There will be no separate discussion of these items unless a Councilmember or member of the public so requests. If a Councilmember or member of the public wishes to discuss an item on the consent igenda,they may request so prior to the motion to accept the consent agenda. The item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Town Council Meeting Agenda Regular/Executive Session March 4, 1999 *1.) Consideration of APPROVING THE MEETING MINUTES of February 4th and 18th, 1999. *2.) Consideration of the SPECIAL EVENT REQUEST submitted by Sharon Morgan of the Fountain Hills Chamber of Commerce for the Native American Art Show. The event will be held on Saturday and Sunday, March 27th and 28th and will be held on portions of Saguaro Boulevard, requiring the closure of Saguaro Boulevard from the Avenue of the Fountains to Palisades. *3.) Consideration of the SPECIAL EVENT REQUEST submitted by Tamala Rosenhagen of the Fountain Hills Fire Department for Public Safety Day to be held on Saturday, April 10, 1999 from 10:00 a.m. until 1:00 p.m. Partial closure of the north side of El Lago Boulevard from Saguaro Boulevard to the Village Bazaar entrance will be required. *4.) Consideration of the SPECIAL EVENT REQUEST submitted by Alan Cruikshank of the Fountain Hills Historical Society for Founder's Day to be held on Saturday, April 10, 1999 from 11:00 a.m. until 6:00 p.m. No street closures will be required for this portion of the event. *5.) Consideration of the SPECIAL EVENT REQUEST submitted by Richard J. DeBernardis of the Perimeter Bicycling Association of America for the El Tour de Phoenix. The event is scheduled for April 17, 1999 from 7:00 a.m. to 3:00 p.m. Cyclists will only be passing through Fountain Hills, traveling east on Shea Boulevard to the Beeline Highway. No street closures will be required. *6.) Consideration of the EXTENSION OF PREMISES/PATIO PERMIT APPLICATION submitted by Kenneth Bowman of the American Legion Post 58 located at 16850 East Avenue of the Fountains. The applicant is asking to temporarily extend their"Club" liquor license #14073009 to an enclosed patio area adjacent to the facility on Wednesday,March 17, 1999 for St.Patrick's Day. *7.) Consideration of an INTERGOVERNMENTAL AGREEMENT with the Department of Public Safety to send another officer to the State Gang Force at no expense to the Town. *8.) Consideration of the RENEWAL of the three-year contract with the independent auditor firm of Cronstrom& Trbovich for the audit of the Town of Fountain Hills financial reports for the periods ending 6/30/99, 6/30/00 and 6/30/01. *9.) Consideration of RESOLUTION 1999-12 approving the application for local, regional and state parks funds for Desert Vista Neighborhood Park—Acquisition/Phase I. *10.) AGENDA ITEM #2— NATIVE AMERICAN ART SHOW—CORRECTION Please make note of a correction to information included in both staff reports on the Native American Art Show Special Event Request. Both Steve and I wrote that the event area would be closed to traffic the evening of Friday, March 26. The application has the correct closure time which is noon on Friday, March 26. This will allow adequate time to set up the large tent and various booths. We apologize for the discrepancy. AGENDA ITEM #6—AMERICAN LEGION EXTENSION OF PREMISE Councilman Mower inquired about the times of operation for the American Legion Extension of Premise Permit. Since this information is not required on the application, it was not included in the staff report. Per the Legion, their normal hours of noon to 10:00 p.m. will be in effect on March 17, the date of the permit. AGENDA ITEM# 14—TENNIS COURT REPAIRS/UPGRADES: kor At Councilmember Al Poma's request, information regarding potential repairs/upgrades to the Four Peaks School tennis courts will be provided for discussion and possible direction to staff. AGENDA ITEM# 15 -FIREROCK FINAL MASTER PLAT: The preliminary plat for the Firerock County Club project was approved by council on April 2, 1998. The final plat was approved in the Firerock Country Club Area Specific Plan. Staff recommends approval of the final master plat. Geir's memo is enclosed. AGENDA ITEM# 16—HAMMERHEAD CUL-DE-SAC PROPERTY LINES: A Fountain Hills resident approached staff to consider changing the front and or street setbacks for some lots on hammerhead cul-de-sacs. Staff recommends approval. Please refer to Jeff's report. AGENDA ITEMS# 17 &# 18—PUBLIC HEARING/ORDINANCE 1999-07/ COMPREHENSIVE SIGNAGE: The first public hearing on the agenda is scheduled to receive input to consider the regulations for a comprehensive sign package. These regulations were designed to provide minimum requirements for signage at commercial centers. This item was unanimously approved by the Planning and Zoning Commission. See Dana's memo. AGENDA ITEMS# 19 & #20—PUBLIC HEARING/ORDINANCE 1999-08/ CLARIFY ACCESSORY STRUCTURES: Another public hearing is on the agenda to consider increasing the minimum set back for accessory structures from three feet to the minimum side yard setback requirements in zoning districts. Approval was unanimously recommended by the Planning and Zoning Commission. Please see Geir's report. AGENDA ITEMS #21 &#22—PUBLIC HEARING/ORDINANCE 1999-09/ COMMERCIAL ZONES: This hearing will consider amending the zoning ordinance to clear up a discrepancy in permitted uses for veterinary clinics. The Planning and Zoning Commission unanimously recommended approval of this item. Dana's memo is attached. AGENDA ITEMS#23 & #24—PUBLIC HEARING/ORDINANCE 1999-10/ ADDITIONAL LANDSCAPE REQUIREMENTS: This public hearing is scheduled to receive input regarding specific landscaping requirements in the development of multi-family (more than four units), commercial, and industrial projects. AGENT., M # ..714 LIC SAFETY DAY SPECIAL EVENT REQUEST Public Safety Day is an annual event that allows the Town's law enforcement, fire fighting and emergency service entities to display their "tools of the trade" and the residents to get "up close and personal" with the various organizations that protect the public safety. This year's request has been submitted by Tamala Rosenhagen and Scott LeGreca for the Fountain Hills Fire Department and (111h,,,. All events will take place in the southwest portion of Fountain Park. The Public Safety portion of the day's activities will take place from approximately 10:00 a.m. to 1:00 p.m. and will require the closure of the north side of El Lago Boulevard between the Village Bazaar entrance and Saguaro Boulevard. This closure will be re-opened for the Founder's Day activities which will take place between 1:00 p.m. and 6:00 p.m. A certificate of insurance naming the Town as an additional insured is on file. Marshal Gendler has been a part of the team organizing the event and feels that all safety issues have been addressed. (Please see attached memo from Steve.) Staff recommends approval. AGENDA ITEM #4— FOUNDER'S DAY SPECIAL EVENT REQUEST The Founder's Day event, scheduled for Saturday, April 10, 1999, is being sponsored this year by the Fountain Hills Historical Society. Similar to last year's event, Founder's Day will be combined with Public Safety Day and all activities will take place in the southeast corner of Fountain Park. The Founder's Day activities will take place from approximately 1:00 p.m. to 6:00 p.m. and include the joint efforts of the Arts Council, the Parks and Recreation Department, and Fountain Hills Four Peaks Rotary, providing a "hometown celebration"for local residents. The Arts Council will sponsor an "Art Day" as part of the festivities featuring the creative talents of local artists. The Parks and Recreation Department will sponsor children's games and activities and the Four Peaks Rotary will again sponsor the "Challenge of the Ages", an event the Town team hopes to win this year! Marshal Gendler has been involved in the planning and has written a traffic safety plan for the various phases of the event (please see attached memo from Steve regarding Public Safety Day). Alan Cruikshank is out of town and will submit the application for the event prior to next week's meeting. Staff will have additional information at that time. AGENDA ITEM #5— EL TOUR DE PHOENIX SPECIAL EVENT REQUEST Marshal Gendler loves these types of requests! Richard J. DeBernardis of the Perimeter Bicycling Association of America has submitted the request for the El Tour de Phoenix, a 70 and 25-mile bicycling event. It is scheduled for Saturday, April 17, 1999 from 7:00 a.m. to 3:00 p.m. The good news is the event only "passes through" Fountain Hills, traveling east on Shea Boulevard to the Beeline Highway. The event will require no local law enforcement personnel since the event coordinators use off-duty MCSO officers. No streets will be closed. Marshal Gendler will make sure that the route within Fountain Hills has adequate coverage to satisfy his safety requirements. Staff recommends approval. AGENDA ITEM #6—AMERICAN LEGION EXTENSION OF PREMISE/PATIO PERMIT Kenneth Bowman has submitted an extension of premise/patio application for the American Legion 58 located at 16850 E. Avenue of the Fountains for St. Patrick's Day, Wednesday, March 17, 1999. The application requests to extend the American Legion's Class 14 (club) license to the courtyard and a fenced area adjacent to the north side of the building. This is the same area used for all previous events. The extension of premise allows liquor sales to members and guests only. It is my understanding that this will be considered by the Council at their meeting of March 4th. Background In reviewing the proposal, and meeting with Sharon Morgan, the plans are for an art show featuring some entertainment and a limited number of concessions. The estimated attendance for the two day event is in the 20,000 range. She plans to advertise regionally so attendance could be slightly higher. The entire event would take place on Saguaro Boulevard between Avenue of the Fountains and Palisades with a display tent and vendor canopies erected in the roadway. In the interest of safety, my plan is to restrict parking on Saguaro between El Lago and Avenue of the Fountains to discourage pedestrian traffic on Saguaro in general. Beginning the evening of March 26th, we would close Saguaro between Avenue of the Fountains and Palisades to allow setup of the event tent and artist booths. This arrangement allows a detour route around Fountain Park as well as access to any of the businesses on Avenue of the Fountains or Parkview. Saguaro would be reopened on Monday morning, March 29th as soon as the main display tent can be removed. Pat Harvey and I have worked out a simplified barricade plan for this purpose. The Marshals department would provide officers to assist with security, traffic and crowd control but will not be involved in parking. It is my understanding that this will be considered by the Council at their March 4th meeting. In reviewing the request, along with information I have received in the planning meetings, the event will really combine Public Safety Day, Founders Day, and Art Day into one event. It will occur in two phases. The first phase, from approximately loam to 1pm, will involve activities requiring partial closure of El Lago westbound between the Village Bazaar entrance and Saguaro. The second phase, from 1pm to 6pm, all events will be in Fountain Park and the street closure can be lifted. Since this is a community event, the Marshals Department is prepared to provide officers at no charge to the organizers as part of our community service commitment. Phase I: Our law enforcement plan would address each phase separately. During the park activities portion of the event, we would use a plan similar to that employed during the concerts in the park series. That involves a road closure from the Village Bazaar entrance to Saguaro to accommodate fire fighting equipment as well as "no parking" posted along Saguaro between El Lago and Avenue of the Fountains. This is designed to keep pedestrians, on-lookers, and motorists who might be distracted by the activities in the park from coming in contact along Saguaro. Two officers are assigned to traffic control for that purpose with one concentrating on the park entrance and the other on the Village Bazaar entrance off El Lago. In addition, a third officer is assigned to the area to enforce the no parking provisions and slow traffic in the vicinity of Fountain Park on both Saguaro and El Lago. Additional officers are assigned in the Park itself for security, crowd control, and participation in the events. Phase II: During the second phase of the event, involving Founders Day activities, games, and the Parks Department children's activities, we would switch to a plan similar to that used during events confined to the park. That involves mobile patrols on Saguaro between El Lago and Palisades to protect pedestrians who may be parking in vacant lots and crossing the street to participate in the activities. We anticipate most parking during this phase of the event to be on El Lago and in the Village Bazaar parking lot. While we are not closing any streets, we do need officers present to ensure that motorists are slowed with pedestrians in the area. We also will assign a security team in Fountain Park for crowd control, however, we do not anticipate any problems with the persons attending this event. The event, which involves a course through Mesa, Scottsdale, Fountain Hills, and the Salt River Reservation, is scheduled for Saturday, April 17th. This year's event will not impact any Fountain Hills interior streets, however, it will involve racers on Shea Boulevard from our border with Scottsdale to the Beeline Highway. Therefore, law enforcement personnel will have to be stationed on Shea at the Palisades,Fountain Hills, and Saguaro intersections. In previous years, the event organizers have had the Sheriff's Office coordinate off-duty law enforcement personnel since it passes through multiple jurisdictions. I anticipate that the same concept will be followed this year and will contact MCSO to coordinate our efforts if the request is approved by the Council. The event, which involves a course through Mesa, Scottsdale, Fountain Hills, and the Salt River Reservation, is scheduled for Saturday, April 17th. This year's event will not impact any Fountain Hills interior streets, however, it will involve racers on Shea Boulevard from our border with Scottsdale to the Beeline Highway. Therefore, law enforcement personnel will have to be stationed on Shea at the Palisades,Fountain Hills, and Saguaro intersections. In previous years, the event organizers have had the Sheriff's Office coordinate off-duty law enforcement personnel since it passes through multiple jurisdictions. I anticipate that the same concept will be followed this year and will contact MCSO to coordinate our efforts if the request is approved by the Council. It is my understanding that this special event request will be considered by the Council at their March 18th meeting. I recommend approval based on the following factors: 1. No road closures are involved; 2. No businesses are effected; 3. No detours are necessary; 4. Town resources such as barricades are not being requested; 5. The event will be restricted to one lane of traffic; 6. Motorist delays will be minimal since the race is spread out over multiple municipalities; 7. Under the provisions of the Arizona Revised Statutes,Title 4, a class 14 license is specifically issued to a veteran or fraternal organization for "on-premise" sale and consumption of alcohol by members and registered guests. Findings: The application in this case would extend the premises for a "Saint Patrick's Day" Celebration catering to members and guests. This is a permitted function under the provisions of the license. In reviewing the application, the American Legion has made provisions for access control and identity checks in compliance with liquor license regulations. Recommendation: Based on this extension being in compliance with all provisions of ARS Title 4 relating to a class 14 license, as well as meeting the requirements for control of access to members and guests, I recommend approval of this application by the Council. L To: Cassie Hansen / From: Steve Gendler, Marshal Date: February 22, 1999 Subject: Request for agenda item The purpose of this memorandum is to request your assistance with an agenda item for the March 4th meeting. I am seeking approval from the Council to enter into an IGA with the state for FY 99-2000 that would allow us to send another officer to the state gang task force. All costs relating to this action would be paid by the state at no expense to the Town of Fountain Hills. Background As you know, three years ago the Marshals Department applied for, and received, a fully funded grant to participate in the state gang task force known as GITEM. This grant, which has been renewed twice, provided 100% of the salary, equipment, supplies, travel and transportation for a Fountain Hills officer to attend training and enforcement operations as a member of the task force. The officer serves one year and returns to the department with specialized training and certifications that we would have otherwise not been able to provide. Opportunity Due to our successful participation in the last three fiscal years, I submitted a proposal for a fourth year under the same terms. The DPS has reviewed that request and offered the Marshals Department another grant,worth up to $50,000,for a position on the state task force in FY 99-2000. The grant is fully funded and would provide all salary, employee related expenses, training, travel, transportation, equipment and supplies for a Fountain Hills officer to replace Ted Lamer beginning July 1, 1999. Advantages By participating in the state task force,Fountain Hills receives the benefit of training and experience for our officers at no cost to the town. In addition, as a member of the task force, Fountain Hills receives a level of gang suppression activities and resources which we could not field under normal circumstances. This includes proactive covert and overt operations at the schools and in the community, intelligence information, threat assessments, and expert analysis of juvenile incidents to determine if they are gang related. Required Action The state has provided three originals of the intergovernmental agreement which would be required to execute this grant in the upcoming fiscal year. It would require approval by the Council, a signature by Mr. Farrell, and certification by the Town Clerk. Once approved and signed as indicated, I would handle all coordination, documentation, and procedural requirements. The department would hold an internal selection process to determine which officer would be appointed to the state gang task force and officer Lamer, who is returning from the task force, would rotate into the vacated position. No new positions are requested for this process. A signed IGA must be on file with the Secretary of State to qualify for funding. In order to ensure uninterrupted reimbursement, the IGA must be signed by Fountain Hills and returned by as soon as possible to ensure that it clears the DPS approval process before June 30th. INTERGOVERNMENTAL AGREEMENT REGARDING STATEWIDE GANG TASK FORCE This Intergovernmental Agreement ("IGA") is entered into between the State of Arizona through its Department of Public Safety, hereinafter referred to as "DPS", and Fountain Hills Marshal's Department hereinafter referred to as "Agency". The purpose of this Agreement shall be to enhance law enforcement services concerning the criminal activities of street gangs, through the cooperative efforts of the parties to this Agreement. DPS is authorized and empowered to enter into this IGA pursuant to A.R.S. §41-1713 B.3 both parties are authorized and empowered to enter into this IGA pursuant to A.R.S. §11-952 and the Agency is authorized and empowered pursuant to Now, in consideration of the mutual promises set forth herein, the parties to this Agreement hereby agree to the following terms and conditions: I. Participation The Agency agrees to assign one (1) P.O.S.T. certified sworn law enforcement officer(s), herein referred to as officer, to DPS on a full-time basis for such assignments within the purposes of this contract, as directed by DPS. During this period of assignment, the Agency and DPS agree to allow said officer(s)to maintain all benefits, rights, and privileges available to said officer(s) as if they were assigned on a full-time basis to the Agency during this period. The assigned officer(s) must abide by all of the applicable rules and regulations of the Agency and are subject to its disciplinary process. II. Reimbursement DPS agrees to reimburse the Agency on a monthly basis (based upon DPS weekly time sheets completed by the officer) for all payroll expenses of the officer(s) related to this assignment, including salary, shift pay, overtime compensation(based upon DPS rules, not to exceed 13 hours per month), benefits (which accrue during the term of this IGA) and employee-related expenses to include employer's workman's compensation and social security at established rates, and vacation, and sick leave taken while working for the gang task force. There must be a minimum of 40 hours GITEM related work in order for DPS to reimburse for overtime in any given week. Overtime compensation will be for GITEM related activities only. The limitation of overtime to 13 hours per month may be exceeded without contacting Agency if DPS determines that additional funding is available. (Monthly vacation, or sick leave which accrues but is not used by the officer will not be reimbursed.) All personnel costs, including shift pay, will be based on the following assumptions: a standard forty-hour work week of four ten-hour days, with standard work schedule of 2:00 p.m. through midnight - Wednesday through Saturday. Prior to the officer reporting to GITEM, the Agency agrees to furnish DPS February 11, 1999 with the following information: officer's annual,bi-weekly and hourly rates of base pay and fringe benefits, as well as, the overtime rate based upon the assumptions outlined above. DPS is not obligated to reimburse Agency for salary raises or modifications to base salaries unless Agency submits such modification to DPS at least 60 days from the effective date of such modification. All approved travel expenses will be reimbursed directly to the officer(s) by DPS under employee travel reimbursement guidelines established by the Arizona Department of Administration. The amount reimbursed for the aforementioned expenditures shall be for actual costs only for the period of this agreement. DPS shall assign and maintain DPS vehicles which shall be provided by DPS in accordance with DPS vehicle policy to the Agency officer(s) assigned to DPS. III. Nondiscrimination All parties agree to comply with the non-discrimination provisions of the Governor's Executive Order 75-5. IV. Indemnification The state of Arizona shall hold harmless the agency, its officers, employees and departments from and against all suits, legal or administrative proceedings, claims or damages while their officers/employees are on duty, acting in the furtherance of the GITEM Gang Task Force and operating under the direction of DPS and are in compliance with DPS policies and procedures. V. Drug Free Workplace Any officer assigned to the task force will be subject to random and/or for cause drug and alcohol testing in accordance with his/her Agency's guidelines. If the Agency does not have a drug free program, the officer will be required to submit to testing pursuant to the DPS Drug Free Workplace Program. Each assigned officer shall be subject to the responsibilities of and shall retain all rights as provided for in the DPS Drug Free Workplace Program Manual, DPS Form Number DPS 932-02056. DPS shall not charge any fee or cost to the contractor for any assigned officer who undergoes testing. Officers may be removed from the task force for failure to comply with the program or for failure to pass DPS drug screening requirements. VI. Termination Either party may terminate this Agreement for convenience or cause upon thirty (30) days written notice to the other party. Upon termination, DPS shall pay all outstanding amounts up through the time upon which the termination becomes effective. All property shall be returned to the owning party upon termination. The following staff report will review several aspects of the project, including the subdivision's design and its conformance with the Subdivision Ordinance and the Zoning Ordinance. Subdivision Design GENERAL DESCRIPTION: Portions of the site have been previously disturbed. The sales/information center for the SunRidge Canyon development is currently located on Lot 2 of the proposed subdivision. The research was done quickly in order to get material to the Town Council for the March 4th meeting. The following improvements are necessary and were specified when talking with contractors submitting quotes on the project: • Repair and resurfacing of two tennis courts • Wind screens installed on fencing surrounding tennis courts • New tennis posts and nets installed • Repair and/or replace light fixtures Contractor quotes on the project ranged from $6,400 from Arizona Master Court LLC to $10,565 from Sunland, Inc. An additional quote was submitted by AZ Playcourts at $8,815. The quotes were submitted by the contractors without inspecting the existing facility. Other contractors were contacted but unable to give project quotes prior to the deadline to get materials to the Town Council. Based on the information received from these contractors, we would estimate it would take approximately$15,000 to improve the tennis courts at Four Peak Neighborhood Park. If the project is approved, the contractors who submitted quotes along with those who did not, would be asked to visit the facility and give an exact quote to complete the project. FireRock Country Club, as stated in the Area Specific Plan, is an 807.77-acre master planned community consisting of 25 residential parcels, five open space parcels and roadway tract/ROW. The proposed FireRock Country Club is to be gated and therefore have private streets. The applicant has approval to build 390 single-family residential lots and 288 multi-family units. The residential portion of the development will cover approximately 486.07 acres. An 18 hole private country club golf course is planned and currently under construction. The single-family residential developments are planned on 22 separate parcels covering 438.01 acres. The proposed density in the single-family areas average 0.8 dwelling units per acre. There are three multi-family parcels proposed. The multi-family areas encompass 48.06 acres at a average density of 5.9 dwelling units per acre. The multi-family areas border Shea Boulevard in the northeastern portion of the country club. The plat contains a table with a subdivision breakdown,parcel by parcel. Improvement plans have been under review by town staff and outside review agencies. Phase one plans are nearly complete and phases two and three are in the earlier stages of review. The applicant is currently constructing the backbone infrastructure and the golf course. Approval of the Final Plat will allow the applicant to have the dry utilities designed. The utility companies will not begin the design process until final legal descriptions are available. The Engineering Department has few remaining comments from the review of the Final Master Plat for FRCC. RECOMMENDATION: The final master plat is the final parceling of the approved FireRock Area Specific Plan. The Town Council approved the preliminary plat on April 2, 1998 along with the FireRock Area Specific Plan. Phase one improvement plans are nearly complete and minor issues can be addressed by stipulation. Staff has been contacted by a resident who would like the Town Council to consider initiating an amendment to Section 5.06 of The Zoning Ordinance for the Town of Fountain Hills to change the front and/or street-side setback regulations for some lots on a"hammerhead"-type cul-de-sac. Hammerhead cul-de-sacs have a"T" shape, whereas the typical bulb-type cul-de sacs are circular. There are 13 hammerhead cul-de-sacs within the Town and there are typically four to six lots on a hammerhead cul-de-sac. Staff has determined that the front or street side setback is calculated from all points of the hammerhead right-of-way, including the portions of the hammerhead right- of-way that are perpendicular to the main right-of-way of the cul-de-sac. Lir The resident desires to build a 6-foot high concrete block wall within the street-side yard at a point near the terminus of the hammerhead right-of-way. Staff will provide a graphic example at the Town Council meeting. The following is the proposed amendment to Section 5.06 of The Zoning Ordinance for the Town of Fountain Hills: 5.06 Yard,Lot,and Area Requirements �. Hammerhead Cul-de-Sacs. Front or street side yards that abut the hammerhead right-of way on lots that are located on the outlet side of and immediately abutting the hammerhead terminus shall be calculated b disre arding the perpendicular portion of the hammerhead if all of the following criteria are met: A. The lot immediately adjacent to the subject lot and at the end of the hammerhead terminus is developed, and; B. The Town Engineer has determined that afe vehicular ingress and egress is maintained for the abutting developed lot due to any encroachment, such as a building, wall or fence, into the front or street side yard of the subject lot. On February 25, 1999 the Commission recommended approval of an amendment to provide minimum requirements for a Comprehensive Sign Package. Staff has identified that there are no regulations regarding a comprehensive sign package as referenced by section 6.07 D. 2. c. This text thaw reads as follows: The signage in a building complex or center shall be contained in a comprehensive sign package which will be approved by the Town of Fountain Hills Community Development Director or designee and conform to the sign regulations contained in this chapter. For the purposes of this Section, a building complex or center is any number of businesses, greater than one, that share the same sight and use common points of ingress and egress to and from the site. The combined outdoor unshielded lighting shall not exceed seventy-five (75) watts within a 25 foot radius after 11:00 p.m. All illumination shall be so arranged as not to shine upon or reflect onto adjoining properties. D. Exterior Lighting. All lighting for off-street parking or loading areas or for the external illumination of buildings or signs shall be directed away from and shielded from any adjacent residential property and shall not detract from driver visibility on adjacent streets. E. Mercury Vapor. All mercury vapor fixtures are prohibited. F. Signage. All outdoor signage, with its lighting, shall conform to Section 8.03 and shall be of such size and color as not to interfere with traffic or limit visibility of adjoining property. Illumination on any sign not wholly illuminated from within must conform to Section 8.03 and be directed towards the ground. EAST: Residential (Arriba Del Lago and Puerto Del Lago) and Vacant, zoned "R-3" & "R1-6A" WEST: Fountain Plaza; zoned "C-1" and Plat 208; zoned"C-2" SUMMARY: On February 25, 1999, the Planning and Zoning Commission recommended approval of an amendment to rezone 61.49 acres from "R-190" Rural Residential zoning and "C-1" commercial zoning to "OSR" Open Space Recreational Zoning District which is located east of Saguaro Blvd., north of El Lago Blvd. and southwest of Panorama Dr. The following staff report will review several aspects of the rezoning request, including the following: 1. A review of the applicable Principles and Guidelines contained within the General Plan, and the development's conformance with those Principles and Guidelines. 2. The rezoning location,compatibility and its conformance with the Zoning Ordinance. Staff Report Z99-08 February 25, 1999 Page 2 Conformance with General Plan: The adopted General Plan Land Use Map designates this site for "Park/Open Space" land use, which is designated to include areas providing for preservation of the unique natural and scenic resources which meet the aesthetic and recreational demands of multi-neighborhood areas. The General Plan Land Use Element presents Planning Recommendations for general areas, including: Land Use Principles, Land Use Definitions and Planning Recommendations. Staff has identified a few recommendations within these general areas which should be reviewed in order to determine the proposed amendment to the Official Zoning Map of the Town of Fountain Hills conformance with the General Plan. Land Use Principles Preserve the unique natural and scenic resources of Fountain Hills, while accommodating new residential and non-residential growth in an orderly and environmentally sound manner. Parks,Recreation,and Open Space 6.4 Planning Recommendations A)Ensure that Fountain Park Remains a Community Park Fountain Park has for many years been perceived as the center of the Fountain Hills community. It is a landmark that distinguishes the Town from other surrounding communities. Its facilities are widely used by residents and it has the potential to accommodate new improvements and even greater public use. The park's size and strategic location make it an economically viable candidate site for a variety of other potential land uses. The development of the park site for other uses is possible under current zoning conditions. If this were to occur, it would result in a major loss to the community and would be a significant step backward at a time when the community is working very hard to expand the size and scope of its park system. It is therefore recommended the Town work cooperatively and expeditiously to develop a strategy that will ensure the long term protection of Fountain Park. Staff Report Z99-08 February 25, 1999 Page 3 The Town has acquired this parcel of land from MCO since the adoption of The Town of Fountain Hills General Plan. Until the Town sees otherwise fit, this rezone will ensure that Fountain Park remains a Community Park. After staffs review of the proposed rezoning for this area, and the Principles, Guidelines and Recommendations contained in the General Plan, staff believes that the proposed rezoning is in conformance with the Fountain Hills General Plan and the requirements of the Zoning Ordinance for a"OSR" zoned parcel. Recommendation On February 25, 1999 the Commission recommended approval to rezone Fountain Park to "OSR" Open Space Recreation. Based on the Principles and Guidelines contained in the Fountain Hills General Plan and the existing surrounding development, staff recommends that the Town Council approve the proposed rezoning.
