NORDIN, TOWN MANAGER DATE: DECEMBER 30, 1999 RE: MANAGER'S REPORT FOR THE JANUARY 6TH COUNCIL MEETING Reminders: One public hearing is on this agenda. We will hold an Executive Session immediately following the regularly scheduled council meeting. PLEASE NOTE - The Special Council Session scheduled for Thursday, January 6th at 5:00 p.m. has been POSTPONED. The cut-off date to submit applications for the Parks and Recreation Commission is December 30th. Eight applications to fill three vacancies for Commissioner positions and one application to fill one vacancy for Youth Commissioner have been received to date. Lior Copies of the applications for Parks and Recreation Commission members are included in this packet for your information. Please note that if additional applications are received on December 30th, we will distribute them to you immediately. Mayor Morgan will advise you of the re-scheduled date for this Special Council Session within the next few days. Please review each item and contact me should you determine any should be removed. AGENDA ITEM#7 &#8 - PUBLIC HEARING/ORDINANCE 00-01/ POSTING LOT SPLITS: A public hearing is scheduled to receive input regarding an amendment to the Subdivision Ordinance requiring lot splits to be posted prior to the public hearing. Bill Farrell has reviewed the legality of this amendment and provided staff with his recommendations. Staff feels that the initiated language will meet the requirements intended by the Commission and eliminate the confusion of residents who have attended the hearings in the past and left upset because they were unable to effect a change. The Planning and Zoning Commission unanimously recommended approval. Please refer to Geir's memo. According to A.R.S. Title 4, a primary requirement for a Class 12 license is that 40% of the establishment's gross revenues are derived from food. The state Liquorm epartment uses square footage and seating capacity to determine LIF whether or not an establishment: has the capability of meeting the 40% criteria. According to Marshal Gendler's memo, an assessment by the State Liquor Department showed that only 25% of the establishment is devoted to food service. Please see the attached memo from Steve. Based on his investigation and his dicussion-with our Liquor Department agent, the Marshal forwards a recommendation to deny. Palisades #126. It is my understanding that the application is scheduled for consideration at the Council session on January 6th. BACKGROUND INVESTIGATION: This application is for a new Class 12 liquor license under the specifications of ARS 4-205.02. A Class 12 license is for restaurant use only. The statutes require that 40% of the business establishment be devoted to serving food and that liquor sales be incidental to the food service. In reviewing the application, and verifying a site inspection with the State Liquor Department, as well as a review of the plans, the applicant is showing only 25% of the establishment devoted to service of food. Moreover, the bar area is not separate and distinct from the restaurant seating; therefore, this would simply be a billiard hall that serves alcohol with food provided on an incidental basis. The applicants, Howard and Francine LaGraffe, are Arizona residents under the provision of ARS Title 28. I have verified that they have no outstanding wants or warrants. Additionally, the establishment has a current town business license, #2154 RECOMMENDATION: Based on the provisions of Title 4 relating to the Class 12 Liquor License, I do not believe this establishment would qualify as a restaurant. As outlined in the application, this establishment would be more appropriate for a class 7 (beer and wine) or class 6 (full bar) liquor license. Therefore, I recommend that the application be denied. I have expressed these concerns to the State Liquor Department who concurs and will enter a protest of the Class 12 license at the state level. Should that occur, I further recommend that the town support the State Liquor Department's actions. A review of the FireRock Country Club Area Specific Plan, and the development's conformance with this plan. 2. The subdivision's design and its conformance with the Subdivision Ordinance and the Zoning Ordinance. Conformance with Fire Rock Country Club Area Specific Plan: The adopted General Plan Land Use Map was amended by GPA 97-01; Fire Rock Country Club Area Specific Plan. This area was designated for "Single-Family/Low" density land uses, with a unit range of 9-18 units and a proposed unit count of 9 units. Parcel "N" proposes 9 lots. The Staff Report FireRock Country Club Parcel "N" January 6, 2000 Page 2 proposed preliminary plat is in conformance with the FireRock Country Club Area Specific Plan and the adopted development agreements. After staffs review of the proposed Preliminary Plat Fire Rock Country Club Parcel "N" Subdivision, and the FireRock Country Club Area Specific Plan, staff believes that the proposed subdivision is in conformance with the FireRock Country Club Area Specific Plan. Subdivision Design GENERAL DESCRIPTION: The topography of the property for Parcel "N" is sloping hillside with areas of moderate to severe slopes, (exceeding 25%). Slopes of 20-30% and 30%+ are predominate in the proposed subdivision. There are few areas of less than 10% and 10-20% slopes, these are located in lots 1-3 and lots 7-9. The subdivision proposes no new streets off of the future FireRock Country Club Drive. All of the lots meet the "R1-35 P.U.D." zoning district's lot dimension requirements, including those for size and lot width. GRADING: The proposed subdivision complies with the Land Disturbance Standards of the Supplemental Development Agreement for FireRock Country Club. The applicant is providing projected disturbance limits on a lot by lot basis. The Supplemental Development Agreement for FireRock Country Club allows the applicant to provide the required amount of non-disturbance required by the subdivision ordinance in any slope category. Therefore the applicant has conducted a hillside analysis by slope bands and has determined the amount of required preservation. This amount will be distributed on each lot on the Final Plat. The numbers provided by the applicant are their current projected allocations for the disturbance area's lot by lot. Current projections for disturbance in Parcel "N" are above the disturbance limits projected by the development agreements, however every plat to this point has been below projected disturbances to allow for transfer to other parcels. This is the first such case. There are no off-site subdivision improvements associated with this plat. ISSUES: There are no major outstanding issues on Parcel "N". The greatest concern that staff has had regarding this proposal, is that area residents will attend the hearing with the belief that they can stop or effect major changes to the proposed lot split. If the proposed plat meets all requirements for the zoning district in which it is located, there are no legitimate reasons to deny the request. Area residents have attended these types of hearings in the past and left angry that they were unable to effect a change. With the language regarding the administrative nature of the request clearly noted on the notice, this kind of confusion should be eliminated. With the assurances of the Town Attorney and the clarifying language on the notice staff feels that the initiated language will meet the requirements intended by the Commission. Staff prepared, at the request of Commissioner Judy Dragiewicz and Chairwomen Fraverd, the following text amendment for The Subdivision Ordinance of the Town of Fountain Hills. This amendment would require the posting of any lot requesting a lot split. Staff has consulted with the Town Attorney as to the legality of requiring the posting of lot split. The Town Attorney has stated that the Town may approve this text as it does not restricted alienation of the property(ability of the owner of a parcel of land to sell his/her land). The Town Attorney recommended that language be placed on the notice that instructs the public of the administrative nature of the process.
