HomeMy WebLinkAboutBA.1992.1006.Minutes TOWN OF FOUNTAIN HILLS MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT OCTOBER 6, 1992 A public meeting of the Fountain Hills Board of Adjustment was convened and called to order by Vice- Chairman Paul Kolwaite at 7:00 p.m., Tuesday, October 6, 1992 in the Town Council Chambers located at 16836 E. Palisades Blvd., Building C, Fountain Hills, Arizona. AGENDA ITEM #1 - CALL TO ORDER Vice-Chairman Kolwaite called the meeting to order at 7:00 p.m. AGENDA ITEM #2 - ROLL CALL, PLEDGE TO THE FLAG, AND INVOCATION Roll call was taken and present for roll call were the following members of the Fountain Hills Board of Adjustment: Vice-Chairman Paul Kolwaite, Boardmember Donald Andrews, and Boardmember Earl Stavely. Also present were Associate Planner, Loras Rauch and Administrative Assistant, Joan McCartney. After the pledge to the flag, the invocation was given by Boardmember Andrews. AGENDA ITEM #3 - CONSIDERATION OF MINUTES - SEPTEMBER 8, 1992 Boardmember Andrews made a MOTION that the minutes of September 8, 1992 be accepted as written. •�r Vice-Chairman Kolwaite SECONDED and the motion CARRIED unanimously. AGENDA ITEM #4 - REVIEW AND CONSIDER VARIANCE REQUEST BY: CUSTOM ABODE BUILDERS (V92-14) 16867 N. STONERIDGE COURT PLAT 505C, BLOCK 1, LOT 42 FOUNTAIN HILLS, ARIZONA Mrs. Rauch read from the Staff Report, Findings of Fact, Analysis and Recommendation. Mrs. Rauch went on to explain that the house has been placed at a 28 foot setback as opposed to a 20 foot setback to accommodate the Town's driveway policy for maximum slope. Boardmember Andrews asked if other alternatives concerning the driveway slope had been reviewed and was told by Mrs. Rauch that other alternatives had been considered, but that the solution presented appeared to be the most viable. The applicant, Mark Swanner, explained to the Board that the perimeter retaining wall had been placed on the property away from the north property line to accommodate the surrounding property owners,keep within the retaining wall height limitations, and in addition, allow for adequate drainage of the area. 1 Mr. Donald Drake,the neighbor to the north, stated that he had no objection to approval of the application and that he would prefer that the retaining wall configuration remain as Mr. Swanner had presented it to allow for drainage. Mr. Swanner stated that he had no problem with keeping the retaining wall configuration as presented. Boardmember Andrews made a MOTION that, after reading the Standards for Review, the Findings of Fact and the Recommendation contained in the Staff Report, the application be approved with the stipulation that the retaining wall remain away from the north property line as proposed. Boardmember Stavely SECONDED and the motion CARRIED unanimously. AGENDA ITEM #8 - ADJOURNMENT Boardmember Stavely made a MOTION to adjourn the meeting. Boardmember Andrews SECONDED and the motion CARRIED unanimously. Stoneridge Court aka Lot 42, Blk. 1, Plat 505-C REQUESTED ACTION: Requesting a Variance to allow an increase in the allowable lot disturbance area from 30% as required by the Hillside Development Standards to 86.2% as proposed by the Applicant. (R1-10) SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT 10,000 SQUARE FEET PER DWELLING UNIT 9.5 Intensity of Use Regulations. The intensity of use regulations are as follows: (4) Lot Coverage: The maximum lot coverage shall be thirty (30%) percent of the lot area. ARTICLE XXIV. HILLSIDE DEVELOPMENT STANDARDS 24.1 Purpose. The principal purpose of the hillside development standards is to allow the reasonable use and development of hillside areas while promoting the public health, safety,convenience and general welfare of the citizens of the Town of Fountain Hills and maintaining the character, identity, and image of hillside areas.
