A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, AMENDING RESOLUTION 1990 -16 TO RESTATE THE PURPOSES
FOR WHICH THE LOCAL TRANSPORTATION ASSISTANCE FUNDS MAY BE USED.
WHEREAS, cities and towns with a population of three hundred thousand
persons or less may use local transportation assistance funds for public
transportation operating and related capital purposes pursuant to A.R.S. 28 -2602,
Section F.; and
WHEREAS, a city or town may authorize by resolution the use of up to ten
per cent of local transportation assistance fund monies received in any one
fiscal year for cultural, educational, historical, recreational or scientific
facilities or programs or for nonresidential outpatient programs or services for
developmentally disabled persons if the monies are matched equally by nonpublic
monies received by the city or town and expended for the same purposes pursuant
to A.R.S. 28 -2603; and
WHEREAS, the Town Council of the Town of Fountain Hills passed Resolution
1990 -16, requesting the aforementioned local transportation assistance funds and
stating that the funds were to be used for the repair and maintenance of streets
and roadways; and
® WHEREAS, it is desirous to use the funds to the full extent that they were
meant to be used;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, THAT, Resolution 1990 -16 is hereby amended, restating
the use of the local transportation assistance funds as follows:
Funds may be used for all legally authorized purposes.
PASSED AND ADOPTED this 18th day of October, 1990, by the Mayor and Common
Council of the Town of Fountain Hills, Arizona.
