Staff Summary (background): The site, plat 401A, Block 1, Lot 13B, is 10,018 square feet (0.3 acres) and is located in an R1 10 RUPD zoning district. The properties adjacent to the site are: North Desert Canyon Golf Club- 4th Fairway -Zoned R1-10 RUPD West Desert Canyon Golf Club-4th Fairway - Zoned R1-10 RUPD South Single Family Residence -Zoned R1-10 RUPD East Single Family Residence - Zoned R1-10 RUPD As a result of continued property damage and the tenant's personal safety concerns due to errant golf balls from the Desert Canyon Golf Club, the property owner is requesting to be permitted to install a golf ball fence along the rear and west side of the back yard. The fence is approximately 25' tall and is a black net mesh design. Such nets may only be installed after receipt of a Special Use Permit. Page I of 4 17008 E.Jacklin Drive Golf Net-Case#SU2015-14 Below is Zoning Ordinance Section 5.09 A.1 which outlines the criteria for Special Use Permits for golf ball fences. Staff's analysis immediately follows each subsection: Section 5.09 A.1 Golf ball fences may be developed by Special Use Permit if all of the following characteristics apply: a. "Golf ball fences may only be developed on lots that directly abut a golf course or driving range, however, they may not be developed within any front or street-side yard setback." STAFF: The applicant's property abuts fairway #4 of the Desert Canyon golf course which is north and west of the property. The fence is within the rear and side setbacks on the property. b. "Golf ball fences should only be developed within Six-Hundred (600) feet of the forward- most golf course tee box or driving range position. Golf course fences to protect against errant secondary golf shots may be approved due to unusual site or course layout circumstances." STAFF: The golf fence is approximately 960' feet from the forward-most golf course tee box. However, the property is located in a fairway dog-leg which places it in an ideal location to receive errant secondary golf shots. c. "Golf ball fences shall be set back from any abutting residential property at a distance not less than the height of the fence. Golf ball fences may be located nearer to such a property line with the prior written consent of the abutting residential property owner." STAFF: The fence will be constructed directly adjacent to the north and west property lines and will not be adjacent to a residential neighbor's property. d. "The maximum height of a golf ball fence shall not exceed twenty-five (25) feet." STAFF: The golf ball fence will be constructed to a height of twenty-five (25) feet. e. "Pole color must blend in with background features as viewed from neighboring properties to minimize its visibility. Net color shall be black." STAFF: The netting and poles will be black. f. "Landscaping should be used where appropriate to obscure the poles from the neighboring properties." STAFF: The golf course side of the fence is landscaped with large trees that were apparently placed there for the purpose of blocking or deflecting golf balls. Beyond meeting the technical requirements of the ordinance there appears to be a real danger for the occupants. The property owner has reported numerous balls landing in the back yard and at least one construction worker (the house is currently under construction) has been hit by an errant golf ball. The fence will provide significant protection to the applicant's home and protect the occupants when they are in the back yard. The disruption to any views is minimal as it is a black net and close to the large trees. There does not appear to be any disruption of views of the golf course for any neighbors, or of the mountains in the distance. Jacklin Drive We are requesting a special use permit to erect a golf fence at 17008 E. Jacklin Drive, Fountain Hills 85268 because of the frequency of golf balls hitting the property. This property is on the approach to the 41h green of the Desert Canyon Golf Course. We are building a house on the lot and the fence is necessary to protect the workers, the building and future occupants from damage caused by errant golf balls. We have already had one worker struck in the forehead on 08/18/15 while working on the retaining wall. A truck roof was damaged on 08/07/15. We have a five gallon bucket of golf balls that have been found on the lot since we began active construction. Staff's analysis immediately follows each subsection: Section 5.09 A.1 Golf ball fences may be developed by Special Use Permit if all of the following characteristics apply: a. "Golf ball fences may only be developed on lots that directly abut a golf course or driving range, however, they may not be developed within any front or street-side yard setback." STAFF: The applicant's property abuts fairway #4 of the Desert Canyon golf course which is north and west of the property. The fence is within the rear and side setbacks on the property. b. "Golf ball fences should only be developed within Six-Hundred (600) feet of the forward- most golf course tee box or driving range position. Golf course fences to protect against errant secondary golf shots may be approved due to unusual site or course layout circumstances." STAFF: The golf fence is approximately 960' feet from the forward-most golf course tee box. However, the property is located in a fairway dog-leg which places it in an ideal location to receive errant secondary golf shots. c. "Golf ball fences shall be set back from any abutting residential property at a distance not less than the height of the fence. Golf ball fences may be located nearer to such a property line with the prior written consent of the abutting residential property owner." STAFF: The fence will be constructed directly adjacent to the north and west property lines and will not be adjacent to a residential neighbor's property. d. "The maximum height of a golf ball fence shall not exceed twenty-five (25) fee`." STAFF: The golf ball fence will be constructed to a height of twenty-five (25) feet. e. "Pole color must blend in with background features as viewed from neighboring properties to minimize its visibility. Net color shall be black." STAFF: The netting and poles will be black. f. "Landscaping should be used where appropriate to obscure the poles from the neighboring properties." STAFF: The golf course side of the fence is landscaped with large trees that were apparently placed there for the purpose of blocking or deflecting golf balls. Beyond meeting the technical requirements of the ordinance there appears to be a real danger for the occupants. The property owner has reported numerous balls landing in the back yard and at least one construction worker (the house is currently under construction) has been hit by an errant golf ball. The fence will provide significant protection to the applicant's home and protect the occupants when they are in rr.,ie back yard. The disruption to any views is minimal as it is a black net and close to the large trees. There does not appear to be any disruption of views of the golf course for any neighbors, or of the mountains in the distance.
