A RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA PURSU-
ANT TO A.R.S. S 48 -3610 ASSUMING THE POWERS
AND DUTIES BY THE TOWN OF FOUNTAIN HILLS
INCLUDING THE ADOPTION OF FLOOD PLAIN MANAGE-
MENT REGULATIONS FOR FLOOD PLAIN CONTROL.
WHEREAS, A.R.S. S 43 -3610 allows incorporated cities
and towns to exercise the powers and duties of flood plain
management; and,
WHEREAS, said section requires that notice in writing
be given to adjacent jurisdictions and the Maricopa County Flood
Control District;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS:
Section 1.
That the Town of

later changed by operation of
Section 2.
Fountain Hills does hereby assume
and duties of flood plain manage -
within the municipal boundaries of
they now exist and as they may be
law.
That the Mayor and Manager are authorized and directed
to execute any and all written notices necessary to other
governmental jurisdictions as required by state law.
Section 3.
That any development plan presently being processed by
the Maricopa County Flood Control District for development within
the boundaries of the Town of Fountain Hills shall continue under
the jurisdiction and control of the Maricopa County Flood Control
District but that all applications and plans submitted to the
Town from and after Monday, July 2, 1990 shall be subject to
provisions of this Resolution and the laws and ordinances of the
Town of Fountain Hills.
