Avenue of the Fountains,Fountain Hills,Arizona. Commissioners of the Town of Fountain Hills will attend either in person or by telephone conference call; a quorum of the Town's Councilmembers or various Commissions or Boards may be in attendance at the Commission meeting. TIME: 6:30 P.M. —REGULAR SESSION WHEN: THURSDAY,JULY 23,2015 WHERE: TOWN HALL COUNCIL CHAMBERS 16705 E.AVENUE OF THE FOUNTAINS PROCEDURE FOR ADDRESSING THE PLANNING&ZONING COMMISSION Anyone wishing to speak before the Commission must fill out a speaker's card and submit it to the Commission Recorder prior to the Commission's discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby and near the Recorder's position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Recorder or the Chairman. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Commission Members. Speakers' statements should not be repetitive. In order to conduct an orderly business meeting, the Presiding Officer shall keep control of the meeting and shall require the speakers and audience to refrain from abusive or profane remarks, disruptive outbursts, applause,protests or other conduct that disrupts or interferes with the orderly conduct of the business of the meeting. Personal attacks on Commissioners, Town Council members, Town staff or members of the public are not allowed. Please be respectful when making your comments. If a speaker chooses not to speak when called, the speaker will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not(i)reserve a portion of their time for a later time or(ii)transfer any portion of their time to another speaker. Firerock Country Club Drive. Each tower requires two Special Use Permits due to 1) their proximity to residential areas and, 2) due to their proposed height. The ground equipment will be placed within an 8' high decorative block wall enclosure with a decorative .00den gate. Section 17.06 of the Zoning Ordinance outlines the criteria for evaluating Special Use Permit applications for towers or antennas. The proposed antennas exceed the zoning district height allowance of 30'. They are also within 300' of residentially zoned property. Therefore, it is the determination of staff that the applicant's proposals must receive Special Use Permits in order to be approved. In granting a Special Use Permit, the Town may impose conditions to the extent such conditions are necessary to minimize any adverse effect of the proposed towers on adjoining properties. Section 17.06.6.3 of the Zoning Ordinance specifically outlines the factors to be considered when reviewing applications for towers. Factors Considered in Granting Special Use Permits for Towers. In addition to any standards for consideration of special use permit applications pursuant to Chapter 2, Section 2.02 of this Zoning Ordinance, the Town Council shall consider the following factors in determining whether to issue a special use permit, although the Town Council may waive or reduce the burden on the applicant of one or more of these criteria if the Town Council concludes that the goals of this ordinance are better served thereby: a. Height of the proposed tower; The proposed Saguaros are both 40" tall. This exceeds the 30' height limit of the OSR zoning district. This requirement may be waived for communication towers as part of the Special Use Permit by the Town Council when deemed appropriate. Staff. Staff believes that the height of the towers will not create undue physical or aesthetic affects on the town or nearby properties. The proposed height is in scale with the area and many nearby real Saguaro cacti. Page 2 of 5 Verizon Wireless SU2015-10&SU2015-11 The zoning ordinance requires that any tower be constructed so that its "fall down" distance (equal to the height of the tower) is entirely contained within the boundaries of the property it is located on. This is a precaution against the tower damaging adjoining properties or structures on abutting property should it fall. This requirement may be waived as part of the Special Use Permit by the Town Council when deemed appropriate. Staff- The proposed location of the towers is slightly less than 300' from the nearest property line and meets this setback requirement. Should the Saguaros fall, they will fall on-site. Staff's opinion is that the proposed location on the property meets this requirement. b. Proximity of the tower to residential structures and residentially zoned district boundaries; The zoning ordinance requires that any tower within 300' of residentially zoned property receive Special Use Permit approval from the Town Council. Staff: The tower is just within 300'of a residentially zoned property to the west. Therefore, staff's opinion is that the residential setback requirement has technically not been met and a Special Use Permit is required. However, the residentially zoned property is a dedicated open space tract. Therefore staff believes that the Special Use Permits would cause no detrimental effects. c. Nature of uses on adjacent and nearby properties; The property contains an existing golf course country club and parking lot. The surrounding properties are either dedicated open space tracks or golf course. Staff- Staff believes that the proposed Saguaro antennas will not have a negative effect on the surrounding properties should the tower fall during a storm or as a result of an accident. Staff's opinion is that the requirement that the proposal not be potentially detrimental to surrounding properties has been met. d. Surrounding topography; The surrounding topography will not present any problems with the placement or use of the Saguaros. Staff- Staff's opinion is that the topography will not affect the placement of the towers or their continued maintenance. e. Surrounding tree coverage and foliage; There is currently natural desert tree and foliage coverage. Staff- Staff's opinion is that including additional landscaping within the trenched and/or otherwise disturbed areas after installation will lessen the visual impact of those disturbed areas. Therefore, staff recommends that the towers include revegetation/landscaping plans for the disturbed areas when applying for building permits. f. Design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; The proposed antennas are designed to look like a Saguaro Cacti. Staff: Staff believes that by using this Saguaro Cactus design rather than a typical tower or monopole, the visual impact is lessened. Page 3 of 5 Verizon Wireless SU2015-10&SU2015-11 g. Proposed ingress and egress; The proposed tower equipment area is located adjacent to the parking lot and is easily accessed by the main driveway. The towers are approximately 140' away from the parking lot and within a reasonable walking distance. Staff. The proposal has good access and egress. h. Availability of suitable existing towers, other structures, or alternative technologies not requiring the use of towers or structures, as discussed in Section 17.06(B)(4) of this chapter; Section 17.06.B.4 specifically relates to the construction of new towers where none previously existed. In such cases the town should require proof that other less-obtrusive options and/or opportunities for co-location are not available. Staff. The applicant indicates that there are no alternative towers in the vicinity. The applicant also indicates that there are no alternative technologies available and that Saguaro Cactus antennas are not typically designed for co-location. Risk Analysis (options or alternatives with implications): Approval of the Special Use Permits will result in two 40' tall Saguaro Cactus cell towers and their attendant ground equipment being placed in a dedicated open space area at 16000 E. Firerock Country Club Drive. Denial of the Special Use Permit will require that the applicant seek an alternative site or antenna design. Laser Drive. Section 17.06 of the Zoning Ordinance outlines the criteria for evaluating Special Use Permit applications for towers or antennas. As the proposed antenna exceeds the IND-1 zoning district height allowance of 40 feet, it is the determination of staff that the applicant's proposal must receive a Special Use Permit in order to be approved. In granting a special use permit, the Town may impose conditions to the extent such conditions are necessary to minimize any adverse effect of the proposed tower on adjoining properties. Section 17.06.B.3 of the Zoning Ordinance specifically outlines the factors to be considered when reviewing applications for towers. Factors Considered in Granting Special Use Permits for Towers. In addition to any standards for consideration of special use permit applications pursuant to Chapter 2, Section 2.02 of this Zoning Ordinance, the Town Council shall consider the following factors in determining whether to issue a special use permit, although the Town Council may waive or reduce the burden on the applicant of one or more of these criteria if the Town Council concludes that the goals of this ordinance are better served thereby: a. Height of the proposed tower; The proposed Monopalm is 65' tall. This exceeds the 40' height limit of the IND-1 zoning district by 25'. This requirement may be waived for communication towers as part of the Special Use Permit by the Town Council when deemed appropriate. Staff. Staff believes that the height of the tower will not create undue physical or aesthetic affects on the town or nearby properties. The zoning ordinance requires that any tower be constructed so that its "fall down" distance (equal to the height of the tower) is entirely contained within the boundaries of the property it is located on. This is a precaution against the tower damaging adjoining properties or structures should it fall. This requirement may be waived as part of the Special Use Permit by the Town Council when deemed appropriate. Staff. The proposed location of the tower is 112'-8" from the nearest property line and meets this setback requirement. Should the monopalm fall, it will fall completely within the subject property. Staff's opinion is that this criterion has been met. Page 2 of 4 T-Mobile Monopalm Case#SU2015-13 b. Proximity of the tower to residential structures and residentially zoned district boundaries; The zoning ordinance requires that any tower within 300' of residentially zoned property receive Special Use Permit approval from the Town Council. Staff. The tower is not within 300' of residentially zoned property. Therefore, staff's opinion is that the residential setback requirements have been met. c. Nature of uses on adjacent and nearby properties; The property contains existing storage buildings. The closest building is approximately 125' away from the proposed tower. The nearest adjacent right-of-way is 112'-8" from the proposed location. Staff- Therefore, staff's opinion is that the requirement that the proposal not be potentially detrimental to surrounding properties has been met. d. Surrounding topography; The surrounding topography will not present any problems with the placement or use of the monopalm. Staff. Staff's opinion is that the topography will not affect the tower placement. e. Surrounding tree coverage and foliage; There is currently no existing tree coverage or foliage. The applicant is proposing to install three additional palm trees in the area to lessen the visual impacts of the monopalm. The three proposed trees are 35', 25' and 25' tall. Staff- Staff's opinion is that including additional palm trees near the tower will lessen the visual impact of a stand-alone monopalm. Therefore, staff's opinion is that this requirement has been met. f. Design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; The proposed Monopalm is designed to look like a palm tree. Staff- Staff believes that by using this monopalm design rather than a typical tower or;nonopole, the visual impact is lessened. g. Proposed ingress and egress; The proposed tower is located within a large, flat, open vehicle storage lot and is easily accessed by vehicles. Staff. The proposal has excellent access and egress. h. Availability of suitable existing towers, other structures, or alternative technologies not requiring the use of towers or structures, as discussed in Section 17.06(B)(4); Section 17.06.B.4 specifically relates to the construction of new towers where none previously existed. In such cases the town should require proof that other less-obtrusive options are not available. Staff. The applicant states that there are no alternative towers in the vicinity. The applicant also states that there are no alternative technologies available. 411) Page 3 of 4 T-Mobile Monopalm Case#SU2015-13 Risk Analysis (options or alternatives with implications): Approval of the Special Use Permit will result in a 65' tall monopalm cell tower being placed at 16701 E. Laser rive. Denial of the Special Use Permit will require that the applicant seek an alternative site or antenna design. Indian Wells Drive Fountain Hills, AZ 85268 Related Ordinance, Policy or Guiding Principle: Fountain Hills Zoning Ordinance Chapter 2, Section 2.02 Special Use Permits Fountain Hills Zoning Ordinance Chapter 17 Wireless Telecommunications Towers and Antennas Staff Summary (background): The EPCOR Water company well #11 site parcel is located completely within the Desert Canyon Golf Club property between the 6th and 7th fairways. The site is enclosed within a walled area which contains the well, associated ground equipment, and also the proposed radio tower. The tower is being designed as a 42' tall monopalm, similar to other monopalm towers in town. Albeit omewhat shorter than the others. Three additional 25' tall real palm trees are also proposed to be 16 installed in the vicinity in order to lessen any visual impacts. Paige I of 4 EPCOR Antenna 7/23/2015 FACTORS CONSIDERED IN GRANTING SPECIAL USE PERMITS FOR TOWERS: In addition to any standards for consideration of special use permit applications pursuant to Chapter 2 the Zoning Ordinance, the Town Council will consider the following factors in determining whether -to issue a Special Use Permit. The Planning & Zoning Commission may make specific recommendations regarding any of these items. The Town Council may waive or reduce one or more of these criteria if they conclude that the goals of the Town are better served by doing so. Section 17.06.B.3 of the Zoning Ordinance specifically outlines the factors to be considered when reviewing applications for towers. Factors Considered in Granting Special Use Permits for Towers. In addition to any standards for consideration of special use permit applications pursuant to Chapter 2, Section 2.02 of this Zoning Ordinance, the Town Council shall consider the following factors in determining whether to issue a special use permit, although the Town Council may waive or reduce the burden on the applicant of one or more of these criteria if the Town Council concludes that the goals of this ordinance are better served thereby: a. Height of the proposed tower; The proposed Monopalm is 42' tall. This exceeds the 30' height limit of the R1-8 RUPD zoning district by 12'. This requirement may be waived for communication towers as part of the Special Use Permit by the Town Council when deemed appropriate. Staff- Staff believes that the height of the tower will not create undue physical or aesthetic affects on the town or nearby properties. 410 The zoning ordinance requires that any tower be constructed so that its "fall down" distance (equal to the height of the tower) is entirely contained within the boundaries of the property it is located on. This is a precaution against the tower damaging adjoining properties or structures should it fall. This requirement may be waived as part of the Special Use Permit by the Town Council when deemed appropriate. Staff- The applicants are in the process of revising the parcel's property lines so that the fall down distance will be achieved. Staff's opinion is that this criterion will be met when the property line revision occurs. If the Special Use Permit is approved, the lot line adjustment should be a stipulation of approval. b. Proximity of the tower to residential structures and residentially zoned district boundaries; The zoning ordinance requires that any tower within 300' of residentially zoned property receive Special Use Permit approval from the Town Council. Staff- The tower is in a residentially zoned property. Therefore, staff's opinion is that the residential setback requirements have not been met and the Special Use Permit is required. c. Nature of uses on adjacent and nearby properties; I The property immediately adjacent to the well site property is the golf course. The closest residence is slightly more than 300' away from the proposed tower. The nearest adjacent right-of- way is 280' from the proposed location. Staff- Staff's opinion is that the requirement that the proposal not be potentially detrimental to surrounding properties has been met. Page 2 of 4 EPCOR Antenna 7/23/2015 d. Surrounding topography; The surrounding topography will not present any problems with the placement or use of the monopalm. Staff- Staff's opinion is that the topography will not affect the tower placement. e. Surrounding tree coverage and foliage; There is currently no existing tree coverage or foliage within the walled enclosure. The applicant is proposing to install three additional 25' tall palm trees in the area just outside the enclosure to lessen the visual impacts of the monopalm. Staff- Staff's opinion is that including additional palm trees near the tower will lessen the visual impact of a stand-alone monopalm and that this requirement has been met. f. Design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; The proposed Monopalm is designed to look like a palm tree. Staff- Staff believes that by using this monopalm design rather than a typical tower or monopole, the visual impact is lessened. g. Proposed ingress and egress; The proposed tower is located within an existing walled enclosure and is easily accessed by maintenance vehicles. Staff The proposal has good access and egress. h. Availability of suitable existing towers, other structures, or alternative technologies not requiring the use of towers or structures, as discussed in Section 17.06(B)(4); Section 17.06.B.4 specifically relates to the construction of new towers where none previously existed. In such cases the town should require proof that other less-obtrusive options are not available. Staff- The applicant states that there are no alternative towers in the vicinity. The applicant also states that there are no alternative technologies available. The applicant shall revise the parcel's property lines so that the tower fall down distance thr requirement will be achieved prior to the issuance of a building permit for the tower. The application was submitted on 6/9/15. The purpose of the antenna is to provide radio communication between the CCWC Well 11 site, the RES#2 storage tank site, and the Shea Water Treatment Plant. The well produces potable water for the town that is stored in the RES#2 storage tank. Stealth Antenna Mast—EPCOR has opted to go with a "palm tree" antenna mast and the plans have been adjusted accordingly. The "palm tree"will be similar to the pictures located in Figure 8 and Figure 9. Our design will have a similar frond configuration but only a single 23" antenna as seen in Figure 5. Live Palm Trees —Three 25' tall, live palm trees will accompany the antenna "palm tree" mast. The location is still being determined as EPCOR has to coordinate with the Golf Course. The installation will be prior to the Certificate of Occupancy. Property Boundary Adjustment — Per a mutual agreement between EPCOR water and Desert Canyon Golf Club (Golf Course), the location, size and orientation of the parcel APN 176-08- 571B is being modified. The new orientation is more parallel to the golfing fairways to the east and west of the site which will allow for better golfing flow. The site is being moved slightly to the south to provide room inside the site for well rigs. Additionally, the golf course will be providing additional property to allow EPCOR to meet the tower setback requirements required by the Town. The new site boundary is show in Figure 4 of the resubmittal. The lot line adjustment (replat) will be a separate submittal and we request that the approval of the lot line adjustment be a stipulation of the tower Special Use Permit Approval. Sunrise is currently in the process of putting together the required information and documentation for the lot line adjustments, which includes the area required to meet setback requirements and easements for temporary and permanent access to the site. Once the property boundary has been agreed upon by both parties it will take Sunrise two weeks to finish the required documentation and submit to the Town. Legal Access from Public Right-of-Way—As part of the agreement between EPCOR and the Golf Course, EPCOR will have a temporary construction and access easement. Additionally, EPCOR will have an ingress/egress and maintenance easement for permanent access to the site. These easements' documentation are part of the lot line adjustment work and will be completed once the lot line adjustment documentation is complete. Figure 6 of the resubmittal shows the location of both the temporary and permanent access points. Tower Setbacks — The tower setback requirement to the property boundaries will be meet by acquiring more property from the Golf Course. EPCOR is in the process of acquiring the necessary property to meet the setback requirements per the property boundary adjustment mentioned above. Vegetation Buffer—The site is unable to provide 4'of buffer from the edge of the facility.Property outside of the facility is either owned by the golf course or the golf course will have an easement to use the property. The 4' buffer zone will have landscaping according to the needs of the golf course. Floodplain Limits —A small portion of the site improvements extends into the floodplain limits. However,the improved area is not impeding flow in the floodway,therefore it will have no adverse impact. The project will comply with ADEQ's AZPDES General Permit Requirements.
