It is the Council's desire to hear public comment on agenda items. As it is important to maintain order during the meeting, please adhere to

AGENDA ITEM #2 — ALAMO EXTENSION OF PREMISE/PATIO APPLICATION
Shawna Worden has submitted an extension of premise/patio permit application for the Alamo Saloon
located at 11807 North Saguaro Boulevard. The request is to temporarily extend the Alamo's Class 6
liquor license to a fenced area adjacent to the east side of the building on Saturday, June 22, 2002.
Additional staff will insure that no alcohol leaves the fenced area.
Since additional parking spaces will be needed to accommodate the extended area, Community
Development reviewed the application with special regard to parking issues. They determined that no
undo hardship would be caused the surrounding patrons and based on their findings, forwarded a
favorable recommendation. (Please see attached memo from Denise.)
Marshal Tate has conducted his background investigation and based on statutory compliance,
forwarded a conditional endorsement. His memo states that the Community Development Director
said that a temporary use permit would be required to achieve zoning compliance. (Please see
attached memo from Todd.) It appears that subsequent investigation by the Community Development
staff determined that this would not be the case, relieving the applicant of the temporary use
requirement stated in the Marshal's memo.
Based on the endorsement by the Community Development staff and statutory compliance, staff
recommends approval.

Fountain Hills Memorandum

Re: Liquor License — Extension of Premises — Alamo
The purpose of this memorandum is to conditionally endorse the attached request for an extension of
premises permit submitted Shawna Worden on behalf of the Alamo Saloon. It would be valid for
one day, Saturday, June 22 and is scheduled for Council review at the June 201" meeting.
Investigative Facts: The Alamo Saloon, located at 11807 Saguaro Boulevard, is owned by J & S
Concepts LLC. The applicant, Shawna Worden, is the sole owner.
The Alamo Saloon has a valid class 6 liquor license, #06070452, in place at the facility. A review of
Marshals Department records shows two previous extension of premises events on October 9, 1999
and September 9, 2001. They used the same configuration as proposed in this application with no
complaints, violations, or incidents reported.
A Class 6 license allows on premise sale of alcoholic beverages. Under the provisions of ARS 4-207.01
as well as liquor regulation R19-1-233, an extension of premises may be allowed if three conditions are
met:
1. There is a valid license at the location and the request meets the provisions of that license;
2. There is a plan to control access; and,
3. There is a written application that includes a diagram.
A review of the Alamo Saloon application indicates that all of these conditions are being met.
In addition, an interview with the applicant indicated that the actual event is planned from approximately
1 to 4 PM for the purpose of benefiting the Fountain Hills Pop Warner.
Findings- In February of this year, the state liquor investigator for Fountain Hills conducted an
inspection to ensure that the establishment remains in compliance with license provisions. There have
also been covert inspections done at the premises. Based on his report to date, there are no violations
that would preclude granting of the permit extension. In addition, the establishment has a current
Fountain Hills business license, #4163, valid through November of 2002. A review of this license file
shows no complaints or violations. However, according to Jesse Drake, Interim Community
Development Director, an extension of premises, such as proposed in this application, would require a
temporary use permit to be in compliance with town zoning codes. She reported that the temporary
use permit is not a problem and that they are already working on it.
Recommendation: Based on compliance with the liquor license requirements, as well as the provisions
of ARS 4-207.01, 1 recommend approval of the Alamo Saloon extension of premises request provided
they secure a temporary use permit as required by the town zoning code.

SUBJECT: Consideration of an Application for Temporary Extension of Premises/Patio
Permit for Alamo Saloon located at 11804 North Saguaro Boulevard.
SUMMARY:
The applicant, Shawna Worden, has requested an extension of Premises to accommodate a proposed
annual fundraising event for Pop Warner Football.
The Alamo Saloon parking lot contains eleven permanent parking spaces, which are shared with a
shutter business located in the same building. The rear lot is not paved and is enclosed by a six-foot
cinder block wall with access by an approximately eight -foot wide gate.
1%W EVALUATION:
The Community Development Department has reviewed the application with special regard for the
temporary additional parking that will be required if this application is approved.
This event is scheduled for Saturday June 22°d between the hours of 12:00 noon and 5:00 p.m.
(approximately). According to the property manager parking for the event last year posed no
problems with overflow parking. accommodated on adjacent properties of businesses (i.e. shopping
center which includes a vacant office building/Mels Vacuum/Jacks Self Indulgence/Norco and CSI
Printing) providing an additional 23 parking spots. These businesses are typically not
open during the hours of the event. No outdoor cooking will be done.
This event is used to raise funds for the local Pop Warner football league and is a once annually
event.
RECOMMENDATION:
Staff recommends approval of the Application for Extension of Premises/Patio Permit for Alamo
Saloon.

RESOLUTION NO.2002-23
A RESOLUTION OF THE MAYOR AND TOWN COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, AUTHORIZING
THE TOWN, PURSUANT TO A.R.S. 28-8104, TO USE UP TO
TEN PERCENT OF LOCAL TRANSPORTATION
ASSISTANCE FUND MONIES FOR ALL USES AS
ALLOWED BY LAW.
WHEREAS, the Thirty -Fifth Legislature, second special session of 1981, established a Local
Transportation Assistance Fund from the proceeds of the Arizona State Lottery; and
WHEREAS, the Forty -Second Legislature, second regular session of 1996, amended Title 28,
Transportation, removing the requirement that cities and towns apply to the department of transportation for
local transportation assistance fund (LTAF) monies each year; and
WHEREAS, A.R.S. 28-8104, still in full force and effect, states that a city or town may authorize
by resolution the use of up to ten percent of local transportation assistance fund monies received in any one
fiscal year for cultural, educational, historical, recreational or scientific facilities or programs or for
nonresidential outpatient programs or services for developmentally disabled persons as defined by A.R.S.
36-551 who have never resided within a facility identified in or established pursuant to A.R.S. 36-558 if the
monies are matched equally by nonpublic monies received by the city or town and expended for the same
purposes, except in a fiscal year when the total distributed from the local transportation assistance fund is
less than twenty-three million dollars; and
WHEREAS, funds received by the Town of Fountain Hills are to be used for the following
purposes:
ALL USES AS ALLOWED BY LAW.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, THAT the Town of Fountain Hills has declared intent, as
authorized by A.R.S. 28-8104, to use ten percent of local transportation assistance fund monies in any one
year for purposes other than transportation.

This request by James and Lome Scheller is for Final Plat approval of a Replat for Lots 11 & 12 Shadow
Canyon Final Plat "Sunridge Canyon, Fountain Hills, Arizona which is a lot join project.
The owners have chosen to reconfigure these lots by combining the two lots into one lot. The
reconfiguration of these lots will allow for greater flexibility in the construction and orientation of the
proposed new home. The new lot will meet all the requirements of the "R1-351T" Zoning District for size
and dimensions. The applicant proposes to combine the current hillside disturbance allowance of 9,000 for
lot 11 and 15,000 for lot 12 to a total of 24,000 for the joined lots.
Engineering has reviewed and approved without stipulations.
RECOMMENDATION:
The proposed lot is in compliance with the regulations of The Town of Fountain Hills Zoning Ordinance.

This request is for consideration of the abandonment of Plat for "Kingsdale Condominiums Unit
11". The abandonment of plat is a request by R. Thomas Pritchard, which would
uncondominimumize four units located at 13643 Hamilton Drive, aka units 101,102, 103, and 104,

SUMMARY:
This request is for approval of abandonment of plat for."Kingsdale Condominiums"
The owners wish to abandon the existing four -unit condominium ownership and restore the single
parcel ownership of the four -unit complex. The four -unit complex is currently under the sole
ownership of R. Thomas Pritchard and Carol Paul Pritchard trustees. The units will continue the
use as a multi -family apartment complex with an approximate living area of 1,350 sf for each
unit. Each unit has a balcony, patio and storage. The complex has a restricted common area, four
individual trash receptacles and one covered and one open parking space per unit.
A ten -foot Public Utility & Drainage Easement exists on the east of the property running from
north property line to south property line.
Engineering has reviewed and found that a transformer has been located on the southwest corner
of the lot and a ten by ten Public Utility Easement must be provided for said transformer. The
Engineering department submitted no other issues.

Petitioners, R. Thomas Pritchard and Carol Paul Pritchard as Trustee under the Declaration of

for Abandonment of a Recorded Subdivision, state as follows:
1 . The final plat of Kingsdale Condominiums Unit 11 (the "Condominium") was recorded
in the office of the Maricopa County Recorder on October 28, 1985 in Book 289 of
Maps on Page 47 as document number 85-509958. Said plat was a subdivision of Lot
6, Block 5 of FOUNTAIN HILLS ARIZONA FINAL PLAT NO. 102, a subdivision of record
as recorded in Book 142, Page 12, of Maricopa County Records.
2. The Declaration of Horizontal Property Regime Together with Covenant, Conditions and
Restrictions and Grant and Reservations of Easements for Kingsdale Condominiums
Unit 11 was recorded in the office of the Maricopa County Recorder on October 28,
1985 as document number 85-509959.
3. R. Thomas Pritchard and Carol Paul Pritchard as Trustee under the Declaration of Trust
dated May 31, 1995 owns all of the units of the Condominium which is that certain
real property located in the County of Maricopa, State of Arizona described as follows:
Units 101, 102, 103 and 104 KINGSDALE CONDOMINIUMS UNIT 11,
according to Declaration of Horizontal Property Regime, recorded in recording
no. 85-509959 and plat recorded in Book 289 of Maps, page 47, records of
Maricopa County, Arizona;
TOGETHER WITH an undivided interest in and to the common elements, as set
forth in said declaration and as designated on said plat.
EXCEPT ALL minerals as reserved in patent from the United States of America;
and
EXCEPT ALL oil, gases and other hydrocarbon substances, coal, stone, metals,
minerals, fossils and fertilizers of every name and description, together with all
uranium, thorium or any other material which is or may be determined to be
peculiarly essential to the production of fissionable materials, whether or not of

4. R. Thomas Pritchard and Carol Paul Pritchard as Trustee under the Declaration of Trust
dated May 31, 1995 desire to terminate the Condominium.
5. R. Thomas Pritchard and Carol Paul Pritchard as Trustee under the Declaration of Trust
dated May 31, 1995 have executed an Agreement and Declaration to terminate
Kingsdale Condominium Unit 11, which Agreement and Declaration has been recorded
in the office of the Maricopa County Recorder on May 15, 2002 as document number
2002-0497667.
6. A copy of said Agreement and Declaration and the recorded subdivision of Kingsdale
Condominiums Unit 11 are attached hereto as Exhibits "A" and "B" and incorporated
herein by reference.
7. Section 2.08 of the Zoning Ordinance for the Town of Fountain Hills provides as
follows:
A. Pursuant to the provisions of Title 28, Chapter 14, Article 1, Sub -Sections 28-
7201 through 28-7208 and 28-7210 through 28-7215, ARS, the abandonment
of all or part of a recorded subdivision may be initiated by written petition to the
Town Council. The petition shall be signed by all owners of real property in said
subdivision requesting abandonment of all streets, alleys and easements within
said subdivision and giving the legal description and recording information
thereof.
B. Applications for the abandonment of a recorded subdivision are filed with the
Community Development Director and referred for recommendation to the Town
staff and the appropriate utility companies. After Town Council approval of the
abandonment of any streets, alleys and easements within the subdivision, and
after Town Council approval of the Abandonment Resolution for the recorded
subdivision, and after the abandonment resolutions are recorded with the
Maricopa County Recorder's Office, the subdivision is removed from the official
maps.
WHEREFORE, Petitioner's request the following:
That the Town Council of the Town of Fountain Hills, Arizona, adopt a
Resolution for Abandonment of the subdivision of Kingsdale Condominiums Unit
11.

of the Maricopa County Recorder on or before July 31, 2002.
3. Effective upon recordation of this Agreement and Declaration in the office of the
Maricopa County Recorder, title to all the real estate formerly in the
condominium located in the County of Maricopa, State of Arizona will be
described as follows:

On April ls` of this year, the Marshals Department submitted a grant application to the Governor's
Office of Highway Safety (GOHS). The application was submitted under the Alcohol/DUI
Enforcement & Speed Enforcement category. The application, if approved October Is` 2002, will
award twenty one thousand seven hundred ninety three dollars and seventy-nine cents to the
Marshals Department to purchase a 2003 Crown Victoria patrol vehicle.
As with all GOHS grants, a Town Council resolution to accept the funds must received by GOHS
prior to the grant being awarded. The approval resolution must be forwarded to GOHS by July Is`
for our department's application to be considered.
This grant application does not require any additional personnel. The grant requires that the vehicle
be used by the Marshals Department for DUI and Speed Enforcement in Fountain Hills. An
additional requirement is for the Marshals Department to continue to participate with the East Valley
DUI Task Force. This vehicle will help our ongoing efforts in DUI and Speed Enforcement through
September 30, 2003. Thank you very much.

FOR DISTRIBUTION OF LTAF MONIES
The LTAF Review/Selection Citizen Committee met Monday, June 3rd to share their ideas, reach a
consensus, and formulate a recommendation to the Council for the distribution of lottery monies.
As you know, pursuant to A.R.S. 28-8104, ten percent of the Local Transportation Assistance
Funds (LTAF) that the Town receives can be used for purposes other than transportation including
cultural, educational, historical, recreational or scientific facilities programs. An equal cash match,
from non-public monies, must be obtained from grant recipients. Resolution 2002-23 that appears
on the consent agenda gives the Council the authority to award these funds for purposes other than
transportation.
The Committee reviewed nine applications that represented requests totaling $16,000. Since the
amount available for distribution this year was $11,000, the Committee recognized that some, if not
all the requests, would need to be reduced. Their rating mechanisms were similar to those used in
the past and included:
Consideration of past awards and funding histories of each group.
Other sources of income and ability to raise funds.
Number of citizens/participants being served by the project/event.
Appropriateness of the request for the projected project.
Additional Town funding such as Community Benefit money.
Composition of groups being served — significant support for youth oriented
purposes.
As consensus was reached, it was evident that the Committee supported the requests that directly
benefited the youth in the community. Of the nine requests, six directly benefited youth programs
and activities. After the necessary reductions were made, these six requests remained fully funded
as follows:

The Community Theater request was reduced from $3,000 to $2,000 since it was more "capital" in
nature. The Committee felt that this benefit would be more indirect as opposed to providing funds
for youth programs that directly impact and benefit the recipients. The Community Chorus ($1,500
to $500) and the Chamber Players ($1,000 to $500) were reduced because the Committee felt they
both had other avenues of support through the Civic Association, their sponsoring organization.
They also noted that the requests were to help fund individuals (i.e. the new director, assistant
director and accompanist of the Chorus and performers of the Chamber Players) and preferred
recommending funding for programs that had broader benefit with a volunteer base. The final
reduction was to the Golden Eagle Foundation that included two separate requests. They
unanimously supported full funding for the mentoring program that benefits students at both Four
Peaks and McDowell Mountain Schools but they did not support the $2,500 request for books at
the new Middle School. They thought the request was somewhat premature as it did not appear that
a full needs assessment had been done as to how the move would affect both of the libraries. The
Committee also cited that the Golden Eagle Foundation is very effective in their fund raising efforts
and had access to other funding sources for the projects they support.
Attached is a summary chart that shows all of the applications received, the proposed projects, the
amounts requested and the Committee's recommendation for award. The chart also includes a short
summary of the Committee's rationale for the recommended award.
As always, Committee members were diligent in thoroughly reading and evaluating the application
materials. It was evident that they took their charge seriously and put alot of time and effort in
making their recommendations. At the meeting there was a willingness to listen and share ideas in
order to award funds where they would do the most good.
The Committee is aware that their recommendation is just that, a recommendation that the Council
can change or modify as they see fit.

The Town currently has two grant cycles, spring and fall, which allow non-profit organization to apply for
funds made available through lottery monies (LTAF) and the general fund (the Community Benefit
Program). Organizations submit applications that are reviewed by a citizen committee that makes a
recommendation to the Council for distribution.
Resolution 2002-23 authorized the Council to use up to ten percent of local transportation assistance fund
monies for purposes other than transportation. By statute, these funds cannot be used until the total
amount distributed from the local transportation assistance fund reaches or exceeds $23 million. Each
year it seems to take longer to reach this amount, pushing our application and review process closer to
the end of the fiscal year. Although we advertised and accepted applications through May 6, we have
been waiting for notification that the $23 million limit was reached before embarking upon the review and
recommendation process. As a result, the citizen committee is meeting the first part of next week to
discuss the applications and formulate a recommendation for Council consideration on June 6. As soon as
they meet, I will prepare a staff report and distribute prior to Thursday's meeting.
This packet includes a summary of the nine requests totaling $16,000. The LTAF money available for
distribution totals $11,000. Also included are copies of the public notice and application format. For the
sake of saving a few trees, I have not duplicated all of the applications for distribution. Please feel free to
come by my office if you would like to review the originals.

Each year, the Town Council distributes ten percent of the Town's local LTAF (Local
Transportation Assistance Fund or lottery) monies for cultural, educational, historical,
recreational or scientific facilities programs. Organizations wishing to apply for a portion of the
funds, expected to be approximately $11,000, are invited to submit applications to Director of
Administration/Town Clerk Cassie Hansen who administers the application/review process
performed by a citizen committee. Application formats outlining the information needed in the
applications for funds are available at Town Hall or the Town's website (addresses below).
APPLICANTS MUST HAVE MATCHING FUNDS FROM NON-PITBIJC MONIES TO
BE ELIGIBLE FOR CONSIDERATION.
The Town is also requesting letters of interest from citizens who would like to serve on the
citizen committee to review LTAF applications and make a recommendation for disbursement
to the Town Council. Those interested in serving on this committee should have no direct
involvement or primary interest in any group applying for funds. Broad familiarity with
community activity would be helpful in evaluating the various requests. Any citizen interested
in serving on this three to five member review committee, is urged to submit a letter of interest,
including a brief description of community activities and involvement, to Cassie Hansen in the
Town's Administration office.

Staff response to Wednesday, June 19, 2002 MCO Custom Properties letter to the Town Council:
Part One: Major Policy concerns:
Item 1:
Per the recommendation from the Planning and Zoning Commission, staff has added a line to page
11 stating: "Large portions of the Town are regulated by Specific Area Plans or Development
Agreements which can be reviewed at the Town's Community Development Department." (See
supplemental staff report)
Staff agrees with the Planning and Zoning Commission that the large number of development
agreements in the many different areas of town are too numerous to mention individually, and that
full notification is satisfied, and the broad nature of the General Plan 2002 is best fulfilled, with a
general statement directing further inquiry regarding these Development Agreements to the Town,
where a copy of each is available.
Item 2:
Staff concurs with standard planning practice as shown in the 2001 HyettPalma Fountain Hills
Downtown Economic Enhancement Strategy report which identifies both the north and south
portions of Plat 208 as important parts of the town center which are best planned with a master plan
and specific plan overlay. It is expected that the Specific Plan would allow less restrictive uses by
right. For example, the Specific Plan Overlay could allow outdoor eating without the cost and time
delay under the current zoning requiring a Special Use Permit for each individual business. No
overlay would conflict, or be more restrictive, than any existing development agreement. The
overlay would serve to provide uses by right that would not exist in other commercially zoned
districts.

Existing Generalized Land Use
The existing land use pattern of Fountain Hills was largely influenced by the
implementation of an original master pla re ared under the su ervision of R V_
McCulloch Properties Inc in the early 1970's. is plan nvisioned a complete, self- `
supporting "New Town" of approximately 70,000 people. In 1980, MCO Properties
revised the original Master Plan to lower the proposed density and land use intensity
in consideration of environmental constraints. The revised Master Plan, approved by
Maricopa County, projected a build -out population of approximately 45,000.
In 1986 the revised Master Plan was amended by Maricopa County to include the
subdivisions of Crestview, Westridge, Summit East and Los Altos Hills (previously
named Summit West). In 1989 an amendment was administratively approved by
Maricopa County for the Lakeside Village, Bainbridge, and Golden Eagle areas.
In 1991, MCO Properties revised the Master Plan Map to include all the prior County
amendments. This revised map was presented to the Town. The Town took no
action on this document. Instead, the original Town of Fountain Hills General Plan
was approved on May 6, 1993. The first amendment to the original General Plan, to
re -designate land uses for the Sunridge Canyon area was approved on May 18`h of
the following year.
Topography was, and continues to be, the major constraint of the existing land use
patterns. Additionally, the pre -selected locations of the Fountain and the wastewater
treatment plant site have guided land use patterns. Originally, single-family
residential areas tended to be planned on the ridges, with commercial uses grouped
primarily on the flatter land near the fountain park: Construction of community
septic tanks and leach fields were abandoned when sewer collection lines became
available.
Currently most of the land is platted and either developed or under construction.

3. South of Shea Boulevard between Palisades and the industrial and

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, ADOPTING THE PUBLIC RECORD ENTITLED
"GENERAL PLAN 2002", AN AMENDMENT TO THE TOWN OF FOUNTAIN HILLS
GENERAL PLAN, THAT WILL REVISE, ADD TO AND UPDATE THE EXISTING

WHEREAS, The Town of Fountain Hills is required to update its General Plan in accordance
with the goals and requirements contained in the Arizona Revised Statutes,
Chapter 9, Section 9-461; and
WHEREAS, The Town has consulted with, advised and provided an opportunity for official
comment by public officials and agencies, civic and professional organizations,
property owners and citizens, as required by Arizona Revised Statutes Section 9-
461; and
WHEREAS, The Community Development Department, as the designated Planning agency for
the Town of Fountain Hills, has, at least sixty (60) days prior to the adoption of
this resolution, transmitted to the Mayor and Town Council a review copy of the
General Plan 2002 and has submitted a copy to, and solicited comments from
each agency required by Arizona Revised Statute Section 9-461 and to all persons
or entities who made a written request to receive a review copy of the proposal;
and
WHEREAS, Both the Planning and Zoning Commission and the Mayor and Town Council
have conducted public hearings in accordance with the procedures detailed in
Arizona Revised Statute Section 9-461, including Notice of the proposal and
public hearings having been published in the official newspaper of general
circulation, The Times of Fountain Hills and Rio Verde at least fifteen (15) days
and not more than thirty (30) days prior to each hearing; and
WHEREAS, The Town of Fountain Hills General Plan 2002 shall consist of maps, community
goals and descriptive text covering the objectives that will revise, add to and
update the existing general plan elements in accordance with the State's 1998
Growing Smarter, and 2000 Growing Smarter Plus legislation, including:
1. A Land Use Element providing a written and graphic form of the proposed
land uses within the community.
2. A Growth Element providing growth strategies and implementation plans
for transportation and infrastructure expansion.
3. A Cost of Development Element providing policies for identifying the costs
of public services and infrastructure and the methods available to require
future development to pay a portion of these development costs.
4. An Open Space Element providing a written and graphic inventory of all
existing and proposed parks, recreation areas and open spaces and a
management plan stressing linkages to adjacent and/or regional systems.
5. A Circulation Element providing a written and graphic form of the existing
and proposed street system and any alternative transportation systems, such
as bicycle and mass transit.
6. A Water Resources Element providing an inventory of the existing available
surface water, groundwater and effluent supply, and which analyses growth,
impacts and distribution of all water systems.
7. An Environmental Planning Element providing policies and implementation
plans that will address the proposed effects of development on air, water and
natural resources.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows:
Section 1. The Mayor and Town Council hereby amend the Town of Fountain Hills General
Plan by adopting the General Plan 2002, subject to ratification by the voters; and
Section 2. The document known as the "General Plan 2002" is hereby referred to, adopted,
and made a part hereof as if fully set out in the Resolution, the provisions thereof
to become effective upon ratification by the voters of the Town of Fountain Hills;
and
Section 3. The proposed General Plan 2002 of the Town of Fountain Hills, Arizona shall be
deemed to have been adoted as of the date of this Resolution and shall be valid for
a term of ten (10) years from the date of adoption; and
Section 4. The proposed General Plan 2002 of the Town of Fountain Hills as adopted by this
Council shall be submitted for ratification to the qualified electors of the Town of
Fountain Hills at a General Election to be held on September 10, 2002; and

Times of Fountain Hills and Rio Verde on May 29, June 5, and June 12, 2002,
and;
WHEREAS, Public hearings were advertised in the May 29, June 5, and June 12, 2002
editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona
Revised Statutes §9-462.04, and;
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning
Commission on June 13, 2002 and by the Fountain Hills Town Council on June
20, 2002.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Pursuant to Chapter 2, Section 2.01 of The Zoning Ordinance for the Town of
Fountain Hills, Chapter 13, Sections 13.05.A.3 and 13.05.B of The Zoning
Ordinance for the Town of Fountain Hills shall be amended as follows, with text
to be added shown as double -underlined:

A. An IND-1 Zoning District may be established and made a part of the Zoning District
maps prior to the Town Council approving a Plan of Development. The Plan of
Development shall contain at least the following:
The location and arrangement of the buildings, structures and other
improvements upon the land, including but not limited to, preliminary
grading and drainage plans, walks, roadways, interior and boundary streets,
vehicle parking areas, outside storage areas, perimeter screening, lighting,
landscaping areas, and signs.
2. Specific site development plans shall include grading plans, landscape plans
and landscaping treatments, building locations, vehicular ingress/egress and
parking, off -site improvements (such as street, curbs and sidewalks,
screening of outside storage areas, lighting, utility services and setbacks of
buildings or structures).
3. The plan shall show that the proposed use or uses would conform with the
requirements of regulations for the IND-1 Zoning District, and development
and use of the subject parcel of land shall be according to these requirements
and the approved Plan of Development.
B. An IND-2 Zoning District may be established and made a part of the Zoning District maps prior
to the Town Council approving a Plan of Development. However, prior to any zoning clearances
and building permits being issued, the following actions need to take place:
1. A Plan of Development must be prepared in accordance with the site plan
requirements detailed in Chapter 2, Section 2.04, herein;
2. This Plan of Development must be submitted to the Planning and Zoning
Commission for its review and report. The Commission will file its report on the
Plan of Development with the Town Council;
3. The Plan of Development must then receive the approval of the Town Council
4. The plan shall_ show that the proposed use or uses would conform with the
requirements of regulations for the END-2 Zoning District. and
development and use of the subject parcel of land shall be according to
these requirements and the approved Plan of Development.

SUBJECT: May Activity Report for the Fountain Hills Community Center.
For Council's information, please find the May Activity Report for the Fountain
Hills' Community Center. The report details, by date, the different activities,
attendance and fees collected for rent, miscellaneous charges, food
commissions, and liquor sales. Amounts shown are those charged for the event
and may not necessarily have been collected in total by the end of the month.
May turned out to be a very good month financially, thanks to several wedding
receptions. Activities were fair with 134, a little lower than last month, however
the receptions brought an increase in overall attendance. Summer is definitely
slower than the cooler months, but we're still cranking out the contracts and
rental arrangements for the upcoming year.
As noted before, the next great Volunteer event will be Serendipity Day,
Saturday, July 13t". Watch for additional details in the "Times" for all the fun
things planned for community enjoyment. Kudos to the folks who have put their
time and effort into the party: Evelyn Breting, Sandra Ursini and Race Car
Raymond Rees.
Just a couple of other notes: Public Works Director Ward is coordinating the redo
of the front handicapped parking. The grade was too steep and that is being
corrected. The striping should be completed next week and we'll be ready to go.
Samantha Coffman's trip to the Class Software Sessions has proved to be very
beneficial. "Class" is the software Parks and we use for booking and room
reservations and we are looking forward to more flexible booking information.
May's Summary: Activities — 134 with 37 being Parks and Rec. functions, YTD
1,191 (298 — Parks); Attendance — 5,611; YTD - 51,520; Space Rent - $6,770,
YTD - $45,361; Misc. Fees - $688, YTD - $3,272; Food — $715, YTD - $5,168;
Liquor - $5,770, YTD - $39,305; Total Revenues-$13,944, YTD - $93,105.
