HomeMy WebLinkAboutMMPC.2011.0628.Minutes 0 A I N yl<e TOWN OF FOUNTAIN HILLS MINUTES OF THE REGULAR SESSION OF THE toi _ MCDOWELL MOUNTAIN PRESERVATION COMMISSION • JUNE 28,2011 •9*that is PsCVL c AGENDA ITEM#1: CALL TO ORDER AND PLEDGE OF ALLEGIANCE A public meeting of the McDowell Mountain Preservation Commission was convened and called to order by Chair Bill Myers at 5:30 p.m., Tuesday, June 28, 2011 in the Council Chambers at Town Hall, located at 16705 East Avenue of the Fountains, Fountain Hills, Arizona. AGENDA ITEM#2: ROLL CALL Present at roll call were Chair Bill Myers,Vice-Chair Tom Barberic, Commissioners Gerard Bisceglia, Steve Fleming, Bob Sanders, Klaus Schadle, and Elena Tone. Staff members present were Director Mark Mayer, and Executive Assistant Nancy Walter. Chair Myers took this time to remind the Commissioners of the Open Meeting Law presentation scheduled for Tuesday,August 9, at 5:30 p.m. in Council Chambers. Chair Myers noted that Fire Chief, Scott LaGreca, distributed the 15 emergency marker and landing zone packets to the appropriate agencies. Ken Valverde now has the maps on the fire trucks' on-board computers. �•- AGENDA ITEM#3: CALL TO THE PUBLIC No one from the public wished to speak. AGENDA ITEM #4: CONSIDERATION OF APPROVING THE MAY 24, 2011 MEETING MINUTES Ms. Torre made a motion to accept the minutes of the May 24, 2011 meeting, Mr. Barberic seconded and the motion passed by unanimous vote. AGENDA ITEM#5 DISCUSSION OF SENATE BILL #1525 Director Mayer distributed a handout from the Arizona League of Cities and Towns meeting he attended with Development Services Director Paul Mood and Deputy Town Manager Julie Ghetti. (Attached) Director Mayer reiterated how instrumental Town Attorney, Andrew McGuire, was in having the proposed language amended; originally the development fees were going to be totally eliminated. The development fee refund is given to the current owner of the property. The development fees can be spent on another project if for the"general good of the community". Town Attorney, Andrew McGuire, is on the committee to come up with a Uniform Ordinance Development Process,which will clarify and make it easier to administrate. c 1 McDowell Mountain Preservation Commission • AGENDA ITEM #6 REPORT ON THE STATUS OF THE AGREEMENT WITH THE REGIONAL PARK AND FH REGARDING THE SONORAN TRAIL Chair Myers spoke with Rand Hubbell, who made more changes to the agreement and sent it back to his boss for approval. Mr. Hubbell hopes to get it back within a month. AGENDA ITEM #7 UPDATE ON THE STATUS OF DIRECTIONAL SIGNS TO THE PRESERVE There will be six to seven brown directional signs, with white lettering, placed throughout the town by next month. The signs will also have the miles to the trailhead on Golden Eagle on them. AGENDA ITEM#8: REPORT ON MCO AGREEMENT The current agreement expires in October. Town Attorney, Andrew McGuire, is making the second amendment to the agreement for an additional three years. The agreement amendment is tentatively on Council's August 18 agenda. AGENDA ITEM#9: REPORT FROM THE MCDOWELL MOUNTAIN MONTH WORKGROUP • October 8 — Kids Hike with Mayor Schlum and Ranger Amy; possibly have the Fire Department talk to the kids about fire awareness. • October 22—FH Make a Difference Day(no hikes/outings scheduled to avoid conflicts) • October 29 — Event in the Regional Park with MMPC, Sonoran Conservancy, Scottsdale, and the MPA o There's a possibility of an Commemorative Air Force flyover on October 29 o Mr. Bisceglia will also be meeting with Mike Scharnow to discuss the TIMES'involvement as a presenting sponsor o Mr. Bisceglia will meet with Dr. Myhr to try to get a comprehensive involvement at the school level o Mr. Schadle is contacting grocery stores and other stores, at both local and corporate level, to get permission to set up tables at the entrances and distribute information about McDowell Mountain Month and increase awareness of the Preserve. (Letter attached.) One of the stores is currently requesting higher liability amounts than what the Town is covered for. AGENDA ITEM #10: REPORT FROM THE FOUNTAIN HILLS AND SCOTTSDALE TRAIL CONNECTION WORKGROUP • The proposed trail has been hiked several times and was GPS tracked. Mr. Fleming distributed a Preserve map with the proposed location of the trail connection • The group will meet next month with Scottsdale's Preserve Planner and staff to review the timeline and process for trail construction, and get input how to approach people with the State Trust Land. Mr. Fleming and Mr. Myers will then seek a meeting with the head of the State Trust Land to find out what they need. • The final flagging will be done once approval is received from State Trust • There is a meeting scheduled with Scottsdale Conservancy volunteers who will help build the trail • Members of two mountain bike clubs will help build the trail AGENDA ITEM# 11: REPORT FROM THE PRESERVE MARKETING WORKGROUP There is no report at this time. 2 McDowell Mountain Preservation Commission AGENDA ITEM # 12: REPORT FROM THE PRESERVE ACCESS WORKGROUP Chair Myers met with MCO to discuss Preserve access through Mayan Canyon. The new water company has more ownership than what was thought. The group will meet with the new water company officials to \.•- see if they will allow access through Mayan Canyon. Chair Myers then inquired about the possibility of closing the Preserve during the 4th of July weekend because of the fire danger. Director Mayer suggested that the responsible hikers are needed in the Preserve to be watchful of anyone with fireworks. By: c alt , Executive Assistant Dated this 29th day of June 2011 411110, McDowell Mountain Preservation Commission FOUNTAIN HILLS McDOWELL MOUNTAIN PRESERVATION COMMISION June 12, 2011 Dear Sir or Madam: The Commission would appreciate your agreement to set up a table outside your store on either the last week-end of September (9/23 through 25) or the first week-end in October (9/30, 10/1 &2). We wish to inform the public about "Mc Dowell Mountain Month" activities, such as hiking with the Mayor, a trivia test with prizes, plus helicopter and horseback riding opportunities. This event is sponsored by the Fountain Hills McDowell Mountain Preservation Commission (MMPC). The goal of the MMPC is to preserve and plan land use. Commission members are appointed by the Town Council, with the responsibility of recommending to the Council routes for public access and use (such as new trails, signs, horse/bike/hike usage), while protecting the Preserve flora, fauna and wildlife. There are three desert parks/preserves in the immediate area: 1.) Maricopa County's McDowell Mountain Regional Park (over 21,000 acres, with some 51 miles of hiking, mountain biking and equestrian trails); 2.) Scottsdale's McDowell Sonoran Preserve (roughly 17,000 acres with 60 miles of hike/bike/equestrian trails. 4400 additional acres are expected to be acquired later this year from State Trust land auctions. The Preserve's goal is to have 34,000 acres). 3.) Fountain Hills' McDowell Mountain Preserve (about 940 acres with 6 miles of trails). With similar goals, all three organizations are involved in the annual October "McDowell Mountain Month" celebration. MMPC's goal is to increase town residents' awareness of this $13 million asset, its impact on the quality of life in Fountain Hills and its importance to the environment. No official action will be taken. McDowell Mountain Preservation Commissioners will attend either in person or by telephone conference call. PROCEDURE FOR ADDRESSING THE COMMISSION Anyone wishing to speak before the Commission must fill out a speaker's card and submit it to the Executive Assistant prior to Commission discussion of that Agenda item. Speaker Cards are located near the Executive Assistant's position at the table. Speakers will be called in the order in which the speaker cards were received either by the Executive Assistant or the Chairman. At that time, speakers should stand. Speakers are asked to state their names prior to commenting and to direct their comments to the Chairman and not to individual Commission Members. Speakers' statements should not be repetitive.In order to conduct an orderly business meeting, the Chairman shall keep control of the meeting and shall require the speakers and audience to refrain from abusive or profane remarks, disruptive outbursts, applause,protests or other conduct that disrupts or interferes with the orderly conduct of the business of the meeting. Personal attacks on Commission members, Town staff or members of the public are not allowed. Please be respectful when making your comments. If you do not comply with these rules,you will be asked to leave. Individual speakers will be allowed three contiguous minutes to address the Commission. Time limits may be waived by (i) discretion of the Director upon request by the speaker not less than 24 hours prior to a Meeting, (ii)consensus of the Commission at Meeting. Notice is hereby given that pursuant to A.R.S. §1-602.A.9 , subject to certain specified statutory exceptions,parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the Town Council are audio and/or video recorded, and, as a result, proceedings in which children are present may be subject to such recording. Parents in order to exercise their rights may either file written consent with the Town Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made,the Town will assume that the rights afforded parents pursuant to A.R.S. §1-602.A.9 have been waived.
