Pursuant to A.R.S. 38-431.02, notice is hereby given to the members of the Fountain Hills Planning and Zoning
Commission and to the general public that the Fountain Hills Planning and Zoning Commission will hold a regular
meeting, which is open to the general public, on May 25, 2017 at 6:30 p.m. in the Town Hall Council Chambers at 16705
E.Avenue of the Fountains,Fountain Hills,Arizona.
Commissioners of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum of
the Town's Councilmembers or various Commissions or Boards may be in attendance at the Commission meeting.

PROCEDURE FOR ADDRESSING THE PLANNING& ZONING COMMISSION
Anyone wishing to speak before the Commission must fill out a speaker's card and submit it to the Commission Recorder prior to
the Commission's discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the
Recorder's position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Recorder or the Chairman. At that
time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to
direct their comments to the Presiding Officer and not to individual Commission Members. Speakers' statements should not
be repetitive. In order to conduct an orderly business meeting, the Presiding Officer shall keep control of the meeting and
shall require the speakers and audience to refrain from abusive or profane remarks, disruptive outbursts, applause,protests
or other conduct that disrupts or interferes with the orderly conduct of the business of the meeting. Personal attacks on
Commissioners, Town Council members, Town staff or members of the public are not allowed. Please be respectful when
making your comments. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her
opportunity to speak on the matter. Speakers may not (i) reserve a portion of their time for a later time or(ii) transfer any
portion of their time to another speaker.
If there is a Public Hearing, please submit the speaker card to speak to that issue prior to the beginning of the Public
Hearing and the Consideration of said issue.
Individual speakers will be allowed three contiguous minutes to address the Commission. Time limits may be waived by (i)
discretion of the Chairman upon request by the speaker not less than 24 hours prior to a Meeting, (ii) consensus of the
Commission at Meeting or(iii) the Chairman either prior to or during a Meeting. If you do not comply with these rules,
you will be asked to leave.

The site, plat 403B, Block 3, Lot 7, is 48,622 square feet (1.12 acres) and is located in an R1-35 RUPD zoning
district. The properties adjacent to the site are:
North Desert Canyon Golf Club— 14th Fairway- Zoned R1-8 RUPD
West Single-Family Residential—Zoned R1-35
South Single Family Residence - Zoned R1-35
East Single Family Residence - Zoned R1-8

Staff Summary(background):
Due to continued damage from wayward golf balls to the subject home which abuts the 14th fairway of the
lesert Canyon Golf Club, the property owner is seeking relief by installation of a golf ball fence to protect the
dome from further damage. The home has had dozens of holes created by golf balls as well as a broken skylight
and broken roof tiles on the covered entry opposite the side of the house facing the fairway. The property owner
has stated that she is concerned about the golf balls causing bodily harm while her and/or guests are in the rear
yard pool and patio areas.
Zoning Ordinance Section 5.09 A.1 lists the criteria for a Special Use Permit for a golf ball fence as follows,
with staff's response in italics:
a. "Golf ball fences may only be developed on lots that directly abut a golf course or driving
range, however, they may not be developed within any front or street-side yard setback."
The applicant's property abuts the golf course which is north of the property. The fence would not lie within any
setback on the property.
b. "Golf ball fences should only be developed within Six-Hundred (600) feet of the forward-
most golf course tee box or driving range position. Golf course fences to protect against
errant secondary golf shots may be approved due to unusual site or course layout
circumstances."
The proposed fence is approximately 300 feet from the forward-most golf course tee box.
c. "Golf ball fences shall be set back from any abutting residential property at a distance not
ttir less than the height of the fence. Golf ball fences may be located nearer to such a property
line with the prior written consent of the abutting residential property owner."
The proposed fence is 25 feet high and 56 feet from the nearest neighbor's property line at the closest point.
d. "The maximum height of a golf ball fence shall not exceed twenty-five (25) feet."
The proposed golf ball fence height is 25 feet.
e. "Pole color must blend in with background features as viewed from neighboring properties to
minimize its visibility. Net color shall be black."
The golf ball fence would be located on the east side of the property, which is also where the closest adjacent
home is located. There is some existing vegetation and the applicant is proposing the poles be dark green to
match with the vegetation. The netting is black.
f. "Landscaping should be used where appropriate to obscure the poles from the neighboring
properties."
Because the proposed golf ball fence is approximately 130 feet from the adjacent residence, the subject
property is lower than the neighbors, and exiting vegetation is located between the subject property and the
neighbors to the east, no additional landscaping is proposed.

Evaluation
The cost to the homeowner will continue to grow if no fencing is allowed. In addition, the potential for bodily
arm will remain without the fence.
The proposed fence will provide significant protection to the applicant's home and inhabitants. The view for the
two neighbors abutting the subject property on the east may be disrupted, but providing the black netting will
reduce visibility of the golf ball fence.
Risk Analysis (options or alternatives with implications):
Should the Planning & Zoning Commission agree that this fence is appropriate, it should forward a
recommendation that the Town Council approve the golf ball fence as outlined in this report.
Should the Planning & Zoning Commission decide that this fence is not appropriate, it should forward a
recommendation that the Town Council deny the golf ball fence as outlined in this report. A recommendation
for denial should include the reasons for the recommendation.

Staff Recommendation(s):
Staff recommends that Planning & Zoning Commission forward a recommendation that the Town Council
approve the Special Use Permit for the golf ball fence as outlined in this report.
UGGESTED MOTION:
Move to FORWARD A RECOMMENDATION that the Town Council APPROVE the Special Use Permit to
allow the installation of a golf ball fence at 16932 E. Monterey Drive.

Staff Summary(background):
Ordinance 17-06 is being proposed in order to address the long-term maintenance of landscaping on lots that have
frontage on town streets. This ordinance seeks to address two concerns. First, regarding commercial properties,
and second regarding residential properties.
COMMERCIAL:
Currently new development is required to provide landscape and irrigation plans as part of their building permit
application submittal. Once approved, the applicants are required to install the landscaping and ensure that it
survives at least one year.This has generally been sufficient to ensure that commercial properties that front along
the town's streets maintain the landscaping along the street.
croft owever, there have been recent instances in which some commercial properties have cleared the landscaping
along their street frontages with no intention of replacement.This has generated concerns that the aesthetic

character of the town could be negatively affected. If adopted, Ordinance 17-06 will amend Section 5.19 of the
)ning Ordinance so that general maintenance and trimming of street-front landscaped areas will still be allowed
ut it will also require that those areas must remain landscaped and any significant changes must first be
permitted in a similar manner as the original permit. Additionally, there will no longer be a one year limit on the
landscaping requirement. Simply removing the landscaping will no longer be allowed regardless of how long it has
been located on the site.
RESIDENTIAL:
Currently new building permit applications for house construction must contain complete landscape and irrigation
plans as part of their building permit application submittal.This requirement has occasionally caused delays in the
permitting process because applicants did not provide the plans initially. Residential landscaping can also be very
personalized and as such each new house will have different standards and many times applicants are not sure
what they will want before the house is built.
Ordinance 17-06 will amend Section 6.09 of the Subdivision Ordinance so that rather than requiring a full
landscape and irrigation plan at the time of building permit application submittal,there will only be a requirement
that the plan show a minimum number of plantings along the front (12 plants) or street-side (6 plants) frontages of
the property. The number of plantings will be verified during the final inspection and a Certificate of Occupancy
can then be issued. The type and size of the plants will be left up to the individual homeowner's discretion.
Thereafter,the same requirements for continuous maintenance will be in effect as described above.
Risk Analysis (options or alternatives with implications):
Approval of these text amendments will allow staff to enforce the long term maintenance of landscaping areas that
front on the town's roadways.
Canial will require that the plan review processes follow the same approval procedures that are currently in place
and that landscaping is only required to survive for one year.

1. Any Commercial, Industrial or Multi-Family (five or more dwelling units) zoned
property, developed or otherwise, with existing landscaping located within the Front
and/or Street Side of the lot must maintain said landscaping in substantial conformance
with its current condition.
2. No Commercial, Industrial or Multi-Family site landscaping may be removed,
destroyed, relocated, or substantially trimmed without first applying for and receiving the
Zoning Administrator's administrative approval of a Town of Fountain Hills Landscaping
Permit. The standards for such permits are outlined in Section 6.05.C.6 of the Fountain Hills
Subdivision Ordinance.

WHEREAS, the Town of Fountain Hills (the "Town") adopted Ordinance No. 93-22 on
November 18, 1993, which adopted the Zoning Ordinance for the Town of Fountain Hills (the
"Zoning Ordinance"); and
WHEREAS, the Mayor and the Council of the Town of Fountain Hills (the "Town
Council") adopted Ordinance No. 96-29, which established the Subdivision Ordinance for the
Town of Fountain Hills (the "Subdivision Ordinance"); and
WHEREAS, the Town desires to amend the Zoning Ordinance to add Section 5.19.H;
and
WHEREAS, the Town desires to amend the Subdivision Ordinance to revise Section
6.09.B 6; and
WHEREAS, in accordance with the Zoning Ordinance and pursuant to ARIZ. REV. STAT.
§ 9-462.04, public hearings were advertised in the May 3, 2017 and May 10, 2017 editions of
the Times of Fountain Hills, and
WHEREAS, public hearings were held by the Fountain Hills Planning & Zoning
Commission on May 25, 2017, and by the Mayor and Council of the Town of Fountain Hills on
June 15, 2017. —_
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. The recitals above are hereby incorporated as if fully set forth herein.

B. APPLICATION:
6. ANY SINGLE-FAMILY OR MULTI-FAMILY (LESS THAN 5 DWELLING
UNITS) ZONED PROPERTY BEING DEVELOPED SHALL, AS AN
ATTACHMENT TO THE BUILDING PERMIT APPLICATION, PROVIDE A
LANDSCAPING AND IRRIGATION PLAN FOR PLANTINGS WITHIN THE
FRONT AND/OR STREET SIDE AREAS OF THE LOT. SAID PLAN SHALL
PROVIDE FOR TWELVE (12) PLANTINGS WITHIN ANY FRONT YARD, AND
SIX (6) PLANTINGS WITHIN ANY STREET SIDE YARD AT A MINIMUM.
SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions of this
Ordinance.
SECTION 6. The Mayor, the Town Manager, the Town Clerk and the Town Attorney are
hereby authorized and directed to execute all documents and take all steps necessary to carry
out the purpose and intent of this Ordinance.

The Planning and Zoning Commission will take up a request for a special use permit
to allow a protective golf ball fence for a residence in the 16000 block of Monterey
Drive.
The proposed fence would be 25 feet tall with a distance of about 300 feet from the
forward most tee for the nearest hole on the golf course.
The resident has provided the town with evidence of damage to stucco and roof tiles
from errant golf balls.
Staff indicates the request meets the criteria established in the Zoning Ordinance for
a golf ball fence.
The commission is being asked to make a recommendation to the Town Council
regarding whether to approve the permit.
The commission agenda also includes a proposed text amendment to the Zoning
Ordinance related to landscape requirements.
The change would address requirements for installation and continued maintenance
for landscaping within the front and street-side yards of developed lots.
A public hearing will be held regarding each of these items.
