prior to the beginning of the 6:30 p.m. Regular Session of the Fountain Hills Town Council.
PROCEDURE FOR ADDRESSING THE COUNCIL
Anyone wishing to speak before the Council must fill out a speaker's card and submit it to the Town Clerk
prior to Council discussion of that Agenda item. Speaker Cards are located in the Council Chamber
Lobby and near the Clerk's position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Clerk or the Mayor.
At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior
to commenting and to direct their comments to the Presiding Officer and not to individual Council
Members. Speakers' statements should not be repetitive. If a speaker chooses not to speak when called,
the speaker will be deemed to have waived his or her opportunity to speak on the matter. Speakers may
not (i) reserve a portion of their time for a later time or (ii) transfer any portion of their time to another
speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue during the Public
Hearing.
Individual speakers will be allowed three contiguous minutes to address the Council. Time limits may be
waived by (i) discretion of the Town Manager upon request by the speaker not less than 24 hours prior to
a Meeting, (ii) consensus of the Council at Meeting or (iii) the Mayor either prior to or during a Meeting.
Please be respectful when making your comments. If you do not comply with these rules, you will be
asked to leave.

Purpose of Item and Background Information: At the request of the Council the Town Prosecutor, Iacovino &
Kayler, have provided the Town with an engagement letter for Fiscal Year 2004-05 outlining scope of work, fee,
and terms. Additionally, the Prosecutor has agreed to provide the Town with a monthly itemized statement of
work performed in a format that provides adequate detail regarding services rendered.

Re: Prosecution Services for Fiscal Year 2004-2005
Dear Tim:
The firm of Iacovino and Kayler appreciates the opportunity to
continue serving the people of Fountain Hills as your Town Prosecutor. As we begin
our fourteenth year of service to the Town, we are ready to meet the challenges facing
the Town's criminal justice system. We are happy to have played a role in the
operations of the Fountain Hills Municipal Court which continues to set the standards
for limited jurisdiction courts throughout Arizona. During the upcoming year, we
look forward to participating in the new Teen Court program and to continued
successful enforcement of Town Code cases referred to us by the new Code
Enforcement Services department.
Our budget proposal corresponds to the Town's approved budget
allocation for the upcoming fiscal year as follows: We will continue to provide the
highest quality prosecution services for fiscal year 2004-2005 at a flat rate of $110,000
for the year, paid in equal monthly installments of $9,166 per month due and payable
on the first of each month commencing July 1, 2004. Included in the flat rate are
attorney time for the prosecution of criminal matters and appeals, certain civil
infractions, legal assistant services, file management and other clerical services,
materials, normal copying charges, postage and supplies. On or about the first of each
month, beginning in August, we will provide the Town with a report itemizing all
legal services rendered during the previous month. We will customize a report format
that itemizes the time spent on behalf of the Town with detailed information in the
most meaningful manner possible. Upon your review of the itemized report, we
welcome your feedback and suggestions concerning the new format.

Re: Professional Liability Insurance for Services Rendered as Town Prosecutor
I am writing this memorandum in response to your request, forwarded
from one or more members of the Town Council, regarding professional liability
insurance covering this firm's activities and services as Town Prosecutor for the Town
of Fountain Hills. As you know, during the past thirteen years, this firm has never
carried insurance covering our activities as prosecutors nor has the town ever required
the same. This is with good reason. As prosecutors, we are afforded by 11w absolute
immunity from civil liability for all actions taken in our official capacity which fall
within the scope of our authority.
Approximately one year ago, the town made inquiries of us about the
availability of professional liability insurance covering our activities as prosecutors. I
contacted my firm's insurance agent who, in turn, contacted several insurance carriers
who write professional liability policies. My agent responded, indicating that there are
no carriers that write policies covering prosecution services since such services do not
give rise to any insurable risk.
A prosecutor's immunity from civil liability is well settled and
universally accepted in American jurisprudence. The doctrine was first pronounced in
Griffith v. Slinkard, 146 Ind. 117, 44 N.E. 1001 (1896). That case involved a local
prosecutor who added an individual's name to a grand jury indictment after the grand
jury had refused to indict that person, causing him to be arrested and repeatedly forced
to appear in court. Despite allegations of malice, the civil action subsequently brought
against the prosecutor was dismissed on the grounds that the prosecutor was absolutely
immune. Id., at 122, 44 N.E. at 1002. Thirty years later, the federal courts examined
the issue in Yaselli v. Goff, 12 F.2d 396 (1926). The Yaselli court held that:
"(A prosecutor) in the performance of the duties imposed
upon him by law, is immune from a civil action for malicious
prosecution based on an indictment and prosecution, although
it results in a verdict of not guilty rendered by a jury. The
immunity is absolute, and is grounded on principles of public
policy." Id. at 406.
In 1976, the United States Supreme Court clearly enunciated the
common law doctrine of prosecutorial immunity in Imbler v. Pachtman, 424 U.S. 409
(1976). In Imbler, the Court discussed the history and policy behind the doctrine of
prosecutorial immunity and held that absolute immunity applies not only to common

law causes of action but also to statutory actions including Sec. 1983 suits. The Court
explained that the prosecutor's immunity from suit is based upon the concern that
"harassment by unfounded litigation would cause a deflection of the prosecutor's
energies from his public duties, and the possibility that he would shade his decisions
instead of exercising the independence of judgment required by his public trust." Id.
at 423. The Court further espoused the public policy underlying prosecutorial
immunity as follows:
"A prosecutor is duty bound to exercise his best judgment both
in deciding which suits to bring and in conducting them in
court. The public trust of the prosecutor's office would suffer
if he were constrained in making every decision by the
consequences in terms of his own potential liability in a suit
for damages." Id. at 424-425.
Since the decision in Imbler, both federal courts and Arizona state
courts have consistently reaffirmed the absolute immunity of prosecutors when acting
within the scope of their authority. See Siano V. Justices of Massachusetts, 698 F.2d
52 (1st Cir. 1983); Demery v. Kupperman, 735 F.2d 1139 (9th Cir. 1984); Gobel v.
Maricopa County, 867 F.2d 1201 (9th Cir. 1989); Challenge, Inc. v. State Ex Rel.
Corbin, 138 Ariz. 200, 673 P.2d 944 (App. 1983). The immunity applies to all actions
and activities with some connection to the general matters committed to the
prosecutor's control or supervision. Gobel, 867 F.2d at 1203. This includes, but is not
limited to, the charging of defendants, plea negotiations, drafting and arguing of
motions, presentation of evidence, the conduct of trials and appeals, as well as actions
performed in connection with the preparation of a case including investigative or
administrative functions. Gobel, 867 F.2d at 1203-1204; Demery, 735 F.2d at 1143.

The above authorities should answer and satisfy any questions or
concerns that you or any members of our Council may have concerning the lack of
availability or necessity of professional liability insurance covering this firm's actions
as Town Prosecutor. If you need any further information on this subject, please

David and Wendy Jindra are requesting Council approval of a new Class 12 liquor license for the
Split Window Diner located at 11056 N. Saguaro Blvd. A Class 12 license is for restaurant use
only. Statute requires ,that 40% of the business establishment be devoted to serving food and that
liquor sales be incidental to the food service.
Public Works and the Maricopa County Sheriff's Office have reviewed the application. It meets the
statutory requirements for a Class 12 liquor license.
The applicants are Arizona residents and have no outstanding wants or warrants. The applicants .
have a Fountain Hills business license on file.
Based on statutory compliance and a favorable recommendation fr6m the MCSO, staff ,
recommends approval.

The purpose of this memorandum is to provide an endorsement of the attached liquor license application
for Split Window Diner located at 11056 N. Saguaro Blvd. Fountain Hills, AZ. 85268.
Background Investigation:
This application is for a new Class 12 liquor license under the specifications of ARS 4-205.02. A Class 12
license is for restaurant use only.
The statutes require that 40% of the business establishment be devoted to serving food and that liquor
sales be incidental to the food service. An inspection of the diagram provided, clearly shows that the
establishment will primarily be devoted to the service of food.
A Class 12 license is exempt from restrictions relating to churches, schools and nearby liquor
establishments.
The applicants, (David and Wendy Jindra) are Arizona residents under the provisions of ARS Title 28. I
have verified that there are no outstanding wants or warrants for these parties.
Recommendation:
Based on compliance with Title 4 relating to the Class 12 liquor license, the fact that the applicants are
Arizona residents with no wants or warrants, and there is a current Fountain Hills business license on file,
I recommend approval.

The licensee fails to keep for two years and make available to the department upon reasonable
request all invoices, records, bills or other papers and documents relating to the purchase, sale
and delivery of spirituous liquors and, in the case of a restaurant or hotel -motel licensee, all
invoices, records, bills or other papers and documents relating to the purchase, sale and _delivery
of food.
A.R.S. §4-205.02(G)
For the purpose of this section:
1. "Restaurant" means an establishment which derives at least forty percent (40%) of its
gross revenue from the sale of food.
2. "Gross revenue" means the revenue derived from allsales of food and spirituous liquor on
the licensed premises, regardless of whether the sales of spirituous liquor are made under a
restaurant license issued pursuant to this section or under any other license that has been issued
for the premises pursuant to this article.

Policy Criteria
The Rancho Montana HOA has requested the Town to construct a speed hump on Woodside
Drive, to be located approximately 81' east (north) of the intersection of Britt Court and
Woodside Drive, and has agreed to pay the cost (not.to exceed $2,000) for the work. (See
attached request letter from Art Zacchia, HOA President, and the HOA Board Meeting Minutes.
The property owners adjacent to the proposed speed hump have all signed.the attached Petition,
in accordance with the Town's requirements.) The Rancho Montana Board has requested that. the.
Council accept the following minor deviations from the. Neighborhood Traffic Management
Process (Speed Hump Policy):
• Accept the HOA Board vote instead of individual homeowners signatures, since Staff had
defined the affected area tote contiguous with the, Rancho Montana HOA boundary (Art.
Zacchia, President, provided the attached HOA Board minutes, requesting the speed
hump, and agreeing to pay for.its cost.)
• Accept the 85%-ile speed of 28 mph, slightly below the 30 mph requirement specified in.
the Speed Hump Policy.
• Accept the street grade at this location of 10.2%, which slightly exceeds the maximum
10% street grade specified in the Speed Hump Policy.
Staff will contract for the asphalt speed hump construction; signing and striping will be placed
by the Town's Street Department; the Rancho Montana HOA will be paying the costs of the
work (not to exceed $2,000).
Staff recommends Council approval of these minor deviations from the Speed Hump
Policy.

Sir, in your letter dated 3/17/04, you stated that, after performing studies of the
requirements for a city funded speed hump installation, Rancho Montana did not meet the
requirements. Further you stated that if the Rancho Montana HOA wanted to have a
speed hump installed at their expense, 4 requirements had to be met.
First, a 75% approval by the Board of Directors would need to be obtained. In the
attached Meeting Minutes dated April 151h, 2004 under Old Business item #2, "the Board
made a motion to accept the cost of installing a speed hump on Woodside dr.".
Second, They would need a waiver from City Council for the installation of the speed
hump since they do not meet the requirements. The project would be funded by the
Rancho Montana HOA in an amount not to exceed $2000.00 but under the complete
control and supervision of the City Engineering Dept.
Third, a location of the speed hump needed to be determined. The location was agreed
upon by yourself and members of the HOA landscaping committee on June 9th, 2004 at
approximately 3:34 PM. The location will be approximately 81 ft. east of the intersection
of Britt Ct. and Woodside Dr. traversing Woodside Dr. from the properties 13806 owned
by Jack and Carol Hendricks and 13809 owned by Art Zacchia.
Fourth, A signed Petition to Modify Traffic Flow by all property owners within 50 feet of
the speed hump would be required, (See attached)

At our last H.O.A., the Rancho Montana Board of Directors approved an
expenditure of $1600.00 to $2000.00 for the installation of a speed hump on
Woodside Dr. at a location yet to be determined. I will fax you copies of
the letters from Randy Harrel, the Town Engineer, that notes the
requirements for this project to be acted on. One letter, dated 10/31/03,
points out the requirements for the city to pay for this and their
subsequent analysis. The second letter, dated 3/17/04, notes the
requirements for our H.O.A. to pursue this at our cost having not met the
requirements set forth by the city.
We have met 1 of the 4 requirements noted in the 3/17/04 letter, that being
the approval by at least 75% of the Board of Directors. Still needed is a
waiver of the speed requirements by the City Council, the location of the
speed hump on Woodside Dr. and approval of the location of the speed hump by
all homeowners within 50 ft. of its eventual location.

MCO has requested to change the private street names in their Eagles Nest Subdivision, as
shown on their attached map. The street names were selected by them to present a "theme" in
each parcel plat. Staff has reviewed the street names, and has no objection to the name changes
presently requested.
In accordance with Section 310 of the Subdivision Ordinance "... the subdivider may propose a
name based on the Town of fountain Hills street naming policy. All names are subject to final
approval by Town staff at the technical review stage."
Engineering and Fire staff have reviewed the proposed street names. This is a private -street,
gated subdivision with specific animal name themes. At MCO's request Staff is agreeable to
three very short cul-de-sacs (each with 2-4 lots which will likely be addressed from the access
street) to have the same root street name as the access street to the cul-de-sac, changing only the
suffix name. (e.g. in Parcel I — Javalina TRAIL and Javalina COURT.) Also, Staff is agreeable
to allowing the 2 houses in the very short cul-de-sac west of White Wing Court (formerly Lost
Canyon Court) to be given Mountain Parkway street addresses.
Parcels 1, 2, 3, 4, 5, & 11 have not presently been recorded at Maricopa County; their street
names will be placed on the plats, prior to the final subdivision plat review by the Council.
Parcels 6, 7, 8, 9, & 10 have previously been recorded with the Maricopa County Recorder. Staff
will notify the appropriate public safety, utilities, and mapping entities of the street name
changes for these recorded plats, in accordance with our standard procedure for changes in
recorded street names.
Staff recommends approval of the street name changes in Eagles Nest, as requested by
MCO, as shown on the attached map.

during this fiscal year that the Town budget $25,000 to the Veterans Memorial Fund so that the groups could
complete their work on the project.
Some $40,000 was originally approved several years ago but due to budget restrictions that amount was reduced
to $15,000. The groups asked that the balance of $25,000 be set aside for the project this year. This request was
approved and is in the 2004 - 2005 budget. This action will simply release the money to the fund.

The Town orney advised Staff on 7-29-04 that the construction haul route for Eagles Nest
will be on the Town Council agenda, due to Councilmember request.
Truck routes within the Town are governed by Section 12-2-12 of the Town Code ("Commercial
Vehicles Prohibited on Certain Streets"). The truck routes are listed in that Section, and trucks
are only permitted on other streets to make a pick-up or delivery via the shortest route. The
nearest truck route to the Eagles Nest subdivision presently is Palisades Blvd (map attached).
Staff was aware that a major amount of trucks hauling materials to (or from) Eagles Nest would
be required through the construction process. Item 12 (9`h bullet point) of the Eagles Nest
Preliminary Plat Staff report stipulations (dated 8-17-01) indicated "Provide special construction
traffic haul routing controls and conditions for Golden Eagle Blvd., Sierra Madre Drive, and
Sunridge Drive." Staff and MCO determined that the preferable construction haul route to
Eagles Nest from Palisades Blvd. was northbound on Sunridge Drive going to Eagles Nest, and
southbound on Golden Eagle Blvd. coming out of Eagles Nest. The primary reasons for
designating the above haul route were as follows:
• Avoiding the turn onto Palisades from SunRidge Drive going southbound. The
sightline is marginal at this location for either left or right turns onto Palisades due to
the hillcrest on Palisades. Also, left turns onto Palisades must turn into a very short,
narrow acceleration lane (the acceleration lane was intended to be a temporary
measure when it was built, until a traffic signal is constructed at this location).
• Avoiding the steep uphill grades going north on Golden Eagle. A number of trucks
over the years have been unable to climb the steep grade going westbound east of
Cerro Alto, and so have had to back down that steep hill. For example, a truck
recently climbing that hill broke its drive axle, went backwards down the hill, and ran
off the road into a wash at the bottom of the hill near Marathon Drive, barely missing
major electrical switch and fuse cabinets.
• Avoiding the northbound traffic lanes directly adjacent to the High School and to
Golden Eagle Park.
• There are 103 lots fronting on Golden Eagle Blvd., versus only 19 lots fronting on
Sunridge Drive.
• Golden Eagle Blvd. has an old, inadequate pavement structural section, installed prior
to incorporation. Sunridge Drive has a thicker and newer pavement section,
structurally designed to be adequate for the present and future anticipated truck
traffic.
Eagles Nest Construction Truck Haul Route — Council Memo
Desert Canyon and Sierra Madre (14 fronting lots) are other possible haul routes, but
are not recommended by either Staff or MCO.
In late June of this year, MCO and Summit Estates indicated that they wanted to haul fill dirt
from Summit Estates to Eagles Nest. Staff's permit directed them to use the previously
determined haul route for that haul. When violations of the haul route were noted by our
Engineering Inspector, Staff printed maps for MCO's flagman at Eagles Nest to hand out to new
truckers, showing the approved haul route.
Staff had several complaints about the June/July fill dirt, construction truck haul on Sunridge
Drive traveling to Eagles Nest (including some complaints on days that there was no dirt haul
being made to Eagles Nest, but only to construct private, residential building pads, which is not a
violation of any Town restrictions).
Staff also received several complaints about the June/July construction truck haul on Golden
Eagle Blvd., particularly the "southbound" downhill stretch between Cerro Alto and Marathon.
We have directed Streets to install "Hill" signage for this roadway segment; those signs have
been installed.
MCSO had advised Staff that any designated construction haul route to Eagles Nest would be
difficult to enforce, as are our codified truck routes.
MCO is in agreement with using either the currently designated construction haul route to Eagles
Nest, or not placing any restriction on the haul route. Please note that had no specific restrictions
been in place during the Summit Estates to Eagles Nest dirt haul last month, the haul trucks
would likely have all used Sunridge Drive going both directions — since that is the shortest route,
instead of only going northbound. The residents along Sunridge Drive would have actually had
double the amount of trucks on their street, and the trucks would have had to make a more
dangerous turn to enter Palisades. Or, had Staff aggressively, literally enforced Section 12-2-12
of the Town Code without a designated haul route, trucks would have been required to use
Golden Eagle Blvd. from Palisades to Sierra Madre, then the full length of Sierra Madre, then the
north segment of Sunridge Drive — going both directions
Staff recommends that the designated construction haul route from Palisades Blvd. for the
Eagles Nest subdivision continue to be Sunridge Drive northbound and Golden Eagle Blvd.

AGREEMENT between
THE TOWN OF FOUNTAIN HILLS and
THE SCOTTSDALE CONVENTION & VISITORS BUREAU
THIS AGREEMENT made and entered into on '45 , 2004, by and between the TOWN
OF FOUNTAIN HILLS, a municipal corporation of the State of Arizona (the "Town"), and the
SCOTTSDALE CONVENTION & VISITORS BUREAU (the "Scottsdale CVB").
The parties agree as follows:
1. Scope of Services. The Scottsdale CVB agrees to perform the tourism and advertising services
(the "Services") to the Town, through the Town's designated destination marketing organization,
the Fountain Hills Chamber of Commerce Tourism Bureau (the "FHCCTB"), as more
particularly set forth in Exhibit A, attached hereto and incorporated herein by this reference.
2. Compensation. Town shall pay the Scottsdale CVB for services rendered herein one third (1/3)
of its three percent (3%) privilege tax upon the business activity of any hotel charging for
lodging or lodging space to any transient levied pursuant to § 4A-447 of the Fountain Hills Town
Code, but not to exceed a total sum of Forty Thousand ($40,000) during the term of this
Agreement. If such tax collected during the Term of this Agreement is less than Forty Thousand
Dollars ($40,000), the monthly amount(s) due hereunder shall be revised and reconciled as
necessary to reflect one-half of such actual tax collections.
Sums due herein are payable in two (2) equal payments of $ 20,000.00. The first installment is
due on or before August 15, 2004; and the second installment is due on or before February 15,
2005, following receipt and approval of the Scottsdale CVB's invoice.
The Scottsdale CVB will substantiate and provide documentation satisfactory to the Town for all
payments made by the Town and expenditures made pursuant to this Agreement.
3. Performance Reports. The Scottsdale CVB will report on the performance of its tourism and
convention program and submit a report to the Town no later than thirty (30) days after the
termination of this Agreement. The report shall include an analysis of the effectiveness of the
program.
4. Audit and Records. The Town may review and audit the Scottsdale CVB's records related to
the expenditure of funds under this Agreement for the purpose of ensuring compliance with this
Agreement and applicable law. The Scottsdale CVB agrees to reimburse the Town for any
expenditures it makes utilizing funds pursuant to this Agreement which are not for the tourism
and convention purposes stated herein.
Law. The Scottsdale CVB shall at all times herein comply with all laws of the Town of Fountain
Hills, the County of Maricopa, the State of Arizona and the United States of America. This
Agreement shall be governed by and construed in accordance with the laws of the State of
Arizona and the Town of Fountain Hills. The Town has determined that this Agreement is for a
public purpose benefiting the welfare of the Town and its citizens, and that the public receives a
valuable and reasonable consideration for the funds expended herein.

6. Insurance. The Scottsdale CVB shall provide the Town with a Certificate of Insurance form
with coverages and limits acceptable to the Town.
Independent Contractor. The Scottsdale CVB is an independent contractor and shall perform
the services described herein and other duties as may be mutually agreed upon in writing
between the parties.
8. Term. The term of this Agreement shall be from the effective date shown above, expiring on
June 30, 2005, unless sooner terminated as provided herein. Either party may cancel this
Agreement at any time with thirty (30) days' written notice to the other party. Upon termination,
amounts owed, according to the terms of the Agreement, will be paid.
9. Sole Agreement. No other agreements or representations of any kind have been made by and
between the parties hereto.
10. Conflict of Interest. This Agreement is subject to cancellation pursuant to A.R.S. § 38-511.
11. Assignment Prohibited, Agreement Binding. This Agreement shall extend to and be binding
upon the heirs, administrators, executors, successors and permitted assigns of the respective
parties. Scottsdale CVB shall not assign this Agreement or any rights thereunder.
12. Notices. All notices pursuant to this Agreement shall be in writing and shall be deemed properly
given if sent by facsimile, personal delivery, by certified mail or by courier, postage prepaid,
addressed to the addresses set forth below. Notice shall be deemed effective on the date of actual
receipt or five (5) days after the date of mailing, whichever is earlier.
13. Amendments. Amendments to this Agreement shall be made in writing and executed by the
parties below.
14. Fiscal Year Appropriation. The parties agree that this Agreement does not obligate the
expenditure of Town funds beyond the close of the fiscal year in which this Agreement is
executed. Such funding for a future fiscal year is dependent on appropriation by the Town.
15. Default, Force Majeure. If any party fails to observe or perform any of the provisions of this
Agreement and such failure is not cured within twenty (20) days after notice by the affected
party, then such party shall be in default and without further notice, the affected party may at any
time thereafter continue this Agreement and recover damages resulting from the default or effect
a cure on the defaulting party's behalf and all costs and expenses so incurred by the curing party
together with interest at the rate of ten percent (10%) per annum shall be due and payable by the
defaulting party. However, if a default cannot reasonably be cured within twenty (20) days, the
defaulting party shall not be in default of this Agreement if it commences to cure the default
within such twenty -day period. If any party is unable to perform hereunder as a result of acts of
God, war, national disasters, strikes, fire or other comparable events, or as a result of any lawful
order issued by the United States government or an official of the State or Arizona or Town, or
for any reason beyond the control of the parties, then this Agreement shall be suspended during
such period and for as long as such conditions shall exist and the term hereof shall not be
extended.

SCOPE OF SERVICES
During the term of the Agreement, the Scottsdale CVB agrees to provide the following services to the
Town, through the FHCCTB:
Marketing —Advertising & Co-ops
• The FHCCTB will receive a $1,000 advertising credit from the Scottsdale CVB to use for
sponsorships of 2004 — 05 Scottsdale CVB IRIS e-mail blasts to customers in the Scottsdale
CVB's database.
• The FHCCTB and the Scottsdale CVB-member businesses in Fountain Hills will be eligible to
participate in the Scottsdale CVB's 2004 — 05 cooperative marketing program and at the same
rates offered to the Scottsdale CVB-member businesses located in Scottsdale and Paradise
Valley.
• The Scottsdale CVB will include Fountain Hills' events and tourism news whenever possible within
the Scottsdale CVB's monthly tourism advertorial page in the Scottsdale Republic.
Marketing —Col lateral
• The Town will be listed on the 2005 Discover Scottsdale destination guide cover in conjunction
with other entities with which the Scottsdale CVB has destination marketing agreements —
circulation 175,000.
• The FHCCTB's logo and copy describing Fountain Hills' tourism offerings will be included within
the destination guide —the amount of copy will be determined by the Scottsdale CVB.
• The FHCCTB will receive a half -page display ad in the 2005 Discover Scottsdale destination guide
(valued at $5,035).
• The Scottsdale CVB-member businesses in Fountain Hills will be listed wherever deemed
appropriate by the Scottsdale CVB within the 2005 Discover Scottsdale destination guide.
Visitor Centers
• The Scottsdale CVB will distribute the FHCCTB's brochures to visitors at the Scottsdale CVB
visitor centers.
Marketing —Web Site
• The FHCCTB's logo will be listed on the home page of the Scottsdale CVB's web site
(www.experiencescottsdale.com) with a link to the FHCCTB's web site.
• The FHCCTB can provide up to 200 words of copy and photos for a Fountain Hills page that will
be created on the Scottsdale CVB's web site. This web page will contain a link to the FHCCTB's
web site. This page will remain on the Scottsdale CVB's site for the duration of this Agreement.
• The Scottsdale CVB-member businesses in Fountain Hills will be listed wherever deemed
appropriate by the Scottsdale CVB within the Scottsdale CVB's web site for the duration of this
agreement.
Sales
• SCVB will provide the FHCCTB with sales leads, site inspections and FAM participation whenever
possible.
• The Town will be listed on the 2005 Scottsdale Meeting & Travel Planners Guide cover in
conjunction with other entities with which the Scottsdale CVB has destination marketing
agreements —circulation 15,000.
• The FHCCTB will receive a half -page formatted ad in the 2005 Scottsdale Meeting & Travel
Planners Guide (valued at $1,095).
• Fountain Hills and Scottsdale CVB-member businesses in Fountain Hills will be listed wherever
deemed appropriate by the Scottsdale CVB within the 2005 Scottsdale Meeting & Travel Planners

• The Scottsdale CVB will provide the FHCCTB with a comprehensive list of travel industry and
meetings trade shows the Scottsdlae CVB plans to participate in between July 1, 2004 and June
30, 2005. The Scottsdale CVB will take one Fountain Hills brochure, provided by the FHCCTB, at
no charge to the Town, to as many as five trade shows that are mutually agreed upon by the
Scottsdale CVB and the FHCCTB.
Membership
• Fountain Hills' resorts and hotels will be allowed to become the Scottsdale CVB members and at
the same membership rates paid by Scottsdale and Paradise Valley hotels and resorts. The
Scottsdale CVB membership benefits provided to Fountain Hills' resorts and hotels are separate
from this agreement. Fountain Hills' resorts and hotels that are not Scottsdale CVB members will
not receive the Scottsdale CVB membership benefits and will not be listed in the Scottsdale CVB's
promotional materials.
• Fountain Hills' tourism attractions and other eligible businesses can become Scottsdale CVB
members at the same membership rates paid by Scottsdale and Paradise Valley businesses.
The Scottsdale CVB membership benefits provided to Fountain Hills' businesses are separate
from this agreement. Fountain Hills' businesses that are not Scottsdale CVB members will not
receive Scottsdale CVB membership benefits and will not be listed in Scottsdale CVB promotional
materials.
Public Relations
• Scottsdale CVB-member resorts, hotels and businesses in Fountain Hills will be promoted in the
Scottsdale CVB's public relations materials as deemed appropriate by the Scottsdale CVB for the
duration of this agreement.
Media
Scottsdale CVB staff will bring media on site inspections and FAMS to Fountain Hills' tourism -
related businesses whenever possible.
Scottsdale CVB staff will send press releases on Fountain Hills' tourism activities, when
appropriate, to national media outlets while coordinating with the Town's and the FHCCTB's public
relations consultants.
Reporting
• Scottsdale CVB will report on its efforts on the Town's behalf to the Fountain Hills Town Council
and Fountain Hills Chamber of Commerce Tourism Bureau.

Regular Agenda Wording: Consideration for approval of a "Water Garden Design" concept plan for The Avenue of the
Fountains.

Purpose of Item and Background Information: On July 17, 2004 the Avenue of the Fountains Concept Plan was
presented to the Town Council for approval. This Council Meeting was well attended by the community and included
considerable public comments and concerns about the Avenue of the Fountains project. Based on their interaction with the
participants, the Town Council tabled the agenda item.
The Town Council requested staff to incorporate the community and the downtown business areas into the Avenue of the
Fountains concept plan by way of public meetings. The goal to be accomplished through the public meeting process was to
present information and review the phases of the Avenue of the Fountains project with the interested parties and to allow for
public participation and input into the project. This direction was accomplished through four public meetings.

Recent History
On June 17, 2004 the Town Council tabled the motion to approve the concept plan for the
Avenue of the Fountains and directed staff to review the project with any and all concerned
citizens in the community.
July 8, 2004 — Community Center, 6:00 P.M. Q6 people attended)
This was the first of four community meetings. Considering the comments from the public and
the phone calls that followed, staff considered the following for Phase I:
Avenue of the Fountains — Water Garden Project
Since this project is located on the Avenue of the Fountains and the town was founded on a
"fountain feature" the general consensus was to move forward with the "Water Garden" concept.
The sidewalk widening and pavement narrowing were omitted from the original plan since they
were a concern with those attending the Council meeting. The entire project is consolidated into
a two-phase project from the original four phases presented by the consultant. Phase I would
consist of the north side streetscape improvements (Saguaro to La Montana) providing the Town
of Fountain Hills the opportunity to negotiate similar development criteria for the south side
streetscape.
July 14, 2004 — Avenue of the Fountains, 9:30 A.M. (20 people attended)
At this meeting the sidewalk texturing issue and crosswalk/traffic calming issues were discussed
in depth. Through the meeting process the majority of the concerns entailed the sidewalks being
well maintained after the staining and texturing process and the crosswalks needed to be only
pedestrian access and not "speed humps". Also, the direction to consider either one or two
crosswalks per block was stated. There was much concern that traffic calming by virtue of
raised crosswalks would deter traffic, not slow the traffic.
July 15 — Community Center, 6:00 P.M. (46 people attended)
y Palm trees, shade trees, design criteria, project funding and decision making by the committee
were all the topics of the evening. Some of the palm trees would be removed for the installation
of the shade structures and some palms that are dead could be replaced with shade trees as a
compromise on this issue. The RFP process will provide the design criteria. If the Avenue of
the Fountains concept plan becomes a reality there can be additional public meetings for
information purposes.
July 20, 2004 — Community Center, 6:00 P.M. (26 people attended)
This was our last meeting. The participants understand the plan and were ready for the project to
become a reality. Questions about lighting the palm trees as a temporary lighting amenity for the
Avenue of the Fountains surfaced during this meeting, but there was no solution provided by
staff.
Summary
Below is an outline of Phase I and Phase II of the proposed concept plan as well as estimated
dollars for the Avenue of the Fountains. There is $150,000.00 in the current budget for design
and engineering of this project. Actual construction and improvement expenditures would not be
scheduled until after July 1, 2005, if approved by Council.
Avenue of the Fountains — Water Garden Project
Phase I includes: Street Lighting
Resurfaced existing concrete with staining and texture application
Improved crosswalk access, traffic calming**
Sidewalk Shade Structures, Benches, Planters, Litter Cans, Bike Racks
Flowering Landscape and potential shade trees close to shade covers
Estimated Cost $450,000.00
**Staff is attempting to be proactive with traffic calming design that
satisfies both the business community and the traffic management process
that was adopted by Town Council on April 16, 1998. The policy states
that a raised plateau crosswalk is recommended where pedestrian safety
concerns exist relative to traffic speeds.
Phase II includes: Median Improvements
Renovate 3 existing water features
Add 4 new water features
Comfort station (rest rooms)
New walkways and seating areas
Shade Structures and Benches
Flowering Landscape, Shrubs and Native Trees

Recently there were two separate articles in local papers regarding the closure of two spray pads
at shopping malls at both Kierland Commons and Desert Ridge Marketplace in Scottsdale by the
Maricopa County Health Department. The issues from the County were twofold, according to
the article. The first was that people and pets were utilizing fountains that used recirculated
water, but were not retreating the water with disinfectant. Secondly, there were no lifeguards or
attendants on duty.
The system being proposed for the spray park in Fountain Park both recirculates and
rechlorinates the water. This complies with the County's requirements. In addition, our system
constantly monitors and adjusts the chemicals in the water to maintain the necessary safety
levels. Should an unlikely malfunction occur in the system, and readings become unsafe, the
system will automatically shut itself down until safe water quality levels are restored. However,
the second issue of having lifeguards or attendants on duty did raise concerns. Previously, the
supplier of the spray park equipment had reassured us that spray parks were considered unique
by the County Health Department, and requirements such as lifeguards did not apply.
Upon further investigation with the Maricopa County Health Department's Environmental
Services Division it was determined that the County holds spray parks and similar facilities to
the same standards as public pools. In other words, all of the rules that apply to public pools
apply to spray parks, unless granted variances. In reviewing the health code specific to pools,
there are a number of items required that would either need variances or would need to be
planned for in the project's construction and budget. These would potentially include the need
for a bathhouse, restrooms, drinking fountain, perimeter fencing, and the need for lifeguards.
There is also a requirement that drawings and specifications of the proposed facility need to be
submitted by an architect, registered engineer, or a licensed pool contractor, and approved prior
to the start of a project. The County plan review can take 30 days. Rulings on variances by the
County can take up to nine weeks.
Based on this new information we have removed the spray park item from the Council's agenda
for the August 5 meeting. The item will potentially be placed back on the agenda when these
issues are further clarified. I have been in contact with the County's Environmental Services
Division to set up a meeting to review the project with them. In addition, I have informed the
Rotary groups, through their representative, of these developments. The primary concern by the
Rotary groups continues to be completing the project no later than January of 2005, in order to
comply with the national requirements for a Rotary Centennial Project. I will of course update
you after my meeting with the County's Environmental Health Services Division.
