Consideration of RESOLUTION 2001-53 abandoning a portion of a Non -Vehicular Access Easement along the northerly property line of Tract "B" in the Plat 514 subdivision, where the proposed Mountain Parkway is to intersect with Sunridge Drive. 2.) Pursuant to A.R.S. 38-431.03.A.1; VOTE TO GO INTO EXECUTIVE SESSION for discussion or consideration of employment, assignment, appointment, promotion, demotion, dismissal, salaries, disciplining or resignation of a public officer, appointee or employee of any public body, except that with the exception of salary discussions, an officer, appointee or employee may demand that such discussion or consideration occur at a public meeting. The public body must provide the officer, appointee or employee with such personal notice of the executive session as is appropriate but not less than 24 hours for the officer, appointee or employee to determine whether such discussion or consideration should occur at a public meeting. The Council will be interviewing applicants for the Planning & Zoning Commission and for the interim town manager position. 3.) RETURN TO SPECIAL SESSION AND ADJOURNMENT. Farrell, Acting Town Manager SUBJECT: Resolution 2001-53 On October 4, 2001 the Town Council approved the preliminary plat for the Eagles Nest subdivision that included a stipulation requiring the abandonment of a non -vehicular access easement (NVAE) along Sunridge Drive that would enable the development of Mountain Parkway. Staff and the developer believed in the intervening time period that a formal resolution would not be necessary, so an abandonment resolution was not included on the Council's December 10, 2001 meeting when the Town Council approved the final plat for this subdivision. Since December 10, 2001 it has become apparent that a formal resolution abandoning this NVAE is necessary, and that the resolution will need to be recorded along with the numerous other documents on December 19 or 20, 2001. Due to the fact that the Council is scheduled to meet (W only once before December 19"', staff has agendized this item for the Council to consider at an extremely short regular meeting on December 18, 2001 Staff recommends Town Council approval of Resolution 2001-53. That a portion of a certain one (1) foot non -vehicular access easement located along the northern property line of Tract "B", Plat 514, Fountain Hills, Arizona; as recorded in Book 402 of maps, Page 6 records of Maricopa County, Arizona, and as more specifically depicted in Attachment "A" hereto, is hereby declared to be abandoned by the Town of Fountain Hills. I am interested in being on the Fountain Hills Planning & Zoning Commission for several reasons. Firstly, I live in Fountain Hills by choice because of the natural beauty, small town feel, and the excitement of watching a town develop and grow. There are so few towns in America where anyone can watch main street build with new business and architecture. I want to be a part of developing the rest of Fountain Hills. Being a well -traveled person and a long-time builder, I feel I can make a difference by being a part of the Planning and Zoning Commission. My goals and objectives are simple. Fountain Hills has been well planned and clearly has solid zoning requirements in place. I would hope to be part of the group (commission) to continue the tradition of good planning and zoning so the beauty of Fountain Hills is properly protected. The current growth and development of Fountain Hills: Being attached to the sixth largest and fourth fastest -growing city in America, it is inevitable that Fountain Hills is going to grow both with commercial and residential construction. The controlled pace of residential construction is, in my mind, about right for a town the size of Fountain Hills. Now that we are building mostly custom homes, I feel the zoning regulations are in place to assure a continuing growth and protection that the existing residents of Fountain Hills deserve. The pace of commercial growth in Fountain Hills is currently slower than I would like to see, but as new families move to Fountain Hills, the need AN WW, for more commercial growth will be naturally developed. So patience and good planning will allow the downtown area to grow and become an area of strong businesses and attractive buildings. In the event the Council allows me to serve on the Planning and Zoning Commission, my commitment to the Council and the residents of Fountain Hills is to actively participate in the Planning and Zoning Commission activities, faithfully attend both regular and special meetings, and lastly make good sound decisions. My position on What is Currently Taking Place There are several very positive development projects recently approved and several more in the works that have received criticism from town residents. I am not sure, but perhaps town officials have failed to adequately articulate the benefits of these projects to the public when casting the approval votes. As a member, I would review the Commission's current public communications plan and make appropriate improvements.
