HomeMy WebLinkAboutRes 1991-07RESOLUTION NO. 1991 -07 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ADOPTING AN ENHANCED NOTIFICATION PROCEDURE TO INFORM NEIGHBORING COMMUNITES OF DEVELOPMENT ACTIVITY. WHEREAS, the MAG Regional Development Policy Committee was formed to guide the regional process of addressing the urban growth concerns of local governments within this region; and WHEREAS, a primary objective of the Regional Development Policy Committee is to evaluate current land use policies and recommend means to enhance regional cooperation and compatibility between the member agencies; and WHEREAS, a basic principle held by the MAG member agencies is that local governments are the most appropriate vehicle for planning for and providing residents with local services and infrastructure; and WHEREAS, communities are able to most effectively plan for these future infrastructure and service needs when they are fully informed of potential future demands; and WHEREAS, in order to ensure that local governments are aware of future demands so that they may provide necessary support, it is important that communities within the MAG region communicate with each other regarding planning and zoning decisions that may pose impacts beyond their borders; and WHEREAS, the Town of Fountain Hills wishes to voluntarily share public information with its neighboring communities in an effort to aid their planning efforts and reduce the potential for incompatible activities to occur; and WHEREAS, a precedent for establishing notification procedures to inform neighboring jurisdictions has been established in state Resolution 1991 -07 Page 1 of 5 statutes (A.R.S. § 9- 461.05F and 9- 462.04 A); and WHEREAS, the Enhanced Notification Procedure as prepared for the MAG Regional Development Policy Committee has been developed by the member agencies with input from other public entities as well as private sector representatives; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the Town of Fountain Hills, Arizona, that the Town of Fountain Hills hereby adopts the Enhanced Notification Procedure, as outlined in Appendix A, attached hereto. Nordin, Town Manager Resolution 1991 -07 Page 2 of 5 Appendix A ENHANCED NOTIFICATION PROCEDURE GUIDELINES In adopting this Enhanced Notification Procedure, the MAG member agencies agree to notification requirements in addition to those required by statutes. This Procedure will be followed when communicating information to adjacent jurisdictions regarding large -scale development proposals that may impact their community. To augment the existing notification requirements, development proposals requiring a public hearing and City /Town Council or Board of Supervisor approval, md meeting or exceeding the specific size and location requirements (see Threshold Criteria), trigger the Enhanced Notification Procedure. The Procedure then dictates that a "request for comments" form, which will be standardized and provided by MAG, be completed by the "host" jurisdiction (the community within which the subject property is located). The form will contain information on the proposed project, and will indicate the timeframe within which neighboring jurisdictions may provide comments on potential effects of the proposal on their jurisdiction. The timeframe specified by the "host" will be no longer than the normal timeframe necessary for the "host" jurisdiction to conduct its internal review of the project. Copies of this request form will be distributed as expeditiously as possible by the "host" jurisdiction to all MAG member agencies that may be effected by the development activity, according to the threshold criteria. Persons within each member agency that will be responsible for communicating this information and responding to the "request for comments" will be identified by the MAG Management Committee representatives. Although all comments provided by a neighboring community are for informational purposes only, it is desired that staff members of the communities would communicate with each other in an attempt to alleviate potential impacts of the development activity. A letter communicating the final decision of the "host" jurisdiction will be provided to the commenting entity regardless of the outcome. This will apply whether: 1) the neighboring community has no comments; 2) the concerns identified will be addressed by the "host" jurisdiction; or 3) the concerns transmitted will not be addressed. It is requested that copies of the request forms b the "host" to MAG so that an assessment of this and comments received be provided y , Procedure may be conducted one year after its implementation. THRESHOLD CRITERIA Individual development proposals requiring action of the City /Town Council or Board of Supervisors and involving a public hearing (such as annexations, general plan elements and amendments, master plans, special study areas, development plans, development agreements, specific plans, community facilities districts, zoning and rezoning applications and preliminary plats) will be reviewed by the host jurisdiction to ascertain whether the threshold criteria indicates expanded notification of the project. The Enhanced Notification Procedure applies to initial as well as subsequent requests for new development activity and additions, which require a public hearing ind meet or exceed the threshold criteria. The intent of assigning threshold criteria for this Procedure is to capture only those major developments that because of their size and /or location could potentially impose impacts upon more than one jurisdiction. The threshold criteria are technically met only if a proposal (as defined above) is within the noted distance from another jurisdiction (excluding Class I county islands - unincorporated areas that are completely surrounded by incorporated municipalities) and is as large or larger than the size criteria indicated. Where a development size is not specified, all activity meeting the distance criteria within that land use category are subject to the Enhanced Notification Procedure. Automotive Sales: Auto malls. Commercial/Office: Retail trade, professional office, services. Hotel/Motel/Resort: Temporary lodging facilities. Industrial: Employment related activities including manufacturing, wholesale trade. Places of Public Assembly: Cultural, entertainment and recreational facilities; convention centers. Power/Communication Facilities: Activities associated with the generation and distribution of power/ communications such as substations, switching stations, generating stations. Public Service Facilities: Police or fire stations, libraries, post offices, or other governmental buildings or facilities that utilize at least one acre. Public Uses: Golf courses, parks, schools, cemeteries. Residential: All housing activity including individual household units, group living accommodations, mobile -home parks. Resource Production and Extraction: Mining operations. Solid Waste Management Facilities: Any use dealing with resource conservation or recovery, or with the collection, source separation, storage, transportation, transfer, processing treatment or disposal of solid waste. Transportation - related Facilities: Park and ride lots, land devoted to moving, storing and servicing motor vehicles, bus terminals.
