HomeMy WebLinkAboutMMPC.2014.0624.Minutes ,to AIN 4, o TOWN OF FOUNTAIN HILLS MINUTES OF THE REGULAR MEETING OF THE MCDOWELL MOUNTAIN PRESERVATION COMMISSION ', 'c JUNE 24,2014 that is Ac‘1" AGENDA ITEM#1: CALL TO ORDER AND PLEDGE OF ALLEGIANCE A public meeting of the McDowell Mountain Preservation Commission was convened and called to order by Chair Gerard Bisceglia at 5:29 p.m., Tuesday, June 24, 2014 in the Council Chambers at Town Hall, located at 16705 East Avenue of the Fountains, Fountain Hills, Arizona. AGENDA ITEM#2: ROLL CALL Present at roll call were Chair Gerard Bisceglia, Vice-Chair Tom Barberic, Commissioners Bill Craig, Klaus Schadle, and Elena Torre. Staff members present were Director Mark Mayer and Executive Assistant Nancy Walter. AGENDA ITEM#3: CALL TO THE PUBLIC No one from the public wished to speak at this time. AGENDA ITEM #4: CONSIDERATION OF APPROVING THE APRIL 22, 2014 MEETING MINUTES fi .• Vice-Chair Barberic made a motion to accept the minutes of the April 22, 2014 meeting, Commissioner Schadle seconded and the motion passed by unanimous vote. AGENDA ITEM #5 CONSIDERATION OF APPROVING TO RECOMMEND TO COUNCIL THE NAMING OF THE CONNECTION TRAIL WITH SCOTTSDALE, "THE ANDREWS-KINSEY TRAIL" Vice-Chair Barberic made a motion to approve to recommend to council the naming of the connection trail with Scottsdale, "the Andrews-Kinsey Trail", Commissioner Craig seconded and the motion passed by unanimous vote. AGENDA ITEM#6 UPDATE ON ADERO CANYON MCO will start the road, do some grading, and put some pads in before selling to Toll Brothers. Director Mayer read aloud from the following portions of the Final Settlement Agreement between the Town and MCO. 7.1.3 Access to Trailhead. Access to the Trailhead prior to completion of the permanent road over the Temporary Roadway Segment shall be provided as follows: (i)The Town may construct a foot path from the current pavement edge of Eagle Ridge Drive to the Trailhead location (the "Temporary Foot Path"). The Temporary Foot Path shall be designed by the Town and reasonably approved by Adero to ensure that its construction and use is compatible with c,,, Adero's planned construction of Eagle Ridge Drive. Adero agrees that the Temporary Foot Path will McDowell Mountain Preservation Commission Page 1 of 3 w be open and accessible to the public until such time as Adero has commenced construction on Eagle Ridge Drive pursuant to a permit issued by the Town. (ii)Access by the Town to the Trailhead for the purpose of constructing or maintaining the • Trailhead will be provided without interruption after completion of the construction of Eagle Ridge Drive. The Town and Adero shall use reasonable efforts to coordinate construction schedules of the Trailhead and Eagle Ridge Drive prior to the Town bidding the Trailhead construction project and shall arrive at a reasonable schedule that accommodates both projects being completed in a timely manner 7.1.4 Permanent Roadway. Adero shall replace the Temporary Roadway Segment with permanent road improvements prior to issuance of the first building permit for construction of a Dwelling Unit within any lot or parcel in any part of Adero Canyon other than the Adero Canyon PAD area and "Parcel 1." In the event that a certificate of occupancy has not been requested and approved, in accordance with the Town's adopted building codes, for a dwelling unit in the Adero Canyon PAD area (not including the Sales Office) by December 31, 2020, unless such date is extended due to a Force Majeure, the Temporary Roadway Segment phasing option described above shall be revoked and MCO shall thereafter be required to construct the entirety of Eagle Ridge Drive prior to issuance of the first certificate of occupancy for any dwelling unit in Adero Canyon, as previously required by the Agreement. Director Mayer will send a copy of the agreement with MCO to the Commission. AGENDA ITEM #7: DISCUSSION OF HOW THE MMPC CAN FACILITATE THE CONSTRUCTION OF THE ADERO CANYON TRAILHEAD Director Mayer will set up a meeting with MCO for the Commissioners to walk the area and locate the section where the trailhead is proposed to be. AGENDA ITEM #8: CONSIDERATION OF APPROVING TO RECOMMEND TO COUNCIL TO UPDATE THE MASTER PLAN FOR THE FOUNTAIN HILLS MCDOWELL MOUNTAIN PRESERVE Some of the Preserve trails are not consistent on the Master Plan, including the naming of the trails and the new Andrews-Kinsey trail. The updated plan will be on Council's August 7tn agenda for approval. AGENDA ITEM #9: UPDATE ON THE STATUS OF RECRUITING FOR THE TWO VACANT SEATS ON THE MMPC The applicants will be interviewed on Tuesday, July 1, 2014. The appointments will be made at the August 7tn Council meeting. AGENDA ITEM #10: DISCUSSION OF GETTING YOUNG PEOPLE INVOLVED WITH THE PRESERVE; YOUTH DAY- FALL 2014 Students will be recruited to work with the Commission and the Sonoran Conservancy for their community hours required for graduation. The parameters of when and what the students will be doing will be given to Principal Brennan. Boy Scouts who are working on their Eagle Project could possibly be involved in trail maintenance,etc. • McDowell Mountain Preservation Commission Page 2 of 3 AGENDA ITEM #11: DISCUSSION OF PLANS FOR 2014 MCDOWELL MOUNTAIN MONTH Vice-Chair Barbaric suggested that the event originally scheduled at Fountain Park would now be a dedication of the Andrews-Kinsey Trail sometime in October. He would like to get plaques, with the trails engraved on them, for Chet Andrews's family and for Roy Kinsey. Some people would have to be driven into the Preserve so that they may attend the dedication. It was also suggested that the Sherriff's Department could use their helicopter to get some of the people into the Preserve. Chair Bisceglia made a motion to move forward with the dedication, Commissioner Torre seconded and the motion passed by unanimous vote. AGENDA ITEM #12: DISCUSSION OF THE COMMISSION MEETING SCHEDULE The meeting dates will remain as scheduled; August 26, September 23, October 28, and December 2. AGENDA ITEM #13: CONSIDERATION OF ADJOURNMENT Commissioner Schadle made a motion to adjourn at 6:02 p.m., Vice-Chair Barberic seconded and the motion passed by unanimous vote.
