Purpose ofltem and Background°information: To obtain Council approval for the transfer of a Class 6 Bar
License at an existing business. The application complies with statutory and liquor license regulations and it
received a favorable recommendation from the Town Marshal based on his background investigation. The impact
on the number of liquor establishments in an area is minimal since it is an existing establishment. At the
manager's request in an attempt to reduce paper, full applications will not be reproduced for the packets. The
front page will be included for representative purposes and the full application is available for review in the
clerk's office.

Christopher Noteboom is requesting Council approval of a transfer of an existing Class #6 Bar
License for Nick Morgan's "The Sports Grill" located at 16737 East Parkview. The existing license
is currently held by Noreen Kurdzialek and issued to Fountain Bowl. Class 6 licenses allow bar
retailers to sell and serve spirituous liquors, primarily by individual portions, to be consumed on the
premises and in the original container for consumption on or off the premises. This is a quota
license, which means there are no "new" Series 06 licenses available. It must be purchased
privately. Once a Series 06 has been purchased, the buyer must apply for a transfer to have the
license put in his or her name, at the same or another location. Mr. Noteboom is purchasing this
license from Ms. Kurdzialek. Although liquor licenses are issued by the state, the Council is
required to forward a local recommendation to the state within sixty days after the application is
filed in the clerk's office.
Administration and the Town Marshal have reviewed the application. It meets the statutory
requirements for a Class 6 Beer and Wine license including the following:
- Licensing Compliance:

o Copy of floor plan on file with the application
o Purchase of license complete
o Premise posted for statutory twenty day period
o No written arguments received by the clerk's office
- Background Investigation:
o Has applied for a local business license
o No outstanding wants or warrants on the applicant
o Favorable recommendation from the Town Marshal (attached)
Based on statutory compliance and a favorable recommendation from the Town Marshal, staff
recommends approval.

The purpose of this memorandum is to endorse the attached Liquor License Application
from Christopher Noteboom. The application is for a transfer of a current license issued
to Fountain Bowl in Fountain Hills to Nick Morgan's "The Sports Grill" at the same
location of 16737 Parkview Avenue. It is my understanding that this application is
scheduled for consideration by the Council at their December 19`h meeting.
Background Investigation
This application represents a request to transfer an existing Class 6 liquor license
purchased by Fountain Bowl to Nick Morgan's "The Sports Grill" in Fountain Hills. The
license, which is held by Noreen Kurdzialek, is currently issued to the Fountain Bowl
located at 16737 Parkview Avenue in Fountain Hills. Under this application, it would be
transferred to Nick Morgan's "The Sports Grill" at the same location at 16737 Parkview
Avenue. A Class 6 license under state statute ARS 4-207A allows on premise sale of
liquor. This series license specifically prohibits sales within 300' of a church or school
and leaves the question of proliferation of liquor establishments up to the local
jurisdiction. A review indicates no schools or churches in the area, however, there are
nine liquor licenses held in the immediate area. These establishments include a class 07
(1), class 09 (1), class 12 (6), and a class 14 (1). Due to the proximity to the downtown
area, this is not a proliferation of establishments serving liquor in the area.
The applicant, Christopher Noteboom, is an Arizona resident residing at 5626 West
Butler Drive in Chandler. He complies with all state regulations relating to residency.
have conducted a background check that revealed no wants or warrants. The facility
itself will operate under the name Nick Morgan's "The Sports Grill". Additionally, I
have found that they have a business license, #5081, valid through 03-31-03.
Recommendation
This business, a sports bar, does not result in a proliferation of liquor establishments for
the area. Based on compliance with the provisions of ARS 4-207A, I recommend
Council approval.

Nancy Shina is requesting Council approval of a transfer of an existing Class #7 Beer and Wine
liquor license for Southwest Inn at Eagle Mountain located at 9800 North Summer Hill Boulevard.
Class 7 licenses allow beer and wine bar retailers to sell and serve beer and wine, primarily by
individual portions, to be consumed on the premises and in the original container for consumption
on or off the premises. This is a quota license, which means there are no "new" Series 07 licenses
available. It must be purchased privately. Once a Series 07 has been purchased, the buyer must
apply for a transfer to have the license put in his or her name, at the same or another location. Ms.
Shina is purchasing this license from Ms. Roberta Glenn. It is currently issued to a Denny's in
Phoenix. As the new owner of the license, Ms. Shina has applied to transfer the license to the
Southwest Inn. Although liquor licenses are issued by the state, the Council is required to forward a
local recommendation to the state within sixty days after the application is filed in the clerk's office.
Administration and the Town Marshal have reviewed the application. It meets the statutory
requirements for a Class 7 Beer and Wine license including the following:

The purpose of this memorandum is to endorse the attached Liquor License Application
from Nancy Shina. The application is for a transfer of a current license issued to a
Denny's Restaurant in Phoenix to the Southwest Inn at Eagle Mountain at 9800 N.
Summer Hill Boulevard. It is my understanding that this application is scheduled for
consideration by the Council at their December 19`h meeting.
Background Investigation
This application represents a request to transfer an existing Class 7 liquor license
purchased by Denny's Inc. to the Southwest Inn in Fountain Hills. The license, which is
held by Roberta Glenn, is currently issued to the Denny's Restaurant located at 2801 N.
Black Canyon Highway in Phoenix. Under this application, it would be transferred to the
Southwest Inn at Eagle Mountain at 9800 N. Summer Hill Boulevard in Fountain Hills.
A Class 7 license allows on premise sale of beer and wine as well as a beer and wine "to
go" privilege for take out purposes. A Class 7 license under state statute ARS 4-207A is
a "quota" license with no new ones available in Maricopa County. Therefore, a transfer
from one business to another is common with this classification. A Class 7 license is
prohibited within 300 feet of a church or school. The local jurisdiction also has to decide
whether or not there is a proliferation of liquor establishments in the vicinity. A review
of the location indicates no churches or schools in the vicinity and the closest
establishments authorized to sell liquor are class 06 (1), class 12 (2), and a class 09 (1).
The applicant, Nancy Shina, is an Arizona resident residing at 10202 N. 103`d Street in
Scottsdale. She and the owner, William Grace, comply with all state regulations relating
to residency. I have conducted a background check which revealed no wants or warrants.
The facility itself will continue to operate under the name "Southwest Inn". Additionally,
I have found that they have a business license, #3129, valid through 03-31-03.
Recommendation
This business, a restaurant/bar, does not result in a proliferation of liquor establishments
for the area. Based on compliance with the provisions of ARS 4-207A, I recommend
Council approval.

RECOMMENDATION:

The intersection of Fountain Hills Boulevard and El Lago Boulevard has been a controversial subject ever
since the east leg of El Lago was tied into Fountain Hills Boulevard. This area has had considerable build
up over the last five years with developments such as Ridgeview Apartments, Fountain View Village and
a new sanctuary for the Lutheran Church. The recent completion of the new Community Center and
Library have also impacted traffic volume for this intersection.
Presently, traffic signal warrants have been met under the Manual on Uniform Traffic Control Devices
(MUTCD). Warrant #1 deals with the amount of traffic volume in an 8-hour period on a major street
(Fountain Hills Boulevard) that is so heavy it affects minor intersecting streets (El Lago Blvd). This is
either with traffic delays or a conflict in entering or crossing the major street. Warrant #2 is somewhat
similar to warrant #1 except it deals with only a 4-hour period of traffic counts for volume only on the
major street and not the minor legs of the intersection. Based on recent counts of volume and speed, both
warrants 1 and 2 are met. The average vehicles per hour is 582 and the minimum under the warrant in
both cases is 480, therefore satisfying the warrant analysis.
Staff estimates a cost not to exceed $245,000 for design and construction of this traffic signal. Under the
1998 Town Center II Final Plat stipulations, MCO Properties, Inc is responsible for 50% cost
participation (see attached commitment letter). This project has been approved in the '02-03 fiscal year
budget. Funding is identified in the appendix, under Section "Q", Development Fee Expenditures.
At this time staff is requesting approval of $24,700 to Burgess & Niple to provide professional services
for design, bidding and construction management (see attached Scope of Work). In the past staff has
utilized the services of Burgess & Niple, most recently for the traffic signal at Palisades and Avenue of
the Fountains, and was very satisfied with their traffic engineering services.
As an interim measure, it is recommended by the MUTCD that a 4-way stop be installed previous to the
installation of a traffic signal. In the attached letter from Burgess & Niple, they concur that this protective
measure should be installed. Staff feels that this will also assist the contractor during construction and
prepare the traveling public for the future signal. Under the Town Code, Section 12-2-2, Traffic Control
Devices, the Town Manager can direct the placement of these devices when required.
Staff, therefore, recommends the approval of $24,700 to Burgess & Niple for professional services.

SCOPE OF SERVICES
Burgess & Niple (B&N) is pleased to submit this scope of service to provide traffic -engineering services
for the design of a traffic signal at the intersection of Fountain Hills Boulevard and El Lago Boulevard for
the Town of Fountain Hills (Town).
PROJECT DESCRIPTION
This project will provide updated contract plans and specifications for the construction of a traffic signal
at the Fountain Hills Boulevard and El Lago Boulevard intersection.
BASIC SERVICES
Design Phase
The work to be performed in this contract includes completing the Town of Fountain Hills signal plans.
B&N proposes to perform the following Basic Services upon receipt of authorization to proceed:
1. Obtain available engineering data, including traffic counts, AutoCAD signal design files, construction
plans, aerial mapping, right-of-way plans, etc. from the Town.
® 2. Conduct a field review to verify the planimetric data shown on the existing signal plan prepared by
the Town.
3. Conduct a field review to obtain curb and driveway locations, as well as storm, sanitary, and water
lines in the vicinity of the proposed signal poles. The location of underground utilities will be shown
according to locations provided to B&N by the individual utility companies having facilities within
the construction area.
4. Prepare updated construction plans for the construction of the traffic signal described above. The
design will provide for mast arm type signal supports, an emergency vehicle -actuated traffic signal
preemption system and traffic -actuated operation.
5. Prepare a traffic control plan including upgrading signing and pavement marking at the project
intersection as needed to comply with the "Manual of Uniform Traffic Control Devices" (MUTCD).
6. Review standard front end documents prepared by the Town. Prepare special provisions for the Town
to add to the front end documents and review the bid package.
7. Submit preliminary traffic signal and traffic control plans and special provisions to the Town for
review.
8. Final plans will be prepared in accordance with the Preliminary Review comments and resubmitted to
the Town for final approval.
9. Reproducible final plans will be submitted to the Town. The final product will become property of
the Town.

to the Town.

following receipt of the Town's authorization to proceed.

Staff recommends approval, and to direct staff to sign, the traffic signal participation agreements for:
• Palisades Boulevard/Palomino Boulevard/Eagle Ridge Drive

• Release of various Developer traffic signal requirements (as per the attached map)
Over the past decade, the Town has placed (or will place) several varying (overlapping) participation
stipulations, on several different developer entities. These participation stipulations have several differing
expiration dates, and regard several different traffic signals along or tributary to Palisades Boulevard going
southwest from Golden Eagle Boulevard. None of these traffic signals have been designed or constructed to
date. The entities and their subdivision projects include:

• Adero Canyon (formerly known as Eagles Ridge North)
• Eagle's Nest
(Note: Adero Canyon and Eagle's Nest — the plat stipulations referenced this anticipated Participation Agreement).
• Eagle Ridge (a Scottsdale subdivision)

• CopperWynd Estates (a Scottsdale subdivision)

Staff has negotiated 3 unified participation agreements with those developers regarding a:
• Traffic signal at the Palisades Boulevard/Palomino Boulevard/Eagle Ridge Drive intersection.
• Traffic signal at the Palisades Boulevard/SunRidge Drive intersection.
• Release of various previous traffic signal commitments along or tributary to Palisades
Boulevard southwest of Golden Eagle Boulevard.
The above traffic signal agreements commit the developers to a total of 50% of these two future estimated
traffic signal costs, for 5-years following Council approval of the agreements. Although not a rigorous
determination of nexus and proportionality, the 50-50 cost split between the Town and developers has been

used for all the Town's past -shared projects. The 50-50 cost split provides the Town (who will manage the
projects) incentive to not put in unneeded traffic signals (even if they do meet a warrant), and to not put in
marginally needed traffic signal features.
The two Traffic Signal Agreements allow an individual developer to fulfill its commitment by making a
fixed early payment amount any time prior to being notified by the Town that a traffic signal warrant had
been met, and that the Town intended to begin design and construction of the traffic signal. (Based on
discussions with the developers, we consider it somewhat likely that SunRidge Canyon LLC will make their
specified early payments.)
The individual developers negotiated the split -out of their 50% participation amongst themselves.
Presumably, they considered the Town's initial proportionally split -out calculation, extension/shortening of
the various commitment durations, perceived value to the various projects, somewhat questionable ability of
the Town to enforce the requirements on the Scottsdale subdivisions, and other factors.
In addition to the Participation Agreements at Eagle Ridge Drive and at SunRidge Drive, a third agreement
releases several developer traffic signal requirements, which will expire in October 2003 and are not
anticipated to likely be needed within the remaining original stipulation period.
We have attached an updated proposed traffic signals map showing the effect of these agreements.
We also hope and anticipate that these agreements will serve as a model for future Traffic Signal
Participation Agreement(s) in conjunction with the "downtown" area (Town Center III), and will likewise
unify the various existing and proposed developer commitments for several future traffic signals in that area.

Attached is the final version of a participation agreement between the Town and various
developers for installation of traffic signals. This agenda item was originally intended to be three
�.. separate agreements but, after reviewing the draft forms of those agreements, I quickly came to
the conclusion that it would be much less confusing for all parties involved if one agreement
addressed all of the issues.
The substance of this single agreement is nearly identical to the language of the three separate
agreements. Under normal circumstances, I would simply have requested that this item be
moved to a subsequent Council meeting so that you would have the full week to review the
agreement prior to the Council meeting. However, several of the developers included within this
agreement have asked that this item be considered by the Council prior to the end of this
calendar year so that they can make any contributions necessary prior to the end of the tax year.
I believe staff continues to recommend approval of this agreement as it will clarify the various
commitments relating to funding portions of certain traffic signals. Please do not hesitate to call
if you have questions.

The following is a very brief preliminary report on the research that has been completed to date
on preparing an RFP for Avenue of the Fountains in comparison to other Downtown
Development plan goals. One of the biggest challenges on presenting the requested information
is the lack of availability of staff time. Currently staff is able to designate approximately eight
(8) hours per week to this project. Staff's workload currently exists of the updates to the sign
ordinance (now in final draft), Scottsdale annexation/deannexation, a mix of assigned
development projects, Fountain Hills Resort General Plan Amendment and Zoning, preliminary
project meetings and processes, daily phone and counter inquiries.
The majority of the improvements for the downtown business district are based on aesthetics.
Quite a few options have been brought to the table and now it becomes a matter of which option
the Town of Fountain Hills and our business partners really want for our community. In order to
determine what it is that we want it is necessary for us to get an idea of how the RFP and other
downtown suggestions flow and work together. The following is a list of additional ideas for the
Downtown Development Concept.
Parking:
❖ Redesign Avenue of the Fountain to provide one car lane traveling in each direction.
❖ The Hyatt Palma Study states that the Town should acquire the currently privately
owned interior parking to accommodate special event parking. Acquisition of this
parking will not eliminate parking problems for the downtown business area, as
acquisition does not provide additional parking. In addition, the acquisition of this
parking would require that the Town pay for maintenance and upgrades to the
parking.
Pedestrian Activity:
❖ Widen sidewalks facing businesses on Avenue of the Fountains to create a sense of
place.
❖ Provide "clearly" marked pedestrian crossings to allow access from north to south
plat 208 and provide a sense of security in those crossings.

❖ Provide landscape buffering between Avenue of the Fountains and the sidewalk
providing shade and to act as a protection factor.
❖ Additional lighting that would fit with a theme in the pedestrian areas should be
installed.
❖ Gathering places should be encouraged in the median and throughout Plat 208. These
gathering places could include benches, tables, and areas for stroller parking, etc.
Fundin -
Identifying funding mechanisms will play a major role in any proposed action. Unfortunately,
due to budget cut backs across the nation (federal, state and private) funding is not as readily
available as it was just a couple of years ago. In addition, Fountain Hills average income
(approximately $85,000 annually) does not allow us to tap funds for economically depressed
communities. Most funding available is in the form or loans. It is suggested, due to the Town's
current financial situation, that grants be selected as the primary funding source for any
downtown development project. Funding source which have been identified by staff are as
follows:
Main Street — Fountain Hills does not qualify as a Main Street city and therefore does not
qualify for funding through the Arizona Main Street program. It is possible that there
may be funding through the National Main Street Program but it is very limited. Staff
continues to research this option.
State Funds —State Funds are limited right now. The annual funding cycle begins in
February or March. Staff will continue to monitor this program.
Maricopa County — Most of the available funding is based on a Capitol Improvement
Plan developed by Maricopa County of Governments. This plan is developed by the
communities submitting their improvement needs and assigning a priority to them. Staff
is not aware that the development of Plat 208 has been submitted or would qualify for
this program. Staff will work with Maricopa County of Governments to determine
whether or not downtown development is a qualifying project.
Private/Public Organizations— Organizations exist that provide matching grants for public
art. The process to receive funds varies between organizations and in most cases is
available only to non-profit organizations. Staff will continue to research this option.
Local — The development of a local Assessment District or special tax may be an option.
Staff has not completed this research.
The above funding research indicates that the Town of Fountain Hills will need to rely on the
funding currently available in the Downtown Development portion of the Local Sales Tax. Per
Julie Ghetti, Finance Manager, current balance of this fund is $492,037. Project growth (shown
below) of this fund is speculative in nature, will be affected by the local economy and is based
on no expenses being drawn from this fund.

The public has asked for the Town of Fountain Hills to take on the primary responsibility for
Economic Development and the development of the Avenue of the Fountains area. Staff would
like to point out that the Avenue of the Fountains area is not the only project or issue that these
funds are designated toward. These funds are for the function of Economic Development for the
entire community.
It has been suggested that a full time staff person should be designated for Economic
Development. The amount previously budgeted for the position is $120,000, including benefits,
supplies, etc. Thus staff for the time frame indicated above would be approximately $360,000.
An award for an RFP on the Avenue of the Fountains will cost about $25,000 depending on the
detail required for the concept. This RFP is for a concept plan only, not for the improvements.
Based on this cost in relationship to the above funding staff sees no problems moving forward
with the RFP.
Maintenance and cost of operations, of any improvement in the downtown development area,
will be an additional cost to the above fund.
Summary —
Staff understands that Council and the community are anxious to move forward with the
downtown development. Staff has begun drafting a Request for Proposal on the Avenue of the
Fountains Median. The next step in this evaluation will provide a comparison on the benefits
and cost of each improvement as well as Staff's recommendation on how to proceed. This
recommendation should be available to Council by February 21, 2003.
