As it is important to maintain order during the meeting, please adhere e following rules of order if you wish to speak: All citizens wishing to speak must first be recognized by the Mayor. 2.) The Mayor will not call for public comment on an item until after a motion has been made and seconded and the Council has had adequate opportunity to discuss the item. 3.) All comment is "subject to reasonable time, space and manner restrictions" and the Council will not discuss or take legal action on matters raised during call to the public unless the matters are properly noticed for discussion and legal action. El Pueblo. Ms. Levato is one of the new owners of the existing business. Although the establishment previously had a Class 12 liquor license, Ms. Levato must apply for a new license. Marshal Gendler has performed his inspection and confirms that the premise satisfies the statutory requirements of a Class 12 license (please see attached memo from Steve). The premise has been posted for the 20-day statutory period and no written arguments have been received at Town Hall. Their Fountain Hills business license is current. Based on statutory compliance, staff recommends approval, AGENDA ITEM #3 — PEI WEI ASIAN DINER LIQUOR LICENSE Russell Owens has submitted an application or new Class 12 Restaurant license for Pei Wei Asian Diner to be located at 14835 E. Shea Boulevard, Suite 100. Mr. Owens is an officer/agent of the new business that will be located in the new Fry's Shopping Center. Marshal Gendler has reviewed the application and floor plan and confirms that the premise satisfies the statutory requirements of a Class 12 license (please see attached memo from Steve). The property has been posted for the 20-day statutory period and no written arguments have been received at Town Hall. Mr. Owens has not yet applied for a Fountain Hills business license since the building is still under construction. It is my understanding that the application is scheduled for consideration at the Council session on March 7th. This application is for a new Class 12 liquor license under the specifications of ARS 4- 205.02. A Class 12 license is for restaurant use only. This will reflect a change in the name currently in place at the restaurant as well as a change in the license holder. The statutes require that 40% of the business establishment be devoted to serving food and that liquor sales be incidental to the food service. A site inspection at the facility clearly shows that over 60% of the establishment will be devoted to service of food. In addition, the •► Council previously approved a class 12 license on June 15, 1995 at the location which has continuously served as a restaurant since that time. A Class 12 license is exempt from restrictions relating to churches, schools and nearby liquor establishments. While the site inspection did show a class 9, and two class 12 liquor licenses in the immediate area, this would not represent a proliferation or have any effect on the license application. The applicant, Patty Levato, is an Arizona resident under the provisions of ARS Title 28. I have verified that she has no outstanding wants or warrants. Additionally, the restaurant has a Fountain Hills Business License, #4721. The building in which this restaurant is to be located is currently under construction, therefore a site inspection could not be completed. However, a review of the proposed floor plan shows that over 60% of the establishment will be devoted to service of food. A Class 12 license is exempt from restrictions relating to churches, schools and nearby liquor establishments. However, the local jurisdiction does have the ability to determine if there is a proliferation of liquor establishments in the vicinity. A review of license holders in the immediate area indicates there are two class 6s, and a class 11 within one-half mile. The Town Council initiated an amendment to the Zoning Ordinance to modify the requirements for menu boards for drive-in or drive -through restaurants on January 17, 2002. The request for the amended language has come about due partly to the fact that several businesses have installed, without proper building permits, menu boards that are in violation of the zoning ordinance, and partly due to a change in technology in the menu board system used by some franchise companies. Menu boards have increased in size because vendors are using visual graphics in place of, and in addition to, text on the menu boards. In addition to the graphic displays, vendors are providing a liquid crystal display (LCD) order confirmation unit that uses a scrolling text readout that replays the requested order. The LCD unit is an attempt to reduce errors in orders and shows the customer a visual readout of the order total. The amended language would increase the allowable size of the menu board square footage from the current maximum of twenty (20) square feet, to a maximum of forty-five (45) square feet, and increase the allowable height of the menu, board to be increased from five (5) feet to seven (7) feet. In addition, the amended language would allow the addition of an LCD order confirmation unit, with moveable text readout, to be displayed as a part of the menu board, or to be added as a separate unit, not to exceed eighteen inches wide by eighteen inches deep by four feet high. Since the proposed change would permit menu boards more than twice the existing allowable size, and the boards would be exempt from signage limitations, a visibility restriction has been added. PLANNING AND ZONING COMMISSION REPORT: The Planning and Zoning Commission reviewed the proposed text amendment on February 28, 2002 and recommended approval with the following two changes to sections 6.07.C4.b & c, and 6.07.D.b & c. 1. Menu board size not to exceed thirty (30) square feet. 2. Menu board height not to exceed six (6) feet. The Planning and Zoning Commission was very opposed to legitimizing non -permitted uses after -the -fact, and was concerned about the trend in the community to ignore zoning ordinances. Town Council Memorandum Sign -Menu Board/LCD These types of activities make enforcement of the code a much more difficult task for both the planning department and the Marshals. The Commission felt that the very large increase in size was not warranted and that their proposed changes were more in keeping with the community character. STAFF EVALUATION: If it is the intent of the text amendment to legalize the existing menu boards in the community that are in violation, then the original text amendment would need to be approved. The changes suggested by the Planning and Zoning Commission would leave Arbys, Burger King, Taco Bell and Wendys in violation. McDonalds menu board was granted under the County regulations and remains a non -conforming use. Now the small town with big ideas has a newly formed tourism council to market the place. The council has penned a slogan — "One Destination, Many Adven- tures ... Experience it" No longer content to get Scotts - dale's tourist leftovers, Fountain Hills wants to sell itself as a more scenic — but just as upscale, — alternative, closer to nature and out- door recreation and away from the city bustle and traffic. "It's fine to be associated with From Page Bl Scottsdale because Scottsdale com- plements Fountain Hills with its great shops, restaurants and art gal- leries," said Roxanne Boryczki, chairwoman of the Fountain Hills Tourism Council. "But we are a unique entity, different from every other place in the Valley, with our clean, natural setting, unrivaled any- where in the Valley." As town leaders worked on Fountain Hills' community center opened in late September. Fountain Hills' economic develop- ment needs, they pegged tourism as the top target industry, Boryczki said. The lure of tourism is that it is a clean industry that adds a lot of cash into the coffers without taxing residents, she said. The budget is mostly from bed taxes, money collected from hotel guests, Boryczki said. The town, which lies east of Scottsdale between the Fort McDowell and Salt River Pima-Maricopa Indian com- munities, also built a combi- nation community center - convention center -museum to give the tourism council something to sell to business groups. The center has conference rooms, classrooms and a grand ballroom. It also will house a River of Time Museum to be completed this summer, Boryczki said. The museum is dedicated to the history of the lower Verde Valley and the Hohokam Indi- ans, and aimed at the cultural tourism crowd, she said. Tho nearby Fort McDow- ell Indian Community has joined the Fountain Hills Tourism Council, kicking in another golf course to pro- mote, along with several attractions, including Fort McDowell Adventures, which offers a cowboy -like experi- ence; Out of Africa, a wildlife park; and a casino. "Fountain Hills .is more than just a fountain now," Boryczki said. "People can enjoy all kinds of recreation here and still be close to Phoenix and Scottsdale." To add to its $65,000 seed money, the tourism council got $11,000 from Proposition 302, a voter -approved tax on hotel guests targeted to build an Arizona Cardinals football stadium and fund tourism promotion, Boryczki said. Of its total $76,000 budget. Fountain Hills Tourism Coun- cil handed $30,000 over to the Scottsdale Convention S Visitors Bureau. That lets Fountain Hills hang on to Scottsdale's coattails for big promotions and have access to meeting planners and other groups that Scottsdale brings into the Valley. Scotts- dale, with its $4 million -plus budget, will help Fountain Hills get better mileage from its cash, Boryczki said. But the rest of the town's tourism budget is pegged for promotions that let Fountain Hills distinguish itself from Scottsdale and Phoenix, she said. So far, the council has used some of it to buy ads in magazines such as Golf Digest and Midwest Living, Boryczki said. Midwestern- ers and golfers are groups likely to favor Fountain Hills, she said. And if the strategy works? Fountain Hills has fewer than 250 rooms to house the trav- elers it could attract. But the town hopes to add more hotels. Saguaro Blvd. COMMUNITY CENTER The new Fountain Hills Community Center provides the latest 'jewel in the desert' for the Valley and especially Fountain Hills. The Community Center will serve as a new facility for valley -wide corporate meetings, local civic programming, art and educational classes as well as black tie events and wedding receptions. The Community Center serves as the focal point in a new Town development, which also includes the newly opened County Library, with a local history museum slated to open in the spring of 2002. The area is open to hiking, biking and trail rides. • Superstition Mountains: Known as the home of the "Lost Dutchman Mine" where miner Jacob Waltz found his pot of gold in 1880 or so the story goes! For years curiosity seekers have tried to find the mine in the Superstitions. The legend is still being told and is an outstanding story for the hiker who is there to glimpse the beauty of the area.
