RESOLUTION 1996-30
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN THE CERTAIN DRAINAGE
AND PUBLIC UTILITY EASEMENTS ALONG THE NORTHEASTERLY
LOT LINE OF LOT 34,BLOCK 1,OF PLAT 505D FOUNTAIN HILLS,
ARIZONA,AS RECORDED IN BOOK 158 OF MAPS,PAGE 41,
RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Council of the Town of Fountain Hills,asthe governing bodyofreal
property locatedinthe Town of Fountain Hills,mayrequirethe dedication of
publicstreets,sewer,water,drainage,andotherutility easements or rights-of-way
within any proposed subdivision;and
WHEREAS,TheTownCouncil of theTownof Fountain Hillshasthe authority toacceptor
rejectoffersof dedication of private property by easement,deed,subdivision,plat
or other lawful means;and
WHEREAS,All present utility companies have received notification of theproposed
abandonment;
NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
SECTION 1.That the certain ten(10)foot public utility and drainage easement,located along
the northesterly (rear)property line of Plat 505D,Block 1,Lot 34,Fountain Hills,
Arizona;as recorded in book 158 of maps,page 41 records of Maricopa County,
Arizona;is hereby declared tobe abandoned bythe Town of Fountain Hills.
SECTION 2.That this Resolution is one of abandonment and disclaimer bythe Town solely for
the purpose of removing any potential cloud onthetitleto said property andthat
the Town innoway attempts to affect therights of any private party to oppose
the abandonment or assert anyright resulting therefrom or existing previous toany
action bythe Town.
