Chairman Lloyd Pew opened the meeting at 6:30 p.m.
ROLL CALL:
The following Commissioners were present: Chairman Lloyd Pew, Commissioners Stan Connick,
Jeremy Strohan, Howie Jones, Eugene Mikolajczyk, and Denise Ham. Also in attendance were Director
of Development Services Paul Mood, Senior Planner and Zoning Administrator Robert Rodgers, and
Executive Assistant and Recorder of the minutes Janice Baxter. Vice-Chairman Michael Archambault
was unable to attend and notified staff in advance.
Chairman Lloyd Pew requested participation in the Pledge of Allegiance and a moment of silent
reflection.

AGENDA ITEM#1 - CONSIDERATION OF APPROVING THE MEETING MINUTES OF THE

AGENDA ITEM #2 — PUBLIC HEARING TO RECEIVE COMMENTS ON A PROPOSED
SPECIAL USE PERMIT TO ALLOW SALT RIVER PROJECT TO INSTALL A 20' TALL
FAUX SAGUARO SMART SIGNAL ROUTER AT 14405 E. MOURNING DOVE DRIVE,
LOCATED IN THE"R1-43"ZONING DISTRICT. ,
Robert Rodgers gave the presentation that would cover two of the proposed Smart Router locations
requested because they were located on private property (within existing easements) and as such needed
Special Use Permits under the zoning ordinance due to their proximity to residential areas. A PowerPoint
presentation was exhibited that covered all the Salt River Pro ect requests.

Mr. Rodgers explained that rather than simply installing bare antennas in residential areas, SRP was
installing a stealth saguaro design, similar to the designs we require with cell towers. The faux saguaros
are roughly 20' tall and seem to be the best fit with the construction to look as natural as possible(Exhibit
Mr. Rodgers added that the entire infrastructure costs would be borne by SRP and the stealth design costs
for these two, as well as the other 9 saguaros being installed on town property would be paid through the
Town's SRP Aesthetics funds.
Mr. Rodgers explained that currently Salt River Project was installing 14 Smart Routers in Fountain Hills
as part of their service upgrades. Smart Meters would be installed shortly thereafter in most homes.
Staff recommended that the Commission forward recommendations to approve the Special Use Permits
and allow the two stealth saguaro smart routers to be installed,as presented.
Mariann Warn, Salt River Project applicant gave a presentation and PowerPoint presentation (Exhibit
"B"). Ms.Warn also was available to answer questions from the Commissioners.
Public Hearing Opened at 6:42 p.m.
The following speakers requested to address the Commission.
David Feldbammer a Fountain Hills resident thanked SRP for their co-operation in working with him on
an alternative location as previously proposed on his property.
Dina Galassini a Fountain Hills resident was opposed to an approval.
There being no other speakers,Chairman Pew closed the Public Hearing at 6:47 p.m.

AGENDA ITEM #6 — PUBLIC HEARING TO RECEIVE COMMENTS ON A PROPOSED
SPECIAL USE PERMIT BY BRIAN AND DEONE BAYLESS TO ALLOW A RESIDENTIAL
APARTMENT AT 11883 N. SAGUARO BOULEVARD. THE PROPERTY IS LOCATED
WITHIN THE C-3 COMMERCIAL ZONING DISTRICT.
Mr. Rodgers gave the presentation and included a PowerPoint presentation (Exhibit "C"). He explained
that this request involved Section 12.03.F of the Zoning Ordinance that allowed residential dwellings to
be created within a Commercial Zoning District (in this case the C-3 Zoning District), by Special Use
Permit only.
Mr. Rodgers pointed out that the request was made by Brian and Deone Bayliss, the property owners of
11883 N. Saguaro Boulevard for a 2nd story apartment for their own use.
Brian and Deone Bayliss were in attendance and available to address questions from the Commissioners.
Public Hearing Opened at 6:50 p.m.
The following speakers requested to address the Commission.
Phillip Blackerby was in favor of allowing this Special Use Permit to be approved.
There being no other speakers, Chairman Pew closed the Public Hearing at 6:53 p.m.

SAGUARO BOULEVARD. THE PROPERTY IS LOCATED WITHIN THE C-3 COMMERCIAL
ZONING DISTRICT.
Commissioner Mikolajczyk commented that he noticed that there were condos across the street from this
property and he stated he felt it was a good idea.
Commissioner Stan Connick stated he was in favor of their request.
Commissioner Denise Ham stated that it was a good design and appropriate use.
Chairman Pew also expressed his support.
There being no further questions or comments from the Commissioners, Chairman Pew asked for a
motion.
Commissioner Howie Jones MOVED to forward a recommendation to the Town Council to approve the
Special Use Permit to allow an apartment at 11883 N. Saguaro Boulevard, as presented in the staff report.
Commissioner Denise Ham SECONDED. The MOTION CARRIED UNANIMOUSLY(6-0, by those
present).

PROCEDURE FOR ADDRESSING THE PLANNING& ZONING COMMISSION
Anyone wishing to speak before the Commission must fill out a speaker's card and submit it to the Commission Recorder
prior to the Commission's discussion of that Agenda item. Speaker Cards are located in the Council Chamber Lobby
and near the Recorder's position on the dais.
Speakers will be called in the order in which the speaker cards were received either by the Recorder or the Chairman. At
that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting
and to direct their comments to the Presiding Officer and not to individual Commission Members. Speakers' statements
should not be repetitive. In order to conduct an orderly business meeting, the Presiding Officer shall keep control of
the meeting and shall require the speakers and audience to refrain from abusive or profane remarks, disruptive
outbursts, applause,protests or other conduct that disrupts or interferes with the orderly conduct of the business of the

Staff Summary (background):
Salt River Project (SRP) is currently upgrading their equipment to allow for wireless meter reading.
Individual meters are being upgraded and a "Smart Router" system of communication collection
facilities is being installed. SRP will be installing fourteen smart routers in Fountain Hills. Eleven of the
routers are in very visible locations and will be constructed to look like saguaro cacti. Nine of the faux
cacti are located within public rights-of-ways and must follow the encroachment permit process for
their installation. The remaining two faux cacti are located within utility easements on private property.
The zoning ordinance requires that these two routers must go through the Special Use Permit
process for their approvals.
The two routers will either be within residential areas or within 300 feet of a residential area. In order
to make the antennas less obtrusive SRP will be utilizing Aesthetic Funds that were set aside for use
in Fountain Hills to use a stealth saguaro cactus design similar to, but significantly shorter than many
of the cell towers currently in town. The cacti will be approximately 20' in height.
The two locations are noted above and the specific site designs are attached to this report separately.
FACTORS CONSIDERED IN GRANTING SPECIAL USE PERMITS FOR TOWERS:
In addition to any standards for consideration of special use permit applications pursuant to Chapter 2
of the Zoning Ordinance, the Town Council will consider the following factors in determining whether
to issue a Special Use Permit. The Planning & Zoning Commission may make specific
recommendations regarding any of these items.
The Town Council may waive or reduce one or more of these criteria if they conclude that the goals of
the Town are better served by doing so:
a. Height of the proposed tower;
b. Proximity of the tower to residential structures and residentially zoned district boundaries;
c. Nature of uses on adjacent and nearby properties;
d. Surrounding topography;
e. Surrounding tree coverage and foliage;
f. Design of the tower, with particular reference to design characteristics that have the effect of
reducing
or, eliminating visual obtrusiveness.
g. Proposed ingress and egress; and
h. Availability of suitable existing towers, other structures, or alternative technologies not
requiring the
use of towers or structures.
