AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE FOUNTAIN HILLS
TOWN CODE, CHAPTER 12, TRAFFIC, ARTICLE 12-3, PARKING, BY
ADDING A NEW SECTION 12-3-13 RELATING TO MOTOR VEHICLE
OWNER'S LIABILITY FOR PARKING OFFENSES.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, as follows:
SECTION 1. That the Fountain Hills Town Code, Chapter 12, Traffic, Article 12-3,
Parking, is hereby amended by adding a new Section 12-3-13, Owner's Liability for Parking
Offenses, to read as follows:
Section 12-3-13 Owner's liability for parking offenses
The registered owner(s) of any vehicle that has been parked in violation of any of
the provisions of this article or any other town ordinance prohibiting or restricting
parking shall be prima facie responsible for such violation and subject to penalty
therefor.
SECTION 2. That if any provision or any portion of any provision of this Ordinance is
for any reason held to be unconstitutional or otherwise unenforceable by a court of competent
jurisdiction, such provision or portion thereof shall be deemed separate, distinct and independent
of the remaining provisions of this Ordinance and shall be severed therefrom without affecting
the validity of the remaining portions of this Ordinance.
PASSED AND ADOPTED by the Mayor and Council of the Town of Fountain Hills,
November 3, 2005.
