Hours of operation are 9:00 a.m. to 10:00 p.m. on Friday and Saturday and 10:00 a.m. to 10:00 p.m. on Sunday. The event will be held at the American Legion located at 16837 East Parkview Avenue. This is an annual event that the American Legion schedules to coincide with the Fall Festival. Although the special event liquor license is issued by the state, local approval by the Council is required. Administration and the Town Marshal have reviewed the application. It is consistent with previous applications and includes the following provisions: Security: o Security guards posted at both entrances to restrict alcohol to the event area o Security personnel present at all times to prevent liquor law violations Licensing Compliance: o Bona fide non-profit, charitable organization o Applicant is a member and authorized to act on behalf of the qualifying organization o Within the ten day per year limit (7 days this year including this event) o At least 25% of the proceeds going to the charitable organization making the application o Written agreement to suspend the existing Class 14 license during the event o Does not sell alcohol before 10:00 a.m. on Sunday morning Background Investigation: o Favorable recommendation from the Town Marshal (attached) o No previous infractions to result in denial Based on incident -free past events, statutory compliance, and the fund-raising nature of the event that benefits the community, staff recommends approval. Page 1 of 1 October 17, 2002 Agenda Item #2 Last printed 10/9/200212:40 PM 10/9/2002 CFountain Hills Memorandum TO: Cassie Hansen FROM: Todd Tate, Interim Town Marshal Zillr DATE: October 3, 2002 SUBJECT: Liquor license application- American Legion The purpose of this memorandum is to endorse the attached liquor license application and forward the results of my investigation. It is my understanding that this item will be reviewed by the Council at their meeting on October 17th. Investigative facts: This application, for a new class 14 liquor license, would be used by the American Legion for a "club" facility at 16837 Parkview. Under the provisions of the Arizona Revised Statutes, Title 4, a class 14 license is a non -transferable, non -quota license issued specifically to an individual veteran or fraternal organization. Known as a "club" license, a series 14 only allows on premise sale and consumption of alcohol to members and registered guests. A review of liquor department requirements for a series 14 license indicates that it can be ® granted without a formal inspection of the premises and that there are no restrictions relating to nearby bars and restaurants. However, a class 14 license is not exempt from the 300' rule regarding churches and schools. The applicant, Kenneth Bowman is a member of the Post #58 Executive Committee and is a Fountain Hills resident which has been verified as part of the background investigation. The applicant does not have any wants or warrants and possesses a valid Arizona driver's license. Findings: The facility, located at 16837 Parkview, is situated in a commercial area well over 300' from the nearest church and school. The non-profit status, supported by IRS Tax -exemption number 86- 6038168, is consistent with a club definition under the provisions of ARS title 4. Moreover, American Legion Post #58, chartered in July, 1985, clearly meets the legal requirements of a veteran or fraternal organization which qualifies for a class 14 license. Moreover, the Council previously approved a class 14 license for the American legion on August 15, 1996 that has been in use at 16850 Avenue of the Fountains and at the current location of 16837 Parkview Avenue. Numerous covert and overt inspections over the last 4 years have not resulted in any significant infractions which would be cause to deny the license. Recommendation: Based on compliance with all provisions of ARS Title 4 relating to club status as well as the requirements for a series 14 liquor license, I recommend approval of this application by the Council at their October 17`h meeting. This event is being held in conjunction with the Fall Festival. Although the special event liquor license is issued by the state, local approval by the Council is required. Administration and the Town Marshal have reviewed the application. It is my understanding that this will be considered by the Council at their meeting on October 17th. Background: The liquor permit would be used in conjunction with the Fall Festival, from Friday November 81h -Sunday November 10th. The special event liquor license is permitted for non-profit organizations as an exception to the Arizona Revised Statutes, Title 4. The Veterans of Foreign Wars Post is a fraternal organization holding IRS number 74-2514547. Investigation: According to the state liquor department, this event will fall under the provisions of R19-1-244 in which qualifying organizations are allowed a total of 10 days per year for special event permits. According to our records, this application represents only three of the ten days allowed in 2002 Since the liquor license will be used in conjunction with a larger event (Fall Festival), two important provisions apply. First, 25% of the gross revenues from any alcohol sales must go to the non-profit organization; and, second, the alcohol must be purchased from a qualified off -premise source rather than a wholesaler. The requirement that the alcohol be purchased from a retailer is outlined in R19-1-250(a) and specifies that the source have a class 6,7,9,or 10 license such as Price Club, Bashas or Safeway. Findings: In reviewing overall plans for the Fall Festival, where the liquor will be available in a "beer garden" setting, the Marshals Department is satisfied that there is adequate control and provisions to prevent minors from having access to intoxicating beverages. The VFW Post will have the area fenced, limited access, and a system in place to control alcohol sales using civilian security personnel at both entrances. Furthermore, the civilian security will be in contact with nearby officers of the Marshals Department by cellular phone or radio, should any problems occur. It is my understanding that the application is scheduled for consideration the council session on October 17th. This application is for a new Class 12 liquor license under the specifications of ARS 4- 205.02. A Class 12 license is for restaurant use only. The statutes require that 40% of the business establishment be devoted to serving food and that liquor sales be incidental to the food service. A review of the proposed floor plan shows that over 60% of the establishment will be devoted to service of food. A Class 12 license is exempt from restrictions relating to churches, schools and nearby liquor establishments. However, the local jurisdiction does have the ability to determine if there is a proliferation of liquor establishments in the vicinity. A review of license holders in the immediate area indicates there are three class 6s, three class 10s, five class 12s, and one class 14 within one-half mile. These licenses are consistent with "downtown" development as well as commercial zoning and do not represent a proliferation issue in this case. The applicant, Salvatore Ripoli, is an Arizona citizen residing on Vista Del Lago Drive in Fountain Hills. There are no outstanding wants or warrants on the applicant. Additionally, the owner applied for and received Fountain Hills business license #4990 for the restaurant. This item on the Town Council's agenda is a proposal to abandon the ten (10) foot public utility and drainage easements located at the westerly and northerly property lines of Lot 30, Block 8, Plat 206, (12236 N. That a portion of the certain ten (10) foot public utility and drainage easements, located along the westerly and northerly property lot lines, of plat 206, Block 8, Lot 30, Fountain Hills, Arizona; as shown in Exhibit "A"; as recorded in book 147 of maps, page 2 records of Maricopa County, Arizona; are hereby declared to be abandoned by the Town of Fountain Hills. The easterly 20' of the northerly 10' public utility and drainage easement will be retained for existing and potential future utility boxes. Certain lots within this subdivision are subject to lot -to -lot drainage runoff. The property owners of Lot 30 are required to pass the developed flows generated by the upstream lots across their property. SECTION 2 That the property owner's of Lot 30 shall not use, nor allow to be used, the abandoned area for regular vehicular access or parking. SECTION 3. That this Resolution is one of abandonment and disclaimer by the Town solely for the purpose of removing any potential cloud on the title to said property and that the Town in no way attempts to affect the rights of any private party to oppose the abandonment or assert any right resulting there from or existing previous to any action by the Town. Jericho Drive Plat 602B, Block 2, Lot 32 John Madden Staff recommends adoption of Resolution 2002-42 with a stipulation: This item on the Town Council's agenda is a proposal to abandon a portion of the ten (10) foot public utility and drainage easements located at the northerly property line of Lot 32, Block 2, Plat 602B, (15948 E. Jericho Drive) as shown in Exhibit "A". The property owner of Lot 32 desires the assurance that any future improvements made to the lot will not be infringed upon by the construction of utilities. Staff has received no comments to date from the adjacent property owners. The northerly 5-10' of the public utility and drainage easement will be retained for any potential future utility lines and for conveyance of storm drainage flows. The Engineering Department has reviewed the site to ascertain any drainage issues in addition to the Town's general interest in the easement. In addition to the site visit, the Engineering Department has reviewed a drainage report from Dave Montgomery (Montgomery Engineering & Management located in Fountain Hills) to assure that the proposed retaining wall (located within the existing 10' Public Utility and Drainage Easement) will not obstruct any future drainage flows. The drainage report shows that the water surface elevation from a 100-year storm event is not raised by the proposed location of the retaining wall and in some areas the water does not touch the wall. It is the professional opinion of the Engineering Department that there is no need for the Town to retain the portion of the drainage easement proposed to be abandoned, with the understanding that certain lots within this subdivision are subject to lot -to -lot drainage runoff. WI-qp& %�yyJ DATE: October 5, 2002 RE: Speed Limit Changes Ordinance 02-14 Town of FOUNTAIN HILLS Public Works Department MEMORANDUM Section 12-2-2 A. of the Town Code regulates traffic control signs and devices, including establishment of speed limits. It states: The authority of the town manager or his designee to place and maintain signs under this chapter shall not include authority to post signs setting speed limits on any part of a street or highway within the town different from the speed limits specified in A.R.S. Title 28, Article 6, Chapter 6 unless the council has first adopted an ordinance in conformance with the provisions of A.R.S. § 28-703 authorizing a change of speed limit on such part of a street or highway within the town. (The A.R.S. designated speed limit is 25 mph in any business or residential district, 15 mph at a school crossing, and 65 mph in other locations.) Speed limits are proposed to be set for: • Shea Boulevard - West town limit to'/a mile west of Technology Drive, 50 mph. Now that MCDOT median, curbing and widening project has been completed, this continues Scottsdale's corridor 50 mph speed zone for Shea Boulevard eastward in this now -developed and developing section. Some of the appropriate speed limit signs are currently in place, as set by MCDOT. • Shea Boulevard - 1200' west of Technology Drive to 700' west of Saguaro Boulevard. With the Target improvements completion, this continues the Town's 45 mph commercial area speed limit westward. • Technology Drive - By its absence from the list, the new section of Technology Drive (and all other unmentioned new streets) is being initially set for 25 mph. (That will be reviewed after the "Target" stores are opened.) 2002 Speed Limit Changes.doc Page 2 of 2 Chron 183 Private Streets With the increasing amount of long, private streets within gated communities, it seems appropriate to officially acknowledge acceptable private street speed limits other than 25 mph set in accordance with their development approval, as follows: • Firerock Country Club Drive - Shea Boulevard to Rock Ridge Trail - 20 mph. • In our field review, staff noted a 30 mph speed limit sign remaining on Summer Hill Boulevard within the gated Eagle Mountain development. By copy of this memo, we are advising the Eagle Mountain HOA that the speed limit in this segment was changed by Council action on 8-05-99 to 25 mph (reference also staff memo of 7-27-99); the one remaining 30 mph speed limit needs to be removed. The remaining revisions are editorial and clerical corrections. An updated speed limit map showing the proposed speed limits and locations is attached for added information, but is not intended as a part of the actual ordinance. Speed limits proposed on the new road sections may be reviewed in the first year after they become open to the public. Such evaluation using the radar speed survey method of determining speed limits should reaffirm or show the need for modification of those proposed by this ordinance. The staff have been accomodating people by placing benches or trees, and plaques, upon request, in Fountain Park. Under this proposed memorial program the process would be formalized and a flyer made available to the public when inquiring about a memorial. There is adequate space to continue the placement of the benches around the lake and trees throughout the park for the forseeable future. Payment under the program would be made to the Department and deposited with the Town, after which the Fountain Park Fund would be credited with the amount. Invoices received for payment of the item(s) placed in the park on behalf of someone under the program would then be billed to that fund. The Parks and Recreation Commission had requested that such a program be formally established. The Commission reviewed and approved this program unanimously at their September 12, 2002 meeting and are recommending its acceptance to the Council. Action: All requests under this program will be as follows: 1. Individuals are given a copy of the brochure that explains the program and the costs. 2. Individuals make payment to the Town of Fountain Hills. 3. Funds are deposited and the necessary items ordered through the Parks Supervisor, who oversees the delivery, location and placement of the items. 4. Fees for the program appear in the brochure and are adjusted as necessary by staff to reflect changes in pricing from the various suppliers. The FY 2002-03 pricing appears in the brochure. Background: For the second year in a row, the Civic Association and the Sunridge Foundation wish to purchase and donate a piece of public art to the Town of Fountain Hills. If the Council approves the artwork at the October 17 meeting, the piece will be "unveiled" at the annual Sunridge Foundation dinner on November 2. Per the process outlined in the Public Art Guidelines, artwork must be reviewed and approved by the Public Arts Committee who then submits a recommendation to the Arts Council. If the Arts Council approves the artwork, they forward a recommendation to the Town Council. Approval by the Council is the final step necessary for official acceptance of donated artwork. This piece has been reviewed and approved by the Public Art Committee. The Arts Council will review and consider approval of the piece at their October 15 meeting. Fountain Hills Arts Council President Jackie Miles submitted a written request to the Town asking that the Council accept the stone sculpture at their October 17 if the piece is approved by the Arts Council on the 15th. It is necessary to have this item on the October 17 agenda to accommodate the November 2 dedication. If the Arts Council does not approve the piece, the item will be removed from the agenda. It is anticipated that the Arts Council will approve the sculpture. The artwork (picture attached) is the creation of David Hiles from Wickenburg. The Public Art Committee, Arts Council, the artist and Town staff identified a location for the piece in the southeast corner of the complex courtyard. A site map is attached showing the approximate location. The sculpture is valued at approximately $9,000. Town staff is arranging for a concrete pad through the existing concrete contract. The cost will be less than $1,000. The artist will arrange for delivery and placement of the piece so the cost to the Town is minimal. Insurance coverage for public art averages $2.50 to $7.00 per $1,000 so the impact on the Town's insurance is minimal as well. Recommendation: Based on compliance with the Public Art Guidelines, the enhancement to the Town's art collection, and the minimal fiscal impact, staff recommends approval of the public art acceptance contingent on approval by the Arts Council. Staff Recommendation: Approve Fiscal Impact: Yes $15,000 - up to this amount for cannon slab only Purpose of Item and Background Information: Seek Council approval for a new Concept Plan for the Veterans Memorial. Project Architect, Ross Bern, of RHB Associates, Architects, will be presenting the plan, which is supported by the local VFW and American Legion. Parks and Recreation and Community Development have reviewed the Concept Plan and have no outstanding issues. I A copy of the new Concept Plan is available in the Parks and Rcreation office should people wish to review the plan prior to the presentation at the Council meeting. Council approved the placement of a Veterans Memorial in Fountain Park in 1998. However, funding for the construction of a concrete slab that would have a demilitarized cannon placed on it was only recently approved during the current year's budget process. At that time the Council approved the expenditure of up to $15,000 to construct the concrete slab for the cannon. Currently there are financial commitments of $4,000 to the project architect under his contract, which has been reviewed by the Town Attorney. In addition, the architect has estimated the cost to construct the, cannon slab at approximately $5,000, utilizing some labor from the veterans groups. This would leave a balance of approximately $6,000. The VFW and the American Legion are also seeking donations of materials and or labor to help complete work on the project. They are also requesting Council approval to spend any remaining portion of the $15,000 to help complete additional work on the monument. Staff would recommend that the actual cost to construct the cannon slab be determined, either through quotes or bidding, before any additional work on the remaining element of the memorial are undertaken. A motion to approve the design plan is recommended.
