NOTICE OF THE
REGULAR SESSION OF
THE FOUNTAIN HILLS TOWN COUNCIL
TIME: 6:00 P.M. – 6:30 P.M.: MAYOR AND COUNCIL RECEPTION -

WHEN: THURSDAY, FEBRUARY 17, 2011
WHERE: FOUNTAIN HILLS COUNCIL CHAMBERS

Councilmembers of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum
of the Town’s various commissions may be in attendance.
PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker’s card and submit it to the
Town Clerk prior to Council discussion of that Agenda item. Speaker Cards are located in
the Council Chamber Lobby and near the Clerk’s position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk
or the Mayor. At that time, speakers should stand and approach the podium. Speakers are
asked to state their name prior to commenting and to direct their comments to the Presiding
Officer and not to individual Councilmembers. Speakers’ statements should not be
repetitive. If a speaker chooses not to speak when called, the speaker will be deemed to have
waived his or her opportunity to speak on the matter. Speakers may not (i) reserve a portion
of their time for a later time or (ii) transfer any portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during
the Public Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time
limits may be waived by (i) discretion of the Town Manager upon request by the speaker not
less than 24 hours prior to a Meeting, (ii) consensus of the Council at Meeting or (iii) the
Mayor either prior to or during a Meeting. Please be respectful when making your
comments. If you do not comply with these rules, you will be asked to leave.

proposed Phase III improvements to Fountain Park.

Pursuant to A.R.S. §38-431-01(G), public comment is permitted (not required) on matters not listed on the agenda. Any
such comment (i) must be within the jurisdiction of the Council and (ii) is subject to reasonable time, place, and manner
restrictions. The Council will not discuss or take legal action on matters raised during “Call to the Public” unless the
matters are properly noticed for discussion and legal action. At the conclusion of the call to the public, individual
Councilmembers may (i) respond to criticism, (ii) ask staff to review a matter or (iii) ask that the matter be placed on a

2. CONSIDERATION of approving a LIQUOR LICENSE APPLICATION submitted by
owner/agent Christina Contandina Karp, DBA as “Jimmy’s”, located at 16758 E. Glenbrook
Blvd., Fountain Hills, AZ. This is for a series 12 license (Restaurant).
3. CONSIDERATION of a SPECIAL EVENT LIQUOR LICENSE APPLICATION submitted
by Robert D. Schmitz representing the American Legion Post 58, for the purpose of a fund
raiser located at 16837 E. Parkview, Fountain Hills, AZ, scheduled to be held on Friday,
Saturday and Sunday, February 25- 27, 2011, from 9:00 AM to 10:00 PM.
4. CONSIDERATION of a SPECIAL EVENT LIQUOR LICENSE APPLICATION submitted
by Robert D. Schmitz representing the American Legion Post 58, for the purpose of a fund
raiser located at 16837 E. Parkview, Fountain Hills, AZ, scheduled to be held on Saturday,
March 26, 2011, from 9:00 AM to 11:59 PM.
5. CONSIDERATION of RESOLUTION 2011-09, authorizing the submission of projects for
consideration in Arizona’s 2012 Governor’s Office of Highway Safety Plan (purchasing
extrication equipment in the amount of $38,000).

11. CONSIDERATION of a SPECIAL EVENT LIQUOR LICENSE APPLICATION submitted
by Robert Harrison Bailey (Sunset Kiwanis Club of Fountain Hills) for the purpose of a
fundraiser that is scheduled to be held March 18 – 20, 2011, to be located on Avenue of the
Fountains, which is part of the 7th Annual Fountain Hills Fine Art & Wine Affaire.
12. CONSIDERATION of APPOINTING four (4) citizens to serve on the Board of Adjustment
with one (1) seat appointed for a one (1) year term beginning February 1 7, 2011 and ending
January 31, 2012; and three (3) two (2) year terms beginning February 17, 2011, and ending
January 31, 2013.
13. CONSIDERATION of APPOINTING two (2) citizens to serve on the Public Safety
Advisory Commission for a two (2) year term beginning February 17, 2011, and ending

February 2011 report of activity

In December 2010 we did plantings on Shorebird Island next to the Veterans’Memorial.We
provided funding to repair the water lines on the island and install new sprinkler heads.About
five inches of top soil was spread on the island.Then the trail builders showed up in force and
planted about 50 plants including some native grasses and low flowering shrubs.
We then sprinkled wildflower seed across the island.Birds immediately showed up and
started eating some of the seeds but did not get many of them as we now have a good stand of
sprouting wild flowers.We did get rain after the planting (too much sometimes)and the
sprinkler system is working fine.
The next steps are to do some weeding and plantings on Great Blue Heron Island by the amphitheater
and then do planting on Duck Island near the North shore in late fall.We received some good news from
Don Clark that the water lines to both of these islands are connected and will only need minor
modification.
We are planning a work party for Saturday March 5,2011 from 7 a.m.to 12 Noon to do planting on the
amphitheater island.The Trail Builders are recruiting volunteers and others can join in if you wish:just
call Bill Schmitt at 480-816-6094 to sign up.The plan is to take out some of the weeds and then plant
some small cacti and some small bushes including golden barrels,jojoba bush,fairy dusters,and
several century plants to celebrate the 100th birthday of Arizona as suggested by Councilperson Ginny
Dickey.Late in the fall of 2011 we will scatter some wild flower seed if the current planting is successful.
We will wade through about 18 inches of water to get on the island so bring old shoes or waders.
Our work is deeply appreciated,especially by the wild inhabitants of the islands.About
one hour after we planted Shore Bird Island I went back to admire the work of the
volunteers.To my surprise I was not the only one checking it out.A pair of Killdeer had
moved in to see if they could get a better waterfront nest site for next spring.

More substantial than current underlying zoning district criteria.
Higher design standards and the flexibility of design.
Allow the TOWN to design developments with maximum benefit and best product to citizens.
Help when dealing with problems of topography or strange lot dimensions.
More site-sensitive designs and creates a more strict architectural review process.
REQUIRES that 15%of any PAD development will be dedicated open space.
Allow dimensional flexibility while maintaining the same density restrictions.
A tool that we use to guide the town towards the land-use goals that are outlined in the General Plan.
The ordinance benefits the Town of Fountain Hills.
