RESOLUTION OF THE TOWN OF FOUNTAIN HILLS
APPROVING THE APPLICATION FOR ARIZONA STATE PARKS BOARD HERITAGE
FUNDS OR LAND WATER CONSERVATION FUNDS
GOLDEN EAGLE COMMUNITY PARK -PHASE V
WHEREAS,the Legislature under ARS§41-503has authorized the establishment ofthe
HeritageFundprogram,providingmatchingfundstotheStateofArizona,itspolitical
subdivisions foracquiringlandsanddevelopingfacilitiesforpublicoutdoorrecreation purposes;
and
WHEREAS,the Congress under Public Law 88-578 has authorized the establishment of
aFederalLandandWaterConservationfundGrant-in-aidProgram,providingmatchingfunds
totheStateofArizona,itspolitical subdivisions andIndianTribesforacquiringlandsand
developing facilities for public outdoor recreation purposes;and
WHEREAS,theArizonaStateParksBoard(ASPB)isresponsiblefortheadministration
oftheprogramwithintheState,settingupnecessaryrulesandproceduresgoverningapplication
bylocal agencies under the program;and
\^/WHEREAS,saidadoptedproceduresestablishedbyASPBrequiretheApplicantto
certifybyresolutiontheapprovalof applications,signature authorization,theavailabilityoflocal
matchingfunds,and authorization tosigna Participant Agreement withASPBpriortosubmission
of said applications toASPB;and
WHEREAS,the proposed project mustbe consistent withthe Arizona State
Comprehensive Outdoor Recreation Plan;and
WHEREAS,theprojectmustbe compatible withthelanduseplansoftheapplicant;
NOW,THEREFORE,BE IT RESOLVED thattheTownofFountainHillshereby:
1.Approves the filing of an application for Arizona Heritage Fund or Land and Water
Conservation Fund assistance;and
2.Certifies thatthe Town of Fountain Hillswill comply withall appropriate stateand
federal regulations,policies,guidelines,and requirements asthey relate tothe application;and
3.Certifies that the Town of Fountain Hills has matching funds in the amount of $647,500
fromthe following sources:Fountain Hills General Fund;andcan finance 100 percent of the
project,half of whichwillbe reimbursed byan Arizona State Parks Board Heritage grantorLand
and Water Conservation fundgrant;and

4.CertifiesthattheTown of Fountain Hillshasthe non-project surcharge nottoexceedten
percentoftotalprojectcostswhichwillbepaidtoASPBuponAORCCapprovalofsaid
application,ifitis selected forLWCF assistance;and
5.CertifiesthattheprojectiscompatiblewiththelanduseplansoftheTownofFountain
Hills;and
6.Certifiesthatthe project hasbeen reviewed bytheparks maintenance andoperationsstaff
oftheTownof Fountain HillsandthattheTownagreesto properly maintainthisproject;and
7.AppointstheTownof Fountain Hills'Director of Parksand Recreation asagentoftheTown
ofFountainHillsto conduct all negotiations,execute and submit all documents including butnot
limitedto applications,agreements,amendments,billing statements,andsoonwhichmaybe
necessary forthe completion of the aforementioned project.
PASSED,ADOPTED AND APPROVED bytheTownof Fountain Hillsthis 11th day
of July,1996.
