A RESOLUTION OF THE COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, MARICOPA COUNTY,
ARIZONA, AUTHORIZING AND DIRECTING THE ACQUISI-
TION OF CERTAIN EASEMENTS IN CERTAIN REAL PRO-
PERTY BY THE TOWN BY DEDICATION, DONATION, PUR-
CHASE OR UNDER THE POWERS OF EMINENT DOMAIN
FOR STREET RIGHT -OF -WAY PURPOSES, DRAINAGE PUR-
POSES AND TEMPORARY CONSTRUCTION EASEMENTS.
BE IT RESOLVED BY THE COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, AS FOLLOWS:
Section 1. That it is hereby deemed necessary and essential and a matter of
public health, safety and welfare that certain easements described in Exhibit A attached
hereto and incorporated herein by reference be acquired for road right -of -way, drainage
and temporary construction purposes by the Town of Fountain Hills.
Section 2. That the acquisition of said easements described in Exhibit A is
hereby authorized by dedication, donation, purchase or the power of eminent domain
and that the Town Manager or his designee and the Town Attorney are authorized and
directed to take all legal action necessary to acquire said easements.
Section 3. That the duly authorized officers and employees of the Town of
Fountain Hills be and are hereby authorized and directed to execute any and all
documents and to pay any and all sums necessary to acquire the above - described
easements including but not limited to title reports, title insurance, escrow fees, closing
costs, legal fees, service of process and any and all other costs connected therewith.
PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS this 21st day of May, 1992.
