The following Commissioners were present: Chairman Paul McDonald, Vice-Chairman Lloyd Pew, Commissioners Cecil Yates, Gary Goodell, and Jeff Mangels. Also in attendance were Robert Rodgers, Senior Planner, Gene Slechta, Planner and Janice Baxter, Executive Assistant and Recorder of the Minutes. Commissioners Jerry Caldwell and Sherry Leckrone were not able to attend the meeting and notified staff in advance. Chairman Paul McDonald requested participation in the Pledge of Allegiance and a moment of silent reflection. REGULAR AGENDA AGENDA ITEM #1 — CONSIDERATION of APPROVING the minutes from the meeting of the Planning and Zoning Commission held on APRIL 8,2010. Vice-Chairman Lloyd Pew MOVED to approve the meeting minutes from the April 8, 2010, Planning and Zoning Commission Meeting, as presented. Commissioner Cecil Yates SECONDED. A roll call was taken and the MOTION CARRIED 3-0,by those present. Chairman Paul McDonald aye Vice-Chairman Lloyd Pew aye Commissioner Goodell abstained(absent 4/8/10) Commissioner Jeff Mangels aye Commissioner Cecil Yates abstained(absent 4/8/10) Page 1 of 4 AGENDA ITEM#2—CONSIDERATION of an EXTENSION of the approved CONCEPT PLAN for "La Bella Vita at Firerock", formerly "The Retreat at Firerock", Case Number CP2006-05. Continued from the April 8,2010,Planning and Zoning Commission meeting. Gene Slechta,Planner recounted the Commission's previous discussion and reiterated what was presented at the April 8, 2010, Planning and Zoning Commission meeting. Mr. Slechta again explained that the Concept Plan was previously approved on August 10, 2006. The applicant was once again requesting an additional one-year extension primarily due to the slow economy. Mr. Slechta mentioned that a Preliminary Plat was approved by the Planning and Zoning Commission on April 24, 2008 and the Preliminary and Final Plat was also approved by the Town Council on May 15, 2008. Mr. Slechta explained that a condition of approval of the Preliminary and Final Plat by the Town Council was to acquire an approval of a Utility Disturbance Permit prior to the recordation of the final plat. The Utility Disturbance Permit was approved by the Town Council on August 7,2008. Chairman Paul McDonald, Commissioners Cecil Yates and Jeff Mangels discussed further the possible ramifications to the community if the applicant broke ground on this project and then was unable to complete what they currently propose. The Commission had concluded at their last meeting that a 60-day extension of the applicant's request would be approved and the Commission would then direct staff to research and consult with the Town Attorney and find out if a construction assurance bond was an appropriate step to help guarantee the Town that this project would be completed or at least have the bond monies to return the site to its original condition. Staff performed the research, consulted the Town Attorney and presented his findings that this was not something the Town should request at this point in the development. • Mr. Paul Gilbert, Blus Gilbert PLLC, 4800 N. Scottsdale Road, #6000, Scottsdale, Arizona, represented the applicant and gave a brief presentation on the project and answered questions asked by the Commissioners. Commissioner Cecil Yates made a MOTION to approve an extension of the "La Bella Vita at Firerock" Concept Plan to May 15, 2011,with approval subject to the stipulations contained in the August 10, 2006 approval. Case Number CP2006-05. Vice-Chairman Lloyd Pew SECONDED the MOTION. A roll call was requested and the MOTION PASSED 4-1,with Chairman Paul McDonald casting the nay vote. NONE Page 2 of 4 AGENDA ITEM#4- SUMMARY OF COMMISSION REQUESTS None Requested. AGENDA ITEM#5-REPORT from Robert Rodgers, Senior Planner. Mr.Rodgers informed the Commission that the Town Manager was in the process of interviewing and selecting a new Development Services Director. Staff also was recommending that the currently scheduled Commission meetings dated June 24 and July 8,2010,be cancelled because of lack of activity. WORK STUDY SESSION Chairman McDonald opened the Planning and Zoning Work Study Session at 6:58 P.M. Item# 1 Topic of DISCUSSION AND DIRECTION to staff regarding the TOWN CENTER COMMERICAL DISTRICT(TCCD NOISE REGULATIONS). Robert Rodgers, Senior Planner gave a brief presentation and acknowledged Richard A. G.Turner,AICP, former Planning and Zoning Director for his participation in this report. Mr. Rodgers pointed out the only correspondence received was from a resident of Fountain Hills and the letter was previously forwarded to each Commissioner via email. (See attached exhibit"A"). Commissioner Cecil Yates spoke to information he would be presenting to staff regarding maximum permissible sound levels by receiving land use. (See attached exhibit"B"). Commissioner Mangels suggested that staff attempt to find a volunteer who was an Acoustical Consultant to help advise the committee. It was decided by the Commission that a subcommittee should be formed to study this issue. Commissioners Cecil Yates, Gary Goodell and Jeff Mangels volunteered to sit on this subcommittee to study and give possible direction to the Town Council regarding this issue. Chairman McDonald requested that staff contact the absent Commissioners Sherry Leckrone and Jerry Caldwell and inquire as to their ability to also sit on this subcommittee. Item#2 Topic of DISCUSSION AND DIRECTION to staff regarding PRODUCTION (TRACT)HOUSING DEVELOPMENT STANDARDS. Robert Rodgers, Senior Planner gave the presentation and Chairman Paul McDonald stated he liked the proposed Ordinance. No other questions were asked. Chairman McDonald requested that staff further develop the draft regulations. AGENDA ITEM#6-ADJOURNMENT. Commissioner Cecil Yates wanted to state for the record his appreciation to Richard Turner for his 5+ years of hard work while Director for the Planning and Zoning Department. The other Commissioners' followed suit and wished Mr. Turner good luck and gave him their thanks. The request was to extend the approval to May 15, 2011. The Concept Plan was approved August 10,2006.The plan is valid for one year but may be given extensions by the Planning&Zoning Commission. Continuing poor real estate market conditions necessitates the applicant's request for another extension. On April 8th,the commission asked for a continuance and requested staff to research and discuss with the Town Attorney the possibility of requiring a"Certificate of Completion"for the development project.This agreement with the applicant would provide some assurance that the"vertical construction"would be completed by some agreed to timetable. Staff has researched the usage of such a concept and communicated the research to the Town Attorney for (r. his opinion.Town staff and the Town Attorney are advising against the creation of such an agreement between the Town and the applicant.The Town Attorney is unable to find support for such a requirement in state statutes. Staff recommends that the applicant be granted an extension of the Concept Plan expiration to Page 1 of 2 May 15, 2011 as originally recommended in the staff report presented at the April 8,2010 Planning& Zoning Commission. I Wednesday,March 17,2010 Mr. Eugene Slechta Fountain Hills Council Fountain Hills Planning&Zoning Town of Fountain Hills 16705 Avenues of the Fountains Fountain Hills,Arizona 85268 Re: La Bella Vita property located within the FireRock Country Club Maser Planned Community Dear Mr. Slechta: The purpose of this letter is to request a one year extension for the following items for the La Bella Vita property: • One year extension from the Town of Fountain Hills Planning and Zoning Commission for the Concept Plan for the La Bella Vita property. • One year extension from the Town of Fountain Hills Council for the Utility Disturbance 4141. Permit for the La Bella Vita property. • One year extension to record the final plat for the La Bella Vita residential development. Over the past year we have and continue to work with the FireRock HOA Design Committee for final approval, as well as working with MCO the FireRock master planned community developer, relative to the necessary utility and draining easements for the subject development. Our extension requests outlined above are necessary because of the continued negative economy components that have a direct affect upon residential development in 2010. However, we will continue to work on and complete the necessary due diligence tasks to be positioned to move forward with the development once the economy shows stronger signs of recovery in 2011. The applicant shall provide a landscaping and lighting plan prior-to the issuance of any building permit and no occupancy permit shall,be issued prior to.the completion of all site improvements as depicted and approved. Gene Slechta, Planner gave the presentation and included a PowerPoint Presentation. Mr. Slechta explained that the Concept Plan was previously approved on August 10, 2006, with approved extensions dated April 23, 2009 and May 15, 2010. The applicant was once again requesting an additional one-year extension primarily due to the slow economy. Mr. Slechta mentioned that a Preliminary Plat was approved by the Planning and Zoning Commission on April 24, 2008 and the Preliminary and Final Plat was also approved by the Town Council on May 15, 2008. Mr. Slechta explained that a condition of approval of the Preliminary and Final Plat by the Town Council was to acquire an approval of a Utility Disturbance Permit by the Town Council prior to the recordation of the final plat. The Utility disturbance Permit was approved by the Town Council on May 15,2008. Ms. Deborah Ray, 16816 E. Parkview Avenue, Fountain Hills representing The Retreat at FireRock, LLP was in attendance to answer any questions from the Commissioners. Ms. Ray explained that the applicant had previously met with the FireRock Homeowners' Association and the issues expressed by the HOA were being resolved. Vice-Chairman Lloyd Pew expressed his support to approve the applicants request for an additional extension. Chairman Paul McDonald, Commissioners Jerry Caldwell and Jeff Mangels discussed the possible ramifications to the community if the applicant broke ground on this project and then was unable to complete what they currently propose. The Commission concluded that a 60-day extension of the applicant's request would be approved and the Commission would then direct staff to consult with the Town Attorney and find out if a construction assurance bond was an appropriate step to help guarantee 411 the Town that this project would be completed or at least have the bond monies to return the site to its original condition. Richard A. G. Turner, AICP, agreed to consult with the Town Attorney and present his findings on their request at the June 10, 2010,Commission meeting. Chairman Paul McDonald made a MOTION to continue this item until June 10, 2010, allowing the applicant and Town Attorney time to explore the possibility of including a completion agreement with their request for an extension. Chairman McDonald would also like the Commission to be able to approve any agreement at the June 10, 2010, Commission meeting for the "La Bella Vita at Firerock" Concept Plan, formerly "The Retreat at Firerock", Case Number CP2006-05. Mr. Turner also suggested that (;) communication between the Chairman and himself on agenda items would be helpful. Page 2 of 4 ffA FT Chairman Paul McDonald explained that the Commission had recently seen single item agendas and he wanted the other Commissioners' opinion to see if they agreed to direct staff to consolidate items on agendas for the Commission's approval, when possible. Chairman McDonald pointed out that the Town Council appears to be able to work with the Commissions draft meeting minutes. Vice-Chairman Lloyd Pew expressed that he was in favor of the Chairman's suggestion and possible direction. Mr. Turner verified with the Commissioners that their request was for staff to consolidate agenda items, when feasible, and the Director of Planning and Zoning or his designee would consult with the Chairman on time sensitive matters. That regulation does not allow amplified music at businesses with outdoor patios that is audible at a distance of 100 feet or more. Staff believes that the noise regulation in the TCCD Zoning District is too restrictive given the character of development that is encouraged to locate in this zoning district and the downtown area. The Commission heard from two members of the community, one of which spoke in favor of keeping the existing regulation. The Commission acted to initiate an amendment to the Zoning Ordinance regarding the noise regulation in the TCCD Zoning District and also requested a work study session to discuss and review the Town's options. In the report to the Commission for the March 11th meeting, staff indicated that if the noise regulation in the TCCD Zoning District were to be eliminated, there would still be noise regulation by virtue of Section 5.19 of the Zoning Ordinance. Upon further review, it appears that this would not be the case. Section 5.19 applies to proposed uses and requires the submittal of information to demonstrate that an activity will not exceed certain noise levels. This review of noise takes place at the time of Concept Plan or Special Use Permit review. Enforcement of this section would apply to uses that had submitted information pursuant to this performance standard and were found to be in violation, after the fact. The Town Code currently provides a noise regulation that applies to the generation of loud music. This is Section 11-1-7. A copy of this regulation is attached to this report. This regulation is enforced by the Sheriff's Office and would apply to the generation of loud music anywhere within the Town limits, without regard to Zoning. Amending the TCCD regulations address the noise regulation specific to the uses allowed in that Zoning District would not stop the enforcement of the noise regulation in the Town Code. Page 1 of 2 The characteristics of sound and the regulation of noise is a complex subject. In an effort to improve understanding of this matter, I have attached an excerpt on sound from the book "Site Planning" by Lynch and Hack. I have also attached a -mple or model noise ordinance (reference Section 172: Noise) that may prove helpful in the review of this topic. ne City of Scottsdale has also been considering changes to their noise regulations. They have supplied us with a copy of a draft regulation that staff has prepared, a copy of which is attached to this report. Scottsdale's draft is not intended as a specific proposal for consideration by the Commission, but rather as additional information on this subject. We have also attached noise regulations that have been adopted by the Town of Gilbert for your information. The purpose of the TCCD Zoning District reads in part "The intent of the district is to encourage the development and sustainability of a vibrant mixed-use area where residents and visitors can live, work, shop, dine, be entertained, enjoy community and cultural events and contribute to the economic viability of the Town Center area and the Town as a whole." This is consistent with the recently adopted Area Specific Plan for the downtown which encourages outdoor activities in an active and vibrant downtown. The Town may want to consider promulgating new noise regulations that would continue to protect residents from unnecessary and offensive noise and, at the same time, encourage live, outdoor entertainment that would take place in the downtown area. Recommendation(s): It is recommended that the Planning and Zoning Commission review the information provided with this report and offer guidance that staff would use to develop draft regulations. Section 18.06 Additional Regulations A. Any outdoor lighting shall be in conformance with the provisions in Chapter 8. All outside lighting shall not exceed twenty (20) feet in height and shall be fully shielded and directed away from residential or uses in the vicinity of the site. 0 Any recorded or live music or sound that is electronically amplified shall only be permitted at establishments with outdoor patios and shall not be audible at a distance of more than one-hundred (100) feet from the business premises from which it originates. C. If a business expands, it shall, in addition to the parking spaces in existence prior to such expansion, be required to provide only the number of additional parking spaces necessitated by the expansion. Required parking may be provided in accordance with a TCCD shared parking plan that is consistent with the shared parking model set forth below. D. All building permits for new construction shall include completion of all right-of-way improvements required for that type of development by the Subdivision Ordinance. E. AGENDA ITEM #3 — PUBLIC HEARING to receive comments on ORDINANCE #10-01, which outlines TEXT AMENDMENTS to the CUT & FILL and GRADING STANDARDS contained in the Fountain Hills Zoning and Subdivision Ordinance that would amend Chapters 1, 5 and 16 in the Zoning Ordinance and Articles 1 and 5 in the Subdivision Ordinance. Public Hearing Opened at 6:38 p.m. Robert Rodgers, Senior Planner gave the presentation and included background history of this previously reviewed Ordinance subject to minor changes by the Town's Attorney. Staff decided that there were enough minor changes that the Commission should have an opportunity to review those changes and then decide if they wished to forward the revised document to the Town Council. Staff recommended the Planning and Zoning Commission vote to forward a recommendation to the Town Council to approve the proposed text amendments. Chairman Paul McDonald asked if anyone from the public had requested to speak. No requests had been received. Chairman McDonald asked if there were any questions from the Commissioners. Commission Jeff Mangels asked if the Town Attorney altered the intent or had changed the regulations. Mr. Rodgers stated that only changes such as elimination of duplication of sections, minor text adjustments had been made by the Town Attorney and that was for clarity only and the ordinances re-numbered for consistency. Staff believed that the noise regulation in the TCCD Zoning District was too restrictive given the character of development that was encouraged to locate in the downtown area. Mr. Turner pointed out the existing TCCD sound/music regulation prohibits indoor amplified music of any kind at businesses that do not have an outdoor patio. Mr. Turner continued to say that those businesses with an outdoor patio are restricted to having outdoor music at a sound level that cannot be heard 100 feet from the business. Staff felt that this provision was overly restrictive and that the provision was not conducive to a lively and vibrant downtown environment. Mr. Turner stated that staff recommended that the Planning and Zoning Commission initiate an amendment to the Zoning Ordinance to delete Section 18.06, Paragraph B. Chairman Paul McDonald asked if there were any requests to speak to this issue. The following members of the community wished to speak(Exhibit B): 1. Richard Taylor, 16836 E. Widgeon Court, spoke against changing the existing ordinance in the TCCD Zoning District. 2. Chapter 11 of the Scottsdale Revised Code is hereby added as follows: CHAPTER 11 REGULATION OF UNREASONABLE NOISE Section 11-1. Purpose and scope. The purpose of this chapter is to promote the health and general welfare of the citizens and businesses of the city by protecting neighborhoods and the community at large against unreasonable noise. It being determined that certain levels of noises are detrimental to the health, quality of life, quiet enjoyment and welfare of the citizenry and it is in the public interest to regulate noise levels. Section 11-2. Definitions. (A) The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: (1) "A"band level means the total sound level of all noise as measured with a sound level `fir► meter using A-weighting network. The unit is the dB(A). (2) Ambient noise means the all-encompassing noise associated with a given environment, being usually a composite of sounds from many sources, near and far. For the purpose of this chapter, ambient noise level is the level obtained when the noise level is averaged over a period of fifteen (15) minutes without inclusion of noise from isolated identifiable sources, at the location and time of day near that at which a comparison is to be made. Averaging may be done by instrumental analysis in accordance with American National Standard S. 13-1971, or may be done manually as follows: (a) Observe a sound level meter for five (5) seconds and record the best estimate of central tendency of the indicator needle, and the highest and lowest indications. (b) Repeat the observations as many times as necessary to ensure that observations are made at the beginning and the end of the fifteen (15) minute averaging period and that there are at least as many additional observations as there are decibels between the highest high indication and the lowest low indication. (c) Calculate the arithmetical average of the observed central tendency indications. (3) Decibel means a sound pressure that is twenty(20) times the logarithm to the base 10 of the ratio of the pressure of sound to the reference pressure, 2 x 10-5 Newton/meter2. (5) Frequency. "Frequency" of a function periodic in time shall mean the reciprocal of the primitive period. The unit is the hertz and shall be specified. (6) Impulse noise means a noise of short duration, usually less than one second, with an abrupt onset and rapid decay. (7) Microbar means a unit of pressure commonly used in acoustics and is equal to one dyne per square centimeter. (8) Period means"Period"of a periodic quantity shall mean the smallest increment of time for which the function repeats itself. (9) Periodic quantity means oscillating quantity, the values of which recur for equal increments of time. (10) Pure tone noise means any noise which is distinctly audible as a single pitch (frequency) or set of pitches as determined by an enforcement officer. (11) Sound level. "Sound level" (noise level), in decibels (dB) is the sound measured with the A-weighting and slow response by a sound level meter. (12) Sound level meter means an instrument including a microphone, an amplifier, an output meter, and frequency weighting networks for the measurement of sound levels which satisfies the pertinent requirements in American Standard Specifications for Sound Level Meters S1.4-1971 or the most recent revision thereof. (13) Zoning District means those districts established, defined and described by the zoning ordinance as codified in Appendix B of the Scottsdale Revised Code. Section 11-3. Penalties. (A) It shall be a civil offense to violate any prohibition imposed by this chapter unless otherwise provided. (B) The penalty for a first violation shall be at least two hundred fifty dollars. (C)The penalty for a second violation within two years shall be at least five hundred dollars. (D)The penalty for a third or subsequent violation within two years shall be at least seven hundred and fifty dollars. (E) The penalty for the holder of a city issued special events permit that violates the noise conditions as stipulated in the authorizing permit shall be two thousand five hundred dollars The court shall not suspend any portion of a fine imposed by this subsection. Section 11-4. Authority to issue civil complaints (A) The City Manager or designee, a code official, Scottsdale police officer or the City Attorney may issue civil complaints to enforce violations of this Chapter. 6720398v3 Ordinance No. XXXX DRAFT Page 3 of 5 (B) Any person authorized to issue a civil complaint may also issue a notice of violation specifying actions to be taken and the time in which they are to be taken to avoid issuance of a civil complaint. Section. 11-5. Exemptions. (A) The following uses and activities shall be exempt from noise level regulations: (1) Air-conditioning equipment when it is in proper operating condition. (2) Lawn maintenance equipment when it is functioning with all mufflers and noise- reducing equipment in use and in proper operating condition; (3) Crowd noises or non-amplified noises resulting from the activities such as those planned by school, governmental or community groups; (4) Noises of safety signals, warning devices and emergency pressure relief valves; (5) Noises resulting from any authorized emergency vehicle when responding to an emergency call or acting in time of emergency; (6) Noises resulting from emergency work as defined in Section 11-2; (7) Noises of church chimes; (8) Power plant equipment during normal operation provided that no plant equipment may cause the noise level measured inside any sleeping or living room inside any residential dwelling unit to exceed forty-five (45) dB(A) between the hours of 10:00 p.m. and 7:00 a.m., nor fifty-five (55) dB(A) between the hours of 7:00 a.m. and 10:00 p.m. (9) Any noise created by any City of Scottsdale or City contractor vehicles, equipment or facilities while being operated or utilized for official business; and (10) An event being held pursuant to a city issued special events permit provided that the noise levels do not exceed the decibel levels authorized by the permit. (11) An unamplified human voice. Section 11-6. Measurement criteria. For the purpose of enforcement of the provisions of this chapter, noise level shall be measured on the A-weighted scale with a sound level meter satisfying at least the applicable requirement for Type 1 sound-level meters as defined in American National Standard S 1.4-1971 or the most recent revisions thereof. The meter shall be set for slow response speed, except that for impulse noises or rapidly varying sound levels, fast response speed may be used. Prior to measurement,the meter shall be verified, and adjusted to ±0.3 decibel by means of an acoustical calibrator. Section 11-7. (C) If the ambient noise level in any zoning district is measured and found to be in excess of the community noise standards described in subsection (a) of this section on or about the time of the offense, then the actual ambient noise level will be the community noise standard. (D) A noise level which exceeds the community noise standard by five (5) dB(A) or more, when measured at the affected area, the nearest property line, or, in the case of multiple-family residential buildings, when measured anywhere in one dwelling unit with respect to a noise emanating from another dwelling unit or from common space in the same building, shall be deemed a prima facie violation of this chapter. Section. 11-8. Special noise sources. (A) It shall be unlawful for any person within any residential zone of the city to use or operate any radio receiving set, musical instrument, phonograph, television set or other machine or device for the producing or reproducing of sound in such a manner as to disturb the peace, quiet and comfort of neighboring residents or any reasonable person of normal sensitiveness residing in the area. Any noise level exceeding the community noise standard at either the property line or the affected area of any property(or, if a condominium or apartment house, within any adjoining apartment) by more than five (5) decibels shall be deemed to be prima facie evidence of a violation of the provisions of this section. (B) It shall be unlawful for any person to operate any machinery, equipment, pump, fan or similar mechanical device in such a manner as to disturb the peace, quiet and comfort of neighboring residents or any reasonable person of normal sensitiveness residing in the area. Any noise which would cause the noise level at either the property line or the affected area of any property to exceed the applicable community noise standard by more than five (5) decibels shall be deemed to be a prima facie evidence of a violation of the provisions of this section. 6720398v3 Ordinance No. XXXX DRAFT Page 5 of 5 Section 11-9 Habitual Offenders A person who commits a violation of this chapter after having previously been found responsible by a court on four or more separate occasions for committing a civil violation of this chapter within a twenty-four month period, whether by admission, by default, or by judgment after a hearing shall be guilty of a class one misdemeanor and shall be punished by a minimum fine of one thousand five hundred dollars. Sound level meter means an instrument including a microphone, an amplifier, an output meter, and frequency weighting networks used to measure sound levels which satisfies the pertinent requirements in American National Standard Specifications for Sound Level Meters S1.4-1971 or the most recent revision thereof. (c) Exemptions. The following uses and activities shall be exempt from noise level regulations: (1) Air-conditioning, pool and spa equipment when it is functioning in accord with manufacturer's specifications and is in proper operating condition provided that no unit may cause the noise level to exceed the residential community noise standards set forth in subsections (e)(1) and (3); (2) Lawn maintenance equipment when it is functioning in accord with manufacturer's specifications and with all mufflers and noise-reducing equipment in use and in proper operating condition; (3) Nonamplified noises resulting from the activities such as those planned for school, governmental or community groups or duly authorized by such groups; (4) Noises of safety signals, warning and alarm devices, emergency generators, emergency generators, storm warning sirens, emergency pressure relief valves or horns and the authorized testing of such equipment; (5) Noises resulting from any authorized emergency vehicle when responding to an emergency call or acting in time of emergency; (6) Noises resulting from emergency work as defined in subsection (b); (7) All noises coming from the normal operations of railroad trains; ( (8) Noises of church chimes; (9) Organized sporting events; (10) Noises created by aircraft; (11) Public or utility owned or operated stationary mechanical equipment so long as such equipment is properly functioning pursuant to manufacturer's specifications; (12) Road and street noise generated from the normal operation of traffic except as regulated herein. (d) Measurement criteria. For the purpose of enforcement of the provisions of this section, noise level shall be measured on the a-weighted scale with a sound level meter. The meter shall be set for slow response speed, except that for impulse noises or rapidly varying sound levels, fast response speed may be used. Prior to measurement, the meter shall be verified, and adjusted according to the manufacturer's specifications by means of an acoustical calibrator. (e) Allowable noise levels. (1) It is unlawful for any person to create any noise which would cause the noise level measured from the inside, with the windows and doors closed, of a complainant's residential dwelling, enclosed commercial building or suite, or enclosed industrial building or suite to exceed the following community noise standards for more than 15 minutes in duration and more than two times in one hour: Noise Standard 4IW i Zone Time dB(A) Residential 10:00 p.m.--5:00 a.m. 45 5:00 a.m.--10:00 p.m. 55 Commercial 10:00 p.m.--5:00 a.m. 55 5:00 a.m.--10:00 p.m. 65 Industrial 10:00 p.m.--5:00 a.m. 60 5:00 a.m.--10:00 p.m. 70 (2) If the measurement location is on a boundary between two zoning districts, the lower noise standard shall apply. (3) If the ambient noise level in a subdivision in a residential zoning district is measured and found at any time to be in excess of the community noise standards, then the actual ambient noise level will be the community noise standard for that subdivision. It is unlawful for the noise level of power plant equipment during normal operation to exceed the industrial community noise standards set forth in section 42- 61(e)(1) and (3). (b) Sound trucks; loudspeakers; other sound amplifiers. It is unlawful to play, operate or use any device known as a sound truck, loudspeaker or sound amplifier, radio or phonograph with a loudspeaker or sound amplifier or any instrument of any kind or character which emits loud and raucous noises and is attached to and upon any vehicle unless such person in charge of such vehicle shall have first applied to and received a permit from the chief of police to operate any such vehicle so equipped. Such permit shall be granted unless the chief of police believes the activity will disturb the public peace. (c) Motor vehicles. (1) Vehicle repair. It shall be unlawful for any person within any residential area of the town to repair, rebuild or test any motor vehicle (between the hours of 10:00 p.m. of one day and 5:00 a.m. of the next day) in such a manner that a reasonable person of normal sensitiveness residing in the area is caused discomfort or annoyance. (2) Motor vehicle mufflers. It is unlawful for any person to operate a motor vehicle which shall not at all times be equipped with a muffler upon the exhaust thereof in good working order and in constant operation to prevent excessive or unusual noise, and it is unlawful for any person operating any motor vehicle to use a cutout, bypass or similar muffler elimination appliance. (3) Braking devices. It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated within the town any compression release or other engine braking device designed to aid in the braking or deceleration of any vehicle which results in noise in excess of that which would otherwise be produced from such vehicle without such braking device. The provisions of this division do not apply to public safety vehicles. (4) Vehicle operation. No person shall operate either a motor vehicle or combination of vehicles at any time or under any condition of grade, load, acceleration or deceleration in such a manner as to exceed the following noise limit of the category of motor vehicle based on a distance of 50 feet from the center of the lane or travel within the speed limits specified in this section: Table Inset Speed Limit Speed Limit of More or of35 mph Less Than 35 mph (i) Any motor vehicle with a manufacturer's gross vehicle weight 88 dB(A) 92 dB(A) rating of 6,000 pounds or more, any combination of vehicles towed by such motor vehicle, and any cso, motorcycle other than a motor-driven cycle (ii) Any other motor vehicle and any combination of vehicles towed by 82 dB(A) 86 dB(A) such motor vehicles (d) Reserved. (e) Schools, churches and hospitals. It shall be unlawful for any person to create any noise on any street, sidewalk or public place adjacent to any school, institution of learning or church while the same is in use or adjacent to any hospital, which noise unreasonably interferes with the workings of such institution or which disturbs or unduly annoys patients in the hospital; provided that conspicuous signs are displayed in such streets, sidewalk or public place indicating the presence of a school, church or hospital. (Ord. No. 1410, § I, 7-23-02; Ord. No. 1688, § 1, 10-11-05; Ord. No. 2124, § I, 2-26-08) Sec. 42-63. Construction of buildings and projects. (a) General provisions. It shall be unlawful for any person to pour concrete or perform construction work in the town, except within the time periods specified herein or if the noise level created thereby is in excess of the applicable community noise standards set forth in section 42- 61(e)(1) and (3) by five dB(a) at either the nearest property line or the affected area of the 11411., property unless a permit has been obtained beforehand from the building and code compliance department. As used in this section, "construction work" shall include (1) operating construction- related equipment, (2) performing outside construction work, (3) performing outside repair work on buildings, structures or projects and (4) operating a pile driver, power shovel, pneumatic hammer, derrick, power hoist or other construction-type device. (b) Start/stop times. (1) Concrete. Concrete may be poured and concrete mixing trucks may be idled, between the hours of 5:00 a.m. and 10:00 p.m. each day or at such other times as authorized by permit. (2) All other construction; residential zones in or within 500 feet. All other construction work shall not begin prior to 5:00 a.m. and must stop by 10:00 p.m. each day in or within 500 feet of a residential zone or at such other times as authorized by permit. (3) Commercial and industrial zones. Construction work in commercial and industrial zones not within 500 feet of a residential zone shall not begin prior to 5:00 a.m. and must stop by 10:00 p.m. or it may be conducted at such times as authorized by permit. (c) Weekends and holidays excluded. Notwithstanding the foregoing, construction work shall not begin prior to 7:00 a.m. and must stop by 7:00 p.m. and concrete pouring shall not begin prior to 6:00 a.m. and must stop by 7:00 p.m. on any Saturday, Sunday or holiday, unless such other times are authorized by permit. (d) Permit. Construction work may be conducted at different times than otherwise permitted herein if, upon written application, a permit is obtained from the building and code compliance department. In granting such permit, the director of the building and code compliance department shall consider whether construction noise in the vicinity of the proposed work site would be less objectionable at night than during the daytime because of the different population levels or different neighborhood activities; whether obstruction and interference with traffic, particularly on streets of major importance, would be less objectionable at night than during the daytime; whether the kind of work to be performed emits noises at such a low level as to not cause significant disturbance of the reasonable peaceful enjoyment of the surrounding neighbors in the vicinity of the work site; whether the neighborhood of the proposed work site is primarily residential in character wherein sleep would be disturbed; whether great economic hardship would occur if the work were spread over a longer time; whether the work will abate or prevent hazard to life or property; whether the proposed early morning or night work is in the general public interest. The director shall prescribe such conditions, working times, types of construction equipment to be used and permissible noise emissions as the director deems appropriate in the public interest. No permit shall be required to perform emergency work necessary to restore property to a safe condition following a public calamity, work required to protect the health, safety or welfare of persons or property or work by private or public utilities when restoring utility service. (e) Revocation of permits; appeal. The director may revoke any permit granted hereunder upon complaints based upon substantial evidence that the construction work causes significant disturbance of the reasonable peaceful enjoyment of the surrounding neighbors in the vicinity of the work site. Any person aggrieved by the granting of a permit or the refusal to grant a permit by the town manager or authorized representative may appeal the decision to the town council who shall hear such appeal at the next regularly scheduled meeting of the town council. (f) Stop orders. Whenever any work on a construction project is in violation of the provisions of this section, the director may order the construction project stopped by notice in writing served on any persons responsible for the project, and any such persons shall forthwith stop work on the project until a permit is obtained. (a) Notwithstanding any other provision of this chapter, and in addition thereto, it shall be unlawful for any person without justification to make or continue, or cause or permit to be made or continued, any unnecessary, excessive or offensive noise, which disturbs the peace or quiet of any neighborhood or which causes discomfort or annoyance to any reasonable person of normal sensitiveness residing in the area. The following information is provided to assist in the preparation and submittal of an application for Administrative Design Review for a residential standard plan. 1. Application Filing—For an application to be accepted, the applicant must provide all of the required information described in the submittal checklist at the time of formal submittal. Incomplete applications will not be accepted. 2. Staff Review — Upon receiving a complete application, the submitted application will be routed to Town staff and affected agencies for review and comments. After this review is completed, the comments are consolidated and returned to the applicant within twenty (20) days of submission. The applicant is responsible for addressing staff comments and submitting revised plans. Staff will then respond to the re-submittal within ten (10)days. 3. Notice of Decision — The Planning Administrator will either approve, approve with conditions, or deny the application and will set forth any proposed findings and decision on a Notice of Administrative Decision. The decision of the Planning Administrator regarding administrative residential design review may be appealed by the applicant to the Planning & Zoning Commission for review and action. 4. Building Permits—Only after the project has received all approvals through the Town processes can IIIconstruction documents be submitted for review. All construction documents for a project must conform to the exhibits approved during residential design review, including any conditions of approval. 5. Inactive Cases — All applications need to be actively pursued to a decision. If no activity has occurred on an application for 180 days, the application will be determined to be inactive, deemed to be withdrawn and the file will be closed. Thirty (30) days prior to that date the staff will notify the applicant in writing. The applicant may submit a written request that the application remain active, with an explanation for the inactivity. Detailing (i.e. veneer stone, brick, shutters, window mullions, decorative corbels, etc) as shown on the approved elevations shall be standard and clearly labeled on the construction documents. Substantial deviations from the approved elevations MUST be reviewed by the Planning Administrator. 7.No similar rear elevations shall be allowed adjacent to one another along open spaces or public right-of-ways. Window detailing shall be applied to the side or rear elevations that side or back onto an open space or public street. The detailing shall be clearly noted on the construction documents. • 8. Wainscoting, pop-outs, and other horizontal banding details applied to the front elevation shall be wrapped around the corner of the house to the return wall or to a prominent end-column feature. 9. All exposed metal roof vents and utility equipment shall be painted to match the adjacent roof or building color. This shall be clearly noted on the construction documents. 10. All ground-mounted mechanical equipment within a side or rear yard of a lot shall be fully screened from view by a finished wall. 11. These conditions and any additional conditions approved by the Planning Administrator shall be placed on the cover sheet of each house plan construction submittal for each individual standard plan. 8 • EXHIBIT 2: RESIDENTIAL STANDARD PLAN TRANSFER POLICY A. The intent of the Standard Plans Transfer policy is to provide an effective, customer friendly administrative review process to allow for the use of approved standard plans in a different subdivision. Concerns regarding sameness in the community and new design requirements over time are addressed by establishing minimum criteria. Minimum criteria for administrative review, submittal requirements, and process are outlined below. B. Minimum criteria for consideration of administrative review of Standard Plans: 1. Standard Plans must have received approval by the Planning Administrator within the last two (2) Years. 2. The maximum number of lots for the originally approved standard plans plus lots in subsequently approved projects for these standard plans shall not exceed 300 lots. 3. The lot size for the approved standard plans shall be comparable to the lot size of the proposed subdivision. Product designed for smaller lots has a limited amount of detail and massing. Product designed for larger lots requires additional detailing. Staff may require additional design features for approved standard plans to be acceptable for a lot size that is larger than the original lot size. 4. The original approval must have a minimum of three standard plans approved by the Planning Administrator. 5. Approved standard plans from separate projects may be combined to form a proposed set of standard plans to transfer. A minimum of three standard plans is required for the proposed subdivision. Building elevations for this new set of standard plans must be compatible and provide a unified design theme. 6. All stipulations for the approved standard plans shall be maintained. S 7. Additional stipulations may be required by staff to comply with design policies related to the proposed transfer. 8. Additional stipulations may be required for design features required by an Ordinance. The approved standard plans shall meet zoning standards in the proposed subdivision. 9. No zoning ordinance amendment will be supported to accommodate the product transfer. C. Submittal and Processing Requirements: 1. A completed application for administrative architectural design review. 2. Payment of the fee for an administrative review. 3. A project narrative describing how the proposal meets the criteria stated above for consideration of transferring standard plans. 4. If additional design requirements are requested by staff to comply with Criteria #3 above, the new set of standard plans must be approved by the Planning Administrator. If a new standard plan is submitted for review to add to the new set of standard plans, the applicant shall submit this for administrative review and pay a separate administrative fee. 5. Provide a lot fit analysis that includes zoning setbacks and lot coverage. Provide information on the number of lots the approved set of standard plans were originally approved for, total number of lots approved in subsequent standard plan transfers (if applicable), and the total number of lots requested with this proposal.
