RESOLUTION 1996-42
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE
CERTAIN PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE SOUTHERLY LOT LINES OF LOT 47,BLOCK 1OF PLAT 505B,
FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 158OF MAPS,
PAGE 43,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,TheTown Council oftheTownof Fountain Hills,asthe governing body of real
propertylocatedintheTownofFountainHills,mayrequirethededicationof
public streets,sewer,water,drainage,andotherutility easements or rights-of-way
within any proposed subdivision;and
WHEREAS,TheTown Council oftheTownof Fountain Hillshasthe authority to accept or
rejectoffersof dedication of private property by easement,deed,subdivision,plat
or other lawful means;and
WHEREAS,All present utility companies have received notification ofthe proposed
abandonment;
NOW THEREFORE,beit resolved bythe Mayor and Common CounciloftheTownof
Fountain Hills,Arizona as follows:
SECTION 1.Thatthecertainten (10)foot public utilityand drainage easements,located along
the southerly property line of Lot47,Block 1,Plat 505B,Fountain Hills,Arizona;
asrecordedinbook158ofmaps,page43recordsofMaricopaCounty,Arizona;
areherebydeclaredtobeabandonedbytheTownofFountainHills,exceptfor
the westerly 10'.

SECTION2.That this Resolution isoneof abandonment and disclaimer by the Town solely for
thepurposeofremovinganypotentialcloudonthetitletosaidpropertyandthat

the abandonment orassertanyright resulting therefrom or existing previous toany
action bythe Town.
