AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING
DISTRICT MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, BY
REZONING THE LAND LEGALLY DESCRIBED AS LOT 34, BLOCK 1,
FINAL PLAT 506-C, AND THE PARCEL OF LAND ABUTTING THE WEST
END OF LOT 34, FROM "R1-35" SINGLE FAMILY RESIDENTIAL ZONING
DISTRICT AND "R1-43" SINGLE FAMILY RESIDENTIAL ZONING
DISTRICT TO "R1-35 PUD" SINGLE FAMILY RESIDENTIAL PLANNED
UNIT DEVELOPMENT AND IMPOSING CONDITIONS UPON SUCH
CHANGE.
WHEREAS, the Mayor and Council of the Town of Fountain Hills (the "Town
Council") desires to amend the Town of Fountain Hills Official Zoning District Map (the
"Zoning Map") pursuant to Aiuz. REV. STAT. § 9-462.04; and
WHEREAS, all due and proper notices of public hearings on the intended amendment to
be held before the Town of Fountain Hills Planning and Zoning Commission (the
"Commission") and the Town Council were given in the time, form, substance and manner
provided by ARE. REV. STAT. § 9-462.04; and
WHEREAS, the Commission held public hearings on February 24, 2005 and June 9,
2005, on the amendment to the Zoning Map pursuant to such notices and as required by ARIz.
REV. STAT. § 9-462.04; and
WHEREAS, the Town Council held public hearings regarding the amendment to the
Zoning map on April 7, 2005 and July 7, 2005.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows:
SECTION 1. That ± 27.54 acres of certain real property, generally located near the
northwest corner of Cerro Alto Drive and Golden Eagle Drive as shown in Zoning District Case
#Z2004-10 and S2004-22 (the "Property"), as more particularly described and depicted in
Exhibit A, attached hereto and incorporated herein by reference, are hereby rezoned from "R1-
35" Single Family Zoning District and "R1-43" Single Family Residential Zoning District to
"R1-35 PUD" Single Family Residential Planned Unit Development subject to the following
conditions:
1. The zoning regulations for this R1-35 PUD Zoning District Case #Z2004-10 and
S2004-22, shall be all of the standards of the "R1-35" Single Family Residential
Zoning District, as amended, except where specifically modified by these
stipulations.

2. The required front yard setback is hereby amended to a minimum of 20 feet
instead of 40 feet.
3. The hillside local road cul-de-sac shall be private and gated, providing emergency
and public utility access only, beginning at the westerly right-of-way boundary for
Cerro Alto Drive. Such gates, and other fences and walls necessary for gating and
roadway construction, shall not exceed six feet in height.
4. Hillside preservation shall be based on the calculations set forth in that certain
development agreement adopted concurrently herewith relating to the Property
and shown on the Precise Plan of Development , attached hereto as Exhibit B and
incorporated herein by reference.
5. The maximum height limitation for Lots 1 through 6 (as shown on the preliminary
plat approved concurrently herewith) is hereby amended to lower the maximum
allowable height within the area extending from the required front setback (20
feet from the front property line) to 40 feet from the front property line. Within
this area, the maximum allowable height shall be reduced to 20 feet at the front
yard setback line and shall increase as the distance from the front setback line
increases until 40 feet from the front property line, at which point the maximum
building height shall be 30 feet, as illustrated in Exhibit C, attached hereto and
incorporated herein by reference.
SECTION 2. This Ordinance shall become effective 60 days after approval by the Town
Council.
SECTION 3. If any provision of this Ordinance is for any reason held by any court of
competent jurisdiction to be unenforceable, such provision or portion hereof shall be deemed
separate, distinct and independent of all other provisions and such holding shall not affect the
validity of the remaining portions of this Ordinance.
