MINUTES OF THE REGULAR SESSION OF THE
PLANNING& ZONING COMMISSION
August 10,2017
Chairman Michael Archambault opened the meeting at 6:30 p.m.
ROLL CALL:
The following Commissioners were present: Chairman Michael Archambault, Vice-Chairman Eugene
Mikolajczyk. Commissioners: Amberleigh Dabrowski, Erik Hansen, Roger Owers and by phone Howie
Jones. Also in attendance were Bob Rodgers, Development Services Director, Marissa Moore, Senior
Planner and Paula Woodward, Executive Assistant and Recorder of the minutes. Commissioner Susan
Dempster was absent.
Chairman Michael Archambault requested participation in the Pledge of Allegiance and a moment of
silent reflection.
CALL TO THE PUBLIC
Chairman Archambault asked if there were any requests to speak and the Recorder Paula Woodward
answered there were no requests.
AGENDA ITEM #1 - CONSIDERATION OF APPROVING THE PLANNING AND ZONING
COMMISSION MEETING MINUTES DATED MAY 25,2017.
Vice-Chairman Mikolajczyk MOVED to APPROVE the meeting minutes dated Thursday, May 25,
2017 as written. Commissioner Dabrowski SECONDED and the MOTION CARRIED
UNANIMOUSLY 6/0.
AGENDA ITEM #2 - PUBLIC HEARING TO RECEIVE COMMENTS ON ORDINANCE 17-08,
AMENDING THE FOUNTAIN HILLS ZONING ORDINANCE RELATING TO CANYON-SIDE
LOTS, BY ADDING A NEW SECTION 5.10, CANYON-SIDE LOT REGULATIONS,
AMENDING SECTION 1.12, DEFINITIONS, AND MODIFYING THE SINGLE FAMILY
ZONING DISTRICT DENSITY, AREA, BUILDING AND YARD REGULATIONS CHART IN
SECTION 10.09.CASE#Z2017-06
The public hearing opened at 6:35 p.m.
Marissa Moore, Senior Planner, presented a staff report and a PowerPoint presentation, (Copy is on
file in the Office of the Town Clerk) about the new set of "Canyon Side" standards staff
developed to allow for development of lots needing a variance or other waivers. She
summarized the proposed amendments:
1. Define which lots or parcels will be labeled"Canyon Side Residential":
a. Lots in residential zoning districts,which are downhill of the right-of-way on which they
have legal frontage or access; and
b. Lots on which the area under the building footprint has a slope equal to or greater than
30%;
2.Provide reduced setbacks to ten feet from the front property line from the requirement in the
respective zoning district;

3.Provide regulations for overall building height to reduce the visual impact down the canyon side.
Ms. Moore concluded that by approving the proposed amendments, residential lots with thirty percent or
greater slopes could be developed under the Canyon Side ordinance criteria. If the proposed amendments
are not approved, lots with slopes equal to or greater than 30% will remain subject to the development
standards set forth in the Hillside Disturbance ordinance. Ms. Moore said that staff recommends that the
Planning&Zoning Commission forward a recommendation to the Town Council to approve the proposed
Zoning Ordinance text amendments.
Chairman Archambault asked if there were any requests to speak and the Recorder Paula Woodward
answered there were no requests.
The public hearing closed at 6:39 p.m.
AGENDA ITEM #3 - CONSIDERATION OF ORDINANCE 17-08, AMENDING THE

Chairman Archambault opened the floor for commission discussion and questions.
Commissioner Dabrowski asked how many lots this ordinance would affect and what area of town would
be most populated with these slopes.
Ms. Moore replied that a GIS layer map was created showing the location of the 30% or more lots. The
majority of the lots are located in the west part of town.
• Chairman Archambault said if one was to drive around the developed areas of town,the sloped lots would
be identifiable because they are without building. Some newer locations are in Eagles Nest and Adero
Canyon,too.
Commissioner Dabrowski asked if the average slope allowed to be 30% or does it need to be no more than
30%.
Ms.Moore said it would have to have an average slope of 30%under the building footprint.
Commissioner Dabrowski said she was contacted by the public who expressed concern regarding the proposed
ordinance and wanted more time to review the proposed ordinance change. Commissioner Dabrowski
referenced the recent building at Firerock Parcel B where a large amount of the topography was removed.
Commissioner Dabrowski MOVED to continue the discussion at the next scheduled meeting on August
24,2017,and the motion FAILED for lack of a second.
Vice-Chairman Mikolajczyk stated the easy lots have been developed but the more difficult lots would
benefit from this amendment. Vice-Chairman Mikolajczyk referenced the Hillside Protection Easement
the commission addressed a year ago. The Hillside Protection Easement restricts how much hillside
could be disturbed to fit a home on a lot.
Ms. Moore replied the hillside disturbance is for any type of slope that is over 15%. The disturbance
could be cut or fill. Those requirements would still need to be met, but this amendment would allow to
41) pull the building closer to the front property line.

Vice-Chairman Mikolajczyk asked if there is anything in the ordinance that would allow for Hollywood
Hills"type"cantilever homes shown in the staff's presentation to be built in Fountain Hills.
• Ms.Moore said it would be no different than it is now.
Vice-Chairman Mikolajczyk asked what prompted this review.
Ms.Moore replied a contractor's request.
Commissioner Owers asked how this would affect uphill lots and if a"Hollywood Hills" type cantilever
homes would be possible on an uphill slope.
Ms. Moore said building on an uphill slope is possible with the maximum height and regular set backs
from the roadway. The height limit would be 30 feet from the natural grade. Ms.Moore said she modeled
this after what Paradise Valley adopted.
Vice-Chairman Mikolajczyk MOVED to forward a recommendation to Town Council to approve
ORDINANCE 17-08, amending the Fountain Hills Zoning Ordinance relating to canyon-side lots, by
adding a new Section 5.10, Canyon-Side Lot regulations, amending Section 1.12, definitions, and
modifying the single family zoning district density, area, building and yard regulations Chart in Section
10.09. Chairman Jones SECONDED and the motion CARRIED by those present(5-1).

Mr. Rodgers announced the Town Attorney's mandatory annual meeting will be held February 6, 2017 at
4:30 p.m. in the council chambers.The meeting is for all commission and board members.
