HomeMy WebLinkAboutBA.1991.0611.Minutes TOWN OF FOUNTAIN HILLS MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT JUNE 11, 1991 A public meeting of the Fountain Hills Board of Adjustment was convened and called to order by Chairman Roland Britten at 7:00 p.m., Tuesday June 11, 1991 in the Town Hall Offices located at 16836 E. Palisades, Building C, Fountain Hills, Arizona. ROLL CALL - Roll call was taken and present for roll call were the following members of the Fountain Hills Board of Adjustment: Chairman Roland Britten, Vice-Chairman George Bard, Commissioner Joel Katl.eman, Commissioner Paul Kolwaite, and Commissioner Ear] Stavely. Also present were Associate Planner Loras Rauch and Administrative Assistant Claire Wilhelm. AGENDA ITEM #3 - INVOCATION AND PLEDGE TO THE FLAG Chairman Roland Britten gave the invocation and the pledge to the flag was given. AGENDA ITEM #4 - CONSIDERATION OF THE MINUTES Lir Commissioner Katleman made a MOTION to dispense with the reading of the minutes. Vice-Chairman Bard SECONDED and the motion passed unanimously. AGENDA ITEM #5 - VARIANCE #V91-006 - DANIEL L. BOWERMAN Chairman Britten opened the hearing by reading the criteria the Board must go by to the Bowerman's. He stated that he wanted the Bowerman's to understand where the Board would be coming from. The Board then asked Mr. Bowerman to give his side. Mr. Bowerman explained to the Board that he was wanting to add more bedrooms to his existing house. He stated that the work was begun "some time ago" and that just recently the framing went up and at that point the Bowerman's got into some trouble with the Town. He went on to present new evidence - saying that he had found out, that day, that his neighbors fence was possibly three (3) feet onto his property and that the measurements were taken from the fence, which he assumed was on the property line. He stated that the reason for the construction was he was trying to give all his children their own room. Commissioner Kolwaite asked if the pad could be lengthened both to what is the back yard and toward what is the front yard and achieve the desired goal? Mr. Bowerman answered by saying that the electrical service would be in the way. There was some discussion on the new evidence regarding the property line and the fence. Mr. Bowerman stated that the survey was going to be clone by a registered engineer to determine the lot lines. Further discussion centered on whether or not to table the decision until the survey was done. Commissioner Kolwaite made a MOTION wait on the decision until the lot lines were • established. The motion died for lack of a second. Commissioner Katleman felt that there was possibly a special circumstance in this situation. However, it was pointed out that if any one of the criteria was not met, the variance had to be denied regardless of the personal feelings of the Board. Vice-Chairman Bard made a MOTION to deny the variance. Commissioner Stavely SECONDED. At this time the applicants expressed disappointment. Mrs. DeFranze expressed great concern over the apparent decision of the Board. She stressed that the addition was for the applicant's children, not for strangers. At this point Chairman Britten told Mrs. DeFranze that her point was well taken. He then asked the Board if there was further discussion on the case. There was no further discussion and the motion passed unanimously. AGENDA ITEM #6 - ADJOURNMENT Vice-Chairman Bard made a MOTION to adjourn. Commissioner Stavely SECONDED and the motion passed unanimously.
