RESOLUTION NO.1996-49
RESOLUTION OF THE TOWN OF FOUNTAIN HILLS
APPROVING THE APPLICATION FOR ARIZONA STATE PARKS BOARD HERITAGE
FUNDS OR LAND WATER CONSERVATION FUNDS
FOUR PEAKS NEIGHBORHOOD PARK
WHEREAS,the Legislature under ARS §41-503 has authorized the establishment of the
Heritage Fund program,providing matching funds totheStateof Arizona,its political
subdivisions for acquiring lands and developing facilities for public outdoor recreation purposes;
and
WHEREAS,the Congress under Public Law 88-578 has authorized the establishment of
aFederalLandandWater Conservation fundGrant-in-aidProgram,providingmatching funds
totheStateofArizona,itspoliticalsubdivisionsandIndianTribesforacquiringlandsand
developingfacilitiesforpublicoutdoorrecreationpurposes;and
WHEREAS,theArizonaStateParksBoard(ASPB)isresponsiblefortheadministration
ofthe program within theState,settingup necessary rulesand procedures governing application
bylocal agencies under the program;and
WHEREAS,saidadoptedproceduresestablishedbyASPBrequiretheApplicantto
certifybyresolutiontheapprovalofapplications,signatureauthorization,theavailabilityoflocal
matchingfunds,andauthorizationtosignaParticipantAgreementwithASPBpriortosubmission
ofsaid applications toASPB;and
WHEREAS,the proposed project must be consistent withthe Arizona State
Comprehensive Outdoor Recreation Plan;and
WHEREAS,theprojectmustbecompatiblewiththelanduseplansoftheapplicant;
NOW,THEREFORE,BEIT RESOLVED thattheTownofFountainHillshereby:
1.ApprovesthefilingofanapplicationforArizonaHeritageFundorLandandWater
Conservation Fund assistance;and
2.Certifies thattheTownof Fountain Hillswill comply withall appropriate stateand
federal regulations,policies,guidelines,and requirements astheyrelatetothe application;and
3.Certifies thattheTownof Fountain Hillshas matching fundsinthe amount of $368,100
fromthefollowingsources:FountainHillsGeneralFund;andcanfinance100percentofthe
project,halfofwhichwillbereimbursedbyanArizonaStateParksBoardHeritagegrantorLand
and Water Conservation fund grant;and

4.CertifiesthattheTownofFountainHillshasthenon-projectsurchargenottoexceedten
percentoftotalprojectcostswhichwillbepaidtoASPBuponAORCCapprovalofsaid
application,ifitis selected for LWCF assistance;and
5.CertifiesthattheprojectiscompatiblewiththelanduseplansoftheTownofFountain
Hills;and
6.Certifiesthattheprojecthasbeenreviewedbytheparks maintenance and operations staff
oftheTownofFountainHillsandthattheTownagreestoproperly maintain thisproject;and
7.AppointstheTownofFountain Hills'DirectorofParksandRecreationasagentoftheTown
ofFountainHillstoconductall negotiations,executeandsubmitalldocuments including butnot
limitedtoapplications,agreements,amendments,billingstatements,andsoonwhichmaybe
necessary forthe completion of the aforementioned project.
PASSED,ADOPTED AND APPROVED bytheTownofFountainHillsthis 11th day
of July,1996.
