It is the Council's desire to hear public comment on agenda items. As it is important to maintain order during the meeting, please adhere to
them `-flowing rules of order if you wish to speak:
1� _) All citizens wishing to speak must first be recognized by the Mayor.
2.) The Mayor will not call for public comment on an item until after a motion has been made and seconded and the Council has had
adequate opportunity to discuss the item.
3.) Please stand, approach the microphone and state your name and address after being called on to speak.
4.) All comments must be directed to the Mayor.
5.) TIME LIMIT — THREE (3) MINUTES PER PERSON PER ITEM.
6.) Statements should not be repetitive.
7.) Persons or groups wishing to make longer presentations should see the Town Clerk prior to the meeting.
1.) Pursuant to A.R.S. §38-431.03.A.1., AND A.R.S. §38-431.03.A.4, VOTE TO GO INTO EXECUTIVE SESSION
FOR: discussion or consideration of employment, assignment, appointment, promotion, demotion, dismissal, salaries,
disciplining or resignation of a public officer, appointee or employee of any public body, except that with the exception of
salary discussions, an officer, appointee or employee may demand that such discussion or consideration occur at a public
meeting. The public body must provide the officer, appointee or employee with such personal notice of the executive
session as is appropriate but not less than 24 hours for the officer, appointee or employee to determine whether such
discussion or consideration should occur at a public meeting. (The Council will discuss the Acting Town Manager's
contract and interview acting town manager applicant Ray Bladine); AND discussion or consultation with the
attorneys of the public body in order to consider its position and instruct its attorneys regarding the public
body's position regarding contracts that are the subject of negotiations, in pending or contemplated litigation, or
in settlement discussions conducted in order to avoid or resolve litigation (specifically regarding the three suits:
Knapp, Hoffman & Robinson vs. the Town of Fountain Hills et al); respectively.

& Recreation Department. Therefore, those titles did not exist in 1999 at the time of the last pay
resolution and did not have assigned ranges.
Due to recent changes in the Department of Public Safety, the position of Director of Public
Safety/Town Marshal has been reclassified to Town Marshal. If the Council approves the pay
resolution, the acting department head (currently Todd Tate) will perform the Marshal's duties
and the Fire Department will report to the Town Manager level.
The position of Human Resources Specialist has been reclassified to Human Resources
Administrator. A specialist indicates the person is responsible for a specific area of Human
Resources such as benefits, employee relations or compensation. The Human Resources person
for the Town is responsible for all aspects of Human Resources and therefore has been
reclassified to indicate such.
This recommended pay resolution represents an initial annual increase of $28,000, or
approximately $1,077.00 per pay period. This is an insignificant amount when you consider that
our employees are our greatest assets and in actuality there have been no updates to our salary
ranges since 1998 figures — about three years. We must continue to strive to recruit and retain a
high level of employees to maintain the Town's professionalism in all operations. In order to
achieve this, we must be willing to stay competitive with other Maricopa County entities.

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS
'`•.- AMENDING THE PAY RESOLUTION FOR EMPLOYEES IN THE MUNICIPAL SERVICE
TOWN OF FOUNTAIN HILLS. OF THE
WHEREAS, the Town Council desires to amend and update job descriptions and pay ranges for
employees in the municipal services of the Town of Fountain Hills; and
WHEREAS, the Town Council desires that the rates of pay set forth in said resolution shall
supersede any pervious salary ranges for said employees in various classes or positions;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA;

SECTION 7: The minimum and maximum rates and the ranges constituting the salary range of a
position title shall supersede any previously adopted for said title.
SECTION 8: Employees in Section 1 are exempt and are not eligible for any overtime
compensation. Employees in Sections 2,3,4,5 and 6 are hourly non-exempt and therefore entitled to
overtime compensation.
SECTION 9: The Town Manager is hereby authorized to place the salary of each employee at a
rate of pay within the salary range for the position title to which said employee is assigned. The rates of
pay so established for various employees shall be effective at the time of review.

This request is for approval of a final replat, which will join Lots 1 & 2, Block 3, Final Plat 207, and
provide the Town with approximately 5,927 square feet of Hillside Protection Easement. The
property owner currently has a building permit under review for this property. Staff is requesting
that Town Council waive the sidewalk requirement of Subdivision Ordinance for this site. Please
refer to the attached Staff report for additional details regarding this request.

SUMMARY & EVALUATION:
This is a request to join lots 1 & 2, Block 3, Final Plat 207 that will create a single contiguous lot
for future multiple family development. Lot 2 has been split under Maricopa County Jurisdiction
through the condominiumization of the La Casa Canada Condominiums, which is located to the
north of the existing Lot 2. This final plat removes the common lot line between Lots 1 & 2. The
La Casa Canada Condominium property boundaries will not change or be affected by this lot join.
Staff has found this request in conformance with all applicable Zoning and Subdivision Ordinances.
The applicant is providing the Town a Hillside Protection Easement (H.P.E.) along to the southern
lot line of the property, adjacent to Colony Wash. The H.P.E. is in conformance with the Mower
Amendment as established in the Subdivision Ordinance, and is approximately 5,927 square feet.
Staff has not requested a perimeter sidewalk for the multiple family project proposed for this site.
The Town of Fountain Hills master sidewalk plan does not include a pedestrian walkway along
Gunsight or Chama Drive, nor do any sidewalks exist along these streets. Staff is recommending
that Town Council waive the requirement for a sidewalk as part of the subdivision approval.
RECOMMENDATION:
Staff recommends approval of "Final Plat of Lot IA, Block 3, Plat 207", with the following
stipulations:
1) The Town Council waive the sidewalk requirement for this property.

SUBJECT: Consideration of Ordinance 02-08 amending Chapter 5, Sections 5.06.G, H and I, of
The Zoning Ordinance for the Town of Fountain Hills that would modify the requirements
for Accessory Buildings and Solar Units including the location of these structures on a lot.
This request is for the Consideration of Ordinance 02-08 amending Chapter 5, Sections 5.06.G, H
and I, of The Zoning Ordinance for the Town of Fountain Hills that would require the following
modifications to the existing text:
❑ Small Accessory Buildings:
o Restricted to a height limitation of twelve (12) feet;
o Required to be located behind the front line of the primary structure on the
front, and behind the side of the primary structure on the street side of a
corner lot.
❑ Large Accessory Buildings
o Shall remain within all building setbacks
o Required to be located behind the front line of the primary structure on the
front, and behind the side of the primary structure on the street side of a
corner lot.
o Could be appealed by Special Use Permit
❑ Solar Units
o Required to be located behind the front line of the primary structure on the
front, and behind the side of the primary structure on the street side of a
corner lot.
o Shall be located a minimum of six feet from any other structure

AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE
REQUIREMENTS FOR ACCESSORY BUILDINGS AND SOLAR
UNITS IN CHAPTER 5, SECTIONS 5.06.G, H AND I, OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18. 1993,
which adopted The Zoning Ordinance for the Town of Fountain Hills, and;
WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and;
WHEREAS, The Town of Fountain Hills desires to amend its regulations to allow for a
modification of the requirements for accessory structures and solar units, and;
WHEREAS, The Town of Fountain Hills has rewritten Chapter 5, Sections 5.06.G, H and I of
The Zoning Ordinance for the Town of Fountain Hills and published these
proposed text changes in the official newspaper of general circulation, The Times
of Fountain Hills and Rio Verde on April 24, May 1, and May 8, 2002, and;
WHEREAS, Public hearings were advertised in the April 24, May 1, and May 8, 2002
editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona
Revised Statutes §9-462.04, and;
WHEREAS, Public hearings were held by. the Fountain Hills Planning and Zoning
Commission on May 9, 2002 and by the Fountain Hills Town Council on May
16, 2002.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Pursuant to Chapter 2, Section 2.01 of The Zoning Ordinance for the Town of
Fountain Hills, Chapter 5, Sections 5.06.G, H and I, of The Zoning Ordinance for
the Town of Fountain Hills shall be amended as follows, with text to be added
shown as double -underlined:

SUMMARY:
This request by Visser Development Group, Inc., is for approval of a special use permit and the
preliminary plat for "Lakeside Villas Condominium", a 12 unit multiple -family subdivision with
a common pool amenity. This property is located at the southwest corner of El Lago Boulevard
and Kiwanis Drive, east of Fountain Channel.
Primary access to this development is located on Kiwanis Drive, aligned with the Lakeside
Resort Casitas entrance. An emergency access point is located approximately 80'south of the
main entrance on Kiwanis Drive. The emergency entrance will be gated and controlled by an
opti-corn sensor and knox lock for emergency access only.
The sidewalk system includes an eight -foot meandering sidewalk along El Lago Boulevard, a
five-foot meandering sidewalk along Kiwanis Drive, and a five-foot interior sidewalk that
connects to the El Lago Boulevard and Kiwanis Drive walkways.
This project provides twenty-eight non -tandem parking spaces, where twenty-seven are required.

Each dwelling unit has a two car attached garage. There are four guest parking spaces, one of
which is handicap accessible, provided at the pool amenity area, located in the center of the
property. In addition, each dwelling unit driveway has a minimum 19' distance from garage
entry to drive aisle to accommodate tandem parking.
Trash removal is serviced on an individual basis. Mail delivery is centralized, with a common
mailbox located adjacent to the pool amenity shade structure.
There are three different housing products planned for this subdivision. Each unit is two-story,
with three bedrooms, two and one-half bathrooms and has a covered patio. Unit A has a covered
patio and balcony. The living areas for the units range from 1,724 square feet to 1,885.
Evalnation
Staff has combined the reports for the special use request and the preliminary plat. The proposed
12 units of Lakeside Villas Condominiums are subtracted from the number of residential units
allowed per the 1997 Town Center Development Agreement, with MCO Properties.
The following staff report will review several aspects of the project, including an evaluation of the
project and conformance to the Zoning and Subdivision Ordinances:
(ar Conformance with the Zoning Ordinance:
The "TCC" Zoning District requires a special use permit for residential developments, and conform
to the "M-3" Multi -family Residential Zoning District criteria. The applicant proposes a density of
5.22 units per acre, where the allowed density of the "M-3" Zoning District for this property is 27
units.
The attached exhibits comprise the Master Design and Architectural Plan (MDAP) as required by
the "TCC" Zoning District. The plans include a color rendering of the building elevations, the
architectural style of the project, the proposed comprehensive sign plan, and building materials,
which are noted on the black and white architectural elevations.
Staff believes that the MDAP is in keeping with the desired quality and type of architecture
described in Section 18.08 of the Zoning Ordinance. The monument sign exceeds the maximum
ten -foot width allowed by the Zoning Ordinance. Staff has provided stipulation number two (2) to
bring the proposed signage into compliance with the Zoning Ordinance. Staff finds this
condominium request in conformance with all applicable Zoning ordinances and regulations with
stipulation number two (2) to reduce the proposed monument sign to a maximum ten -foot width.
Conformance with the Subdivision Ordinance:
Staff finds this preliminary plat request in conformance with the Subdivision Ordinance. Staff
recommends the Town Council require a five-foot sidewalk on only one side of the interior drive
aisle (stipulation three in the recommendation).
Staff and the Planning & Zoning Commission recommend Town Council approval of the special
use permit and preliminary plat for "Lakeside Villas Condominium", with the following
stipulations:
1) Prior to Final Plat approval, the Master Landscaping and Lighting Plan and the on/off-site
improvement plans are to be approved by the Town.
2) The applicant revises the monument sign width to a maximum of ten feet.
3) The Town Council waive the Subdivision Ordinance requirement for a sidewalk on both
sides of the interior private roadway system.
4) The site grading and drainage improvement plans are revised to reflect the Engineering
Department drainage comments.
5) Provide stone veneer treatment on the rear and sides of each building, to be consistent
with the materials shown on the front building elevations.

Condominiums"; Case Number SU2001-13

This is a request by Gene Baker, with Hallcraft Homes, to extend the expiration period of the approved
Special Use Permit for "Desert Vista Place Condominiums". The applicant is unable to obtain a grading
and building permit for the construction of this 21-unit multiple -family condominium complex within the
six-month expiration period of the Special Use Permit.
This project involves a Development Agreement with the Town, a Special Use Permit to allow a multiple -
family use in a "C-l" Zoning District, a replat of Lots 1-6, Block 3, Final Plat 302, and an alley right-of-
way abandonment. This project received unanimous approval by Town Council on December 4t1i, 2001.
Since that time, the applicant has not submitted the improvement plans or construction assurances needed
for Final Plat approval.
Because of the complexity of this project, Staff recommends the Town Council extend this Special Use
request for an additional six months. Please find attached, a letter requesting an extension dated April 25"',
2002, from Gene Baker, the Special Use Permit, and the December 4th, 2001 Planning & Zoning and Staff

property was duly posted and public hearings were held, Town Council approved this
special use request. Therefore, this letter is to serve as the;

As a special use, effective December 4`h, 2001, the "Desert Vista Place Condominiums"
shall be subject to the site plan approved as part of this special use permit. A grading and
building permit for the construction of this multiple -family project shall be secured
within six (6) months from the date of approval. Any lapsing of the building permit prior
to completion of the improvements will cause the special use permit to become null and
void. Prior to the termination of this time limit, the applicant may make a written request
to the Town Council and the Council may reconsider said use permit to determine if the
use permit should be reissued for an additional time period or be terminated. Use of the
site must conform to the Town of Fountain Hills Zoning Ordinance and the approved site
plan for this special use.

SUMMARY:
This request by MCO Properties L.P. and Hallcaraft Homes, is for a Development Agreement
and special use permit for the proposed "Desert Vista Place Condominiums", a 21 unit multiple -
family gated subdivision with a common pool amenity. This project requires a Special Use
Permit to allow residential development in the "C-l" Commercial Zoning District, a replat of
Final Plat 302, Block 3, Lots 1-6, which would abandon all property lines and alley rights -of -way
within Block 3 of Plat 302, and also the abandonment of the existing alley right-of-way located
along the east property boundary of Lots 3 & 4, Block 3, Plat 302, with dedication from the
Town to the property owners.
On November 29, 2001, the Planning and Zoning Commission recommended approval of the
Special Use with one amendment to staff's suggested stipulations. The Planning and Zoning
Commission believes that the project is too congested with buildings, in particular the adjacency
of buildings one and two. The Planning and Zoning Commission added a stipulation that the

developer reduce the project density by one dwelling unit, suggesting he remove one unit from
building one to allow more open space and less congestion in that area. The preliminary plat
request was continued due to this stipulation so the Planning and Zoning Commission would
have the opportunity to review a reconfiguration of the site plan if Town Council supports their
recommendation to reduce the number of units.
This project has been designed in conformance with the "M-1" Multiple -Family Residential Zoning
District requirements. The alley abandonment and dedication to the owner/applicant will allow a
maximum density of 21 dwelling units, as it is proposed, per the "M-1" Zoning District standards.
There are two vehicular access points to this subdivision. The main point of access is the Desert
Vista gated entrance, and a secondary vehicle access point is located off of Sioux Drive. The total
parking required for this project is forty-eight, one of which must be handicap accessible. Each unit
has an attached two -car garage that is setback a minimum of 19' from the back of sidewalk or back
of curb, whichever is closer, to allow space for tandem parking. There are four uncovered parking
spaces adjacent to the pool amenity and three more parking spaces distributed along the west side of
the drive aisle adjacent to Sioux Drive.
All utilities and access aisles are located within a forty-two foot roadway and public utility
easement. The drive aisle paved width is twenty-six feet with a five-foot sidewalk on one side.
The individual dwellings are both single -level and two-story with living areas ranging from 1,312
to 2,082 square feet. The end units of all the proposed buildings are single story.
The proposed replat associated with this special use request will create a single lot with three street -
side property lines. Article 308(F) of the Subdivision Ordinance establishes the following:
"Through lots shall not be permitted. An undevelopable tract of land, at a minimum depth
equal to at least 20 feet or the street -side yard setback requirement of the zoning district
within which the subdivision is located, shall be shown on the final plat between the rear
and street side lot line(s) of all lot(s) and the abutting street right-of-way (See Exhibit 21).
In subdivisions where all of the lots are at least 18,000 square feet in size and are not graded
with the subdivision improvements, a no -build or other comparable easement may be
platted, at the Town's discretion, instead of the separate tract of land."
Staff believes it is appropriate in this instance to allow a thirty-foot No Build Easement (N.B.E.)
and a one foot Non -Vehicular access Easement (N.V.A.E.) in place of a separate tract. This lot

configuration has been designed with a thirty-foot minimum building setback from all four sides, as
the "M-1" Zoning District prescribes. The Zoning Ordinance allows a maximum wall height of
forty-two inches within these setbacks.
The applicant has requested the Town enter into a development agreement to transfer hillside
preservation and for the development and maintenance of Parcel "C". In accordance with Article
504 of the Subdivision Ordinance, this property has approximately 4,233.9 square feet of hillside to
preserve. The proposed condominium preliminary plat proposes 100% disturbance. Staff is
recommending the Town Council approve a participation of funds to transfer hillside preservation
to the McDowell Mountain hillside preserve, in -lieu of on -site preservation.
The site design proposes to convey all drainage from this site through Parcel "C", which is located
adjacent to the eastern property boundary. Staff will agree to allow the applicant to convey
drainage through this area, however, it must be contained within an underground storm drain.
(W Containing the storm water in a pipe will allow for easier maintenance for the property owners and
allow safer access to the public utilities. An easement will be maintained over the existing sewer
and utility lines located in the alley. Staff recommends that the developer provide a trail,
landscaping, and perpetual maintenance of Tract "C", as part of the development agreement, at his
sole expense.
Staff recommends acceptance of the Development Agreement with Hallcraft Homes as presented.
The Planning & Zoning Commission and Staff recommend Town Council approve the special use
permit for "Desert Vista Place Condominiums", with the following stipulations:
1) That the applicant reduces the density of this project by removing one dwelling unit.
2) Receive right-of-way abandonment from Town Council, as recommended by the Town
Engineer (revise north eastern corner of lot line at alley as it is shown on southeast corner,
place drainage structure on lot).
3) That the applicant provide a title report showing his ownership of the property and any
easements on, across, and over all properties to be dedicated prior to recording the
Development Agreement.

SUBJECT: April Activity Report for the Fountain Hills Community Center.
For Council's information, please find the April Activity Report for the Fountain
Hills' Community Center. The report details, by date, the different activities,
attendance and fees collected for rent, miscellaneous charges, food
commissions, and liquor sales. Amounts shown are those charged for the event
and may not necessarily have been collected in total by the end of the month.
April slowed down a bit more noticeably in revenues when compared to March,
however the activities were still good with 162. We are now moving into the
wedding reception business and most weekends through June are for receptions.
It is certainly good business as the Center is such a good place for this type of
function.
The Volunteer Reception, coordinated by Advisory Commission member Bill
Muehlhauser was a terrific event and we appreciate those members of Council
who were able to attend.
The next great Volunteer event will be Serendipity Day, Saturday, July 13th. With
Evelyn Breting coordinating the volunteers, our own Sandra Ursini adding her
creative input and Raymond Rees' car races, it should be a fun, exciting and
different kind of day.
I have decided to discontinue the supplemental Monthly Fee Usage Analysis.
The report required considerable time and while the resulting information was
nice, it was a bit confusing and not too useful. The Advisory Commission has
requested an hourly review for usage and we will attempt to do so. Again, to do
this manually would be very time consuming, however we think our scheduling
program has the capabilities of providing this information. It's a matter of defining
how to organize and gather the data. We are sending Samantha Coffman, our

Resolution 2002-16, calling a ` special election for September 10, is another step in achieving
compliance. Although this will be our third election in 2002, the bright side is we receive a healthy
,.discount by -participating, in the consolidated September election. Because the November ballot is so
full, the .County has, offered reduced rates of .16/per-registered voter to appear on the September
ballot rather than mbeijr%, Staff recommends approval of Resolution 2002-16.

This item on the Town Council's agenda is a proposal to abandon the ten (10) foot public utility
and drainage easements located at the northerly and westerly property lines of Lot 29, Block 13,
Plat 107, (15038 N. El Sobrante Avenue) as shown in Exhibit "A". The property owner of Lot 29
desires the assurance that any future improvements made to the lot will not be infringed upon
by the construction of utilities. Staff has received no comments to date from the adjacent
property owners. The easterly 20' of the northerly 10' public utility easement will be retained for
existing and potential future utility boxes. The drainage easement along the northerly property
line will be retained as shown in exhibit "A".
The Engineering Department has reviewed the site to ascertain any drainage issues in addition
to the Town's general interest in the easement. It is the professional opinion of the Engineering
Department that there is no need for the Town to retain the westerly drainage easement
proposed to be abandoned, with the understanding that certain lots within this subdivision are
subject to lot -to -lot drainage runoff. The property owner of Lot 29 is required to pass the
developed flows generated by the upstream lots across their property.
All affected utility companies have been notified of this abandonment proposal and have
approved of the proposed abandonment of this public utility easement.
Staff recommends adoption of Resolution 2002-N subject to the following stipulations:
Complete an impermeable fence (such as with a 2' minimum height of masonry along
the north side of the property. (That is the owner's expressed intention to do) or provide
other drainage improvements.

This item on the Town Council's agenda is a proposal to abandon the twenty (20) foot public
utility and drainage easements located at the northwesterly property line of Lot 34, Block 6, Plat
401 B, (10214 N. Demaret Drive) as shown in Exhibit "A". The property owners of Lot 34 desire the
assurance that any future improvements made to the lot will not be infringed upon by the
construction of utilities. Staff has received no comments to date from the adjacent property
owners.
The Engineering Department has reviewed the site to ascertain any drainage issues in addition
to the Town's general interest in the easement. It is the professional opinion of the Engineering
Department that there is no need for the Town to retain the drainage easement proposed to be
abandoned, with the understanding that certain lots within this subdivision are subject to lot -to -
lot drainage runoff. The property owners of Lot 34 are required to pass the developed flows
generated by the upstream lots across their property.
All affected utility companies have been notified of this abandonment proposal and have
approved of the proposed abandonment of this public utility easement.

The owner William R. Scott, has chosen to convert an existing two -unit complex and record a Declaration
of Condominium to make individual units that could be sold independently. A building permit was issued
for the structure on November 15, 2000. The units will have a maximum livable area of 1,546 square feet,
and a minimum livable area of 1,496 square feet. Each unit has a covered patio and a two -car garage.
The final inspection for the units was conducted on March 14, 2002.
RECOMMENDATION:
On May 9, 2002, the Planning & Zoning Commission, by unanimous vote, recommended approval of
S2002-12; Preliminary and Final Plat "The Sunrise Condominiums". Staff recommends approval of
this preliminary and final plat.

The Town Council discussed at the May 2, 2002 meeting authorization to the staff to execute the
first amendment to restrictions regarding the site at Four Peaks school that was deeded to the Town
from the school district. The purpose of the amendment to the restrictions is to allow specifically
for a wireless telecommunications site to be located on that property. Attached to this memorandum
is a copy of the warranty deed dated June 27, 2001 and recorded July 2, 2001. Also attached is an
intergovernmental agreement dated May 23, 2001. The final attachment is the actual first
amendment to the restrictions and an affirmative vote on this consent agenda item will authorize the
Mayor and/or Manager to execute the document on behalf of the Town.

Re: Four Peaks Park Land Conveyance to the Town of Fountain Hills
Dear Governing Board and Town Council Members:
In support of the Town's Four Peaks Neighborhood Park Phase II plans and consistent with the concepts and
understandings as outlined in the current District -Town Intergovernmental Agreement (IGA), dated July 24,
2000, the district is conveying a 9.9-acre parcel in the Four Peaks Neighborhood Park to the Town of Fountain
Hills. This transaction is deemed to be a sound business decision and beneficial to both parties for the
following reasons:
1. On July 28, 1998, the District conveyed a 3.92-acre parcel adjacent to the Four Peaks Elementary School
and District Administrative Center to the Town in support of the Four Peaks Neighborhood Park project.
This 9.9-acre conveyance is in support of Phase II of the park project. As with the 1998 deed, the 2001
deed restricts the use of the 9.9-acre parcel to municipal and recreational purposes only.
2. The aforementioned IGA, as revised in 2000, effectively represents the joint interests of the District and
Town for the shared use of facilities between the two parties.
3. This conveyance benefits the Town by providing the land for the Phase II development.
4. The district benefits with access to the Phase II capital improvements for school -related activities as well as
the Town's financial commitment for the maintenance of the park in accordance with the IGA.
5. The value of the District property is difficult to measure because the deed restrictions eliminate any
potential economic use. As such, the Appraisal Institute suggests that the appraisal has only a non-
economic highest and best use and, therefore, the property has no measurable market value in terms of cash
in U.S. Dollars. The value of the property, and benefit to the Town, is therefore best described as an
essential element of the phase Il plan.
6. The value of the Town contribution associated with this conveyance is measured by the proposed park
improvement costs (>$1.8 million) coupled with the Town's estimated annual operating budget for the park
(>$200,000).

0 The District Superintendent and Town Manager share the following understandings and expectations
Project Design and Budget:
The District and Town jointly designed the playground features of the Four Peaks Neighborhood Park that
directly impact the daily activities for the Four Peaks Elementary School. Both Orcutt/Winslow and E Group,
architectural/engineering firms representing the District and Town respectively, facilitated the project
programming and design development phases and established the project's total budget at $105,000.
The district's base bid -funding from the Four Peaks renovation project already underway includes site
preparation for the playground area as well as the relocation of the existing playground set with new curbing
and padding material. This base bid contribution from the District is $35,000.
The additional playground improvements and scope of work not already included in the district's existing base
construction contract includes:
1) One new playground set with curbing, padding material, and shade structure;
2) Additional playground equipment such as swings and slides;
3) Sidewalk access to playground;
4) Fencing;
5) Landscaping;
6) Other design features, as needed, to integrate this playground area into the overall Four Peaks
Neighborhood Park Design.
It is understood that the funding strategy for this playground project includes three sources: Fountain Hills
Unified School District, the Town of Fountain Hills, and the Penny Park Fundraising endeavor. Penny Park's
contribution is estimated not to exceed $15,000. To date, the Penny Park efforts have raised $11,000, with two
major fund raising projects in the near future. The funding is therefore projected as follows:
District $35,000 (in base bid)
Town $55,000*
Penny Park $15,000 est.
$105,000
* The Town's contribution will be made upon available Four Peaks Neighborhood Park Phase II funding.
The Town and District also recognize that the Four Peaks Elementary renovation will not be finished by June
30, 2001. For project continuity, the General Contractor already on -site and under contract with the District
may complete the school playground construction. The District will establish appropriate procedures for
payment to the contractor with outside funding sources.
Special Warranty Deed:
The deed and legal description for the conveyance is presented in Exhibit A. The conveyance does not include
the school building and parking areas, District Administrative Center and parking lot, and an adjacent parcel
being considered for a multi -purpose educational/youth activity facility. On May 23, 2001, the District
Governing Board conditionally approved the land conveyance and associated Special Warranty Deed pending
acceptance of this LOU.
Future Considerations:
The Town and District have been involved in preliminary discussions with AT&T for the installation of
antennas at the Four Peaks Park for wireless services. The District has also had similar discussions with Qwest.
The Town and District have agreed that the revenue from these potential contracts, if ever approved, will be
equally shared. If the Town enters into such a contract after the conveyance date, the District proposes that the
initial 5-year contract be the basis for any shared revenue considerations.
The undersigned representatives, Fountain Hills Unified School District Superintendent and Fountain Hills
Town Manager, do hereby support the concepts and expectations outlined above.

seek alternative solutions.
A stealth saguaro is the only viable option.
A unanrnous vote of Town Council in June 2000
instructs AT&T to install a stealth saguaro on the
ridge above the industrial park if feasible.

been provided by a tower on Laser Drive.

SUBJECT: 2002 Pay Resolution
In the spring of 1999, the Town of Fountain Hills contracted services with the consulting firm,
Nash & Associates, to write a pay resolution for the Town. This involved the firm reviewing
salary surveys from public employers throughout the valley and classifying all staff positions.
The information available to them at that time was from surveys received with 1998 information.
The pay resolution written by Nash & Associates was adopted by the Council in December,
1999. It was a goal of the Town to update the pay resolution every two years to stay competitive
with the market.
Since that time there have been no updates to the salary ranges for any staff positions, nor does
the Town grant cost of living increases. The need to do an update became increasingly apparent
when the last four applicants for positions with the Town turned down our offers because of
salary, and the number of qualified applicants we receive for advertised positions is very small,
even though the unemployment rate in the valley has increased.
Consequently, I have done extensive research through surveys, websites, phone calls, etc. to
obtain salary ranges and comparable job descriptions from Maricopa County towns and cities, as
well as private entities in Maricopa County. Attached are updated, competitive salary ranges
arrived at for each of our positions using this data.
The positions that are labeled "new position" are new only in that they came into existence
during 2001 when we opened the Community Center and reorganized the structure of our Parks

& Recreation Department. Therefore, those titles did not exist in 1999 at the time of the last pay
resolution and did not have assigned ranges.
Due to recent changes in the Department of Public Safety, the position of Director of Public
Safety/Town Marshal has been reclassified to Town Marshal. If the Council approves the pay
resolution, the acting department head (currently Todd Tate) will perform the Marshal's duties
and the Fire Department will report to the Town Manager level.
The position of Human Resources Specialist has been reclassified to Human Resources
Administrator. A specialist indicates the person is responsible for a specific area of Human
Resources such as benefits, employee relations or compensation. The Human Resources person
for the Town is responsible for all aspects of Human Resources and therefore has been
reclassified to indicate such.
This recommended pay resolution represents an initial annual increase of $28,000, or
approximately $1,077.00 per pay period. This is an insignificant amount when you consider that
our employees are our greatest assets and in actuality there have been no updates to our salary
ranges since 1998 figures — about three years. We must continue to strive to recruit and retain a
high level of employees to maintain the Town's professionalism in all operations. In order to
achieve this, we must be willing to stay competitive with other Maricopa County entities.

SUMMARY & EVALUATION:
This is a request to join lots 1 & 2, Block 3, Final Plat 207 that will create a single contiguous lot
for future multiple family development. Lot 2 has been split under Maricopa County Jurisdiction
through the condominiumization of the La Casa Canada Condominiums, which is located to the
north of the existing Lot 2. This final plat removes the common lot line between Lots 1 & 2. The
La Casa Canada Condominium property boundaries will not change or be affected by this lot join.
Staff has found this request in conformance with all applicable Zoning and Subdivision Ordinances.
The applicant is providing the Town a Hillside Protection Easement (H.P.E.) along to the southern
lot line of the property, adjacent to Colony Wash. The H.P.E. is in conformance with the Mower
Amendment as established in the Subdivision Ordinance, and is approximately 5,927 square feet.
Staff has not requested a perimeter sidewalk for the multiple family project proposed for this site.
The Town of Fountain Hills master sidewalk plan does not include a pedestrian walkway along
Gunsight or Chama Drive, nor do any sidewalks exist along these streets. Staff is recommending
that Town Council waive the requirement for a sidewalk as part of the subdivision approval.

Staff recommends approval of "Final Plat of Lot 1A, Block 3, Plat 207", with the following
stipulations:

THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE

WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18. 1993,
which adopted The Zoning Ordinance for the Town of Fountain Hills, and;
WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and;
WHEREAS, The Town of Fountain Hills desires to amend its regulations to allow for a
modification of the requirements for accessory structures and solar units, and;
WHEREAS, The Town of Fountain Hills has rewritten Chapter 5, Sections 5.06.G, H and I of
The Zoning Ordinance for the Town of Fountain Hills and published these

SUMMARY:
This request by Visser Development Group, Inc., is for approval of a special use permit and the
preliminary plat for "Lakeside Villas Condominium", a 12 unit multiple -family subdivision with
a common pool amenity. This property is located at the southwest corner of El Lago Boulevard
and Kiwanis Drive, east of Fountain Channel.
Primary access to this development is located on Kiwanis Drive, aligned with the Lakeside
Resort Casitas entrance. An emergency access point is located approximately 80'south of the
main entrance on Kiwanis Drive. The emergency entrance will be gated and controlled by an
opti-com sensor and knox lock for emergency access only.
The sidewalk system includes an eight -foot meandering sidewalk along El Lago Boulevard, a
five-foot meandering sidewalk along Kiwanis Drive, and a five-foot interior sidewalk that
connects to the El Lago Boulevard and Kiwanis Drive walkways.
This project provides twenty-eight non -tandem parking spaces, where twenty-seven are required.
Each dwelling unit has a two car attached garage. There are four guest parking spaces, one of
which is handicap accessible, provided at the pool amenity area, located in the center of the
property. In addition, each dwelling unit driveway has a minimum 19' distance from garage
entry to drive aisle to accommodate tandem parking.
Trash removal is serviced on an individual basis. Mail delivery is centralized, with a common
mailbox located adjacent to the pool amenity shade structure.
There are three different housing products planned for this subdivision. Each unit is two-story,
with three bedrooms, two and one-half bathrooms and has a covered patio. Unit A has a covered
patio and balcony. The living areas for the units range from 1,724 square feet to 1,885.
Evaluation:
Staff has combined the reports for the special use request and the preliminary plat. The proposed
12 units of Lakeside Villas Condominiums are subtracted from the number of residential units
allowed per the 1997 Town Center Development Agreement, with MCO Properties.
The following staff report will review several aspects of the project, including an evaluation of the
project and conformance to the Zoning and Subdivision Ordinances:
Conformance with the -Zoning Ordinance -
The "TCC" Zoning District requires a special use permit for residential developments, and conform
to the "M-3" Multi -family Residential Zoning District criteria. The applicant proposes a density of
5.22 units per acre, where the allowed density of the "M-3" Zoning District for this property is 27
units.
The attached exhibits comprise the Master Design and Architectural Plan (MDAP) as required by
the "TCC" Zoning District. The plans include a color rendering of the building elevations, the
architectural style of the project, the proposed comprehensive sign plan, and building materials,
which are noted on the black and white architectural elevations.
Staff believes that the MDAP is in keeping with the desired quality and type of architecture
described in Section 18.08 of the Zoning Ordinance. The monument sign exceeds the maximum
ten -foot width allowed by the Zoning Ordinance. Staff has provided stipulation number two (2) to
bring the proposed signage into compliance with the Zoning Ordinance. Staff finds this
condominium request in conformance with all applicable Zoning ordinances and regulations with
stipulation number two (2) to reduce the proposed monument sign to a maximum ten -foot width.
Conformance with the Subdivision Ordinance -
Staff finds this preliminary plat request in conformance with the Subdivision Ordinance. Staff
recommends the Town Council require a five-foot sidewalk on only one side of the interior drive
aisle (stipulation three in the recommendation).

Staff and the Planning & Zoning Commission recommend Town Council approval of the special
use permit and preliminary plat for "Lakeside Villas Condominium", with the following
stipulations:
1) Prior to Final Plat approval, the Master Landscaping and Lighting Plan and the on/off-site
improvement plans are to be approved by the Town.
2) The applicant revises the monument sign width to a maximum of ten feet.
3) The Town Council waive the Subdivision Ordinance requirement for a sidewalk on both
sides of the interior private roadway system.
4) The site grading and drainage improvement plans are revised to reflect the Engineering
Department drainage comments.
5) Provide stone veneer treatment on the rear and sides of each building, to be consistent
with the materials shown on the front building elevations.

Condominiums"; Case Number SU2001-13

This is a request by Gene Baker, with Hallcraft Homes, to extend the expiration period of the approved
Special Use Permit for "Desert Vista Place Condominiums". The applicant is unable to obtain a grading
and building permit for the construction of this 21-unit multiple -family condominium complex within the
six-month expiration period of the Special Use Permit.
This project involves a Development Agreement with the Town, a Special Use Permit to allow a multiple -
family use in a "C-1" Zoning District, a replat of Lots 1-6, Block 3, Final Plat 302, and an alley right-of-
way abandonment. This project received unanimous approval by Town Council on December 4', 2001.
Since that time, the applicant has not submitted the improvement plans or construction assurances needed
for Final Plat approval.
Because of the complexity of this project, Staff recommends the Town Council extend this Special Use
request for an additional six months. Please find attached, a letter requesting an extension dated April 25th,
2002, from Gene Baker, the Special Use Permit, and the December 4th, 2001 Planning & Zoning and Staff

SUMMARY:
This request by MCO Properties L.P. and Hallcaraft Homes, is for a Development Agreement
and special use permit for the proposed "Desert Vista Place Condominiums", a 21 unit multiple -
family gated subdivision with a common pool amenity. This project requires a Special Use
Permit to allow residential development in the "C-1" Commercial Zoning District, a replat of
Final Plat 302, Block 3, Lots 1-6, which would abandon all property lines and alley rights -of -way
within Block 3 of Plat 302, and also the abandonment of the existing alley right-of-way located
along the east property boundary of Lots 3 & 4, Block 3, Plat 302, with dedication from the
Town to the property owners.
On November 29, 2001, the Planning and Zoning Commission recommended approval of the
Special Use with one amendment to staff's suggested stipulations. The Planning and Zoning
Commission believes that the project is too congested with buildings, in particular the adjacency
of buildings one and two. The Planning and Zoning Commission added a stipulation that the

developer reduce the project density by one dwelling unit, suggesting he remove one unit from
building one to allow more open space and less congestion in that area. The preliminary plat
request was continued due to this stipulation so the Planning and Zoning Commission would
have the opportunity to review a reconfiguration of the site plan if Town Council supports their
recommendation to reduce the number of units.
This project has been designed in conformance with the "M-1" Multiple -Family Residential Zoning
District requirements. The alley abandonment and dedication to the owner/applicant will allow a
maximum density of 21 dwelling units, as it is proposed, per the "M-1" Zoning District standards.
There are two vehicular access points to this subdivision. The main point of access is the Desert
Vista gated entrance, and a secondary vehicle access point is located off of Sioux Drive. The total
parking required for this project is forty-eight, one of which must be handicap accessible. Each unit
has an attached two -car garage that is setback a minimum of 19' from the back of sidewalk or back
of curb, whichever is closer, to allow space for tandem parking. There are four uncovered parking
spaces adjacent to the pool amenity and three more parking spaces distributed along the west side of
the drive aisle adjacent to Sioux Drive.
All utilities and access aisles are located within a forty-two foot roadway and public utility
easement. The drive aisle paved width is twenty-six feet with a five-foot sidewalk on one side.
The individual dwellings are both single -level and two-story with living areas ranging from 1,312
to 2,082 square feet. The end units of all the proposed buildings are single story.
The proposed replat associated with this special use request will create a single lot with three street -
side property lines. Article 308(F) of the Subdivision Ordinance establishes the following:
"Through lots shall not be permitted. An undevelopable tract of land, at a minimum depth
equal to at least 20 feet or the street -side yard setback requirement of the zoning district
within which the subdivision is located, shall be shown on the final plat between the rear
and street side lot line(s) of all lot(s) and the abutting street right-of-way (See Exhibit 21).
In subdivisions where all of the lots are at least 18,000 square feet in size and are not graded
with the subdivision improvements, a no -build or other comparable easement may be
platted, at the Town's discretion, instead of the separate tract of land."
Staff believes it is appropriate in this instance to allow a thirty-foot No Build Easement (N.B.E.)
and a one foot Non -Vehicular access Easement (N.V.A.E.) in place of a separate tract. This lot

configuration has been designed with a thirty-foot minimum building setback from all four sides, as
the "M-1" Zoning District prescribes. The Zoning Ordinance allows a maximum wall height of
forty-two inches within these setbacks.
The applicant has requested the Town enter into a development agreement to transfer hillside
preservation and for the development and maintenance of Parcel "C". In accordance with Article
504 of the Subdivision Ordinance, this property has approximately 4,233.9 square feet of hillside to
preserve. The proposed condominium preliminary plat proposes 100% disturbance. Staff is
recommending the Town Council approve a participation of funds to transfer hillside preservation
to the McDowell Mountain hillside preserve, in -lieu of on -site preservation.
The site design proposes to convey all drainage from this site through Parcel "C", which is located
adjacent to the eastern property boundary. Staff will agree to allow the applicant to convey
drainage through this area, however, it must be contained within an underground storm drain.
40 Containing the storm water in a pipe will allow for easier maintenance for the property owners and
allow safer access to the public utilities. An easement will be maintained over the existing sewer
and utility lines located in the alley. Staff recommends that the developer provide a trail,
landscaping, and perpetual maintenance of Tract "C", as part of the development agreement, at his
sole expense.
Staff recommends acceptance of the Development Agreement with Hallcraft Homes as presented.
The Planning & Zoning Commission and Staff recommend Town Council approve the special use
permit for "Desert Vista Place Condominiums", with the following stipulations:
1) That the applicant reduces the density of this project by removing one dwelling unit.
2) Receive right-of-way abandonment from Town Council, as recommended by the Town
Engineer (revise north eastern corner of lot line at alley as it is shown on southeast corner,
place drainage structure on lot).
3) That the applicant provide a title report showing his ownership of the property and any
easements on, across, and over all properties to be dedicated prior to recording the
Development Agreement.

SUBJECT: April Activity Report for the Fountain Hills Community Center.
For Council's information, please find the April Activity Report for the Fountain
Hills' Community Center. The report details, by date, the different activities,
attendance and fees collected for rent, miscellaneous charges, food
commissions, and liquor sales. Amounts shown are those charged for the event
and may not necessarily have been collected in total by the end of the month.
April slowed down a bit more noticeably in revenues when compared to March,
however the activities were still good with 162. We are now moving into the
wedding reception business and most weekends through June are for receptions.
It is certainly good business as the Center is such a good place for this type of
function.
The Volunteer Reception, coordinated by Advisory Commission member Bill
Muehlhauser was a terrific event and we appreciate those members of Council
who were able to attend.
The next great Volunteer event will be Serendipity Day, Saturday, July 13th. With
Evelyn Breting coordinating the volunteers, our own Sandra Ursini adding her
creative input and Raymond Rees' car races, it should be a fun, exciting and
different kind of day.
I have decided to discontinue the supplemental Monthly Fee Usage Analysis.
The report required considerable time and while the resulting information was
