RESOLUTION 1996-16
A RESOLUTION OFTHE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING
WHATEVER RIGHT,TITLE,OR INTEREST IT HAS IN PORTIONS OF
THE CERTAIN PUBLIC UTILITY AND DRAINAGE EASEMENTS
ALONG THE SOUTHERLY AND WESTERLY LOT LINE OF PLAT 506B,
BLOCK 1,LOT 19,AS RECORDED INBOOK159OFMAPS,PAGE
3,RECORDSOF MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Councilof the Town ofFountain Hills,as the governingbodyof
real property located in the Townof Fountain Hills,may require the
dedication ofpublicstreets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,The Town Councilof the TownofFountain Hills has the authority to accept
or reject offersof dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
SECTION 1.That the certain ten (10)foot public utility and drainage easement located
along the southerly and westerly property line of Lot19,Block1,Plat 506B,
Fountain Hills,Arizona;as recorded in book 159 of maps,page 3 records of
Maricopa County,Arizona;is hereby declared to be abandoned by the
Townof Fountain Hills;except that the drainage easement along the
southerly property line shall be retained.
SECTION 2.ThatthisResolution is one of abandonment and disclaimer by the Town
solely for the purpose of removing any potential cloud on the title to said
property and that the Townin no way attempts to affect the rightsof any
private party to oppose the abandonment or assert any rightresulting
therefrom or existing previous to any action by the Town.
