HomeMy WebLinkAboutRes 1993-38RESOLUTION 1993 -38 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA ABANDONING WHATEVER RIGHT, TITLE, OR INTEREST IT HAS IN THOSE CERTAIN PUBLIC RIGHTS -OF -WAYS DESCRIBED IN EXHIBITS A -1 THROUGH A -11 LOCATED IN FOUNTAIN HILLS ARIZONA FINAL PLAT NO. 507 -A AND FOUNTAIN HILLS ARIZONA FINAL PLAT NO 507 -B TO THE BENEFICIAL OWNER OF RECORD OF THE LAND AT THE TIME OF DEDICATION; AND DECLARING AN EMERGENCY. WHEREAS, The Town Council of the Town of Fountain Hills, Arizona has the authority to abandon public rights -of -ways pursuant to A.R.S. 28 -1901 et. seq. and replat existing subdivisions; pursuant to A.R.S. 9 -463 et. seq.; and WHEREAS, Fountain Hills Arizona Final Plat No. 507 -A was recorded on September 5, 1973 in Book 165, Page 41, of the records of Maricopa County, Arizona; with all public rights -of -ways being dedicated to the Fountain Hills Road District No. 11 and No. 12. WHEREAS, Fountain Hills Arizona Final Plat No. 507 -B was recorded on September 5, 1973 in Book 165, Page 38, of the records of Maricopa County, Arizona; with all public rights -of -ways being dedicated to the Fountain Hills Road District No. 12. WHEREAS, Fountain Hills Road District No. 11 and No. 12 did disband and by warranty deed conveyed all right, title, and interest to the Town of Fountain Hills and the Town of Fountain Hills accepted said warranty deed by Resolution. WHEREAS, The Town Council has approved Fountain Hills Final Plat No. 512 on September 2, 1993; as recorded in Book 368, Page 5, of the records of Maricopa County, Arizona. Resolution 1993 -38 page 1 of 2 a NOW THEREFORE, be It resolved by the Mayor and Common Council of the Town of Fountain Hills, Arizona as follows: SECTION 1, That pursuant to A, R.S. 28 -1301 et.seq, the Council finds that public rights -of- way described in Exhibits A -1 through A -11 are no longer of public use. SECTION 2. That this Resolution is one of abandonment of interest and conveyance of said interest by the Town to MCO Properties, Inc., the beneficial owner of the adjacent property in Fountain Hills Final Plat No. 507 -A and Fountain Hills Final Plat No. 507 -B at the time of their dedication. SECTION 3. That the Town Clerk is directed to record a certified copy of this Resolution and the accompanying Exhibits A -1 through A -11, after adoption, in the office of the County Recorder of Maricopa County. SECTION 4. Whereas the public peace, health and safety of the Town is and may be placed at Issue by the town's acceptance and maintenance of unneeded public utility and drainage easements described herein, an emergency is declared to exist and the public welfare of the town and Its citizens are being served by the Immediate adoption of this resolution upon the affirmative vote of three - fourths of all the elected members of the Town Council and the Mayor and as such Is exempt from the provisions of referendum, PASSED AND ADOPTED this 18th day of November, 1993.
