ORDINANCE NO. 08-12
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING
DISTRICT MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA BY
REZONING LAND COMMONLY REFERRED TO AS THE "STATE TRUST
LAND"AS DESIGNATED IN ZONING FILE Z2008-01.
WHEREAS, pursuant to ARIz. REV. STAT. § 9-462.04, the Mayor and Council of the
Town of Fountain Hills (the "Town Council") desires to amend the Town of Fountain Hills
Official Zoning District Map (the "Zoning Map") for the approximately 1,276 acres (50 parcels)
of real property generally located 100 feet north of Cascade Drive, Baca Drive and Hawley Drive
and 220 feet north of Glenbrook Boulevard and 105 feet east of Boulder Drive at its closest
point, generally described as P/O NW1/4, NW1/4, SEC. 12, T3N, R6E AND P/O W1/2, W1/2,
SEC. 1, T3N, R6E AND SECS. 2 AND 3, T3N, R6E, G&SRB&M and as more particularly
described and depicted on Exhibit A, attached hereto and incorporated herein by reference (the
"State Trust Land"), by dividing it into 50 parcels according to the table set forth on Exhibit B,
attached hereto and incorporated herein by this reference (the "Rezoning Table") and as shown
on the Rezoning Map (the "Rezoning Map") depicted on Exhibit C, attached hereto and
incorporated herein by this reference; and
WHEREAS, the zoning categories set forth on the Rezoning Table are consistent with
the amendment to the Fountain Hills General Plan 2002, as amended by GPA2008-01, approved
by the Town Council on May 15, 2008; and
WHEREAS, all due and proper notices of the public hearings on this Ordinance held
before the Town of Fountain Hills Planning and Zoning Commission (the "Commission") and
the Town Council were given in the time, form substance and manner provided by ARIz. REV.
STAT. § 9-462.04; and
WHEREAS, the Commission held public hearings on May 5, 2008 and May 6, 2008, on
the amendment to the Zoning Map pursuant to such notices and as required by ARIz.REV. STAT.
§ 9-462.04; and
WHEREAS, the Town Council held a public hearing regarding the amendment to the
Zoning map on May 15,2008.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. That the State Trust Land is hereby rezoned by changing the Zoning Map
designation thereon by assigning the appropriate zoning designations to the Rezoning Parcels as
shown on the Rezoning Map in accordance with the Rezoning Table and subject to the following
conditions:

1. Compliance with the provisions and commitments expressed in the staff report/council
agenda action form and the text and exhibits of the major general plan amendment report
entitled"Fountain Hills ASLD"prepared by CMX Engineering and dated April 9, 2008.
2. Prior to approval of the master plat for the property, Developer shall:
a. Provide a daily Total Traffic analysis/map of the site showing additional
roadways and intersection volumes suitable for design; the analysis shall include
offsite traffic from offsite roads travelling into the site in the daily trip
assignments to obtain the Total Traffic. Develop the above traffic projections for
an interim project phasing and for the design year.
b. Provide a Peak Hour turning movements analysis/map (including traffic counts
and safety analysis at affected offsite collector/arterial intersections) indicating
turn pockets/lengths, design speeds, horizontal and vertical curvature
requirements and level of service calculations.
c. Evaluate all-way stop and traffic signal warrants at affected intersections. Provide
traffic control devices as warranted and directed by the Town.
3. In conjunction with the infrastructure improvements on the property, Developer shall:
a. Widen the pavement and right-of-way width for Richwood Avenue, with a
® median (similar to that of a Major Collector), from a point adjacent to the eastern
entrance to Parcel 17 to Fountain Hills Boulevard. This requirement for widening
does not apply to Richwood Avenue at the west end of the site. Provide median
turn pockets at the proposed park, middle school ball fields, the east entrance to
Parcel 17 and other parcel entrances, and a widened round-a-bout approach at
Fountain Hills Boulevard.
b. Widen Ivory Drive to a Minor Collector, if needed, based on the traffic design for
the adjacent commercial parcel.
c. Provide Limited Collector or Local Road widths at Parcel 13, Parcel 8 and other
entrance roadways east/west from their intersection with FHB if justified based on
the subdivision lot layout and/or more detailed traffic analysis provided at the
time of preliminary plat review.
d. Widen new roads intersecting Fountain Hills Boulevard to allow separate left and
right intersection turn lanes, a widened departure lane throat and bike lanes on
appropriate roadways.
e. Provide two, 3" PVC traffic signal interconnect conduits and a fiber optic cable
on Fountain Hills Boulevard within the project limits.

f. Separately meter irrigated public roadway medians from the property frontage
landscaping. Developer shall maintain all roadway center medians for a
minimum of five years after approval of construction and acceptance by the
Town.
g. Place sidewalks on the perimeter block of the project on the side(s) of the streets
corresponding to the sidewalks shown on the Town's "Sidewalk Plan, Long-
Range Plan" map. Developer shall extend these sidewalks to the first street or
alley intersection past the boundary of the property.
4. That a site plan for the development of Parcel 8 must be approved by the Commission
within five years of the approval of the R1-6 zoning, otherwise, the Council may revert
Parcel 8 back to R1-18 zoning.
SECTION 2. That if any portion of any provision of this Ordinance is for any reason
held to be unconstitutional or otherwise unenforceable by a court of competent jurisdiction, such
provision or portion thereof shall be deemed separate, distinct and independent of the remaining
provisions of this Ordinance and shall be severed therefrom without affecting the validity of the
remaining portions of this Ordinance.

Government lots 1 thru 4, and the south half of the north half, and the south half, lying within
Section 3, all being within Township 3 North, Range 6 East,of the Gila and Salt River Meridian,
Maricopa County,Arizona;
EXCEPT:
A parcel of land located in the southeast quarter of Section 3,Township 3 North, Range 6 East, of
the Gila and Salt River Meridian, Maricopa County, Arizona, more particularly described as
follows:
COMMENCING at the southeast corner of said Section 3;
Thence along the south line of said Southeast quarter, South 89 degrees 59 minutes 54 seconds
