(by Interoffice Memo To: HONORABLE MAYOR AND TOWN COUNCIL From: CASSIE HANSEN, DIRECTOR OF ADMINISTRATIO Date: October 12, 1999 Re: KNIGHTS OF COLUMBUS SPECIAL EVENT LIQUOR LICENSE Last Friday, Mr. Cisak came to Town Hall and wanted to apply for a special event liquor license for Saturday, October 16. Staff explained that the Council had met the night before and the next meeting was October 21. The event was already scheduled and tickets had been sold and he wanted to know if there was any way the license could be expedited. I suggested he submit the application as soon as possible and contact the Council members to see if they would be willing to attend a special meeting some time this week. He called later on Friday to report that a sufficient number of Council members had replied affirmatively and the meeting was subsequently scheduled for Wednesday, October 13 at 3:30 p.m. Marshal Gendler has reviewed the application and conditionally endorsed the license request. His conditional recommendation stipulates that the Class 15 license requires that alcohol be law purchased from a retailer instead of a wholesaler. The Marshal also noted that the application did not contain provisions to restrict alcohol to the premises and from minors. I spoke to Mr. Cisak about these two stipulations and he assured me that the alcohol would be purchased from Bashas, a local retailer, and that security would be posted at the door of the hall to restrict alcohol. The Knights of Columbus have held this event in the past and no violations have been reported. Based on compliance to the stipulations in Marshal Gendler's report, staff recommends approval. Page 1 of 1 Staff Report for 10/13/99 Meeting Last printed October 12,1999 12:25 PM Fountain Hills Memorandum TO: Cassie Hansen FROM: Steve Gendler, Marshal DATE: October 8, 1999 SUBJECT: Special Event Liquor Licenses - Knights of Columbus The purpose of this memorandum is to conditionally endorse the attached special event liquor licenses submitted by the Knights of Columbus for October 16th dinner dance. It should be noted that this request was just submitted today and requires approval by the Council. However, there are no regularly scheduled meetings between now and the proposed event date. Background A review of the applications indicates that the Knights of Columbus are filing for the permit under the "charitable" category. Based on the provisions of ARS 4-203.02,they would, in effect, be awarded a class 15 license for their event. Two important provisions apply. The first is that 25% of the gross revenues from any alcohol sales must go to the charitable organization if applicable; and, second, that the alcohol must be purchased from a qualified off-premise sale source rather than a wholesaler. The requirement that the alcohol be purchased from a qualified retailer is outlined in R19-1-250(a) and specifies that the source have a class 6,7,9, or 10 license such as Walgreens, Price Club, Bashas, or Safeway. Qualifying organizations that apply for a special event liquor permits are restricted to a total of 10 days per year under the provisions of R19-1-244. According to our records, this application is the first submitted by the Knights of Columbus this year and represent only one of the 10 days each is allowed. Access Control One of the law enforcement considerations in any public event involving liquor is ensuring that minors do not have access to intoxicating beverages.In reviewing the application, I have a concern regarding the lack of details on how they plan to restrict access or make any provisions to station a "security person" at the access location. Conditional Recommendation While the Knights of Columbus qualifies as an exempt organization, I am concerned that they should be made aware that alcohol must be purchased through a licensed retailer for consumption on premises. I recommend that some acknowledgement of this fact be required. Furthermore,I recommend that approval be contingent upon providing details on their plans to restrict access and ensure that alcoholic beverages are not consumed by minors. If these conditions are met, they would be in compliance with the (' provisions of ARS 4-203.02, and therefore, the application could be approved by the Council. This is a temporary license. ADDITIONAL RIGHTS AND RESPONSIBILITIES: The applicant for a special event license must request a special event application from the Department and file the application with the governing body of the city or town, or Board of Supervisors of an unincorporated area of a county, where the special event is to take place, for approval or disapproval. If the application is approved by the local authority, and the event meets the requirements for granting the license, the DIRECTOR will issue a special event license to the qualifying organization. Qualifying organizations will be granted a special event license for no more than ten (10) days in a calendar year. Events must be held on consecutive days and at the same location or additional licenses will be required. The license is automatically terminated upon closing of the last day of the event or the expiration of the license, whichever occurs first. The qualified organization must receive at least twenty-five percent (25 %) of the gross revenues of the special events. A person selling spirituous liquor under a special event license must purchase the spirituous liquor from the holder of a license authorized to sell off-sale; except that, in the case of a non-profit organization which has obtained a special event license for the purpose of charitable fund raising activities, a person may receive the spirituous liquor from a wholesaler as a donation. AVERAGE APPROVAL TIME: One (1) to seven (7) days. PERIOD OF ISSUANCE: Issued for no more than a cumulative total of ten (10) days in a calendar year. A special event may be held for more than one (1) day, but it must be held on consecutive days and at the same location, or additional licenses will be required. FEES: $25.00 per day.
