TOWN OF FOUNTAIN HILLS
MINUTES OF THE MEETING OF THE
BOARD OF ADJUSTMENTS
NOVEMBER 12, 1991
A public meeting of the Fountain Hills Board of Adjustment was convened and
called to order by Commissioner Kolwaite at 7:01 p.m., Tuesday, November 12, 1991
in the Town Court Room located at 16836 E. Palisades Blvd., Building C, Fountain
Hills, Arizona.
ROLL CALL - Roll call was taken and present for roll call were the following
members of the Fountain Hills Board of Adjustment: Commissioner Joel Katleman,
Commissioner Paul Kolwaite, and Commissioner Earl Stavely. Also present were
Associate Planner Loras Rauch and Administrative Assistant Joan McCartney. With
an excused absence were Chairman Roland Britten and Vice-Chairman George Bard.
AGENDA ITEM #3 - INVOCATION AND PLEDGE TO THE FLAG
After the pledge to the flag, the invocation was given by Commissioner Stavely.
AGENDA ITEM #4 - CONSIDERATION OF THE MINUTES OF SEPTEMBER 10, 1991.
Commissioner Katleman made a MOTION to accept the minutes as written.
Commissioner Stavely SECONDED and the motion passed unanimously.
AGENDA ITEM #5 - VARIANCE #V91-009 - ROBERT WOOD FOR: JOSEPH D'AGOSTINO
Commissioner Kolwaite asked Mrs. Rauch to explain to the Board the circumstances
which brought about the request for a variance. Mrs. Rauch pointed out
particulars of the lot and stated that the applicant had requested a twenty (20)
foot setback for the front yard instead of the forty (40) foot setback requirement
in an R1-35 zoning district. Mrs. Rauch explained the Hillside Development
Standards as they applied to the applicant's lot. Mrs. Rauch also stated that Mr.
Wood, the architect, had made an effort to design the house to fit the lot and
had stepped the house down the hillside three (3) and four (4) levels. Mrs.
Rauch pointed out that had Mr. Wood kept the house at the forty (40) foot
setback line, the house would be down the hill, have no street presence and be
out of compliance with the Hillside Development. Standards for lot disturbance.
Commissioner Kolwaite asked Mrs. Rauch for the Staff Recommendation. Mrs.
Rauch told the Board that the Staff recommended approval of the variance.
Commissioner Kolwaite asked Mr. Wood if he had additional comments. Mr. Wood
further elaborated and confirmed what Mrs. Rauch had stated. When asked by
the Board which homeowners had written letters opposing the variance, Mrs.
Rauch pointed out on a zoning map the particular lots and stated that none of
the homes were on Sunburst Drive. Commissioner Kolwaite asked for any further
discussion and received none.
Commissioner Stavely made a MOTION to grant thy' variance based on Staff
recommendation. Commissioner Katlernan SECONDED and the motion passed
unanimously..

AGENDA ITEM #6 - DISCUSSION OF TRANSPORTATION ARRANGEMENTS FOR BOARD
OF ADJUSTMENT WORKSHOP ON NOVEMBER 15, 1991
It was decided that a Town vehicle would be used to transport Commissioners
Stavely, Bard, and Katleman and Associate Planner Rauch to the Workshop.
Commissioner Kolwaite would be driving his own vehicle to the afternoon session.
AGENDA ITEM #8 - ADJOURNMENT
Commissioner Katleman made a MOTION to adjourn the meeting. Commissioner
Stavely SECONDED and the motion passed unanimously.
The meeting adjourned at 7:27 p.m.
