Kingstree Blvd. Case #V 2015-01 Owner/Applicant: Steve Shain Applicant Contact Information: 17052 E Kingstree Blvd, Fountain Hills, 85268 602-770-1075 Property Location: 17052 E Kingstree Blvd, Fountain Hills, 85268 (Plat 204, Blockl0, Lot 10) (APN: 176-08-288) Related Ordinance, Policy or Guiding Principle: Town Code Article 2-8-4 — Board of Adjustment Duties Town Code Article 2-8-6 — Variances 2006-2010 Strategic Plan — Conformance with Town Regulations Staff Summary (background): The residence located on the corner of Kingstree Blvd and Zephyr Drive at 17052 E Kingstree Blvd, is in the R1-10 RUPD Zoning District. The property currently has a driveway accessing off Kingstree Blvd leading to a carport that will accommodate two off-street parking spaces. There is also room for additional off-street spaces in the existing driveway. The current use is conforming and lot coverage restrictions are met. There is currently a pre-existing, non-conforming portion of the home as well as a screen wall within the east street side yard setback facing Zephyr Drive. Page I u1 7 Variance: 17052 E.Kingstree Blvd Case:V 2015-01 There is an existing storage shed located within three feet (3') of the west side property line. The storage shed is a small detached structure and conforms to the zoning setbacks at this time. This application is requesting a zoning variance in order to allow the applicant to enclose the carport and attach it to the existing storage shed on the west side of the property. Attaching the storage shed to the primary structure will create a non-conformity that does not currently exist as it will cause the shed to be considered as part of that primary structure and require that it meet the home's 7' side- yard setback requirement rather than the 3' side-yard setback requirement of a detached accessory structure. Staff may not knowingly approve such a renovation if it will result in a non-conforming situation where none currently exists. The variance request is from Section 5.06.B to allow an enclosed carport (garage) and attached storage shed to be within the 7' side building setback (within approximately 3') of the property line. Chapter 5- GENERAL PROVISIONS Section 5.06 Yard, Lot, and Area Requirements B. Application: No building shall be erected, nor shall any existing buildings be altered, enlarged, moved, or rebuilt, nor shall any open space surrounding any building be encroached upon or reduced in any manner, except in conformity with the yard, lot, area and building location regulations hereinafter designated for the zone in which such building or open space is located, except as otherwise specifically provided. An additional zoning ordinance section which applies is: Chapter 4-NONCONFORMING USES AND STRUCTURES Section: 4.01 Nonconforming Uses and Structures E. Extensions: 1. Any extension of a nonconforming structure shall conform with all regulations for the zoning district in which such structure is located. 2. All changes to distinguishing traits or primary features of the use of a building or land as evidenced by increased parking requirements, change of occupancy, change of outside storage, or other features, occurring to existing properties after the effective date of this Zoning Ordinance, shall be subject to all of the provisions of this Zoning Ordinance. Both the carport and the shed currently exist and are conforming structures. Portions of the carport roof rest on top of the shed for support. Roof-only connections are not considered as "attached" for the purposes of this regulation. In order to be considered as attached, the structures must share at least 4' of common wall or a doorway. The applicants' proposal is to fully enclose the carport and attach the outer walls to the shed. The shed will then become a storage room in the new garage space which will only be accessible from the interior of the garage. Page 2 of 7 Variance: 17052 E. Kingstree Blvd Case V 2015-01 CODE REQUIREMENTS: Town Code Article 2-8 BOARD OF ADJUSTMENT Section 2-8-4 Duties B. It shall be the duty of the board of adjustment to hear and decide appeals for variances from the terms of the zoning code only, if because of special circumstances applicable to the subject property, including its size, shape, topography, location or surroundings, the strict application of the zoning code will deprive such property owner of privileges enjoyed by owners of other property of the same classification in the zoning district. Any variance granted is subject to such conditions as will assure that the adjustment authorized shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located. C. The board of adjustment may not: 1. Make any changes in the uses permitted in any zoning classification or zoning district, make any changes in the terms of the zoning code or make changes to the zoning map, provided the restriction in this paragraph shall not affect the authority to grant variances pursuant to this article. 2. Grant a variance if the special circumstances applicable to the property are self-imposed by the property owner. Town Code Article 2-8 BOARD OF ADJUSTMENT Section 2-8-6 Variances Every variance shall be personal to the applicant and shall run with the land only after completion of any structure or structures authorized thereby. Zoning Ordinance Chapter 2 PROCEDURES Section 2.07 Appeals and Variances B. Variance. 1. Any aggrieved person may appeal to the Board of Adjustment for a variance from the terms of the Zoning Ordinance if, because of special circumstances applicable to the property, including its size, shape, topography, location, or surroundings, the strict application of the Zoning Ordinance will deprive such property owner of privileges enjoyed by owners of other property of the same classification in the same Zoning District. Any variance granted shall be made subject to such conditions as will assure that the adjustment authority shall not constitute a granting of special privileges inconsistent with the limitations upon other properties in the zone in which such property is located. Pay.3 of 7 Variance. 17052 E Kingstree Blvd Case.V 2015-01 2. The Board shall hear the appeal at the next regularly scheduled meeting after the required advertising requirements have been fulfilled. Notice of the hearing shall be made by publishing a notice thereof in the official newspaper of the Town and by posting the property affected not less than fifteen (15) days prior to the hearing. The notice shall set forth the time and place of the hearing and include a general explanation of the matter to be considered. 3. A variance shall not be granted by the Board unless the alleged hardship caused by literal interpretation of the provisions of this ordinance results in more than personal inconvenience and/or personal financial hardship, and is not the result of actions of the applicant. 4. In granting a variance, the Board shall impose such conditions and safeguards as are appropriate to ensure that the purpose and intent of this ordinance remain intact. 5. No nonconforming use or violations of this ordinance with respect to neighboring lands, structures, or buildings in the same Zoning District, and no permitted use of lands, structures or buildings in other zoning districts shall be considered grounds for granting a variance. 6. Every variance shall be personal to the applicant therefore and shall be transferable and shall run with the land only after completion of any structure or structures authorized thereby. 7. Nothing herein contained shall be construed to empower the Board to change the terms of this ordinance, to authorize uses which violate any other Town ordinance, to affect changes in the zoning map, or to add to or change the uses permitted in any Zoning District. FINDINGS: The four findings which must be made by the Board of Adjustment in order to grant a variance are listed below. The applicants have provided their written justifications for each criterion in their attached narrative. The applicants have also provided photos of the current buildings. Staff has noted their responses below. 1. There exist special circumstances or conditions regarding the land, building or use referred to in the application which does not apply to other properties in the district. Staff Response: The proposal seems reasonable at first glance. However, the proposed new construction creates a new non-conformity in the structure where none exists today which is not really necessary if the shed is removed or reduced in size. 2. The above special circumstances or conditions are preexisting and are not created or self- imposed by the owner or applicant. Staff Response: The home as well as the detached storage shed were built in 1979 and conformed to the county zoning ordinance at that time. The building currently does not conform to the Town's setback requirements along the Zephyr Drive property line as previously noted. However the area of the proposed construction is currently in conformance with the Fountain Hills Zoning Ordinance. The proposed new construction will create an increased self-imposed non- conformity. Pagc 4 of 7 Variance. 17052 E.Kingstree Blvd Case:V 2015-01 3. The Variance is necessary for the preservation of substantial property rights. Without a Variance the property cannot be used for purposes otherwise allowed in this district Staff Response: The property is currently being used as a single-family residential dwelling and is in conformance with the town's zoning ordinance. No variance is necessary for the property owners to use their property as permitted in the ordinance. The pre-existing setback encroachment on the east side does not create any additional hindrances as this can be considered grandfathered. Denial of the requested variances will not alter this. There is no loss of substantial property rights. 4. The authorizing of the Variance will not be materially detrimental to persons residing or working in the vicinity, to adjacent property, or to the neighborhood or the public welfare. Staff Response: The proposal appears to be consistent with the surrounding neighborhood. However, it could be detrimental to the nearest immediate neighbor to the west as it is so close. This may mean that the proposal fails to meet the requirement of not being detrimental to the neighborhood or general public welfare. Risk Analysis (options or alternatives with implications): Approval of the requested variance will allow the applicant to enclose the carport, attach an existing shed, and permit the structure to be within 3'of the westerly side property line. Denial of the requested variance will require that the applicants redesign the proposal so that it conforms to the minimum setback restrictions of the zoning ordinance. Fiscal Impact (initial and ongoing costs; budget status): No Financial impact to the town is anticipated. Staff Recommendation(s): Staff does not object to the proposal, subject to the Board of Adjustments determinations that the above four findings have been adequately addressed. The property is used for a primary use that is allowed in the Zoning District. Staff believes that the variance, while definitely self-imposed and not wholly necessary, will not create a safety issue. Staff also believes that granting the variance will not be detrimental to persons residing in the vicinity. SUGGESTED MOTIONS: Move to FIND that the written and verbal testimonyt has addressed the four required criteria as listed in the staff report and based on that information that the Board of Adjustment (GRANT / DENY) the requested Variance from Section 5.06.B1 to allow a carport to be enclosed and attached to a storage shed, thereby resulting in a 3' side yard setback. Kingstree Boulevard, Fountain Hills, Arizona DATE: August 25, 2015 The purpose of this variance request is to allow Steve and Helen Shain to enclose their carport and turn it into a garage. Our firm prepared plans to complete miscellaneous remodeling projects at the residence, including the enclosure of the carport, and applied for the building permit. The building permit application was rejected, with the reason being that a storage area on the west side of the house, where the carport is located, extends into the required side yard Coy building setback space. The Shain Residence was built in 1979, legally under Maricopa County zoning regulations. The area in question at the west side of the residence is part of the original construction and has not been altered.The storage area is an integral part of the design of the original residence and the building structure. It has a structural foundation and is a part of the support structure for the roof of the carport, and the carport is connected to the house. In addition, the electrical entrance service panel for the house is located on the west side of the storage area, which confirms that this is part of the original house construction. The proposed enclosure of the carport will take place completely within current side yard setback requirements. We are not proposing to expand the residence into the required setback area. Following are "Justifications of Variance" for the proposed carport enclosure, per the Town of Fountain Hills Requirements: A. Special Circumstances: This residence was legally constructed in 1979 in a special zoning district, Z82-122 RUP,which is directly across Kingstree Boulevard from the golf course and is a part of the golf course zoning district. If you look at an aerial photo of the houses along Kingstree in this area, most of them appear to be non-conforming to today's zoning requirements in terms of side yard setback, and other homes built along Zephyr Drive at about the same time also have non-conforming street side setbacks. The Z82- 122 zoning document may have information about special zoning allowances for the district, but unfortunately the Town of Fountain Hills cannot find a copy of this zoning document. B. Pre-Existing Conditions: As mentioned previously, the residence was constructed legally in 1979 according to rules then in force for Maricopa County, and the Shains have not altered the portion of the residence that lies within the current Town of Fountain Hills side yard setback. C. Property Rights: The Shains wish to enclose their carport and use it as a garage. Kingstree is a busy street and their residence is one of the few in this area of Fountain Hills that has a carport rather than a garage, with their vehicles and other items exposed to passing traffic. The open carport presents a security problem for the Shains that will be relieved by constructing an enclosed garage. D. Public Welfare: The property owners' association has approved the proposed garage addition and the enclosure of the carport into a garage space will enhance the value of the residence and the surrounding neighborhood. With this in mind,we ask that you approve a variance that allows the Shains to enclose their carport and turn it into a garage.The residence was legally constructed in 1979, has not been altered, the enclosed garage will enhance values in the neighborhood, and the work will be completed within the current required setbacks.Thank you.
