WHEN: TUESDAY,APRIL 22, 2014 WHERE: FOUNTAIN HILLS COUNCIL CHAMBERS 16705 E. AVENUE OF THE FOUNTAINS, FOUNTAIN HILLS,AZ A majority of the Council members may be in attendance. No official action will be taken. Council Members and McDowell Mountain Preservation Commissioners will attend either in person or by telephone conference call. PROCEDURE FOR ADDRESSING THE COMMISSION Anyone wishing to speak before the Commission must fill out a speaker's card and submit it to the Executive Assistant prior to Commission discussion of that Agenda item. Speaker Cards are located near the Executive Assistant's position at the table. Speakers will be called in the order in which the speaker cards were received either by the Executive Assistant or the Chairman. At that time, speakers should stand. Speakers are asked to state their names prior to commenting and to direct their comments to the Chairman and not to individual Commission Members. Speakers' statements should not be repetitive.In order to conduct an orderly business meeting, the Chairman shall keep control of the meeting and shall require the speakers and audience to refrain from abusive or profane remarks, disruptive outbursts, applause,protests or other conduct that disrupts or interferes with the orderly conduct of the business of the meeting. Personal attacks on Commission members, Town staff or members of the public are not allowed. Please be respectful when making your comments. If you do not comply with these rules,you will be asked to leave. ,ndividual speakers will be allowed three contiguous minutes to address the Commission. Time limits may be waived by (i) Idiscretion of the Director upon request by the speaker not less than 24 hours prior to a Meeting, (ii)consensus of the Commission at Meeting. Notice is hereby given that pursuant to A.R.S. §1-602.A.9 , subject to certain specified statutory exceptions,parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the Town Council are audio and/or video recorded, and, as a result, proceedings in which children are present may be subject to such recording. Parents in order to exercise their rights may either file written consent with the Town Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made,the Town will assume that the rights afforded parents pursuant to A.R.S. §1-602.A.9 have been waived. C C ADERO CANYON & MMPC BACKGROUND: Fountain Hills = 740 acres --- Scotsdale = 200 acres = 940 acres in Town; Preserve is 16 times larger than Fountain Park MMPC established 2/96; 7 members; appointed by Town Council to advise/ recommend on Preserve Management issues, incl. establishing the Sonoran Conservancy of FH (1997) 7/97 Town Council asked voters' approval for $6MM GO bond issue - 66% voter approval - - plus, in 2000, a 0.4% sales tax incr. were basis for $13.5 MM Preserve acquisition After some Irgal unpleasantness between the Town & MCO, a SETTLEMENT AGREEMENT was reached covering Eagles Nest (244) &Adero Canyon (171). Extension of Eagle Ridge Dr. was platted and deeded to the town; MCO retained responsibility to build road MCO and the Town have significantly different views who, how and when the road extension could be built The Preserve was totally landlocked until Sept. '02; trailhead established at end of Golden Eagle Blvd with access to Mc Dowell Mtn Regional (County) Park - round trip to Preserve = 1.5mi1es*2 = 3 miles - - plus 1.8miles*2 = 3.6 miles In Nov. 2004, MCO approved guided tours through Eagle Ridge Dr. - round trip about 2miles * 2 = 4 miles WE HAVE BEEN WAITING FOR ALMOST 2 DECADES TO GET IMMEDIATE ACCES TO PRESERVE THROUGH ORIGINALLY ENVISIONED TRAIL HEAD CURRENT: On Commission for 2 1/2 years - - - 1st priority has been Preserve access Alternatives: Mayan Dr through EPCOR water tower access road Sunridge Dr. @ Desert Canyon Dr - access legally possible -HOA? Cholula Dr. @ Eagles Nest - behind gates —MCO ? ADERO alsways remained as first choice Many meetings with Northridge & Shadow Canyon HOA's, water company, Town ,,� Staff ADERO DEVLPMT. PROPOSAL PUTS ACCESS/TRAILHEAD GOAL IN SIGHT ..rid MMPC unanimously endorsed proposal - - - letter sent to Council; Conservancy likewise endorsed proposal Town Staff also in agreement STUNNED BY P&Z DECISION TO TURN DOWN PAD (Planned Area Devlpmt.) PLAN Co-ordinated opposition by Scottsdale (Cordabella) residents Speakers from within Town favorable PERSONAL BELIEF: Benefits of Adero development go beyond Preserve access and Trailhead; Increased building activity will make FH a "destination" again - - - lookers and buyers will have a positive impact on Town business, population, tax revenues, collection of development fees. While it may be possible to circumvent AZ law 9-463.05, the best way forward is to open the Preserve now and build the Trailhead before 1/1/2020. THE MMPC RECOMMENDS THAT THE COUNCIL APPROVE THE ADERO DEVELOPMENT PLAN or WE'LL HAVE TO CONTINUE LOOKING FOR ALTERNATIVE ACCESS ROUTES (which most likely will not be available without legal challenges).
