HomeMy WebLinkAboutPZ.2011.1215.Minutes TOWN OF FOUNTAIN HILLS MINUTES OF THE SPECIAL SESSION OF THE PLANNING & ZONING COMMISSION DECEMBER 15, 2011 Chairman Lloyd Pew opened the SPECIAL SESSION of the Planning and Zoning Commission at 5:00 p.m. The following Commissioners were present: Chairman Lloyd Pew, Vice-Chairman Cecil Yates, Commissioners Richard Turner, Stan Connick, Mike Archambault, Gene Slechta, and Angela Strohan. Also in attendance were Paul Mood, Director of Development Services, Robert Rodgers Senior Planner, and Janice Baxter Executive Assistant and Recorder of the Minutes. Chairman Lloyd Pew requested participation in the Pledge of Allegiance and a moment of silent reflection. REGULAR AGENDA AGENDA ITEM #1 — CONSIDERATION of APPROVING the regular and joint session meeting minutes of the Planning and Zoning Commission from November 10,2011. Vice-Chairman Cecil Yates MOVED to approve the regular session meeting minutes for the Planning and Zoning Commission dated November 10, 2011. Commissioner Mike Archambault SECONDED. A roll call was taken and the MOTION CARRIED (6-1). Angela Strohan abstained due to her absence on November 10, 2011. The amendments extend the expiration date to December 31, 2012 for A-frame signs and banners for special sales events. Sections of the zoning ordinance that would be revised are Section 6.08.B.13 and Section 6.08.D.3. Robert Rodgers, Senior Planner gave the presentation explaining that two sections of the Sign Ordinance included expiration dates of December 31,2011,and read as follows: Zoning Ordinance Chapter 6- Section 6.08.B.13 stated; "No A-frame sign is permitted anywhere within the Town of Fountain Hills after December 31, 2011." Zoning Ordinance Chapter 6—Section 6.08.D.3 stated; "Banners, balloons and pennants are permitted for events such as special sales events with advance notification to the Town for not more than sixty (60) consecutive hours per month. The provisions of this subsection 6.08. (D) (3) shall expire on December 31,2011. Mr. Rodgers gave a brief summary of current ordinance compliance regarding A-frame signs and banners. Mr. Rodgers noted that the current Sign Ordinance Review Subcommittee had been meeting since June 2011, and had requested that an extension be granted in order for the subcommittee to complete their comprehensive review and make recommendations regarding the entire sign ordinance. Staff supported the subcommittee's request. Chairman Lloyd Pew opened the Public Hearing at 5.04 p.m. No one requested to speak Chairman Lloyd Pew closed the Public Hearing at 5.04 p.m. AGENDA ITEM #2 — CONSIDERATION of ORDINANCE #11-15, a TEXT AMENDMENT to the sign regulations in the Fountain Hills Zoning Ordinance. The amendments extended the expiration date to December 31, 2012, for A-frame signs and banners for special sales events. Sections of the zoning ordinance that would be revised are Section 6.08.B.13 and Section 6.08.D.3. Commissioner Gene Slechta pointed out that he and Vice-Chairman Cecil Yates were actively involved with the current"Sign" Subcommittee. Commissioner Slechta also thanked those who were participating on the Sign Subcommittee. Commissioner Slechta stated that after some consideration and speaking to Robert Rodgers,he decided to propose a six(6)month extension instead of one(1)year. Commissioner Slechta added that he felt it was not necessary to continue this text amendment extension for one (1) year. Commissioner Slechta agreed that the stipulation should be included in the Commission's recommendations to Town Council. Commissioner Gene Slechta MOVED to forward a recommendation that the Town Council approve ORDINANCE 2011-15, a text amendment to the sign regulations in the Zoning Ordinance that extended the expiration date to June 30, 2012, for A-frame signs and banners. Commissioner Richard Turner SECONDED. A voice vote was taken and the MOTION CARRIED(7-0). Page 2 of 3 AGENDA ITEM#3-ADJOURNMENT. Speaker Cards are located in the Council Chamber Lobby and near the Secretary's position on the dais. Speakers will be called in the order in which the speaker cards were received either by the Secretary or the Chairman. At that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting and to direct their comments to the Presiding Officer and not to individual Commission Members. Speakers' statements should not be repetitive. In order to conduct an orderly business meeting, the Presiding Officer shall keep control of the meeting and shall require the speakers and audience to refrain from abusive or profane remarks, disruptive outbursts, applause,protests or other conduct that disrupts or interferes with the orderly conduct of the business of the meeting. Personal attacks on Commissioners, Town Council members, Town staff or members of the public are not allowed. Please be respectful when making your comments. Page 1 of 3 In past years Town Council has directed staff to initiate amendments to the sign regulations that would extend the expiration date one additional year. This year staff has completed similar amendments. Attached is the draft Ordinance, #11-15, that addresses these extensions: 0 or the past three years, staff has presented potential options to the Town Council regarding the expiration dates of these sign types along with a brief year-end compliance summary. Each year Council has indicated their reluctant agreement with the extension provided that the businesses using these forms of signage attempt to self-police their use and abide by the town's laws. Below is a brief summary of current ordinance compliance regarding A-frame signs and Banners: A-Frame signs: (survey done on Tuesday, November 11, 2011) • There are 56 current A-Frame permits issued. • 57 A-Frame signs were displayed. O 44 of the A-Frame signs that were out were in violation of one or more regulation. (64 total violations) O 30 of the A-Frames that were out have Permits. ■ 21 of the A-Frames that have Permits and that were out, were still in violation of one or more regulation. COMPLIANCE RATE = 16% Banners: (survey done on Wednesday, November 16, 2011) • There are currently no valid Banner Permits issued. • 24 Banners were displayed. COMPLIANCE RATE = 0% ;ompliance rates such as this would generally indicate that staff should recommend that the expiration date not be extended. However, the Sign Ordinance Review Committee has been meeting regularly since June 2011 and has requested that the extension be granted in order for the committee to complete their comprehensive review and make recommendations regarding the entire sign ordinance. Based on this request, staff has agreed to recommend the extension. Risk Analysis (options or alternatives with implications): Approval of this ordinance amendment will extend the A-frame and banner expiration date for an additional year to December 31, 2012. If this ordinance amendment is not approved, commercial A-frame signs, and banners for special sales events will not be allowed after December 31, 2011.
