Staff Summary (Background) On March 11, 2020, Governor Doug Ducey declared a state of emergency due to the spread of COVID-19. Similarly, on March 13, 2020, the President of the United States of America declared a national emergency due to the spread of COVID-19. In addition, on March 18, 2020, Mayor Ginny Dickey issued an Emergency Proclamation to protect the health, safety, and welfare of the Town and its residents, which proclamation was amended, and remains in effect. On June 17, 2020, Governor Ducey issued Executive Order 2020-40 entitled "Containing the Spread of COVID-19" that authorizes cities and towns to require the wearing of face coverings in public in order to limit the spread of COVID-19. The Centers for Disease Control and Prevention, the Arizona Department of Health Services, and the Maricopa County Disease Control Division all currently recommend the use of face coverings in public settings to slow the spread of COVID-19. Pursuant to A.R.S. § 26-307, Town Code Section 2-1-2, and Executive Order 2020-40, the Town Council has the authority to issue an Emergency Order to require the wearing of face coverings in public. Related Ordinance, Policy or Guiding Principle A.R.S. § 26-307, Town Code Section 2-1-2, and Executive Order 2020-40 Risk Analysis Several cities and towns in Arizona are enacting similar emergency orders due to the need to contain and control the spread of COVID-19. The face covering mandate will hopefully prevent the closure of businesses and another mandated Stay at Home Order by reducing the spread of COVID-19.
