Anti° a • that is Copies Routed To: ❑ Administration ❑ Engineering ❑ Planning and Zoning ❑ Parks & Recreation ❑ Magistrate Court Lir ORDINANCE NO. 06-11 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING DISTRICT MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA BY REZONING LAND COMMONLY REFERRED TO AS THE "STATE TRUST LAND," FROM R1-43 TO A COMBINATION OF R1-35, R1-18, R1-10, R1-8, R1-6, L-2, OSR AND OSC, AS DESIGANTED IN ZONING FILE NO. Z2006- 02. WHEREAS, pursuant to ARIZ. REv. STAT. § 9-462.04, the Mayor and Council of the Town of Fountain Hills (the "Town Council") desires to amend the Town of Fountain Hills Official Zoning District Map (the "Zoning Map") for the approximately 1,311 acres (34 parcels) of real property generally located 100 feet north of Cascade Drive, Baca Drive, and Hawley Drive and 220 feet north of Glenbrook Boulevard and 105 feet east of Boulder Drive at its closest point, generally described as P/O NW1/4, NW1/4, SEC. 12, T3N, R6E AND P/O W1/2, W1/2, SEC. 1, T3N, R6E AND SECS. 2 AND 3, T3N, R6E, G&SRB&M and as more particularly described and depicted on Exhibit A, attached hereto and incorporated herein by reference (the "State Trust Land"), by dividing it into 34 parcels as described on Exhibit B, attached hereto and incorporated hereto by reference (the "Rezoning Parcels"), according to the table set forth on Exhibit C, attached hereto and incorporated herein by this reference (the "Rezoning Table") and as depicted on Exhibit D, attached hereto and incorporated herein by this reference; and WHEREAS, the zoning categories set forth on the Rezoning Table are consistent with the Fountain Hills General Plan 2002, as amended by GPA2006-01, approved by the Town Council on May 4, 2006; and WHEREAS, all due and proper notices of public hearings on this Ordinance held before the Town of Fountain Hills Planning and Zoning Commission (the "Commission") and the Town Council were given in the time, form, substance and manner provided by ARIZ. REv. STAT. § 9- 462.04; and WHEREAS, the Commission held a public hearing on April 13, 2006, on the amendment to the Zoning Map pursuant to such notices and as required by ARIZ. REv. STAT. § 9-462.04; and WHEREAS, the Town Council held a public hearing regarding the amendment to the Zoning Map on May 4, 2006. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows: SECTION 1. That the State Trust Land is hereby rezoned by changing the Zoning Map designation thereon from R1-43 to a combination of R1-35, R1-18, R1-10, R1-8, R1-6, L-2, OSR and OSC, and by assigning the appropriate zoning designations to the Rezoning Parcels as shown on the Rezoning Table. 643883.2 SECTION 2. That if, at any time prior to the effective date of this Ordinance, any person (i) obtains from the Town Clerk of the Town of Fountain Hills (the "Town Clerk") a referendum petition number and (ii) files in the office of the Town Clerk a petition for referendum of this Ordinance appearing (a) to be in proper form and(b) to have the requisite number of signatures to cause a referendum thereon, this Ordinance shall immediately become null and void and of no effect without further action of the Town Council. SECTION 3. That if any portion of any provision of this Ordinance is for any reason held to be unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such provision or portion thereof shall be deemed separate, distinct and independent of the remaining provisions of this Ordinance and shall be severed therefrom without affecting the validity of the remaining portions of this Ordinance.
