Speakers will be called in the order in which the speaker cards were received either by the Secretary or the Chairman. At
that time, speakers should stand and approach the podium. Speakers are asked to state their name prior to commenting
and to direct their comments to the Presiding Officer and not to individual Commission Members. Speakers' statements
should not be repetitive. In order to conduct an orderly business meeting, the Presiding Officer shall keep control`o f
the meeting and shall require the speakers and audience to refrain from abusive or profane remarks,

outbursts, applause, protests or other conduct that disrupts or interferes with the orderly conduct of the business of the
meeting. Personal attacks on Commissioners, Town Council members, Town staff or members of the public are not
allowed. Please be respectful when making your comments. If a speaker chooses not to speak when called, the speaker
will be deemed to have waived his or her opportunity to speak on the matter. Speakers may not(i) reserve a portion of
their time for a later time or(ii)transfer any portion of their time to another speaker.
If there is a Public Hearing,please submit the speaker card to speak to that issue prior to the beginning of the Public
Hearing and the Consideration of said issue.
Individual speakers will be allowed three contiguous minutes to address the Commission. Time limits may be waived by
(i)discretion of the Chairman upon request by the speaker not less than 24 hours prior to a Meeting, (ii) consensus of
the Commission at Meeting or(iii) the Chairman either prior to or during a Meeting. If you do not comply with these
rules,you will be asked to leave.

Fountain Hills Zoning Ordinance Chapter 6, Section 6.07.1 Prohibited signs
Staff Summary (background):
The Town Manager has received several inquiries regarding desires to install electronic signage that would
include movable or changeable text and animation. Currently the Fountain Hills Zoning Ordinance does not allow
these types of signage. Staff was directed to investigate how the technology is implemented in the valley and
provide the Planning & Zoning Commission the findings. The Town Manager is asking for some direction from
the commission on how, or if, to proceed with changes to accommodate this technology.
Staff used the following methodology to address the request:
• Select approximately ' of the valley communities, with diverse populations and commercial
zoning
• Use the Internet to explore their regulations
• Categorize sign technologies and usage restrictions
• Contact each community for additional information and experiences
• Summarize each community
This report includes the results of the research. The report does not include any discussions on hardware
chnology, i.e. LED versus other illumination. There also is not discussion on sign sizes, illumination values or
acement of signs. These criteria vary widely across the valley regardless of signage type.

The summarytable below identifies if the community allows electronic signage, breaks out electronic signage's
two major categories which is animated and static and identifies major application type for the community.

It is impor
tant to define two terms, column headings, for the discussion. They are"animated" and"static".
Static electronic signs are signs that contain text and/or graphics that do not move for a prescribed time period.
That time period can be seconds, minutes or hours. An example might be a time and temperature sign that shows
the time for 30 seconds,then displays the current temperature for 30 seconds.
Animated signs are signs that contain text and/or graphics that are constantly changing such as a video, or text that
is scrolling across the screen, or flashing lights or signs that physically rotate.
The applications for electronic signage also logically fell into a few categories. Staff has identified those as
commercial, municipal/schools/churches and freeway. Sign n distinguishtypes

Included below the table are brief summaries of each of the 13 communities researched. They provide further
explanations for the table values supplied. The table indicates for the selected communities a couple key points:
• Few communities allow animated signage. Static signage is more widely accepted.
• Municipal/schools/churches is the most widely allowed application
Staff is asking for direction from the Planning&Zoning Commission on this item.Three possible options are:
• Take no action as the commission feels the value added would be less than potential negative
0 impacts such as impact on the dark skies or safety concerns
• Ask staff to continue research and return with recommendations based on feedback from this
discussion
• Assign a subcommittee to further study the request

Below are brief summaries of each community:
AVONDALE
Avondale allows only electronic signs that are"static".No animation, video, special effects are allowed.The message
must be fixed for a minimum of 8 seconds.
In addition,there are only a few classes of businesses/entities that can apply for an electronic sign.They are schools,
theaters,churches,veterans and fraternal organizations,municipal uses and gas stations.

CAVE CREEK
Cave Creek does not allow any illuminated signs at all.
CHANDLER
Except for churches,municipal applications,electronic signs are not permitted...and action signs are not permitted either.
Action signs are signs that can rotate or move up and down. A few commercial electronic signs exist from approval of
development plans by the city.
FOUNTAIN HILLS
Section 6.07.I of Chapter 6 of the Zoning Ordinance prohibits"any sign with intermittent or flashing illumination,
animated or moving signs, including electronic message center signs".
GILBERT
Gilbert allows electronic message signs in any commercial district. They need to be approved by the design review board
and include messages, animation,etc.The board decides minimum time interval between messages.The changeable
message part of the sign cannot exceed 50% of the sign.Most are monument signs.
MESA
Mesa allows electronic message boards/signs in any commercial district,but no animation is allowed.The sign requires a
special use permit and staff looks at street details, illumination and size.
esa's ordinance indicates that these signs can only be in the downtown and along freeways,but in practice they have

PARADISE VALLEY
Paradise Valley has no commercial zoning districts.Even the hotels are zoned residential under a special use permit.They
Qve received a request from a church in town for a static message sign but the request was denied.
PEORIA
Only electronic signs allowed are of the"static"nature.Requests for animated signage have been denied multiple times.
In addition,electronic signs are limited to municipal uses,theaters and churches.
Walgreens applied for exception for a"static' sign and was denied.
PHOENIX
Phoenix does not allow motion of any kind. Static signs are allowed.Phoenix defines animation slightly differently in
that content that changes within 24 hours is considered animation though it does not move.
QUEEN CREEK
Queen Creek does not allow any electronic signs except for time&temperature.
SCOTTSDALE
Scottsdale prohibits all signs with flashing, blinking,or rotating lights or movement of any kind.
SURPRISE
No electronic signage permitted.
TEMPE
Electronic signs allowed as marquees and freeway use only(eg. autoplex). Marquees can only be used for churches,
theaters,museums, schools. These can be animated but all undergo rigid design review.Regular commercial/retail
businesses cannot have electronic signage.
