All citizens wishing to speak must first be recognized by the Mayor. 2.) The Mayor will not call for public comment on an item until after a motion has been,made and seconded and the Council has had adequate opportunity to discuss the item. 3.) Please stand,approach the microphone and state your name and address after being called on to speak. 4.) All comments must be directed to the Mayor. 5.) Consideration of APPROVING THE MEETING MINUTES of December 5 and 7,2000. *2.) Consideration of the LIQUOR LICENSE APPLICATION submitted by Shawna Worden for the Alamo Saloon located at 11807 North Saguaro Boulevard. The application is for a transfer of the existing Class 6 Bar License to the new owner. *3.) Consideration of the SPECIAL EVENT REQUEST submitted by Kenny Krell of Fountain Hills Cross Country/Track and Three Disciplines Racing for the Mountain to Fountain race scheduled for Saturday, February 24, 2001. The race, that begins in McDowell Mountain Park and terminates at Town Hall, is scheduled to begin at 7:30 a.m. and conclude by 10:30 a.m. Although traffic may be temporarily interrupted, no street closures are required. *4.) Consideration of a PRELIMINARY AND FINAL PLAT for the proposed "The Mountainside Condominiums", a 2-unit condominium, located at 12812 N. Mountainside Drive, aka Plat 601A, Block 3, Lot 13,Case Number S2000-045. *5.) A ENDA ITEM- 3 M UN All TC FOUNTAIN RUN SPECIAL EVENT REQUEST Kenny Krell;."the Fourntain:Hills Hig t School cross country/track coach, has submitted a special event request';for the annual Mountain to Fountain Race held during the same weekend as the Great Fair. This year the race is scheduled for Saturday, February 24 from 7:30 a.m. to 10:30 a.m. In past years, th s race has been sponsored by the unrise Kiwanis, a club that is no longer active in the community. frtitq,Krell took over-sponsorship of the race this year and made some changes to accommodate the Marshal's concerns. Mr. Krell has worked out the route and personnel details with Marshal Gendler faTtisbre the safety of the participants and the Marshal has forwarded a favorable recommendation. As many of you are aware, Mr. Krell created and annually sponsors the Jingle Bell Run and has a proven track record of conducting safe and successful events. This application is scheduled for consideration at the December 21st Council meeting. Background Investigation The application would transfer an existing class 6 "bar license" under the specifications of ARS 4-101.23. A class 6 license allows both on premise and off premise sale of liquor. Under ARS 4-207, a class 6 license is prohibited within 300' of a church or school. The nearest school (Fountain Hills Learning Center) is .2 mile north on Panorama at Enterprise, with a church and daycare center on Amhurst.75 miles south. A class 6 license is known as a"quota" license under ARS 4-203 which means only a limited number are issued based on the population of the county. Therefore, these licenses become commodities which are frequently bought, sold, or transferred. This application is for a transfer of license #06070452 currently issued to Gary Davis representing New Visions LLC. The applicant, Shawna Lee Worden, is listed as the sole owner of the license once the transfer is complete. The Marshals Department has completed a background check on Ms Worden which showed that she is an Arizona resident with no wants or warrants. In addition, I have interviewed both the applicant and her proposed facility manager, Jeff Binkley. Both are thoroughly knowledgeable regarding liquor laws. The Alamo Saloon has a current business license, #2695, valid through 3/31/01 Recommendation Based on a review of the state liquor license statutes I found this a straightforward transfer of an existing class 6 liquor license. The license classification is appropriate for the intended use and there is nothing that would indicate a problem with the change in ownership. I recommend approval L . It is my understanding that this will be considered by the Council at their meeting on December 21 st Background: The "Mountain to Fountain" Run is a track and field event which begins in McDowell Mountain Park and terminates in Fountain Hills. This is an annual event designed to coincide with the Chamber of Commerce"Great Fair". Previously,the event was sponsored by the Sunrise Kiwanis Club who has since withdrawn and Kenny Krell has stepped forward to take on the organizing role. (kw Route Changes: Under the Kiwanis Club,the race went up Saguaro through a portion of the artist and concessions area of the Great Fair. Even though the event was scheduled before the opening of the fair,the mixture of delivery vehicles, race participants, spectators, and pedestrians always represented a potential hazard. This was particularly evident when the race was late in starting or the lagging runners did not arrive at the finish line before the fair opened. Kenny Krell has taken my concerns into consideration and adjusted the route so that the race terminates on LaMontana behind the town hall complex. This eliminates the hazardous crossing of Saguaro and Palisades as well as having participants racing through the display and concession area of the fair. It also eliminates the problem of spectators parking on the fair ground area and pedestrian traffic sharing the same roadway as delivery vehicles. Detours and Road Closures: As now planned,there will be a temporary holding of traffic at Fountain Hills and Saguaro while the runners cross (done by a police officer), and LaMontana traffic will be detoured at Saguaro and again at Hamilton to accommodate the race. This will allow access by area residents as well as an alternate route around the race area. Kenny Krell has agreed to place his volunteers at each intersection of residential streets along the route to facilitate the runners while police officers will handle the major intersections along Saguaro at LaMontana,Grande,and Fountain Hills. Recommendation: With the concessions made by the event organizer, I believe conflicts with the Great Fair and hazardous situations have been significantly reduced. My break out group was youth participation. I was really interested in this group because (kw I've always lived in Fountain Hills and when I was a little I, like a lot of youth here, was bored and not aware of all the great programs available. It seems to be a constant complaint with kids that there is nothing to do here, but they just don't know about all the things available through Parks and Rec and other groups. Now that I am older, and in so many clubs at school as well as the Mayor's Youth Council I see the problem in trying to get people to participate in the activities we do. The best part about the break out group was the diversity of people in it. The representatives were from small town of less than a thousand to huge cities of as many as a million. The councils differed greatly in size, age, and formats, but we all shared a common goal: to improve our cities for the youth. It gave me a great perspective to compare the groups , and decide what could work for our city. We all discussed our various programs, what worked and what didn't, and asked for advice from other groups for how to improve our councils. I was amazed to see how successful our group was in comparison to other groups as new as we were. It was really great to help out the groups struggling for membership, which is a problem we've never had. Many groups also struggled with finances to the point of not being able to have councils at all, luckily we are fortunate enough to not have problems getting sponsored. Still we do have the problem of getting people involved in our activities. It is a common (kw problem, kids today are so busy with school, various clubs, sports, and jobs, and its hard to coordinate schedules. Still the biggest problem with youth involvement is advertising. It's difficult to find a way to inform kids about events, dates and times, and follow up with reminders. The solution?Although there really isn't just 1 solution, what seemed to work best for all the groups was live advertising to smaller groups. The best way to apply this to Fountain Hills is to advertise in school homerooms. The groups are only about 25-30 kids and with people talking, in addition to flyers passed out the kids are forced to pay attention and given a written reminder with dates, times, and contact numbers. This is also easy and inexpensive to implement. Another big issue discussed was Youth and Teen centers. This was a major topic of conversation for every council represented in my group. Only one of the groups had actually gotten a center. But every group also faced very different problems in getting Youth and Teen Centers. For some of the groups it was location, for most it was money, but for us it is support.None of the other groups lived in a town like Fountain Hills which has a mainly older population. Since we were the only group with a problem of support, no one really had a concrete answer for what to do. But after talking about it for a long time we decided that we need to advertise with the community so that they are all aware of our need for a Youth Center. To do this we need to eliminate the stereotypes and help close the generation gap. By doing this we can show everyone in the town the positive things the youth does for the community and hopefully develop a positive relationship between the youth and older communities in our town. The best suggestion for how to do Lair this was to advertise our community service projects in the local paper, on the local TV station, Channel 11, and to form partnerships with the local groups such as the Kiwanas, (kipr Rotary Club, , where we can reach many older people on a one-to-one basis. It was also suggested that we make an organized outline and floor plan for our Youth Center. This will help show people exactly what we are proposing and how dedicated we are to seeing it become a reality. Going to Boston was an amazing experience. I learned so much and made important connections which I am already following up with through e-mail, and I plan to stay in touch. We got so many ideas and we are all eager to implement these great ideas in our community. It was so interesting to see how different life is for other people my age in other parts of the country, and it really made me realized how truly blessed we are to live in Fountain Hills were our problem is kids being bored, not kids being killed. rtc (Ow Our most important role at the NLC conference was to attend the Youth Advisory Board Meeting and Forum. Before the three-hour session, we split into breakout groups and were each assigned a topic of discussion. My group focused on the causes and prevention of school and community violence, an issue that is very important to youth in every city. In my group I was joined by delegates from Alabama, Massachusetts, Kansas, Virginia, Indiana, as well as two members of the up and coming City of Peoria Youth Advisory Board from right here in Arizona. We began our session by sharing some facts about our hometowns and the youth councils that we serve on. Our eight-person group represented youth from the smallest of rural towns to huge urban cities and everything in between. Members of our group had served for years on their town's established youth councils while others had come to Boston to get ideas about starting their own. Fountain Hills fell about in the (10, middle of the spectrum each time. As we discussed how violence affected each of our towns, we also suggested programs in our area that seem to help the problem. I was surprised and proud that a version of nearly every program mentioned is currently in place in Fountain Hills. Groups like the Falcon Leadership Team, mentoring programs like, drug prevention plans like DARE, and even our brand new Teen Court were all praised for helping other communities. I came away from the NLC conference with some new ideas, many valuable contacts, and most important, a new respect for the community in which I live. I would like to take this opportunity to thank the Town of Fountain Hills for providing us with such an incredible experience. C t NLC presentation (kw The National League of Cities Conference was an incredible experience. We met mayors, town council members, and most importantly people our age in other youth councils. The Youth Forum, held on Friday, was inspirational to all of us. We got a chance to talk to delegates about youth violence, youth participation, guidance and diversity. I was amazed at the enthusiasm and insightful information we received. My breakout group discussed guidance. I was surrounded by open, caring people. We got started immediately talking about how much teenagers need someone to talk to outside the home, whether that person is at school or from an organization that specializes in counseling. I met two people from Project Empower; a governmentally funded program based in Kentucky that reaches out to high school drop outs and gang members between the ages of 14-21 . They teach them how to keep a job and encourage them to go back to school. They offer special L classes and personal counseling. Each counselor has a nickname and reason for choosing it. The kids pick their counselor by looking at their nicknames. It helps them get a feel for the counselor's personality, making sure that it is someone that the kids can talk to and feel comfortable with. I think that it is a great idea and could be adopted in the mentoring programs in Fountain Hills. We also talked about the fact that all the mentoring programs available to kids in high school and especially elementary school are always saying "don't." I work at the Boys and Girls Club and every training that we've had talks about how children respond better to positive commands. We should obviously keep telling them that drugs and alcohol are the wrong choices, but we should include positive messages as well. They should be hearing things like " love yourself, trust yourself,and you can make the right decisions." I felt so passionate about that part of our discussion that I would like to talk to Mr. Corcoran about implementing that idea into Falcon Leadership Team. r What was really encouraging to discover is that our Mayor's (thy Youth Council is on the right track. A few of these youth councils just got started this year, others have been around for almost 28 years. Some of them focus on activities for students, or give out grants, others are trying to find funding for a youth center. Basically, everyone is in different stages of development and the delegates with experience had great advice. They told us about their subcommittees and how they use them to get more projects done. We also talked about how they run their meetings and discovered that our relaxed atmosphere is effective for raising member attendance. I left the forum with e-mail addresses from delegates all over the country including , Oregon, Santa Barbara, California, Glauster, Massachusetts and Jasper, Wyoming. Every council was so unique, and I know that if we run across any problems, I can e-mail the people I met and find someone that has experienced the same situation. I also got a reminder that we are very lucky to line in such a beautiful, peaceful community. We don't have to face homelessness, hunger, poverty or violence in our streets. I would like to meet with the Phoenix delegates and talk to them about starting a joint project to help some of those problems. Our youth council members are fortunate beyond their understanding and it would be good for us to help people who need it so desperately. We left the conference with a lot of ideas and great advice and we return with plenty of work ahead of us. We can't wait to show you the value of this experience in actions as well as words. t MEMORANDUM TO: THE TOWN COUNCIL THE PARKS AND REC TION MMISSION FROM: SHARON MORGAN MA DATE: DECEMBER 14,2000 RE: MCO SURVEY It has been brought to my attention that there appears to be some confusion over the two surveys recently conducted by MCO Properties. Portions of results are being released to some individuals and copied to others accompanied by varied versions of origination, responsibility and purpose. At the December 11 meeting of the Parks and Recreation Commission, it was stated that MCO's second survey, dealing with Parks and Recreation priorities, was specifically requested by the Town Council and the Mayor who would be dealing with it in January. I would like to make it clear that I made no such request nor did I have any input on the questions asked or the provider used to conduct the survey. I did make comments regarding the MCO survey at the October 5, 2000 Town Council meeting. During the discussion of a possible citizen survey to determine Parks and Recreation priorities, I referenced the MCO survey and suggested that we ask to share their results rather than duplicating efforts and unnecessarily spending Town funds. I have attached a copy of those minutes for your review. Also attached is the cover letter I received from Hank Lickman when he forwarded a copy of the survey results to me. The letter clearly states that MCO took up the task of conducting the survey discussed at the Council meeting at their own expense. Further,Mr. Lickman initiated the request to invite Professor Merrill to discuss the survey with the Council at a meeting in January. I hope this helps to clarify any possible misunderstanding or misinformation regarding my personal or the Town's involvement in the MCO survey. Mayor Morgan said that the master developer might have saved the Town money at this time. She referred to the survey recently mailed by the developer, which spoke to among other things such as preservation,Parks and Recreation, and Parks. She wanted to see this item tabled until the survey results were returned to MCO and then see if the Town might be able to share the results. Councilman Kavanagh said he had placed this on the agenda because at the joint meeting between the Council and the Parks and Recreation Commission he had sensed the Council wanted to conduct a professional survey. He said his research resulted in his locating the name of the individual from ASU who conducts surveys for ASU and the Morrison Institute,Dr. Bruce Merrill. He had been informed that a random telephone survey could be done with about 500 residents based upon questions that the Council/Town placed together. He was told that the cost would be approximately $7,500 and could be completed in about two weeks. He had wanted to bring this up for Council discussion with direction to staff to contact the Parks and Recreation Department so that they could start constructing a sample survey with input from the Council. He had wanted to begin the process he believed the Council was interested in. He was surprised that the Council now wanted to rely on a survey completed by MCO. Mayor Morgan responded that she was being fiscally prudent to see if some of the information couldn't be gathered without having to conduct a survey. Councilman Kavanagh MOVED that the Town contract with ASU Professor Merrill to conduct a survey for the fee of$7,500. The motion died due to the lack of a second. Mayor Morgan MOVED to table this item until it was determined if the Town could share in any of the results from the master developer's survey and Councilwoman Ralphe SECONDED the motion,which CARRIED unanimously. AGENDA ITEM#8 DISCUSSION OF ESTABLISHING A POLICY ON PUBLIC RELATIONS AND ADVERTISING EXPENDITURES FOR MOUNTAIN PRESERVATION ISSUES WITH POSSIBLE DIRECTION TO STAFF. Mr. Nordin said he had hired a public relations firm,Bliss Marketing,to help him and Council in the public communication efforts. He had felt it had been necessary as it was relative to the various issues regarding the mountains. He said he had placed two ads in the local paper. He confirmed the amount of the contract was slightly less than$20,000. Vice Mayor Hutcheson MOVED to table this item and Councilman McNeill SECONDED the motion, which CARRIED on a vote of 6- 1. Councilman Kavanagh cast the nay vote. Mayor Morgan reminded the groups that they were allowed 15 minutes for their presentations. AGENDA ITEM#9 PRESENTATION BY THE LOGICAL LAND USE COMMITTEE ON ISSUES RELATING TO THE SHEA RETAIL CENTER DEVELOPMENT. Mr. Bill McGivern explained there would be more than one presenter. They felt the project was technically deficient and professionally unacceptable. They were requesting the specifics of the project to be defined as part of their cause and asked that the contingencies be solidified. Mr. Bob Tripp,Jody Knapp, and a woman(who did not give her name)reviewed what they felt would be the economic impact to the Town. He pointed out that significant traffic problems had not been addressed. Merrill of Arizona. State University, During the Town Council meeting of October 5, 2000, several members of the Council considered conducting a survey of parks and recreation priorities in Fountain Hills. MCO Properties subsequently took up this task at its expense. The survey was designed and conducted by Professor Merrill, Professor of Mass Communication and Director of the Media Research Program at ASU (note that the survey was not conducted under University auspices). I suspectpeople in Fountain Hills are familiar with Professor Merrill's many work; among other accomplishments, he is well known for conducting the Cactus State Poll in conjunction with KAET-TV, since 1990. I'm not going to add any spin to the results -- I think they speak for themselves. However, I would like to ask if we could invite Professor Merrill to address the Town on his findings, if the Mayor and Council would like to explore this matter further.
