1) All citizens wishing to speak must first be recognized by the Mayor.
2) The Mayor will not call for public comment on an item until after a motion has been made and seconded and the Council has had
adequate opportunity to discuss the item.
3) Please stand,approach the microphone and state your name and address after being called on to speak.
4) All comments must be directed to the Mayor.

All items listed with an asterisk (*) are considered to be routine, non-controversial matters and will be enacted by one
motion and one roll call vote of the Council. All motions and subsequent approvals of consent items will include all

(iv Councilmember or member of the public so requests. If a Councilmember or member of the public wishes to discuss an
item on the consent agenda, they may request so prior to the motion to accept the consent agenda. The item will be

*1.) Consideration of APPROVING THE MEETING MINUTES of September 16 and 28, 1999.
*2.) Consideration of RESOLUTION 1999-48 abandoning whatever right,title,or interest the Town has in certain
public utility and drainage easement located along the northeasterly property line of Plat 604B, Block 1,Lot 5
(15068 Mustang Drive) as recorded in Book 196, Page 27 records of Maricopa County, Arizona. EAA 99-21

*3.) Consideration of RESCINDING EA99-17, RESOLUTION 1999-42 and consideration of the new EA99-17,
RESOLUTION 1999-49, abandoning whatever right, title, or interest the Town has in certain public utility
and drainage easement located along the northerly property line of Plat 213. Block 1, Lot 14 (16710 Oxford
Drive) as recorded in Book 155, Page 24 records of Maricopa County, Arizona. EA 99-17 (William F.

*4.) Consideration of AWARDING THE BID of September 21, 1999 to Han Mar Energy for the construction of
the traffic signal at Saguaro and Grande, the modification of the signal at Palisades and Saguaro and the
interconnect from Palisades to Grande.
*5.) Consideration of the FINAL REPLAT for Plat 201,Block 3,Lots 8, 9, and 10,a lot join project.
*6.) Consideration of the REIMBURSEMENT AGREEMENT between the Maricopa County Sheriffs Office
and the Fountain Hills Marshal Department for the purpose of implementing the Universal Hiring Program.
*7.) Consideration of the SPECIAL EVENT REQUEST submitted by the Fountain Hills Chamber of Commerce
for the 1999 Fall Festival. The annual event, scheduled for November 12 through 14, will run from 10:00 a.m.
to 5:00 p.m. and will require the closure of Saguaro Boulevard between Steward Vista and Parkview Avenue
and the Avenue of the Fountains between Saguaro Boulevard and La Montana Drive.
*8.) Consideration of the SPECIAL EVENT REQUEST submitted by Kenny Krell on behalf of Three
Disciplines Racing for the Jingle Bell 5K and lmile Fun Run. The event is scheduled for Sunday, December
19 from approximately 4:45 p.m. to 7:00 p.m. The event, intended to raise funds for the Fountain Hills High
School cross country and track teams, will require the closure of the Avenue of the Fountains between
Saguaro Boulevard and Verde River Drive.
*9.) Consideration of the SPECIAL EVENT REQUEST submitted by Peggy Affolter for the Fountain Hills
Chamber of Commerce for the annual Thanksgiving Day Parade. The event will be held on Thursday,
November 25, 1999 from 6:30 a.m. to 11:00 a.m. and will require the closure of Saguaro Boulevard between
El Lago and Palisades, Palisades between Saguaro and La Montana, and La Montana between Palisades and
Park View. Vehicular access to Panorama will be limited to local traffic only.
*10.) Consideration of the SPECIAL EVENT LIQUOR LICENSE APPLICATION submitted by Mary Jo
Flaherty for the Sunridge Foundation. The request is for a special event liquor license to be used for the
Sunridge Foundation fundraiser to be held on Saturday, November 6, 1999 from 6:00 p.m. to midnight at the
SunRidge Canyon Clubhouse located at 13100 North Sunridge Drive.
11.) Consideration of the Mayor's recommendation of APPOINTING three citizens to the Planning and Zoning
Commission to fill the vacancies caused by expiring terms.
12.) ROTATION OF THE POSITION OF VICE MAYOR from Councilman Mower to Councilman Apps. The
Vice-Mayor is an eight-month,rotating position to be held by every councilmember.
Ly 13.) PRESENTATION of a traffic safety report by Public Safety Director Steve Gendler.
14.) UPDATE on the current efforts of the Town to develop an Alternative Fuel Program.

17.) PUBLIC HEARING on ORDINANCE 99-27 amending The Zoning Ordinance for the Town of Fountain
Hills, Chapter 5, Section 5.06. Yard, Lot and Area Requirements regarding swimming pool setback
requirements and Section 5.07.B Building Height Requirements which would regulate which structures have
exceptions to building height limitations, Case Number Z99-20.
18.) Consideration of ORDINANCE 99-27 amending The Zoning Ordinance for the Town of Fountain Hills,

SESSION for discussion or consultation with the attorneys of the public body in order to consider its position
and instruct its attorneys regarding the public body's position in pending or contemplated litigation regarding
the Town versus MCO Properties; AND discussions or consultations with designated representatives of the
public body in order to consider its position and instruct its representatives regarding negotiation for the purchase
of lease of real property with regards to the possible acquisition of Chaparral City Water Company;respectively.

AGENDA ITEM# 11 - APPOINTMENT OF THREE CITIZENS TO THE
PLANNING & ZONING COMMISSION:
The terms of three P&Z Commissioners expire on October 1st. Council will hold an
Executive Session this Tuesday, October 5th, for the purpose of interviewing seven
applicants, four new candidates, and three incumbents. Mayor Morgan will nominate three
applicants to fill these terms at the October 7th council meeting. Jeff's report is enclosed.
AGENDA ITEM# 12 - COUNCILMAN APPS BECOMES VICE-MAYOR:
The Vice-Mayor position will be assigned to Councilmember Apps for the next eight-month
period. See Cassie's attached memo.
AGENDA ITEM# 13 - TRAFFIC SAFETY REPORT:
Public Safety Director Steve Gendler will provide an update on traffic safety and the planned
enforcement efforts in Fountain Hills. Lt. Scott Penrose and Officer Ken Martinez will be
present to answer questions. Steve's report is attached.
AGENDA ITEM# 14 -UPDATE ON ALTERNATIVE FUEL PROGRAM:
Jim Leubner will discuss the Town's current efforts to develop an alternative fuel program.
Staff is scheduled to attend MAG's AFV workshops designated to assist cities with future
program planning. The Town submitted a grant application for AFV funding on September
fliw 17th and grant allocations should be distributed by the end of November 1999. Jim's memo is
attached.
AGENDA ITEM# 15 - PRESENTATION OF PRIORITIES FROM THE
MCDOWELL MOUNTAIN PRESERVATION COMMISSION:
Community Development Director Jeff Valder will report on the MMPC's possible
recommendation regarding acquisition priorities for the mountains. A draft map and cover
memo were distributed to you today from Jeff regarding an upcoming article in the
Scottsdale Tribune. The MMPC meeting will be held Tuesday, October 5th. A report will be
provided to you if additional action is taken at that meeting. No report is attached.
AGENDA ITEM# 16 - OWNERSHIP TRANSFER OF A PORTION OF PANORAMA
WASH/PUERTO DEL LAGO:
Ten months ago, the Puerto del Lago Homeowners Association requested that the Town
assume ownership of their portion of the Panorama wash area. The Association feels that
Fountain Lake has been the source of excessive water in this wash; thereby creating
burdensome maintenance costs. Staff recommends approval per the conditions outlined in
Jim Leubner's attached report.

AGENDA ITEMS # 17 & # 18 - PUBLIC HEARING/ORDINANCE 99-27/GRADING
STANDARDS & BUILDING HEIGHT REQUIREMENTS:
A public hearing is on the agenda to collect input regarding swimming pool setback
requirements and regulating building height requirements. After the hearing, Council will
consider this text amendment. Approval was unanimously recommended by the Planning &
Zoning Commission and Town staff concurs. See Geir's attached memo.
AGENDA ITEMS # 19 & #20 - PUBLIC HEARING/ORDINANCE 99-28/TRASH
ENCLOSURES:
Another public hearing is scheduled for comments on regulations for trash receptacles. An
amendment was initiated to require common trash enclosures for lots or parcels with more
than four dwelling units, and duplex and multi-family units to fully screen trash receptacles
from public view. The Planning & Zoning Commission unanimously recommended
approval. Dana's report is attached.

AGENDA ITEM #8—JINGLE BE RUN SPECIAL EVENT REQUEST

event for a date and time to minimize community inconvenience. He is requesting to hold the
Jingle Bell run on Sunday, December 19, from approximately 4:45 p.m. to 7:00 p.m. when all
stores are closed and traffic is minimal. The event will consist of a 5K run around Fountain Park
and a 1 mile fun run utilizing part of the Avenue of the Fountains between Saguaro and Verde River
Drive and the unpaved portion of Verde River and Stewart Vista. The Avenue will be closed from
Saguaro to Verde River Drive. (Please see the enclosed map for more details.) "Rolling road
blocks" will be used on Saguaro Boulevard where the runners will cross the street at the Saguaro

Boulevard/Avenue of the Fountains intersection. Mr. Krell and his volunteers will place cones all the
way around Fountain Park clearly marking the bike lane as the race course. His plan is to have the
race run prior to dusk with the award ceremony on the Avenue as the holiday lights are lit. Each
contestant will receive a shirt and bells to wear on their shoes, creating a holiday atmosphere. The
application includes a letter received from Mr. Krell providing additional details on the event.
Mr. Krell met with Marshal Gendler, Pat Harvey and me to work out all the details of the event and
insure that all safety issues were addressed. (Please see enclosed memo from Steve.) A certificate
of insurance will be on file prior to the event. Staff recommends approval.
AGENDA ITEM #9—THANKSGIVING DAY PARADE SPECIAL EVENT REQUEST
The Chamber of Commerce has submitted their request for the Annual Thanksgiving Day Parade to
be held on Thursday, November 25th, 1999 from 6:30 a.m. to 11:00 a.m. The event will utilize
portions of Panorama Drive, allowing access to local traffic only. Saguaro will be closed from El
Lago to La Montana; Palisades will be closed from Saguaro to La Montana; La Montana will be
closed from Palisades to Parkview. Marshal Gendler has prepared traffic and safety plans for the
event, taking into consideration the Town sponsored Turkey Trot. A certificate of insurance is on
file. This event has run smoothly in years past and staff recommends approval.
AGENDA ITEM #10 — SUNRIDGE FOUNDATION SPECIAL EVENT LIQUOR LICENSE
The Sunridge Foundation is preparing for their annual fund raiser for Fountain Hills charities. They
will need a special event liquor license for the gala to be held on Saturday, November 6 from 6:00
p.m. to 12:00 a.m. at 13100 North Sunridge Drive. Marshal Gendler has conducted his background
investigation and states in his memo dated October 1, 1999 that the request fulfills all the
requirements of ARS 4-203. Of primary importance is the assurance that the alcohol will remain
within the event area. The Marshal feels that his requirement has been satisfied. Staff
recommends approval.
AGENDA ITEM #12— ROTATION OF VICE MAYOR
Per the Town Code Section 2-2-2, October 7 marks the "changing of the guard" for the position of
Vice Mayor. The aforementioned section states: "Each member of the council, except the mayor,
shall serve an eight month term as vice mayor". Vice Mayor Mower assumed the position at the
first Council meeting in February 1999 and will conclude his term at the October 7th meeting.
Councilman Apps will fill the Vice Mayor position through May 2000.
INFORMATIONAL ITEM —IMAGINE RECOVERY RESOURCES REPORT
Tony Bass has offered to provide monthly reports on their activities with the youth in Fountain Hills.
At the back of your packet you will find his first report received mid-September. Staff will include
these reports with your Council packets or in the TIP depending on the date they are received.
If you have any questions or desire additional information prior to the Council meeting, please do
not hesitate to contact me.

This item on the Town Council's agenda is a proposal to abandon the ten (10)foot public
utility and drainage easements located at the northeasterly property line of Lot 5, Block 1,
Plat 604B, (15068 Mustang Drive). The property owner of Lot 5 desires the assurance that
any future improvements made to the lot will not be infringed upon by the construction of
utilities. Staff has received no comments to date from the adjacent property owners.
The Engineering Department has reviewed the site to ascertain any drainage issues in
addition to the Town's general interest in the easement. It is the professional opinion of
the Engineering Department that there is no need for the Town to retain the drainage
easement proposed to be abandoned, with the understanding that certain lots within this
subdivision are subject to lot-to-lot drainage runoff. The property owner of Lot 5 is
required to pass the developed flows generated by the upstream lots across their
property.
All affected utility companies have been notified of this abandonment proposal and
have approved of the proposed abandonment of this public utility easement.
Staff recommends adoption of Resolution 1999- 48.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA ABANDONING WHATEVER RIGHT,TITLE, OR
INTEREST IT HAS IN THE CERTAIN PUBLIC UTILITY AND DRAINAGE
EASEMENTS ALONG THE NORTHEASTERLY LOT LINE OF LOT 5, BLOCK 1,
OF PLAT 604B, FOUNTAIN HILLS, ARIZONA, AS RECORDED IN BOOK 196 OF
MAPS, PAGE 27, RECORDS OF MARICOPA COUNTY, ARIZONA.
WHEREAS, The Town Council of the Town of Fountain Hills, as the governing body of real
property located in the Town of Fountain Hills, may require the dedication of public
streets, sewer, water, drainage, and other utility easements or rights-of-way within
any proposed subdivision; and
WHEREAS, The Town Council of the Town of Fountain Hills has the authority to accept or reject
offers of dedication of private property by easement, deed, subdivision, plat or
other lawful means; and
WHEREAS, All present utility companies have received notification of the proposed
abandonment;
NOW THEREFORE, be it resolved by the Mayor and Common Council of the Town of Fountain Hills,
Arizona as follows:
SECTION 1. That the certain ten (10)foot public utility and drainage easements, located along
the northeasterly property lot line of Lot 5, of Plat 604B, Block 1, Lot 5, Fountain Hills,
Arizona; as recorded in book 196 of maps, page 27 records of Maricopa County,
Arizona; are hereby declared to be abandoned by the Town of Fountain Hills.
Certain lots within this subdivision are subject to lot-to-lot drainage runoff. The
property owner of Lot 5 is required to pass the developed flows generated by the
upstream lots across their property.
SECTION 2. That this Resolution is one of abandonment and disclaimer by the Town solely for
the purpose of removing any potential cloud on the title to said property and that
the Town in no way attempts to affect the rights of any private party to oppose the
abandonment or assert any right resulting therefrom or existing previous to any
action by the Town.

RE: Staff Report- Easement Abandonment
Resolution 1999-49
The Council adopted Resolution 1999-42 on August 16, 1999 which abandoned the
Town's rights in a public utility and drainage easement along the northerly lot line of Lot 14 in
Block 1 of Plat 213. An error in the staff report and the resolution placed the lot in Block 3
rather than Block 1 and indicated that the address was 16610 Oxford Drive when, in fact, the
correct address is 16710 Oxford Drive.
Staff discovered the error and the purpose of the resolution on tonight's agenda is to
clarify that error and to record the new resolution to effectively repeal the former resolution.
There is no fiscal impact and this action is being taken with the full knowledge and
consent of the property owners involved.
Staff recommends approval on the consenting of this item.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,REPEALING RESOLUTION
1999-42 AND ADOPTING THIS RESOLUTION ABANDONING WHATEVER
RIGHT,TITLE OR INTEREST THE TOWN HAS IN A PORTION OF A
CERTAIN PUBLIC UTILITY EASEMENT AND DRAINAGE EASEMENT
ALONG THE NORTHERLY LOT LINE OF LOT 14,BLOCK 1 OF PLAT
213,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 155 OF
MAPS AT PAGE 24,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,the Town Council,Town of Fountain Hills, on the 16th day of August, 1999
adopted Resolution 1999-42; and
WHEREAS, on September 1, 1999 in the official records of the Maricopa County Recorder
at Instrument No. 99-0829923 did record Resolution 1999-42; and
WHEREAS, that said Resolution 1999-42 contained a typographical error identifying Lot 14
as being in Block 3 of Plat 213, whereas Lot 14 is located in Block 1 of Plat 213; and
LP' WHEREAS, it is the intention of the Town by the adoption of this resolution to rescind
Resolution 1999-42 and to record the new Resolution 1999-49 to correct the error;
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AS FOLLOWS:
Section 1. That Resolution 1999-42 is hereby rescinded and that the certain 20'public utility and
drainage easement located along the northerly property line of Lot 14, as shown in Exhibit A of Plat
213, Block 1, Fountain Hills, Arizona, as recorded in Book 155 of Maps, Page 24, Records of
Maricopa County, Arizona is hereby declared to be abandoned by the Town of Fountain Hills.
Certain lots within the subdivision are subject to lot-by-lot drainage runoff. The property owner of
Lot 14, Block 1 is required to pass the developed flows generated by the upstream lots across their
property.
Section 2. That this resolution is one of abandonment and disclaimer by the Town solely for the
purposes of removing any potential cloud on the title to said property, and that the Town in no way
attempts to affect the rights of any private property to oppose the abandonment or assert any right
resulting therefrom or existing previous to any action by the Town.

Bid Award
Bids were opened on Tuesday, September 21 for the Traffic Signal Construction and Traffic
Signal Upgrade project. Three bids were received, as shown on the attached bid tabulation
sheet. Low bidder was Han Mar Energy, Inc., with a bid of$177,189; the engineer's estimate
was $200,835. However, the project budget was $130,000.
As seen above, the low bid is in excess of the project's overall budget. This happened because
a significant amount of new work was added.
• The Saguaro/Palisades signal modifications include several additional items than was
originally planned, i.e. five new loop detectors, new controller cabinet, and additional new
wiring.
• During the design phase, due to the close proximity of the Grande and Palisades signals, it
was suggested by our traffic engineer that we install an interconnection between these two
signals. This will enable traffic to move more efficiently during peak periods. This work
was not originally budgeted.
• After review of the capital improvement projects, staff concludes it will be able to recover
the budget shortfall since the Town Directional Signage and Avenue of the Fountains
Electrical projects were both under budget. Also, since budget approval, staff had obtained
a Regional Public Transportation Authority (RPTA) grant, thus reducing the amount of
capital expenditure for FY '99-'00.

This request is for final plat approval of a Replat for "Final Plat of Lot 9-A, Block 3, Fountain
Hills, Arizona Final Plat 201" which is a lot join project. Due to the simplicity of this request a
"fast track" process is being allowed.
The owner, Lenore Abbate, has chosen to reconfigure these lots by combining the lots
into one lot. The reconfiguration of these lots will allow for greater flexibility in the
construction and orientation of buildings without crossing lot lines. The new lot will meet all
the requirements of the "R-3" Multi-Family Residential Zoning District for size and
dimensions.
RECOMMENDATION:
Staff recommends approval of replat S99-027 " Final Plat of Lot 9-A, Block 3, Fountain Hills,

SUBJECT: 1999 Fall Festival
The purpose of this memorandum is to endorse the attached special event request from
the Fountain Hills Chamber of Commerce. The request covers the annual Fountain Hills "Fall
Festival of the Arts" which is scheduled for November 12-14th. It is my understanding that this
will be considered at the Council session on October 7th.
I am recommending approval of this request based on the following factors:
1. Sharon Morgan, Event Coordinator for the Chamber of Commerce, has arranged
insurance documentation which will protect the town's interests. Although it is not
included in the application package, I have been assured that the insurance certification
will incorporate all liability reduction provisions suggested by my department based on
our experience with previous events of this nature.
2. I have been in contact with the Fire Department to work out an emergency
medical services plan and fire prevention provisions for review by the Chamber of
Commerce. Both the Assistant Chief and I am satisfied with its components.
3. Traffic and parking provisions are being handled by the Marshals Department in
an effort to keep costs as low as possible. We have made provisions for traffic control
from Shea through the interior streets to the event, with specific attention to traffic in the
immediate area around the Art Fair. In addition, we have made provisions for Marshals
Department personnel to assist with parking control to help merchants along Avenue of
the Fountains who will be open during the event.
4. Sharon Morgan has made arrangements to contract for signs, signals and markings
which will direct visitors to the event. This will be carefully reviewed and approved by
my department and Pat Harvey, street superintendent.
5. Provisions have already been made with Pat Harvey for traffic barricades to close
Saguaro at El Lago and Parkview. In addition, Avenue of the Fountains will be closed
at Verde River Drive and La Montana Thursday, Friday and Saturday nights. The
Thursday closure will be after business hours to avoid any conflict with area merchants.
In addition to the items outlined above, I plan personal visits to merchants along Avenue
of the Fountains and Southtique Mall as well as speaking to the Plat 208 property owners
association regarding changes in traffic patterns. Extra effort will be put into securing parking
spaces for their patrons during the event. I also intend to issue a press release to advise citizens
of detours and alternate routes caused by the event.
I believe the Art Fair is well planned, will reflect credit on our community, and represents
an opportunity for civic clubs, social groups, and town merchants to benefit. I recommend
approval by the Council at their October 7th meeting.

SUBJECT: Special Event Request - Thanksgiving Day Parade
The purpose of this memorandum is to endorse the attached special Event Request from
the Chamber of Commerce for the Thanksgiving Day Parade.
I have had an opportunity to review the request with Peggy Affolter, event coordinator
at the Chamber of Commerce and we have agreed on a traffic plan which should minimize
inconvenience to local residents. This plan will require the following:
1. Closure of Saguaro Blvd. between El Lago and Palisades.
2. Panorama will be closed from Saguaro to El Lago except for local residents and
parade participants.
3. Palisades will be closed at LaMontana.
4. LaMontana will be closed at Parkview and Palisades and barricades will be placed
at the entrance to the Basha's parking lot.
We anticipate the closures to begin at 6 A.M. in conjunction with a possible Parks &
Recreation Turkey Trot and remain in effect until the parade has concluded. The parade has been
extended along LaMontana and our traffic plan accommodates parents picking up children who
participate in the parade.
This event reflects well on the community and has become a Fountain Hills tradition. I
recommend approval by the Council.

Re: Special Event Request—"Jingle Bell Run"
The purpose of this memorandum is to endorse the attached special event request
from Ken Krell for a "fun run" on December 19t. I understand that this will be
considered by the Council at the October 7th meeting.
After meeting with Mr. Krell on September 24th, I believe his proposed event will
involve minimal inconvenience to motorists and residents while benefiting the High
School Cross Country and Track team.
As envisioned, the event would feature both a 1 mile and a 5K run. It would require
closure of Avenue of the Fountains between Verde River and Saguaro, as well as a
short traffic delay on Saguaro at Avenue of the Fountains. However, the event is
scheduled for approximately 5pm on a Sunday and would condude by 7pm. During
that period, businesses are dosed and traffic is minimal in the proposed area.
The 1 mile run would be staged on Stewart Vista while the 5k would involve a course
twice around Fountain Park. The start and finish line for both events is behind the
protective barricades on Avenue of the Fountains. The event has been planned to
take place during a 2 hour period that takes advantage of daylight, but occurs after
normal business and recreation uses in the area have conduded.
In planning with the Street Department, temporary barricading would be erected on
Avenue of the Fountains at Verde River and Saguaro with "no parking"designated by
cones and signs along Saguaro at Fountain Park.
Recommendation: Based on the proposed time (5pm-7pm), the length (2 hours),
the fact that it involves minimal barricading, detours, or traffic delays, as well as the
proposed benefit to the track and cross country teams, I recommend approval by the
Council at the October 7th meeting.

To whom it may concern at Fountain Hills City Operations,
I am the Fountain Hills cross Country and Track coach as well as the race director for the 3
Disciplines racing events. You may have seen the articles that Todd Elwood has done on us in the Times.
We are putting on a 6 race duathlon series at McDowell Mountain Park and a trail run.
I would like to put a Jingle Bell run on under the lights on the Avenue of the Fountains. I came up
with this idea from a lot of events back in Michigan. There is no other Jingle Bell run like this in the state.
It is a great opportunity to get friends and family members out before the stressful Christmas Holiday to
have some great fun.
I have designed the course to take full advantage of the holiday lights as well as the Fountain. I
have also taken into consideration the amount of road closure needed as you can see on the accompanying
map. I have seen many Town Council meetings and realize the problem the residents have with the closing
of Suguaro road. There would be probably a maximum of 30 to 40 minutes of total closure time. It would
not even be a straight 30 minutes. We would have to close it at the start of the race for about 5 minutes as
the runners cross suguaro to the Fountain. Then about 15 minutes later a closing again to let the runners
cross the street to the finish line. The only other closure would obviously be the Avenue of the Fountains.
Traffic would be light as well being on a Sunday evening.
I hope you can recognize the tremendous opportunity for the Town of Fountain Hills to promote
itself and to bring more families together during this great holiday.
In addition I will be putting a portion of the proceeds back into the cross country and track
programs at the high school.
Advertising for this event will include Sweat magazine with a circulation of 45,000 copies,Race
place magazine 30,000 copies, our web site,local cable, all health and fitness clubs and stores.

A 5k run and a 1-mile fun run for kids in beautiful down town Fountain Hills under the Christmas
lights on December 19th. This will be promoted as a family event with Christmas music, Santa Claus and
other Christmas icons as well as the lights. All of the race volunteers will be wearing elf hats,with one of
the characters calling out mile times at the 1,2,and 3-mile marks. Each participant will receive Jingle bells
to tie on their shoes while they are running. They will also receive a festive T shirt and candy cane. All of
the awards will be given wrapped in Christmas wrapping paper.
The event will start with the 1-mile fun run at approximately 4:45 p.m. Then the 5k will begin at
about 5:10 p.m. This should put the last competitor under the lights right at dusk about 5:40 p.m. With the
awards party taking place after that and ending at 7:00 p.m.
I will send information packets to all of the local merchants explaining the opportunity to take part
and promote their business during the event.
I am sure you can imagine what an incredible event this can be. Like I stated before there is
nothing else like it in the state. This will bring many families to our great town to participate in a healthy,
festive,atmosphere.

Re: Special Event Liquor Permit—Sunridge Foundation
The purpose of this memorandum is to endorse the attached special event liquor
permit submitted on behalf of the Sunridge Foundation by Mary Jo Flaherty. It is my
understanding that this will be considered by the Council at their meeting on October
7th.
Background: The event, scheduled for Saturday, November 6th, is a charity
fundraiser permitted as an exception to the Arizona Revised Statutes, Title4. The
Sunridge Foundation is a tax exempt organization holding IRS number 86-0800268.
Investigation: According to the state liquor department, this event will fall under the
provisions of ARS 4-203.02 which permits a licensee to suspend their license for the
duration of the charitable event on ten occasions per year. The Marshals Department
records show that Sunridge Canyon Golf Club has a valid class 6 (#06070667) in
place at 13100 N. Sunridge Drive. Further, the Marshals Department records show
that this will be the first such special event permit for this location in 1999.
Findings: In reviewing the plans, they are consistent with similar events held by the
Sunridge Foundation annually since 1996. I am satisfied that provisions have been
made which ensure controlled access to those areas serving alcohol. According to
the plans, entrance to the event is through the foyer at the clubhouse and access to
the tent area is off a terrace area behind the clubhouse. Additionally, there is only
one entrance to the tent itself which lends itself to further control. Access to the areas
where liquor will be served is being monitored by security personnel from the Sheriffs
Posse. These arrangements all comply with the requirements of ARS 4-203.
Recommendation: Based on the application meeting all legal requirements for a
charitable event, the existence of a valid Bass 6 license for the premises, and the fact
that this will not exceed the ten special event days authorized for a location per year,
I recommend approval by the Council at their October 7th meeting.

PURPOSE:
Allows a charitable, civic, fraternal, political or religious organization to sell and serve
spirituous liquor for consumption only on the premises where the spirituous liquor is sold, and
only for the period authorized on the license. This is a temporary license.
ADDITIONAL RIGHTS AND RESPONSIBILITIES:
The applicant for a special event license must request a special event application from the
Department and file the application with the governing body of the city or town, or Board
of Supervisors of an unincorporated area of a county, where the special event is to take
place, for approval or disapproval.
If the application is approved by the local authority, and the event meets the requirements
for granting the license, the DIRECTOR will issue a special event license to the qualifying
organization.
Qualifying organizations will be granted a special event license for no more than ten (10)
days in a calendar year. Events must be held on consecutive days and at the same
location or additional licenses will be required. The license is automatically terminated upon
closing of the last day of the event or the expiration of the license, whichever occurs first.

revenues of the special events.
A person selling spirituous liquor under a special event license must purchase the spirituous
liquor from the holder of a license authorized to sell off-sale; except that, in the case of a
non-profit organization which has obtained a special event license for the purpose of
charitable fund raising activities, a person may receive the spirituous liquor from a
wholesaler as a donation.
AVERAGE APPROVAL TIME: One (1) to seven (7) days.
PERIOD OF ISSUANCE:
Issued for no more than a cumulative total of ten (10) days in a calendar year. A special
event may be held for more than one (1) day, but it must be held on consecutive days and

The terms of Planning and Zoning Commissioners David Combs,Michael Downs and Thomas
Fox will expire on or about today, October 1, 1999. Planning and Zoning Commissioners are
appointed for two year, staggered terms. The Town Council needs to appoint three people to fill
these three expired terms, and those people will be sworn in and seated before the Commission's
first meeting of October, scheduled for October 14, 1999.
The Town has advertised for applicants in The Fountain Hills Times for the last six weeks. The
Town has received seven applications, including letters from the three current Commissioners, all
of whom desire to be reappointed. In addition to Mr. Combs, Mr. Downs and Mr.Fox,the Town
has received applications from Mr. Ken Koutsky,Mr. Hal Lucas,Mr. Jay Schlum and Mr.
George Williams. Please see the attached applications for all of these gentlemen.
On Tuesday, October 5, 1999 at 6:30 PM in the Large Conference Room in Building"C", the
Town Council will hold an Executive Session meeting at which the Council will be interviewing
all seven candidates. Please see attached the interview schedule for that meeting.
On Thursday, October 7, 1999 Mayor Morgan will nominate three applicants to fill these expired
terms. An affirmative majority vote of the Town Council is needed to appoint someone to the
Planning and Zoning Commission.

1. I am very encouraged over the positive actions taking place on the part of
our town's responsibility to its people. In the several years my wife and I
have lived here, we have seen the leadership become more responsible
through the democratic process. I believe my participation as a commissioner
will continue and reinforce this process. I feel it is important for citizen's to
share in the process of growth and development.
2. As a commissioner I will persue the "balance" we must all have to be
respectful to the property owners, the mandates of government and the
environment. The action we take in the short term, impact the long term
future for all of us. I have no more simple goal than to help plan and structure
a community that embraces our town motto, "All that is Arizona".
3. I am concerned over many issues that have risen recently;
a. The need to focus on the town center to anchor our business base.
b. Development of the Shea corridor.
c. Multifamily vs. single family housing.
d. Cooperation in planing with the sanitary commission.
e. The issue of growth vs. desert.
4. I am politically moderate and believe though we may not please all the
people, we must strive to stabilize the growth of Fountain Hills. It is my goal
co, to help insure a bright future for all segments of our town as we preserve the
desert and environment that drew us here. The experience and skills I have
accumulated during my 27 years in business, prepared me for this position.

1 am interested in serving on the Fountain Hills Planning and Zoning Commission
for several reasons.
My main motivation for joining the Commission is to become more involved in and
contribute to the community I have lived in and loved since age 11.
Planning and Zoning is an area I have been interested in for several years.
Having been active in residential and commercial real estate for the past 9 years I
have learned much and grown more interested in the way government can improve
and protect the lifestyles of its residents.
I also offer the community and commission my telecommunications eiperience and
background.
My ability to read blueprints and my above average understanding of the building
process are a few additional benefits I offer to the commission.
Initially, if granted a position on the commission I will focus on learning the town
codes,listening to the other commissioners' opinions, and actively seek out the
concerns and input from our wonderful and respectable community residents.
I have 2 children and a wonderful wife and we plan on living in Fountain Hills for a
long time.
I am focused on improving and preserving this community.
I appreciate Fountain Hills for the many things that make Fountain Hills unique.

To whom it may concern:
I moved to Fountain Hills three years ago, from the Valley,to raise my family in what I consider the
most balanced and wholesome community in the Valley.My goal in serving on the commission would
be to try to insure that our community continues to develop in a balanced manner. I am tired of hearing
people complain about the way things are happening and then say that they are just resigned to moving
away. Personally I would rather get involved and keep this a community that I am proud to call my
home.
My goals and objectives for serving on the Commission would be:
1.)To seek a more balanced mix of Single Family development versus Multi Family development.I see
Fountain Hills as a classy little town in the likeness of a Sedona or Carefree versus where Single Family
custom developments are the rule rather than the exception. Our Town has become inundated with
Multi Family developments as of late and I feel that if this trend is to continue rather than a classy little
town we will be just another little Mesa or Phoenix.
2.)Density transfers have been used excessively in the last few years here and often I feel we have been
short changed on what we have given up for what we have received. Often in the past we have given
density transfers to preserve open space in areas that either were impossible or financially prohibitive to
develop and rewarded the developer unjustifiably with additional densities elsewhere. Carefree has
developed into a beautiful area without a great deal of density transfers. They have a great mix of large
custom homes which tend to be better suited in our landscape than cluster upon cluster of tract style
homes on mass graded pads.
3.)I would like to see a vegetation ordinance similar to Scottsdale or Carefree that requires builders and
developers to revegatate a disturbed area prior to the issuance of a Certificate of Occupancy. I feel the
chain link fence ordinance has good intentions but it is somewhat misguided, it does not insure that the
site will be restored to any type of pristine state.
4.)Finally,I feel that Fountain Hills needs to be more conducive to commercial development that will
generate sales tax dollars. Fountain Hills is entering its final stages of large scale building which may
last three to five years at which point we will have to look to commercial and retail businesses to
generate the much needed sales tax dollars our community will continue to need.

Re: Agenda Item—Traffic Safety Report
Background:
During a five-week period between mid August and mid September, our community
experienced three motor vehide accidents at intersections on Saguaro Boulevard.
These resulted in one fatality, and six serious injuries requiring medical evacuation
helicopters.
This has generated considerable public interest in traffic safety efforts as well as
measures planned by Fountain Hills Law Enforcement.
At the request of our Paul Nordin, a brief oral report is scheduled for the Council
meeting on October 7t. Both Lt. Penrose and Officer Ken Martinez will be present to
answer questions. The purpose of this memorandum is to outline highlights of our
report.
Analysis:
All traffic accidents have three basic causes; roadway conditions, mechanical failure,
or driver error. In each of the accidents in question, the cause has been attributed to
driver error. The fatal accident on Aust 13th resulted from inattention; the accident
with four injuries on September 10thresulted from an unsafe turn in front of an
oncoming truck; and, the accident with two injuries on September 17th resulted from a
failure to yield.

The concept of traffic safety encompasses a combination of engineering, education,
and enforcement. In the recent series of accidents, the cause involves driver error.
Therefore, education and enforcement are appropriate responses.
Actions:
When considering enforcement, the first elements we look at are patterns that could
be used as the basis for scheduling and deployment of personnel. All three accidents
occurred on Fridays. Therefore, Fountain Hills Law Enforcement has diverted two
officers from their normal duties to traffic on Friday afternoons. Since the accidents
occurred on Saguaro at intersections with traffic lights, the emphasis of these officers
will be lighted intersections.
In addition, our traffic safety officer, Ken Martinez, has worked with engineering to
lengthen the yellow cycle at Saguaro and Palisades from 6 seconds to 12. This
change, which took effect September 25th, should help clear the intersection on
Palisades before traffic resumes on Saguaro.
Along with enforcement and changes in the traffic signal, a public information and
education effort is being initiated. This indudes articles designed to increase traffic
safety awareness (September 22nd issue of the Times), as well as a series of "traffic
safety tips"that will appear using the"help us help you"format.
Finally, as part of a more comprehensive approach to the growing traffic problem and
the challenge of gaining voluntary compliance, other alternatives are being studied.
These indude camera use, display boards, and public safety campaigns.

RE: Update of Town's current efforts to develop an Alternative Fuel
Program
On July 6 during a special Council meeting, the Town Council voted to approve
the alternative fuel vehicle (AFV) waiver application with the understanding
that staff would continue to pursue developing an alternative fuel program. We
had also talked about staff preparing a report or preliminary AFV program at
the August 5th Council meeting.
As you are aware, MAG has since organized three AFV workshops to assist
towns and cities in preparing or developing an AFV program and also in
assisting with alternative fuel grant program applications. On September 15th I
attended the first of three workshops ("Funding for Alternative Fuel Vehicles")
designated to help cities in their planning. This workshop focused primarily on
grant applications for AFV fueling stations with some discussion on grant
funding for municipal alternative fueled vehicles. They reviewed the AFV grant
funding application requirements, answered questions, and urged everyone to
submit their application on time. There will be approximately three million
dollars in grant money available.
As a result of staff meetings, Department of Energy workshops, and the
continued interest in AFV, staff submitted the Municipal Alternative Fuel Grant
Application on September 17, 1999.
In a recent discussion on September 28, 1999 with the Department of Energy,
they anticipated that grant funding awards would be distributed by the end of
November 1999. Our grant application has requested funding for three
additional "OEM" (original equipment manufacturer) propane vehicles to
replace some of our older pickups. Also note that we have recently added to
our fleet a liquid propane sidewalk sweeper. At this point in time, propane
seems to be the logical choice for any AFV, especially when considering the

limited availability of compressed natural gas fueling (CNG) stations close to
Fountain Hills and the Fountain Hills' steep terrain.
Continued research and discussion with both CNG representatives and also
electric fuel vehicle sponsors will be done in the near future to evaluate these
options thoroughly. Our main goal is to prepare a CNG alternative while
realizing that all three AFV options (CNG, propane, and electric) may be utilized
at some point and simultaneously within the next 3-5 years. However, staff
feels that ultimately a compressed natural gas AFV program may be developed
as the main fuel source.
Staff is scheduled to go to the next MAG workshop on October 12, 1999 on
"Repairing Alternative Fuel Vehicles".
As soon as staff hears the results of the grant application, we will inform
Council of the grant application status and of any new information or data.
If Council would like to schedule a workshop where we could have all three
AFV representatives present their program and respective advantages, staff
would be willing to organize the meetings/presentations.

RE: Recommendation regarding land acquisition priorities in the McDowell Mountains of Fountain
Hills.
Dear Mayor Morgan and Councilmembers:
Since July 1, 1999 the McDowell Mountain Preserve Commission has met many times to discuss ways in
which the Town's preservation goals can be achieved. These discussion topics have included
conversations about the Commission's past and present land acquisition priorities, trails and trailheads, •
the nature and use of the proposed preserve,etc. In our conversations about land acquisition priorities, we
also discussed the different methods the Town could utilize to acquire land.
The Commission is fully aware of the limited financial resources the Town now has available for land
acquisition in the McDowells. The Commission is also aware that the Town could, if it chose, raise
additional funding for land acquisition. We also understand that undeveloped, unimproved land is more
affordable than subdivided and/or developed land. It is with these parameters in mind that the
Commission now believes and recommends to you that all land in the McDowell Mountains of Fountain
Hills above the 2,400 foot elevation, instead of the previously-recommended 2,240-foot elevation, should
be included in the McDowell Mountain Preserve and should be acquired by the Town.
After our review of this information, the McDowell Mountain Preserve Commission voted unanimously
on October 5, 1999 to recommend that the Town Council acquire those lands in the prioritization method
shown and as graphically depicted on the attached map. On this map there are eleven specific areas that
are prioritized for acquisition. The following list describes those areas and the Commission's rational for
seeking their acquisition by the Town.
Area 1: This 18.68-acre parcel of land straddles the Eagles Ridge North and Eagles Nest areas, and is
located both east and west of, and abuts a highly visible portion of the "jeep trail." This is the land that
the Town has already condemned. The acquisition of this area is important for viewshed protection, to
provide a connection between two other pieces of Town-owned land, and to provide a portion of a
planned north-south trail that would connect the existing Town-owned land to McDowell Park.

Area 2: This 190.30-acre parcel of land is located on the western most side of the Eagles Nest area. Its
acquisition would eliminate the possibility of homes, roads, or other development above the 2,500-foot
elevation in Eagles Nest. The southern portion of this Area includes the northern section of the highly
visible "jeep trail." The acquisition of this area is important for viewshed protection, and to complete the
northern section of the planned north-south trail that would connect the existing Town-owned land to
McDowell Park.
Area 3: This 58.24-acre parcel of land is located in the northeastern portion of Eagles Ridge North,just
south of Area 1. Its acquisition would eliminate the possibility of homes, roads, or other development
above the 2,500 foot elevation in this portion of Eagles Ridge North,including the southern section of the
highly visible "jeep trail." The acquisition of this Area is important for viewshed protection. The
acquisition of this Area would allow for the completion of not only the northern section of the planned
north-south trail that would connect existing Town-owned land to McDowell Park, but would enable the
Town to develop a spur trail to the southeast along a prominent ridgeline and the beginning of an east-
west trail leading to the planned City of Scottsdale trail system. This Area also includes the site of the
most viable and only "hidden" location for a planned central trailhead for the Preserve. By acquiring this
Area,no development in Eagles Ridge North would be visible from the northern areas of Fountain Hills.
Area 4: This 44.78-acre parcel of land is located west of Area 3 and in the northwestern corner of the
Eagle Ridge North development area. Its acquisition would eliminate the possibility of homes, roads, or
other development above the 2,500-foot elevation in this portion of Eagles Ridge North. The acquisition
of this area would preserve a large part of the area known as the"saguaro forest", and would allow for the
completion of an east-west trail leading to the planned City of Scottsdale trail system.
Area 5: This 9.22-acre area of land would guarantee public vehicular access to the Preserve. The area
represents the planned and probable alignment of a road that would otherwise provide vehicular access to
the Eagles Ridge North area in the event the area was developed. The Town should either acquire the
land itself or a public vehicular/roadway easement.
Area 6: This 0.82-acre area of land would guarantee public vehicular access to the recommended
trailhead site just north of the Eagles Nest area in McDowell Park. The area includes the planned and
probable alignment of a road that would otherwise provide vehicular access to a portion of Eagles Nest in
the event the area was developed. The Town should either acquire the land itself and/or a
vehicular/roadway easement.
Area 7: This 36.21-acre parcel of land is located in the central-western portion of the Eagles Nest area.
Its acquisition would eliminate the possibility of homes, roads, or other development between the 2,400-
foot and 2,500-foot elevation in this portion of Eagles Nest. The acquisition of this area is important for
viewshed protection, and would provide additional trail alignment options for the planned north-south
trail that would connect the central trailhead site in Area 3 and McDowell Park.
Area 8: This 24.39-acre parcel of land is located in the northwestern portion of the Eagles Nest area. Its
acquisition would eliminate the possibility of homes, roads, or other development between the 2,400-foot
and 2,500 foot elevation in this portion of Eagles Nest. The acquisition of this area is important for
viewshed protection, and would provide additional trail alignment options for the planned north-south
trail that would connect the central trailhead site in Area 3 and McDowell Park.

Its acquisition would eliminate the possibility of homes, roads, or other development between the 2,400-
foot and 2,500-foot elevation in this portion of Eagle Ridge North.
We hope that these specific recommendations will be of help to you as the Council continues to work
toward the acquisition of land in the McDowells that would provide the viewshed protection and passive

RE: Acquisition of Panorama Wash (Portion of Tract "C"- Puerto del Lago Plat)
In January of this year, the Town was approached by the Puerto del Lago Homeowners
Association to take over and assume the responsibility and costs of their portion of the
Panorama Wash area. Their request to transfer ownership to the Town is based on their
inability to fund the costs to effectively maintain the wash. The Homeowners Association also
feels that Fountain Lake has been the source of some of the water within the wash.
The Town Engineer (Randy Harrel) responded to the Puerto del Lago Homeowners Association
letter on February 19, 1999 (attached). Briefly summarizing his letter:
• Randy stated that testing to date of the lake and wash water does not show a definite
connection or correlation between a lake "leak" and wash "water".
• The Town assumed operation and maintenance of the pumpback system in July 1998. The
pumpback system pumps water out of the wash and back into the Lake has been modified
to increase its capacity. We feel this will substantially reduce the proliferation of
vegetation in this wash.
Randy's letter continued to outline potential items as related to the transfer of ownership to the
Town and staff recommended conditions if the Council wishes to accept such a transfer. These
items and conditions are listed below:
ITEMS:
• The Town did acquire 160 parcels totaling 557 acres—the majority of which included
washes—from MCO in 1997. MCO, an existing master developer, had demonstrated its
willingness to let these parcels be sold at a Sheriffs tax sale. Because of the onerous
development possibilities, the Council wisely voted to acquire these parcels for preservation
and protection.
• Such a transfer will be a Council discretionary decision. The Town Manager will agendize
any such item for Council consideration.
CONDITIONS:
Staff will recommend the following conditions if the Council wishes to accept such a transfer:
• The property should be deeded to the Town by the HOA.
• If only a portion of Tract C will be deeded to the Town, a lot-split replat is needed. Normally
the property owner would provide this document, but staff is capable of preparing this.
• There should be no restrictions on the Town's use of the property, other than recorded
easements and other items of record. (Please note that the Town's Watercourse
Panorama Wash.doc Page 1 of 2

Preservation & Habitat Ordinance already substantially restricts what can occur in Town-
owned washes.)
Staff recently received the Phase I Environmental Site Assessment Report on this portion of
Panorama Wash. The investigative report did not find evidence of petroleum products,
hazardous waste, underground storage tanks, or other conditions that would appear to present
a material risk of harm to the public health or the environment or would be the subject of an
enforcement action, if brought to the attention of the appropriate governmental agencies. The
report did note that five (5) Leaking Underground Storage Tanks (LUST) (Red Rock facility) were
on ADEQ's list within .5 miles of the site. Four of the LUST sites are confined to soils and are
under consideration for case closure. Only one LUST site has affected groundwater within the
site vicinity. Because the Red Rock facility is cross-gradient from the site, the consultant's
opinion is that the Red Rock facility would not significantly affect the subject site. Based on
the results of the investigative report, Asset Environmental Services, LLC does not recommend
any additional environmental investigation at this time.
The Town is concerned about how this wash area is maintained and would like to continue to
take a pro-active stance to minimize any potential "public nuisance" problem. The
homeowners association and developer assisted in paying for some of the wash cleanup costs.
If acquisition is approved, the Town Public Works Department will continue the cleanup and
revegetation.
Staff recommends approval of the acquisition of Panorama Wash per conditions outlined
above.

Gentlemen:
Thank you for your letter of January 31, 1999 (attached). You requested the Town to be "taking
over and assuming the responsibility and costs of this wash area". From the highlighted area
marked on the map attached to your letter, it appears that this area consists of the portion of
Tract C of Puerto del Lago adjacent to Panorama Drive and to the Morningside Subdivision
plats.
, You stated in your letter that a leak in the lake has caused the vegetation to proliferate.
However, testing to date of the lake water and the water in the wash does not show a definite
connection. Anecdotal reports indicate that this wash may have been an artesian groundwater
area prior to constructing Fountain Lake. There are a number of similar artesian areas within
Fountain Hills.
There is a"french drain" and pumpback pump (discharging into Fountain Lake) located in this
wash. MCO had built and maintained this system long before the Puerto del Lago subdivision
existed. After the Town acquired Fountain Park, MCO stopped operating and maintaining that
system—although it had not been included in the listed transfer facilities. With the transfer of
the effluent system to the Sanitary District last summer, MCO clearly moved out of the pumping
business. In an agreement with the Sanitary District in July 1998 clarifying a number of
functional issues, the Town agreed to assume operation and maintenance of the pumpback
system. We repaired the pump, casing, and electrical system and have been operating that
system ever since. We believe that this proper operation will substantially reduce the
proliferation of vegetation in this wash for your Association.
Regarding a potential transfer to the Town, we would note the following items:

will likely not make any recommendation on a discretionary action like this.
Staff will recommend the following conditions if the Council wishes to accept such a transfer:
• The property should be deeded to the Town by the HOA.
• If only a portion of Tract C will be deeded to the Town, a lot-split replat is needed.
Normally the property owner would provide this document, but staff is capable of preparing
this if so directed by the Council.
• The initial cleanup, as required by the Fire District since last summer, should be performed
by the HOA prior to the transfer. Bud Clutter on the Town staff is experienced in wash
cleanup operations and is available to you for consultation. Bud estimates the cleanup
costs at$0.16 per square foot, totaling $30,000 for the 4 acres of wash property.
Alternatively, the HOA could contribute that money to the Town, and staff could manage
the cleanup operations. The cleanup needs to include removal of trash, dead vegetation,
desert broom, salt cedars, and low (ladder-fuel) branches, as well as initial herbicide
treatment of the desert broom and salt cedars.
• There should be no restrictions on the Town's use of the property, other than recorded
easements and other items of record. (Please note that the Town's Watercourse
Preservation & Habitat Ordinance already substantially restricts what can occur in Town-
owned washes.)
• If recommended by the Town Attorney, the Town may request a title report/insurance, a
Phase I environmental report, and/or other appropriate "due diligence" items.
We would be happy to meet with the HOA to discuss these items at your convenience. If we
can be of any furth assistance, please advise.

As you may or may not know the Puerto Del Lago Homeowners' Association, Inc. was
deeded the wash next to their project by the developer when the project was platted. I have
enclosed a map showing this area for reference.
The reason we are writing is to respectfully request that the Town of Fountain Hills
consider taking over and assuming the responsibility and costs of this wash area.
The principal reason and rationale for this is that the wash has experienced for a long time
a leak from the lake that has caused the vegetation to proliferate and cause a potential fire hazard
in the summer. It would be cost prohibitive for our small Association to maintain this area to the

SUBJECT: Consideration of an amendment to The Zoning Ordinance of the Town of Fountain
Hills amending Chapter 5, Sections 5.06.F and 5.07.B of The Zoning Ordinance of
the Town of Fountain Hills amending the requirements swimming pool setbacks
and revising which structures have exceptions to building height.
Staff prepared the following text amendment which was initiated by the Commission at the August
26, 1999 Commission meeting and recommended for approval at the September 23, 1999
Commission meeting. When the Zoning Ordinance was amended to change setbacks on accessory
structures, swimming pools were inadvertently included in the changes to small accessory
structures. The amendment now requires swimming pools to maintain a six foot setback from the
main building and observe building setbacks. Staff has also begun to notice a trend of utilizing
over-height flagpoles to draw attention to specific sites in Town. Staff feels that some of the
Building Height Exceptions listed in 5.07 should be eliminated or reworded. Accordingly staff and
the Planning and Zoning Commission recommend that Chapter 5 be amended as follows. The
proposed text amendment additions are double underlined and deletions are .
CHAPTER 5
GENERAL PROVISIONS
Section 5.06 Yard,Lot,and Area Requirements
F. Swimming Pools. Any swimming pool in any zone shall not be located in the
required front or street side yard, shall be at least three (3) feet from the main
structure, and shall be at least three (3) feet from the any rear and interior side lot
lines, and shall maintain side yard setbacks from the street side lot lines as required
for the main structure in that zone.
G. Small Accessory Buildings (Detached) . Any detached
accessory building 120 square feet or less in size in any zone
shall not be located in the required front or street side yard, shall be at least six (6)
feet from the main structure, and shall be at least three (3) feet from the any rear and
interior side lot lines, and shall maintain side yard setbacks from the street side lot
lines as required for the main structure in that zone.

parcels with more than four dwelling units and to require all duplex and multiple
family dwellings to fully screen trash receptacles from public view.
On August 26, 1999 the Planning & Zoning Commission initiated an amendment to require
common trash enclosures for lots or parcels with more than four dwelling units and to require all
duplex and multiple family dwellings to fully screen trash receptacles from public view. On
September 23, 1999 the Planning & Zoning Commission unanimously recommended approval of
this text amendment,Z99-21.
The following Section is from Chapter 5 of the Zoning Ordinance of the Town of Fountain Hills.

5.18 Trash Enclosures.
A permanent enclosure for temporary storage of garbage, refuse and other waste materials
shall be provided for every use, other than single-family dwelling and or multiple-family
developments containing four (4) or less dwelling units le than fur (4) nite. The
enclosure shall be entirely surrounded by screen walls or buildings. Trash enclosures shall
comply with the following regulations:
A. Construction: Trash enclosures shall be so constructed that contents are not visible
from a height of five (5) feet above grade from any abutting street or-property, and
shall be constructed of solid or ornamental pierced masonry walls with solid
concrete floor sloped for drainage and maintenance of sanitary conditions.
Enclosures shall be of sufficient height to conceal contents, including containers,but
in no case shall any enclosure be less than four(4)feet in height above grade. Gates
are required and shall be solid or baffled, equal in height to the enclosure and
equipped with latches to ensure closure when not in use. Central trash enclosures
shall be provided for multiple-family developments having five (5) or more
dwelling units, and must be accessed in a forward motion at points of ingress/egress.

Executive Summary
f
Due to the fact that school just started, most of the meetings we have had in Fountain Hills this
month were planning and/or organizational meetings.
Background
Thc goals of our grant arc:
• To provide organized substance abuse counseling services without leaving Fountain Hills
• To offer intensive outpatient treatment for a specific number of patients as determined by the
provider
• To offer Parent Support and Education Groups
• To target adolescents from grade levels 6-12 in the local school district
•To establish a facility, or location, for continuing support within the Town of Fountain Hills.
Three services have been set up to meet these goals:
•Assessment, Intervention,Adolescent &Parent Support Groups
The Assessment and/or Interventions arc at The Fountains Methodist Church. They are
scheduled on an as needed basis and seen by Jon Sholeff
The Adolescent Sobriety Support Groups are also held at The Fountains Methodist Church.
The groups are facilitated by Jon Sholeff on Tuesday afternoons from 4-5 pm.
The Parent Support Groups are currently bcing help at Imagine Recovery Resources' Office
at 9318 N. 95th Way, Suite 101 in Scottsdale. Thc groups are run on Monday evenings
from 6-8 pm and arc facilitated by Lori Holleran, CISW.
• Education/Intervention Groups
The Education/Early Intervention Groups will take place on the campus of Fountain Hills
High School. Mike Salazar, CSAT will facilitate these meetings on Wednesdays from 7-9
pm. They will begin as soon as we start getting referrals from the schools
• Intensive Outpatient Scholarships
Imagine Recovery Resources will provide Intensive Outpatient Treatment to fifteen
chemically dependent adolescents from the Fountain Hills Community. The use of these
funds will be limited to an as needed basis. Prior to granting a scholarship to a Fountain
Hills teenager, their parents and the teenager must complete a chemical dependency
assessment. They will also complete a Financial Disclosure Form. This service will be
provided at our North Scottsdale location.
