONS 5.06 Yard, Lot and Area Requirements. G. Small Accessory Buildings (Detached). Any detached accessory building 120 square feet or less in size in any zone shall not be located in the required front or street side yard, shall be at least six (6) feet from the main structure, aftd shall be at least three (3) feet from any rear and interior side lot lines..., shall be located behind the front line of the primary structure on the front, and behind the street side of the primary structure on the street side of a corner lot, and shall not exceed twelve (12) feet in height. H. Large Accessory Buildings (Detached). Any detached accessory building greater than 120 square feet in size, shall not be located in the required ffent, side or street size , any building setback, shall be at least six (6) feet from the main structure, and shall not be leeated nearer- to any rear- lot line a distanee of not less than the f!equir-ed interior- side yard setbaek foF that zoning dishall be located behind the front line of the primary structure on the front, and behind the street side of the primary structure on the street side of a corner lot, and shall not exceed fifteen (15) feet in height. An application for a Large Accessory Building (Detached) that does not meet the above requirements may be appealed to the Town Council by Special Use Permit. 1. Solar Units. Solar heating, cooling units, solar greenhouses and associated apparatus front and stfeet side areas, previded that sueh apparatus does shall be located behind the front line of the primary structure on the front, and behind the street side of the primary structure on the street side of a corner lot, shall not cover more than thirty (30) percent of that any side or rear yard, and shall be no elosef * twe (2) foot to any lot hnr�. shall be at least three (3) feet from any rear and side lot lines, shall be at least six (6) feet from any other structure, and shall not exceed twelve (12) feet in height. With the exception of the solar panels, any solar heating or cooling unit shall be screened from public view. An application for a Solar Unit that does not meet the above requirements may be appealed to the Town Council by Special Use Permit.
