HomeMy WebLinkAboutRes 1990-23RESOLUTION NO. 1990 -23 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA ABANDONING WHATEVER RIGHT, TITLE OR INTEREST IT HAS IN THAT CERTAIN PUBLIC UTILITY EASE- MENT AFFECTING ALONG THE NORTH AND EAST LOT LINES OF LOT 31, BLOCK 2, FINAL PLAT 505 C FOUNTAIN HILLS, ARIZONA AS RECORDED IN THE OFFICE OF THE MARICOPA COUNTY RECORDER AND BOOK 158 OF MAPS PAGE 42. WHEREAS, the Town Council of the Town of Fountain Hills as the governing body of real property located in the Town of Fountain Hills may require the dedication of public streets, sewer and water utility easements or rights -of -way within any proposed subdivision; and WHEREAS, the Town Council of the Town of Fountain Hills has the authority to accept of reject offers of dedication of private property by easement, deed, subdivision plat or other lawful means; and WHEREAS, it appears that all utilities serving the area in question that have been granted that a Certificate of Convenience and necessity by the Arizona Corporation Commission have consented to the vacation and abandonment of a certain public utility easement; and WHEREAS, all abutting property owners have consented by letter to the vacation and abandonment; and WHEREAS, there appears to be no objection to said abandonment; NOW, THEREFORE, be it resolved by the Mayor and Common Council of the Town of Fountain Hills, Arizona as follows: SECTION drainage easement Block 2 Final Plat Book 158 of Maps, hereby declared to RSLO17WEFA -C C00082590 1. That a located along 505 -C Fountain Page 42 records be abandoned by certain 10 foot utility and the rear lot line of Lot 31, Hills, Arizona, as recorded in of Maricopa County, Arizona is the Town of Fountain Hills. SECTION 2. That this Resolution is one of abandon- ment and disclaimer by the Town solely for the purpose of remov- ing any potential cloud on the title to said real property and that the Town in no way attempts to effect the rights of any private party to oppose the abandonment or assert any right resulting therefrom or existing previous to any action by the Town.
