A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, RATIFYING AND CLARIFYING THE
PRIOR RECOMMENDATION OF THE TOWN COUNCIL RELATED TO
"CUTILLO PLAZA."
WHEREAS, on June 6, 1996 the Mayor and Council of the Town of Fountain Hills (the
"Town Council ") approved the motion to "accept the committee recommendation that the 13-
acre footprint for the Civic Center Complex be designated as `Cutillo Plaza' along with the
appropriate identification and to recommend this action be implemented by a future council
when the property was owned by the Town" (the "Recommendation "); and
WHEREAS, the Town Council has determined that it is appropriate to implement the
Recommendation by designating an area of the Town's Civic Center Complex as "Cutillo
Plaza."
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows:
SECTION 1. The recitals above are hereby incorporated as if fully set forth herein.
SECTION 2. The Town Council Recommendation related to "Cutillo Plaza" is hereby
approved and ratified.
SECTION 3. From and after the date of this Resolution the area of the Town's Civic
Center Complex shown on Exhibit A, attached hereto and incorporated herein by reference, shall
be referred to as "Cutillo Plaza."
SECTION 4. The Interim Town Manager is hereby directed to propose for Town
Council consideration options for appropriate identification acknowledging the designation.
SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this
Resolution is for any reason to be held invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions
thereof.
SECTION 6. The Mayor, the Interim Town Manager, the Town Clerk and the Town
Attorney are hereby authorized and directed to take all steps and to execute all documents
necessary to carry out the purpose and intent of this Resolution.
