A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA ABANDONING
WHATEVER RIGHT, TITLE, OR INTEREST IT HAS IN THOSE
CERTAIN RESTRICTIONS AFFECTING THE NORTH LOT LINE
OF LOT 6, BLOCK 1, OF PLAT 201 -A FOUNTAIN HILLS,
ARIZONA, AS RECORDED IN BOOK 150 OF MAPS, PAGE 32,
RECORDS OF MARICOPA COUNTY, ARIZONA.
WHEREAS, The Town Council of the Town of Fountain Hills as the governing body of real
property located in the Town of Fountain Hills may require the dedication of
public streets, sewer, water, drainage, other utility easements or rights -of -way, or
"No Vehicular Access" restrictions within any proposed subdivision; and
WHEREAS, Upon incorporation, the Town of Fountain Hills, Arizona received easements, and
access restrictions; and
WHEREAS, The Town Council of the Town of Fountain Hills has the authority to accept,
reject, or abandon the dedication of private property by easement, deed,
subdivision, plat or other lawful means;
WHEREAS, A "No Vehicular Access" restriction exists along the north property line of Lot #6,
Block 1, Plat 201 -A; and
WHEREAS, The owner of Lot 6, Block 1, Plat 201 -A has petitioned the Town of Fountain
Hills to abandon the "No Vehicular Access" restriction on said lot;
WHEREAS, The Town of Fountain Hills does not deem this "No Vehicular Access" restriction
necessary; and
NOW THEREFORE, be it resolved by the Mayor and Common Council of the Town of
Fountain Hills, Arizona as follows:
That the "No Vehicular Access" restriction located along the north lot line of
Lot 6, Block 1, Plat 201 -A Fountain Hills, Arizona, as recorded in book 150 of
maps, page 32 records of Maricopa County, Arizona; is hereby declared to be
abandoned by the Town of Fountain Hills.
