A RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA
EXPRESSING INTENTION TO ACCEPT FROM ROAD
DISTRICTS NOS. 9, 10, 11 AND 12 ALL RIGHT,
TITLE, AND INTEREST THEY POSSESS TO CERTAIN
REAL AND PERSONAL PROPERTY LOCATED IN
FOUNTAIN HILLS, ARIZONA.
WHEREAS, the Town of Fountain Hills was incorporated by
act of the Maricopa Board of Supervisors on December 29, 1989;
and
WHEREAS, said incorporation entitles the Town of
Fountain Hills to whatever right, title or interest may have
existed in any public roads prior to the incorporation; and
WHEREAS, Fountain Hills Road Districts Nos. 9, 10, 11
and 12 possess certain interests in a majority of the roads
within the corporate limits of the Town of Fountain Hills; and
WHEREAS, it is the expressed intention of the four Road
Districts to convey said interest to the Town of Fountain Hills
along with certain equipment, the ownership of which will also be
given to the Town of Fountain Hills;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the
Common Council as follows:
Section 1. That it is the intention of the Mayor and
the Common Council of the Town of Fountain Hills, Arizona to
accept by deed and /or bill of sale any and all interest possessed
by Road Districts Nos. 9, 101 11 and 12 of Fountain Hills in the
real property known as the roads and streets of Fountain Hills
and equipment owned by said Districts for the maintenance
thereof.
Section 2. That upon presentation of proper
documentation reviewed by the Town Attorney and certified by the
Town Engineer, the Mayor and Town Clerk are hereby authorized and
directed to accept deeds and bills of sale for the real property
and personal property and are instructed to record same in the
Office of the Maricopa County Recorder for notice to the world as
the intent of the Town of Fountain Hills to accept these roads as
public roads and to accept this equipment as property of the Town
of Fountain Hills.
