HomeMy WebLinkAboutBA.1993.0706.Minutes TOWN OF FOUNTAIN HILLS �r- MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT JULY 6, 1993 A public meeting of the Fountain Hills Board of Adjustment was convened and called to order by Vice- Chairman Don Andrews at 7:00 p.m.,Tuesday, July 6, 1993 in the Town Hall Conference Room located at 16836 E. Palisades Blvd., Fountain Hills, Arizona. AGENDA ITEM #1 - CALL TO ORDER Vice-Chairman Andrews called the meeting to order at 7:00 p.m. AGENDA ITEM #2 - ROLL CALL Roll call was taken and present for roll call were the following members of the Fountain Hills Board of Adjustment: Vice-Chairman Donald Andrews, Commissioner Paul Kostura, Commissioner Samuel Nicholson, and Commissioner Earl Stavely. Also present were Associate Planner, Loras Rauch and Administrative Assistant, Joan McCartney. Chairman George Bard had an excused absence. AGENDA ITEM #3 - PLEDGE TO THE FLAG AND INVOCATION Vice-Chairman Andrews dispensed with the pledge to the flag and invocation because of the lack of a flag in the conference room. `fir. AGENDA ITEM #4 - SWEARING IN OF BOARD MEMBERS: EARL STAVELY Magistrate Stuart Shoob swore in Earl Stavely as a Boardmember on the Fountain Hills Board of Adjustment. AGENDA ITEM #5 - CONSIDERATION OF MINUTES - JUNE 8, 1993 Boardmember Nicholson made a MOTION that the minutes of June 8, 1993 be accepted as written. Boardmember Kostura SECONDED and the motion CARRIED unanimously. AGENDA ITEM #6 - REVIEW AND CONSIDER VARIANCE REQUEST BY: STUART & CHRISTA FARR (#93-03) 15660 TEPEE DRIVE PLAT 505B, BLOCK 1, LOT 80 FOUNTAIN HILLS, ARIZONA Mrs. Rauch presented the Staff Report on case number V93-03. Boardmember Kostura asked what the distance to the curb from the house was and was told by Mrs.Rauch that it was 16 feet,but that the Board could only be concerned with the distance to the property line from the garage which was 6 feet. 1 Boardmember Stavely asked if the Zoning Ordinance setback requirements or the driveway policy took precedence. Mrs. Rauch stated that the Zoning Ordinance would take precedence because although the Town Engineer had developed the Driveway Policy,she wasn't certain that it was mandated by law. Mrs. Rauch stated that she would check with the Town Attorney for a more defmite determination. Boardmember Stavely asked what the front yard setback on the neighboring property was and was told by Mrs. Rauch that a variance had been granted by the county for a 6 foot front yard setback. Vice-Chairman Andrews asked if the garage was attached. Mrs. Rauch explained that the garage was attached and that access to the home could be obtained by interior steps and that access to the front door was by exterior steps. Mr. Wayne Lee, Cervantes Court, stated that he was within a 300 foot radius of the property in question and wanted to observe the process by which a variance is heard. Mr. Lee offered no objection to the variance. Vice-Chairman Andrews wanted it entered into the record that neither the applicant nor his representative was present for the meeting. Boardmember Nicholson made a MOTION that the variance be granted for a six foot front yard setback at the garage only. Boardmember Stavely SECONDED and the motion CARRIED unanimously. AGENDA ITEM #7 - ADJOURNMENT Boardmember Nicholson made a MOTION that the meeting be adjourned. Boardmember Stavely SECONDED and the motion CARRIED unanimously.
