A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA AMENDING THE TOWN
EMPLOYEES RETIREMENT PROGRAM BY EXPANDING ELIGI-
BILITY TO ALL FULL TIME EMPLOYEES UPON HIRING AND
DECLARING AN EMERGENCY
WHEREAS, the Mayor and Common Council of the Town of Fountain
Hills did through Resolution No. 1991 -10 adopt and establish a
retirement program for full time Town employees; and
WHEREAS, the Town has been informed of changes in the federal
law regarding the eligibility of public sector employees who are
not members of a retirement system; and
WHEREAS, it is the desire and the intention of the Town to
fully conform to these changes in the federal law by amending its
already existing employee retirement plan; and
WHEREAS, it is the desire and intent of the town to make
available to all full time employees the benefits of a retirement
plan upon their hiring;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS:
Section 1. That the Town of Fountain Hills employee retire-
ment plan is hereby amended to allow all full time employees of the
Town of Fountain Hills to be eligible upon hire for participation
in their program.
Section 2. That the Mayor and Town Manager are authorized to
execute any and all documents necessary to amend the plan.
Section 3. That in order to allow eligible employees to par-
ticipate in the retirement plan at the earliest possible date an
emergency is hereby declared to exist and as such this resolution
shall become effective immediately upon its passage and adoption by
no less than six members of the Town Council.
